1. Selling state property through public listing."b) In addition to the lists of public services issued according to the provisions of Clause 2, Article 4 of this Decree, specialized agencies under provincial People's Committees shall report to the provincial People's Committee for decision-making on amending, supplementing, or issuing the list of public services funded by the state budget within their jurisdiction and consistent with the local budget capacity within the approved budget by the Provincial People's Assembly, and send it to the Ministry of Finance and relevant ministries and sectors for supervision during implementation."2. Regulations on management and use of state property at agencies, organizations, and units.n l4. Public disclosure forms of state property, reports on declaration of state property."
2. Supplementing Clause 6a after Clause 6 as follows:
1. Amend and supplement Article 1 as follows:
"Article 1. Scope of Regulation
"Clause 6a. Selecting partners for joint ventures and cooperations when using state property at public service units for joint venture and cooperation purposes
1. Principles for selecting partners for joint ventures and cooperations:
a) Comply with legal regulations, ensuring compliance with the criteria specified in Clause 3, Article 47 of the Decree and Appendix I attached to this Circular.
b) Ensure accuracy, independence, honesty, transparency, fairness, and objectivity.
c) Organizations and individuals registering to participate in joint ventures and cooperations shall be responsible for the completeness and accuracy of the information in their registration files. In cases where incomplete or inaccurate information provided by organizations or individuals leads to the public service unit selecting the wrong partner for joint ventures and cooperations, such organizations or individuals will be subject to legal sanctions.
d) Do not select individuals or organizations whose legal representatives have been convicted by a final and binding judgment for crimes related to joint ventures and cooperations activities, or discovered providing inaccurate or false information about criteria in the registration file at the time of selecting partners for joint ventures and cooperations.
2. Units with joint venture and cooperation properties must publicly announce the selection of partners for joint ventures and cooperations according to Clause 3, Article 47 of the Decree at least five working days before the deadline for submitting registration files.
3. Registration files for participation in joint ventures and cooperations, prepared by organizations and individuals, must be stamped and signed by the organization and individual, respectively, and include complete information about the groups and components of criteria specified in Appendix I attached to this Circular, accompanied by printed or photocopied documents and materials proving (stamped by the organization and signed by the individual). Public service units with property may not require organizations and individuals to submit original or certified copies of documents and materials proving in the announcement of selection of organizations and individuals participating in joint ventures and cooperations.
In cases where organizations and individuals have been administratively sanctioned for violations in the field related to joint venture and cooperation activities, or have been convicted by a final and binding judgment for crimes related to joint venture and cooperation activities, they must provide full information in their registration files for participation in joint ventures and cooperations.
4. Based on the registration files for participation in joint ventures and cooperations submitted by organizations and individuals, public service units with property shall evaluate and score according to the criteria specified in Appendix I attached to this Circular and handle any arising situations according to Clauses 5, 6, 7, and 8 of this Article.
c) Tổ chức, cá nhân đăng ký tham gia liên doanh, liên kết tự chịu trách nhiệm về tính đầy đủ, chính xác của các thông tin trong hồ sơ đăng ký tham gia lựa chọn. Trường hợp do tổ chức, cá nhân kê khai không đầy đủ, chính xác thông tin dẫn đến đơn vị sự nghiệp công lập lựa chọn đối tác liên doanh, liên kết không đúng quy định thì tổ chức, cá nhân đó bị xử lý theo quy định của pháp luật.
d) Không lựa chọn các cá nhân, tổ chức có người đại diện theo pháp luật đã bị kết án bằng bản án có hiệu lực pháp luật về tội vi phạm quy định trong lĩnh vực liên quan đến hoạt động liên doanh, liên kết mà chưa được xoá án tích hoặc phát hiện tổ chức, cá nhân cung cấp thông tin không chính xác hoặc giả mạo thông tin về tiêu chí trong hồ sơ tại thời điểm lựa chọn đối tác thực hiện liên doanh, liên kết.
