Decision No. 1134/2016/UBTVQH13 detailing and guiding the organization of voters' meetings; the introduction of candidates for People's Council representatives at village and ward levels; and the negotiation and introduction of candidates for National Assembly and People's Council representatives in supplementary elections.

RESOLUTION

DETAILING AND GUIDING THE ORGANIZATION OF CITIZEN MEETINGS; THE INTRODUCTION OF CANDIDATES FOR DEPUTIES OF THE PEOPLE'S COUNCIL AT THE COMMUNE LEVEL IN VILLAGE GROUPS; THE NEGOTIATION AND INTRODUCTION OF CANDIDATES FOR NATIONAL ASSEMBLY DEPUTIES AND DEPUTIES OF THE PEOPLE'S COUNCIL IN SUPPLEMENTARY ELECTIONS

On the basis of the Constitution of the Socialist Republic of Vietnam;

Pursuant to the Law on the Organization of the National Assembly No. 57/2014/QH13;

WHEREAS, the Law on Local Administration No. 77/2015/QH13;

Pursuant to the Law on Elections of National Assembly Deputies and People's Council Members No. 85/2015/QH13;

Pursuant to the Law on the Vietnam Fatherland Front No. 75/2015/QH13;

RESOLUTION:

PART I 
DEPUTIES TO THE PEOPLE'S COUNCILS
Article 1. Organization of citizen meetings at place of work

2. The authority to preside over and convene citizen meetings at place of work shall be implemented as follows:

1. The organization of citizen meetings at the workplace or place of work to solicit opinions on candidates for National Assembly deputies and People's Council deputies (including those recommended and self-nominated candidates) shall be held at the workplace or place of work of the candidate (if applicable). In cases where the candidate has multiple workplaces, the meeting shall be organized to solicit opinions from citizens at the place where the candidate regularly works.

b) For candidates who are Chairperson or Vice-Chairperson of the National Assembly, working at the Standing Committee of the Ethnic Council, Committees of the National Assembly, specialized departments under the Ethnic Council, Committees of the National Assembly, working at the National Assembly Office, or specialized Party cadres at the National Assembly Party Committee, the organization of citizen meetings to gather opinions at the workplace shall be decided and directed by the National Assembly Standing Committee, with the meeting convened and chaired by the leadership comprising the head and deputy heads of the National Assembly Office;

a) For candidates for National Assembly deputies who are full-time staff at Party agencies at all levels, the leadership of the agency shall convene and chair the meeting.

For candidates for People's Council deputies who are full-time staff at Party agencies at all levels, the head of the agency shall coordinate with the Trade Union Committee of the agency to convene and chair the meeting;

b) For candidates for National Assembly deputies working at agencies of the National Assembly, the Standing Committee of the National Assembly, or full-time representatives of the National Assembly Delegation at the local level, the meeting to solicit opinions from citizens shall be held at the National Assembly Office, the National Assembly Delegation Office, and the People's Council Office or the National Assembly Delegation Office (where such offices exist). The head of the agency shall coordinate with the Trade Union Committee of the agency to convene and chair the meeting.

For candidates for People's Council deputies working at the Standing Committee of the People's Council, the various Committees of the Provincial People's Council, the meeting to solicit opinions from citizens shall be held at the National Assembly Delegation Office and the People's Council Office or the People's Council Office (where such offices exist); for those working at the Standing Committee of the People's Council, the various Committees of the District People's Council, the meeting to solicit opinions from citizens shall be held at the People's Council Office and the People's Committee Office. The head of the agency shall coordinate with the Trade Union Committee of the agency to convene and chair the meeting.

For candidates for National Assembly deputies who are President, Vice President, Prime Minister, Deputy Prime Minister, the meeting to solicit opinions from citizens shall be held at the President's Office, the Government Office; for candidates for National Assembly deputies and People's Council deputies who are Chairmen or Deputy Chairmen of the People's Committee at the provincial or district level, the meeting to solicit opinions from citizens shall be held at the People's Committee Office at the same level. The head of the agency shall coordinate with the Trade Union Committee of the agency to convene and chair the meeting.

