CIRCULAR
activities of calibration, verification, testing delegation, decentralization, and determination of authorityto perform state management tasks of two-level local administration concerning vocational education, continuing education
Pursuant to Resolution No. 190/2025/QH15 dated February 19, 2025 of the National Assembly on handling certain issues related to the restructuring of the state apparatus;
Pursuant to the Government Decree No. 37/2025/NĐ-CP dated February 26, 2025, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;
Pursuant to Decree No. 142/2025/NĐ-CP dated June 12, 2025 of the Government stipulating the determination of authority of two-level local administration in the field of state management by the Ministry of Education and Training;
Pursuant to Decree No. 143/2025/NĐ-CP dated June 12, 2025 of the Government stipulating delegation and decentralization in the field of state management by the Ministry of Education and Training;
At the proposal of Legal Affairs Department Director;
The Minister of Education and Training issues this Circular stipulating delegation, decentralization, and determination of authority to perform state management tasks of two-level local administration concerning vocational education, continuing education.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation and Applicability
Article 1. This Circular stipulates delegation, decentralization, and determination of authority to perform state management tasks of two-level local administration concerning vocational education, continuing education as prescribed in legal normative documents issued by the Minister of Education and Training.
Article 2. This Circular applies to central administrative agencies, local authorities, vocational education institutions, continuing education institutions, and other organizations and individuals related thereto.
Article 2. Principles of Delegation, Decentralization, and Determination of Authority
1. Ensuring compliance with the Constitution; consistent with principles and provisions on delegation, decentralization, and determination of authority under the Law on Organization of the Government, the Law on Organization of Local Administration, and Government Decrees on delegation, decentralization, and determination of authority in the field of education.
2. Ensuring appropriate delegation, decentralization, and determination of tasks and powers between levels of local administration in accordance with the tasks, powers, and capacity of the agencies and authorized persons; avoiding overlap, duplication, or omission of functions and tasks between levels of local administration and among agencies and organizations within local administration when performing state management tasks concerning vocational education, continuing education.
3. Ensuring that it does not affect the implementation of international treaties and agreements on the field of education to which the Socialist Republic of Vietnam is a party.
4. Resources for implementing tasks of delegation, decentralization, and determination of authority shall be guaranteed from the State budget in accordance with regulations.
Article 3. Fees and Charges
When handling administrative procedures requiring payment of fees and charges as prescribed by laws on fees and charges, individuals and organizations must pay such fees and charges simultaneously with submitting their application for administrative procedures to the receiving agency. The amount of fees and charges, management, and utilization of such fees and charges shall be carried out in accordance with regulations of the Government, the Minister of Finance, or the People's Council at the provincial level corresponding to the respective fees and charges.
Article 4. Principles of Exploitation and Utilization of Electronic Data
Agencies handling administrative procedures have the responsibility to exploit electronic data already available in the National Population Database and other specialized databases to supplement information in the electronic files of individuals and organizations handling administrative procedures, without requesting individuals and organizations to submit or present documents whose information has been extracted from these databases; except in cases where such data is used for purposes of verifying or rechecking the authenticity of the information, documents, or materials that have been digitized.
Chapter II
DELEGATION, DECENTRALIZATION, AND DETERMINATION OF AUTHORITY TO PERFORM STATE MANAGEMENT TASKS OF TWO-LEVEL LOCAL ADMINISTRATION CONCERNING VOCATIONAL EDUCATION, CONTINUING EDUCATION
Article 5. Competence to manage community learning centers
1. The professional and operational guidance authority for community learning centers at commune, ward, and town levels, as stipulated in Article 6 of the Regulation on the organization and operation of community learning centers at commune, ward, and town levels issued together with Decision No. 09/2008/QD-BGDĐT dated March 24, 2008 of the Minister of Education and Training, which has been amended and supplemented by Circular No. 40/2010/TT-BGDĐT dated December 30, 2010 of the Minister of Education and Training (hereinafter referred to as Decision No. 09/2008/QD-BGDĐT), shall be implemented by the Department of Education and Training.