2. Đơn vị có tài sản liên doanh, liên kết thông báo công khai về việc lựa chọn đối tác liên doanh, liên kết theo quy định tại khoản 3 Điều 47 của Nghị định trong thời hạn ít nhất là 05 ngày làm việc, trước ngày hết hạn nộp hồ sơ đăng ký.
3. Hồ sơ đăng ký tham gia liên doanh, liên kết do tổ chức, cá nhân xây dựng, có dấu xác nhận của tổ chức, chữ ký của cá nhân bao gồm thông tin đầy đủ về các nhóm tiêu chí, tiêu chí thành phần quy định tại Phụ lục I ban hành kèm theo Thông tư này, gửi kèm theo bản đánh máy hoặc bản chụp các giấy tờ, tài liệu chứng minh (có dấu treo của tổ chức, chữ ký của cá nhân). Đơn vị sự nghiệp công lập có tài sản không được yêu cầu tổ chức, cá nhân nộp bản chính hoặc bản sao có chứng thực các giấy tờ, tài liệu chứng minh trong thông báo lựa chọn tổ chức, cá nhân tham gia liên doanh, liên kết.
Trong trường hợp tổ chức, cá nhân đã bị xử phạt vi phạm hành chính do vi phạm quy định trong lĩnh vực liên quan đến hoạt động liên doanh, liên kết, bị kết án bằng bản án có hiệu lực pháp luật về tội vi phạm quy định trong lĩnh vực liên quan đến hoạt động liên doanh, liên kết thì tổ chức, cá nhân có trách nhiệm cung cấp đầy đủ các thông tin này trong hồ sơ đăng ký tham gia liên doanh, liên kết.
4. Trên cơ sở các hồ sơ đăng ký tham gia liên doanh, liên kết của các tổ chức, cá nhân, đơn vị sự nghiệp công lập có tài sản thực hiện đánh giá, chấm điểm theo các tiêu chí quy định tại Phụ lục I ban hành kèm theo Thông tư này và xử lý các trường hợp phát sinh theo quy định tại các khoản 5, 6, 7 và 8 Điều này.
The head of a public service unit is responsible for approving the results of selecting joint venture and cooperation partners. The organization or individual selected must have the highest total score and not less than 50% of the maximum total score specified in Appendix I issued together with this Circular. In cases where the joint venture and cooperation do not require all criteria as stipulated in Appendix I issued together with this Circular, the public service unit shall exclude the scores of these criteria when determining the maximum total score.
The public service unit is responsible for publicly announcing the results of selecting joint venture and cooperation partners on its website (if available), the Ministry's or central agency's electronic portal, local portal, and the State Asset Management Portal of the Ministry of Finance, and sending a notification letter regarding the selection results to organizations and individuals who submitted registration applications within five working days from the date the partner selection results were approved. The content of the announcement of the selection results includes: the name of the selected organization or individual; a list of organizations and individuals not selected and a summary of the reasons why each organization or individual was not selected; a plan to complete and sign the joint venture and cooperation contracts with the selected organization or individual.
5. In cases where two or more organizations or individuals have the same highest total score, the organization or individual with a higher financial plan score will be selected; if the financial plans are equal, the public service unit with assets will base its decision on other criteria determined by the public service unit itself, which are appropriate to the purpose of the joint venture and cooperation, functions, and tasks of the public service unit, to decide on the selection of one of the organizations or individuals.
If, at the end of the period for submitting registration applications to participate in joint ventures and cooperations, only one organization or individual registers and has a total score not lower than 50% of the maximum total score, the asset-holding unit will consider and decide to select that organization or individual.