For candidates for National Assembly deputies and People's Council deputies working at the People's Court, the People's Procuracy, the State Audit Agency, Ministries, agencies equivalent to ministries, government agencies, specialized agencies under the People's Committee at the provincial or district level, and other state agencies, the head of the agency shall coordinate with the Trade Union Committee to convene and chair the meeting;

c) For candidates for National Assembly deputies working at the Vietnam Fatherland Front Committee, political-social organizations, political-social-professional organizations, social organizations, social-professional organizations at all levels, the leadership of the organization shall convene and chair the meeting.

For candidates for People's Council deputies working at the Vietnam Fatherland Front Committee, political-social organizations, political-social-professional organizations, social organizations, social-professional organizations at all levels, the head of the organization shall coordinate with the Trade Union Committee to convene and chair the meeting;

d) For candidates for National Assembly deputies and People's Council deputies working at public service units, economic organizations, the head of the unit shall coordinate with the Trade Union Committee to convene and chair the meeting;

đ) For candidates for National Assembly deputies and People's Council deputies working at the Party Committee, the Standing Committee of the People's Council, the People's Committee, the Vietnam Fatherland Front Committee, political-social organizations at the commune level, a joint meeting shall be organized between the Party Committee, the People's Council, the People's Committee, the Vietnam Fatherland Front Committee, and political-social organizations at the commune level, convened and chaired by the head of the Party Committee;

e) For candidates for National Assembly deputies and candidates for People's Council deputies working in people's armed forces units, the leaders and commanders of the unit shall convene and chair the meeting;

g) In cases where the workplace or place of work of candidates for National Assembly deputies and People's Council deputies specified in this clause does not have a Trade Union organization, the head of the agency, organization, or unit shall convene and chair the meeting. If the head of the agency, organization, or unit is a candidate for National Assembly deputy or People's Council deputy, then the deputy head of the agency, organization, or unit shall convene and chair the meeting.

3. Where there are less than one hundred voters at the citizen meeting at the workplace or place of work to solicit opinions on candidates for National Assembly deputies and People's Council deputies, a general meeting shall be organized, but it must ensure that at least two-thirds of the total number of voters participate.

Where there are one hundred or more voters, a representative meeting may be organized, but it must ensure that at least seventy voters participate. Depending on the specific circumstances and actual conditions of the agency, organization, or unit, the Trade Union Committee shall coordinate with the head of the agency, organization, or unit to allocate the number of people for the subordinate trade union organizations to elect representatives to attend; if there is no Trade Union organization, the head of the agency, organization, or unit shall allocate the number of people for the subordinate units to elect representatives to attend.

4. Nominees for National Assembly deputies and People's Council representatives shall be invited to attend the meeting.

Article 2. Organizing the residents' meeting

1. The solicitation of opinions from citizen meetings at the place of residence regarding candidates for National Assembly deputies and People's Council deputies (including those recommended and self-nominated candidates) shall be organized at the place where the candidate regularly resides in villages, hamlets, ấp, bản, buôn, phum, sóc, village groups, neighborhoods, blocks (hereinafter referred to collectively as villages, village groups), regardless of whether they have permanent or long-term temporary residency户籍所在地或经常居住地的选民会议对候选人征求意见的组织，应在候选人经常居住的村、村民小组（以下简称村、村民小组）进行，不论其是否有常住户口或长期暂住户口。

2. The Standing Committee of the Vietnam Fatherland Front Committee at the commune level shall coordinate with the People's Committee at the same level to convene and preside over the meeting.

The participants in the meeting shall be invited by the Head of the Mass Mobilization Team in coordination with the Village Chief or the Resident Group Leader.

