Issuing the Enrollment Regulations for Lower Secondary Schools and Upper Secondary Schools

Pursuant to the Education Law on June 14, 2005; the Law Amending and Supplementing Certain Articles of the Education Law on November 25, 2009;
Pursuant to Decree No. 32/2008/NĐ-CP dated March 19, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;

The Minister of Education and Training issues the Enrollment Regulations for Lower Secondary Schools and Upper Secondary Schools.
Article 1. This Circular takes effect from February 14, 2025.
Article 2. This Circular takes effect from June 2, 2014.
This Circular replaces Circular No. 02/2013/TT-BGDĐT issuing the Enrollment Regulations for Lower Secondary Schools and Upper Secondary Schools dated January 30, 2013 of the Minister of Education and Training.
Article 3. The Director of the Office, Heads of the Secondary Education Department, Heads of units related to the Ministry of Education and Training; Chairpersons of People's Committees of provinces and centrally governed cities; Directors of Departments of Education and Training are responsible for implementing this Circular.

Enrollment for Lower Secondary Schools and Upper Secondary Schools

PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation and Applicability
Article 1. This Regulation stipulates the enrollment for lower secondary schools and upper secondary schools.
Article 2. This Regulation applies to Vietnamese students, foreign students residing in Vietnam; lower secondary schools, upper secondary schools, and general education schools with multiple levels, and relevant organizations and individuals.
Article 3. This Regulation does not apply to the enrollment for specialized upper secondary schools.
Article 2. Principles of Enrollment and Age for Enrollment
Clause 1. Each year, there shall be one enrollment session for lower secondary schools and upper secondary schools; the enrollment for lower secondary schools and upper secondary schools must ensure accuracy, fairness, and objectivity.
Clause 2. The age of students in lower secondary schools and upper secondary schools shall be implemented according to the Charter of Lower Secondary Schools, Upper Secondary Schools, and General Education Schools with Multiple Levels.
Chapter II
ENROLLMENT FOR LOWER SECONDARY SCHOOLS
Article 3. Enrollment Documents
Point 1. A certified copy of a valid birth certificate.
Point 2. Elementary school report card or other documents of equivalent value.
Article 4. Organization of Enrollment
Point 1. The target group for enrollment is those who have completed the elementary school program.
Point 2. Enrollment for lower secondary schools shall be conducted through a selection process.
Point 3. The Department of Education and Training decides on the organization of enrollment for lower secondary schools.
Chapter III
ENROLLMENT FOR UPPER SECONDARY SCHOOLS
Article 5. Target Group and Method of Enrollment
Point 1. The target group for enrollment is students who have graduated from the lower secondary school program under the general education curriculum or the regular education curriculum, within the age range specified in Clause 2 of Article 2 of this Regulation.
Point 2. Enrollment for upper secondary schools shall be organized in one of the following three methods:
Subpoint a) Selection based on the results of discipline and study over four years of lower secondary school for the target group, if they have repeated a grade, then the results of that repeated year will be taken into account;
b) Examination;
Subpoint c) Combination of examination and selection.
Article 6. Admission Documents
Point 1. A certified copy of a valid birth certificate.
2. Graduation certificate of junior high school or temporary graduation certificate of junior high school or a copy of the graduation certificate of junior high school.
3. Junior high school academic record book.
4. Certificate of preferential treatment issued by the competent authority (if any).
5. Certificate issued by the People's Committee of commune, ward, town confirming that the applicant has graduated from junior high school in previous years and is not serving a prison sentence, undergoing non-custodial re-education, or violating the law.
Article 7. Direct Admission and Preferential Treatment
1. Direct admission to secondary schools for the following categories of students:
a) Students of boarding schools for ethnic minorities;
b) Students who are members of ethnic groups with very small populations;
c) Students with disabilities;
d) Students who have won national-level awards or higher in cultural, artistic, physical education, sports competitions, or science and technology contests for secondary school students.
2. Categories eligible for additional points under preferential treatment.
The Department of Education and Training shall specify additional points for each category of students entitled to preferential treatment, including:
a) Group 1:
- Children of martyrs;
- Children of war invalids with a disability rate of 81% or more;
- Children of veterans with a disability rate of 81% or more;
- Children of persons granted "Certificate of Persons Entitled to Benefits Equivalent to War Invalids" where the person granted such certificate has a disability rate of 81% or more.
b) Group 2:
- Children of Heroes of the Armed Forces, Heroes of Labor, and Mothers of Vietnam Martyrs;
- Children of war invalids with a disability rate below 81%;
- Children of veterans with a disability rate below 81%;
- Children of persons granted "Certificate of Persons Entitled to Benefits Equivalent to War Invalids" where the person granted such certificate has a disability rate below 81%.
c) Group 3:
- Individuals whose father or mother is a member of a minority ethnic group;
- Ethnic minority candidates;
- Individuals studying and living in areas with extremely difficult socio-economic conditions.
3. Categories eligible for additional points under encouragement.
The Department of Education and Training shall specify the categories of students and additional points for each category entitled to encouragement.
Article 8. Admissions Board
1. Composition.
a) Chairperson is the principal or vice-principal;
b) Deputy chairperson is the vice-principal;
c) Secretary and some members.
2. Duties and powers of the Admissions Board are stipulated by the Department of Education and Training.
3. Authorized to use the school seal on Admissions Board documents.
Chapter IV
RESPONSIBILITIES FOR IMPLEMENTATION
Article 9. Responsibilities of the Provincial People's Committee and the District People's Committee
1. Provincial People's Committee.
a) Directing and approving plans and methods for secondary school admissions;
b) Directing inspection and supervision of admissions and setting examination fee rates.
2. District People's Committee.
a) Directing and approving plans for junior high school admissions;
b) Directing inspection and supervision of admissions.
Article 10. Responsibilities of Departments of Education and Training
1. Drafting admission plans, submitting them to the Provincial People's Committee for approval, including the following main contents: area, method, target group, preferential and encouraging policies, organization of secondary school admissions.
For regions choosing examination-based admission or a combination of examination and assessment-based admission, the following additional contents must be included:
a) Subjects, examination questions, examination format, time limit, weightage of examination scores, additional points;
b) Organization, tasks and activities, powers and responsibilities of the examination question-setting board, examination supervision board, examination marking board, examination review board; examination question-setting, printing, and distribution work.
2. Guiding admission procedures for educational departments and secondary schools.
3. Issuing decisions to establish admissions boards; approving admission results for each secondary school. Receiving admission documents from admissions boards, examination supervision boards, and examination marking boards.
4. Organizing inspections and supervision of junior high school and secondary school admissions.
5. Storing admission documents in accordance with legal regulations.
6. Implementing periodic and annual statistics, information, and reports on admissions to the Provincial People's Committee and the Ministry of Education and Training.
Article 11. Responsibilities of the Department of Education and Training, junior high schools, and high schools
1. Responsibilities of the Department of Education and Training.
Implement the directives and guidance of the Provincial Department of Education and Training regarding admission work. Develop an admission plan to submit for approval by the People's Committee at the district level. Guide and inspect the admission work of junior high schools. Conduct regular and annual statistics, information, and reports on admission work to the People's Committee at the district level and the Provincial Department of Education and Training.
2. Responsibilities of junior high schools and high schools.
a) Implement the directives and guidance of the Provincial Department of Education and Training (for high schools) and the Department of Education and Training (for junior high schools) regarding admission work;
b) Admit students with disabilities who have needs to study;
c) Ensure the implementation of universal education tasks assigned in their respective areas;
d) Receive and resolve complaints within their authority or refer them to competent authorities for resolution;
e) Maintain admission records in accordance with the provisions of the law;
f) Carry out statistical work and report to the direct educational management agency./.