2. The authority to consider and decide on the allocation of primary school teachers or lower secondary school teachers to work at community learning centers, as stipulated in Clause 3, Article 11; to decide on the Director and Deputy Director of community learning centers, as stipulated in Clause 2, Article 12, and Clause 1, Article 13 of Decision No. 09/2008/QD-BGDĐT, shall be implemented by the People's Committee of the commune.
3. Replace the term "district level" with "commune level"; replace the term "Department of Education and Training" with the term "People's Committee of the commune" in Decision No. 09/2008/QD-BGDĐT.
Article 6. Payment of policy scholarships and other support
1. The authority to organize and implement the payment of policy scholarships and other support to students studying at vocational education institutions, as stipulated in Clause 2, Article 5 of Joint Circular No. 12/2016/TTLT-BLDTBXH-BGDĐT-BTC dated June 16, 2016 of the Ministers of Labor, Invalids and Social Affairs, Education and Training, and Finance guiding the implementation of the residential policy stipulated in Decision No. 53/2015/QĐ-TTg dated October 20, 2015 of the Prime Minister regarding the residential policy for college and intermediate-level students, which has been amended and supplemented by Circular No. 18/2018/TT-BLDTBXH dated October 30, 2018 and Circular No. 08/2023/TT-BLDTBXH dated August 29, 2023 of the Minister of Labor, Invalids and Social Affairs (hereinafter referred to as Joint Circular No. 12/2016/TTLT-BLDTBXH-BGDĐT-BTC), shall be implemented by the People's Committee of the commune where the students are registered as permanent residents.
2. Replace the terms "Department of Labor, Invalids and Social Affairs," "People's Committee of the district level" with the term "People's Committee of the commune" in Joint Circular No. 12/2016/TTLT-BLDTBXH-BGDĐT-BTC.
3. Adjust the deadline for reviewing applications and the procedure for granting residential policies for students participating in programs at public vocational education institutions as stipulated in Joint Circular No. 12/2016/TTLT-BLDTBXH-BGDĐT-BTC as follows:
a) The heads of public vocational education institutions, based on the provisions of Article 1, Article 2, Clause 1, and Clause 2, Article 4 of this Circular, shall organize the verification and review of applications and bear responsibility for their accuracy; compile and prepare lists of beneficiaries. In cases where the application is not valid, the public vocational education institution shall notify the student within two working days from the date of receipt of the application;
b) Procedure for granting residential policies: Within twenty working days from the start of classes, the vocational education institution shall notify students participating in the intermediate and college training programs about the residential policy.
Article 7. Management and direction of public vocational education centers
1. The direct management and direction authority over public vocational education centers at the district level as stipulated in Clause 1 of Article 4 of Circular No. 05/2020/TT-BLDTBXH dated August 16, 2020 issued by the Minister of Labor, Invalids, and Social Affairs on the organizational structure and operation regulations of public vocational education centers at the district level (hereinafter referred to as Circular No. 05/2020/TT-BLDTBXH) shall be implemented by the People's Committee at the commune level.
2. Replace the term "district level" with "commune level" in Circular No. 05/2020/TT-BLDTBXH.
Article 8. Authority to assess and recognize "Learning Community" at the commune level
1. The authority to assess and recognize communes achieving the "Learning Community" standard at the commune level as stipulated in Clause 1 of Article 5 of Circular No. 25/2023/TT-BGDĐT dated December 27, 2023 issued by the Minister of Education and Training on the assessment and recognition of "Learning Community" standards at the commune, district, and provincial levels (hereinafter referred to as Circular No. 25/2023/TT-BGDĐT) shall be carried out by the Director of the Department of Education and Training.
2. Replace the term "commune, ward, town" with "commune, ward, special administrative region"; replace the term "district level" with "commune level"; and replace the term "commune, district, province level" with "commune, province level" in Circular No. 25/2023/TT-BGDĐT.
