PRIME MINISTER
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to Decision No. 07/2006/QĐ-TTg dated January 10, 2006 of the Prime Minister approving the Socio-Economic Development Program for Particularly Difficult Communes in Ethnic Minority Areas and Mountainous Regions for the period 2006-2010;
Considering the proposal of the Minister, Chairman of the National Ethnic Minorities Committee,
DECISION:
Article 1. Approve the supplementation of the list of 12 particularly difficult communes, border communes, and safe area communes from 7 provinces to be included in the investment scope of Phase II of Program 135 (Annex I attached hereto) to implement the program's tasks from the 2009 plan with central budget support.
Article 2.
1. The communes of CưKlông, Ea Tam, and Ea Trang in Krông Năng district, Dak Lak province; Long Phú commune in Long Phú district, Soc Trang province; Lương Thiện commune in Sơn Dương district, Tuyên Quang province, which were approved for inclusion in the investment scope of Phase II of Program 135 according to Decision No. 69/2008/QĐ-TTg dated May 19, 2008, already appeared in Decision No. 164/2006/QĐ-TTg dated July 11, 2006, the central budget will allocate funds only once according to the current standard.
2. Correct the name of Sinh Phinh commune in Sa Pa district, Lao Cai province in Decision No. 69/2008/QĐ-TTg dated May 19, 2008 to Sinh Phìn commune in Sa Pa district, Lao Cai province.
Article 3.
1. Approve the supplementation of the list of 3 communes from Cao Bang and Binh Dinh provinces (Annex II attached hereto) that have completed their targets and exited the investment scope of Phase II of Program 135 from 2009. Do not reduce the allocated budget funds for the 2009 provincial budgets of Cao Bang and Binh Dinh provinces. The unreduced funds shall continue to be used to implement projects in communes within the investment scope of Phase II of Program 135.
2. Particularly difficult hamlets and villages in communes that have completed their targets and exited the investment scope of Phase II of Program 135 may be considered for inclusion in the investment scope of Phase II of Program 135 from 2009.
Entrust the Minister, Head of the Committee for Ethnic Minorities Affairs to decide on approving the specific lists after coordinating with the Ministry of Planning and Investment and the Ministry of Finance.
Article 4. Poor households according to the poverty standard stipulated in Decision No. 170/2005/QĐ-TTg dated July 8, 2005 of the Prime Minister on issuing the poverty standard applicable for the period 2006-2010 (referred to as poor households), members of poor households, students, civil servants, military officers, police officers working in communes listed in Annex II attached hereto shall enjoy policies as those in communes under Phase II of Program 135 until the end of 2010.
Article 5.
1. The Committee for Ethnic Minorities Affairs shall take the lead and coordinate with relevant ministries and sectors to guide, direct, inspect, and urge localities to effectively implement and utilize the investment support funds for communes within the investment scope of Phase II of Program 135 in accordance with current regulations.
2. The Ministry of Planning and Investment and the Ministry of Finance shall allocate targeted assistance funds for the People's Committees of provinces and centrally-administered cities having particularly difficult communes within the investment scope of the Programs.
3. The Ministries of Agriculture and Rural Development, Transport, and other relevant ministries, agencies shall organize implementation in accordance with their assigned functions and tasks based on Article 2 of Decision No. 07/2006/QĐ-TTg dated January 10, 2006.
4. The People's Committees of provinces and centrally-administered cities having communes within the investment scope of the Program shall direct the preparation, approval, and organization of implementation in accordance with the designated purposes, beneficiaries, and contents of support as prescribed.
Article 6. This Decision shall take effect from the date of signing.
Article 7. Ministers, heads of ministerial-level agencies, heads of government agencies, and Chairpersons of Provincial People's Committees and Municipal People's Committees directly under the Central Government shall be responsible for enforcing this Decision.