6. In cases where, within twelve months from the date of submission of the application, the organization or individual falls under any of the following circumstances, the following actions will be taken:
a) An organization or individual is administratively penalized for violating regulations related to joint venture and cooperation activities, then for each administrative penalty violation, that organization or individual will lose 5% of their total score.
b) An individual or organization whose legal representative has been convicted by a legally effective judgment for a crime related to joint venture and cooperation activities and has had their criminal record expunged will lose 20% of their total score.
c) An organization or individual that has been disqualified from participating in joint ventures and cooperations by another public service unit according to Clause 7 of this Article or refused to have their application considered due to providing inaccurate or fabricated information about criteria in the registration application will lose 25% of their total score.
7. After obtaining the results of selecting partners for joint ventures and cooperations, if the public service unit with assets receives information from authorized agencies or organizations confirming that the selected organization or individual provided inaccurate or fabricated information about criteria in the registration application, the following actions will be taken:
a) If the joint venture and cooperation contract has not yet been signed, the public service unit with assets will revoke the selection result of that organization or individual, and simultaneously announce the revocation of the selection result on its website (if available), the Ministry's or central agency's electronic portal, local portal, and the State Asset Management Portal of the Ministry of Finance.
b) If the joint venture and cooperation contract has already been signed, the asset-holding unit will revoke the selection result of that organization or individual and simultaneously unilaterally terminate the joint venture and cooperation contract with that organization or individual without having to compensate for damages. The asset-holding unit will announce the unilateral termination of the contract and the reasons for the termination on its website (if available), the Ministry's or central agency's electronic portal, local portal, and the State Asset Management Portal of the Ministry of Finance.
8. In cases where, at the end of the registration period, no organization or individual submits a registration application or the total scores of those who submit applications do not meet the minimum score requirement, the public service unit with assets will reorganize the process of selecting partners for joint ventures and cooperations according to Clause 3 of Article 47 of the Decree and this Article.
9. In cases where the selection results of partners for joint ventures and cooperations are revoked according to Clause 7 of this Article, the following actions will be taken:
a) If the selection result is revoked within six months from the date of approval of the result, the head of the public service unit will reapprove the selection result of the joint venture and cooperation partner for the organization or individual with the next highest score if that organization or individual still has the desire to participate in joint ventures and cooperations and their total score is not lower than 50% of the maximum total score.
If the organization or individual with the next highest score no longer wishes to participate in joint ventures and cooperations or their total score is lower than 50% of the maximum total score or there is no organization or individual with the next highest score, the public service unit with assets will reorganize the process of selecting partners for joint ventures and cooperations according to Clause 3 of Article 47 of the Decree and this Circular.
b) If the result is revoked after six months from the date of approval of the result, the public service unit will reorganize the process of selecting joint venture and cooperation partners according to Clause 3 of Article 47 of the Decree and this Article."
Article 2. Repeal and replace some Articles, Clauses, and Forms of Circular No. 144/2017/TT-BTC dated December 29, 2017, issued by the Minister of Finance guiding certain contents of Decree No. 151/2017/NĐ-CP dated December 26, 2017, of the Government detailing certain provisions of the Law on Management and Use of State Property.
1. Repeal Article 6, Article 8, Clause 4 of Article 12.
2. Replace Form No. 09d-CK/TSC - Public Disclosure of the Situation of State Asset Disposal (annexed to this Circular).
Article 3. Implementation Provisions
Article 1. This Circular takes effect from the date of issuance.
2. Transitional provisions for cases where a Board is established to determine the value of state assets as stipulated in Article 8 of Circular No. 144/2017/TT-BTC:
a) In cases where a Board has been established to determine the value of state assets and the Board has concluded on the value of the state assets before this Circular takes effect, such value shall continue to be used.
b) In cases where a Board has been established to determine the value of state assets but has not concluded on the value of the state assets by the time this Circular takes effect, the Board shall cease its operations.
3. Ministries, agencies at the ministerial level, government agencies, other central agencies, People's Committees of provinces and centrally-administered cities, relevant agencies, organizations, and units have the responsibility to implement this Circular.