3. Where the number of voters attending the voter meeting to seek opinions on candidates for National Assembly deputies and People's Council members is less than one hundred, a general meeting shall be organized, but it must ensure that more than 50% of the voters attend. Where there are one hundred or more voters, at least fifty-five voters must attend.

4. The Chairperson and Vice-Chairpersons of the People's Council at the same level, candidates for National Assembly deputies and People's Council members, representatives of agencies, organizations, units, villages, and resident groups that have introduced candidates shall be invited to attend the meeting.

Article 3. Content and minutes of the meeting of voters

1. At the voter meetings held at the workplace or place of residence, voters shall compare the candidates with the standards for National Assembly deputies and People's Council members, express their opinions, and indicate their trust in the candidates.

2. The minutes of the voter meeting must clearly record the composition, number of attendees, proceedings, and results of the meeting; including the total number of voters summoned, the number of voters present, opinions expressed, and the trust of voters in each candidate. The sending of the minutes is regulated as follows:

a) Minutes of the voter meeting at the workplace to seek opinions on individuals proposed by central agencies, organizations, or units to run for National Assembly deputy positions must be sent together with the minutes of the leadership meeting of the agency, organization, or unit expressing opinions on the proposed candidate to the Standing Committee of the Central Vietnam Fatherland Front before the second round of negotiation meetings is convened;

b) Minutes of the voter meeting at the workplace to seek opinions on individuals proposed by local agencies, organizations, or units to run for National Assembly deputy positions must be sent together with the minutes of the leadership meeting of the agency, organization, or unit expressing opinions on the proposed candidate to the Standing Committee of the Vietnam Fatherland Front at the provincial level before the second round of negotiation meetings is convened;

c) Minutes of the voter meeting at the workplace to seek opinions on individuals proposed to run for People's Council member positions must be sent together with the minutes of the leadership meeting of the agency, organization, or unit where the individual works expressing opinions on the proposed candidate to the Standing Committee of the Vietnam Fatherland Front at the level organizing the negotiation meeting before the second round of negotiation meetings is convened;

d) Minutes of the voter meeting at the place of residence to seek opinions on individuals proposed by central agencies, organizations, or units to run for National Assembly deputy positions must be sent to the Standing Committee of the Central Vietnam Fatherland Front; minutes of the voter meeting to seek opinions on individuals proposed by local agencies, organizations, or units to run for National Assembly deputy positions must be sent to the Standing Committee of the Vietnam Fatherland Front at the provincial level immediately after the conclusion of the voter meeting;

đ) Minutes of the voter meeting to seek opinions on self-nominated candidates for National Assembly deputy positions must be sent to the Standing Committee of the Vietnam Fatherland Front at the provincial level immediately after the conclusion of the voter meeting;

e) Minutes of the voter meeting to seek opinions on self-nominated candidates for People's Council member positions, and minutes of the voter meeting at the place of residence to seek opinions on individuals proposed by agencies, organizations, or units to run for People's Council member positions must be sent to the Standing Committee of the Vietnam Fatherland Front at the level organizing the negotiation meeting immediately after the conclusion of the voter meeting.

Article 4. Procedures for organizing voter meetings

1. The chairperson of the meeting declares the purpose, introduces the representatives attending the meeting. The chairperson has the following responsibilities:

a) Introduce the purpose and requirements of the meeting;

b) Introduce the Meeting Secretary for the meeting to decide;

c) Report on the number of voters invited and the number of voters present;

d) Introduce the list of candidates;

đ) Read the qualifications of National Assembly deputies stipulated in Article 22 of the Law on the Organization of the National Assembly (for voter meetings seeking opinions on candidates for National Assembly deputies), the qualifications of People's Council members stipulated in Article 7 of the Law on the Organization of Local Administrative Bodies (for voter meetings seeking opinions on candidates for People's Council members), and the cases not eligible to run for National Assembly deputies and People's Council members stipulated in Article 37 of the Law on the Election of National Assembly Deputies and People's Council Members.