3. Replace the phrase "At least 90% of districts recognized as achieving the 'Learning Community' standard at the district level at Level 1 as provided for in Point a, Clause 1, Article 13 of this Circular" with the phrase "At least 90% of communes recognized as achieving the 'Learning Community' standard at the commune level at Level 1 as provided for in Point a, Clause 1, Article 8 of this Circular" in Point a, Clause 4, Article 16; and replace the phrase "At least 90% of districts recognized as achieving the 'Learning Community' standard at the district level at Level 2 as provided for in Point b, Clause 2, Article 13 of this Circular" with the phrase "At least 90% of communes recognized as achieving the 'Learning Community' standard at the commune level at Level 2 as provided for in Point b, Clause 2, Article 8 of this Circular" in Point a, Clause 4, Article 17 of Circular No. 25/2023/TT-BGDĐT.
Article 9. Replacing certain terms and phrases in some legal normative documents of the Minister of Education and Training regarding vocational education and continuing education
1. Replace the phrases "Department of Labor, Invalids, and Social Affairs" and "Department of Labor, Invalids, and Social Affairs" with the phrase "Department of Education and Training" in Clauses 3, 5, and 6 of Article 14 of Circular No. 43/2015/TT-BLDTBXH dated October 20, 2015 issued by the Minister of Labor, Invalids, and Social Affairs on regular training programs which have been amended and supplemented by Circular No. 34/2018/TT-BLDTBXH dated December 26, 2018 issued by the Minister of Labor, Invalids, and Social Affairs.
2. Replace the phrase "District group" with the phrase "Commune and Ward group" in Item 2 of Table 02; and replace the phrases "District A," "District B" with the phrases "Commune A," "Commune B" in Sub-item 2.1 and 2.2 of Item 2 of Table 02 promulgated together with Circular No. 22/2017/TT-BLDTBXH dated August 10, 2017 issued by the Minister of Labor, Invalids, and Social Affairs guiding the implementation of some provisions of Decree No. 113/2015/NĐ-CP dated November 9, 2015 issued by the Government on special allowances, preferential allowances, responsibility allowances, and heavy, toxic, and dangerous work allowances for teachers in public vocational education institutions.
3. Replace the phrase "Education and Training Department" with the phrase "People's Committee at the Commune Level" in Article 14 and Clause 1 of Article 15 of Circular No. 10/2022/TT-BGDĐT dated July 12, 2022 issued by the Minister of Education and Training on the evaluation of learners in the Literacy Program.
4. Replace the phrase "commune, ward, town" with the phrase "commune, ward, special administrative region"; replace the phrase "Education and Training Department" with the phrase "People's Committee at the Commune Level"; and replace the phrase "People's Committee at the District Level" with the phrase "People's Committee at the Provincial Level" in Circular No. 18/2024/TT-BGDĐT dated November 28, 2024 issued by the Minister of Education and Training on the educational program to meet the needs of learners; updating knowledge, skills, and technology transfer.
Chapter III
IMPLEMENTATION PROVISIONS
Article 10. Effectiveness and Responsibility for Implementation
1. This Circular takes effect from July 1, 2025.
2. This Circular shall cease to be effective from March 1, 2027, except where laws, resolutions of the National Assembly, ordinances, resolutions of the Standing Committee of the National Assembly, decrees, resolutions of the Government, decisions of the Prime Minister, or Circulars of the Minister of Education and Training provide for authority, responsibility for state management, procedures, and formalities stipulated in this Circular to be approved or promulgated from July 1, 2025 and become effective before March 1, 2027, in which case the corresponding provisions in this Circular shall cease to be effective at the time these legal normative documents come into effect.
3. During the period when the provisions of this Circular are effective, if the provisions regarding authority, responsibility for state management, procedures, and formalities in this Circular differ from those in related legal normative documents issued before July 1, 2025, then implementation shall follow the provisions of this Circular.
4. The Director of the Office, the Head of the Legal Department, the Director of the Vocational Education and Continuing Education Bureau, the Heads of relevant units under the Ministry of Education and Training; the Chairpersons of the People's Committees of provinces and centrally governed cities; the Directors of Departments of Education and Training; the Chairpersons of the People's Committees of communes and towns; relevant agencies, organizations, units, and individuals shall be responsible for implementing this Circular./.