2. The Meeting Secretary reads the brief biography of each candidate.

3. Voters express their opinions regarding each candidate.

4. Candidates and representatives of agencies, organizations, or units introducing candidates shall make statements.

5. The meeting shall vote by raising hands or secret ballot. The meeting shall form a Vote Counting Team consisting of three to five people.

In the case of voting by raising hands, the Vote Counting Team shall count and calculate the voting results for each candidate.

TIn the case of voting by secret ballot, the trust votes of voters at the workplace or place of work must bear the stamp of the agency, organization, or unit or the Executive Board of the Trade Union of the agency, organization, or unit. The trust votes of voters at the place of residence must bear the stamp of the Vietnam Fatherland Front Committee at the commune level or of the People's Committee at the same level. On the trust vote, clearly write the name of the candidate. If there are multiple candidates, clearly write the names of the candidates in alphabetical order A, B, C... Voters shall strike out the name of the candidate they do not trust and put the ballot in the ballot box.

6. The Team Leader of the Vote Counting Team shall announce the voting results.

7. The meeting shall approve the minutes of the voter meeting (according to Model 01 or Model 02/BC ĐBQH, ĐBHĐND-UBTVQH).

PART II
INTRODUCING CANDIDATES FOR DEPUTIES OF THE PEOPLE'S COUNCILS AT THE COMMUNE LEVEL IN VILLAGES AND HOUSING COMPLEXES
PEOPLE'S COUNCIL AT THE COMMUNE LEVEL IN VILLAGE, HOUSING ESTATE

Article 5. Content and procedures for nominating candidates for People's Council representatives at village and ward levels

1. The Chairman of the Mass Organization Work Board shall convene a meeting with the Secretary of the Party Branch, Village Head, or Ward Chief to nominate candidates from the village or ward for People's Council representatives according to the notification of the Standing Committee of the Vietnam Fatherland Front Committee at the commune level regarding the allocation of quantity and composition.

2. The Chairman of the Mass Organization Work Board shall convene and chair a meeting comprising all members of the Mass Organization Work Board to discuss and nominate candidates, and appoint a secretary for the meeting. The procedures for organizing the meeting shall be carried out as follows:

a) The Chairman of the Mass Organization Work Board shall introduce the purpose and requirements of the meeting and read the notification of the Standing Committee of the Vietnam Fatherland Front Committee at the commune level regarding the allocation of quantity, composition, and components of people from the village or ward nominated as candidates for People's Council representatives; the standards of People's Council representatives stipulated in Article 7 of the Law on the Organization of Local Administration and the cases prohibited from being nominated as People's Council representatives stipulated in Article 37 of the Law on the Election of National Assembly Deputies and People's Council Representatives;

b) The Chairman of the Mass Organization Work Board shall present the proposed candidates for People's Council representatives;

c) The meeting discusses and comments on the proposed candidates;

d) The Chairman of the Mass Organization Work Board shall conclude the opinions of the meeting regarding the comments on the proposed candidates;

đ) The meeting shall approve the minutes of the meeting (according to Model No. 03/BC ĐBHĐND-UBTVQH).

Article 6. Meeting of voters to nominate candidates for People's Council representatives at village and ward levels

1. The Chairman of the Mass Organization Work Board shall coordinate with the Village Head or Ward Chief to send invitations to attend the meeting of voters to nominate candidates for People's Council representatives at the village or ward level. The attendees invited include:

a) Voters or representatives of household voters.

In places where there are fewer than one hundred voters, a general meeting shall be organized, but it must ensure that more than 50% of the voters participate. In places with one hundred or more voters, at least fifty-five voters must participate;

b) All members of the Mass Organization Work Board;

c) The Village Chief, Deputy Village Chief, or the Neighborhood Ward Leader, Deputy Neighborhood Ward Leader;

d) Representatives of the Standing People's Council, People's Committee, and the Standing Committee of the Vietnam Fatherland Front Committee at the commune level; for pilot wards without a People's Council, representatives of the People's Committee and the Standing Committee of the Vietnam Fatherland Front Committee at the ward level shall be invited;

2. The procedures for organizing the meeting of voters to obtain opinions on candidates for People's Council representatives shall be carried out as follows:

a) The Chairman or Deputy Chairman of the Mass Organization Work Board shall chair the meeting of voters, state the reasons for the meeting, and introduce the attendees; introduce the purpose and requirements of the meeting; introduce the Secretary of the meeting for the meeting to decide;

b) The Chairperson of the meeting shall read the notification of the Standing Committee of the Vietnam Fatherland Front Committee at the commune level regarding the allocation of quantity and composition of people from the village or ward nominated as candidates; read the standards of People's Council representatives stipulated in Article 7 of the Law on the Organization of Local Administration and the cases prohibited from being nominated as People's Council representatives stipulated in Article 37 of the Law on the Election of National Assembly Deputies and People's Council Representatives;

c) A representative of the Mass Organization Work Board shall read the list of people from the village or ward proposed by the Mass Organization Work Board to nominate as candidates for People's Council representatives. Voters may propose additional candidates for the meeting to consider;

d) The meeting discusses the proposed candidates;

đ) The meeting shall decide the official list of people nominated as candidates by the village or ward through raising hands or secret ballot. The meeting shall form a counting team consisting of three to five people;

In the case of voting by raising hands, the Vote Counting Team shall count and calculate the voting results for each candidate.

In the case of voting by secret ballot, the voter's endorsement must be stamped by the Vietnam Fatherland Front Committee at the commune level or the same-level People's Committee. On the endorsement form, clearly write the name and surname of those nominated as candidates by the meeting of voters. If there are multiple candidates, clearly write the name and surname of each candidate, arranged alphabetically from A, B, C... The voter shall strike out the name of the candidate they do not endorse and place it in the ballot box.

The person nominated as a candidate is someone who receives more than 50% endorsement from the voters present;

e) The head of the Vote Counting Team announces the voting results;

g) The meeting shall approve the minutes of the meeting (according to Model No. 04/BC ĐBHĐND-UBTVQH).

Chapter III
NEGOTIATION AND NOMINATION OF CANDIDATES
IN SUPPLEMENTARY ELECTIONS
IN A BY-ELECTION

Article 7. Work on consultation and introduction of candidates for supplementary elections

The negotiation and nomination of candidates in supplementary elections for National Assembly deputies and People's Council representatives shall be organized and implemented according to the provisions in Section 2 and Section 3 of Chapter V of the Law on the Election of National Assembly Deputies and People's Council Representatives and related detailed regulations and guidance. However, the time for conducting negotiations and nominations in supplementary elections shall be carried out according to the provisions in Article 8 of this Resolution.

Article 8. Time for conducting consultations and introducing candidates for supplementary elections

1. The first negotiation meeting to agree on the structure, composition, and number of candidates for National Assembly deputies and People's Council representatives shall be held no later than 20 days before the supplementary election day.

2. After the first negotiation meeting, the agencies, organizations, units, villages, and wards allocated the number of nominees shall select and nominate candidates no later than 19 days before the supplementary election day.

3. The second consultation meeting to agree on the preliminary list of candidates for National Assembly deputies and People's Council representatives shall be held no later than 16 days before the date of the supplementary election.

4. The organization of meetings of voters to obtain comments and endorsements from voters residing or working (if applicable) on candidates for National Assembly deputies and People's Council representatives shall be carried out no later than 14 days before the supplementary election day.

5. The third negotiation meeting to select and compile a list of candidates meeting the criteria for National Assembly deputies and People's Council representatives shall be held no later than 12 days before the supplementary election day.

Chapter IV
IMPLEMENTING PROVISIONS

Article 9. Effective Date

This Resolution shall take effect from the date of signing.
