Regulations on the dossier for planning tasks and planning projects for regional construction, urban planning, and special functional area construction planning

Based on the Construction Law No. 50/2014/QH13; Urban Planning Law No. 30/2009/QH12;

Based on Decree No. 44/2015/NĐ-CP dated May 6, 2015 of the Government detailing certain contents regarding construction planning; Decree No. 37/2010/NĐ-CP dated April 7, 2010 of the Government on the preparation, review, approval, and management of urban planning;

Based on Decree No. 62/2013/NĐ-CP dated June 25, 2013 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Construction,

At the proposal of the Director of the Department of Planning and Architecture;

The Minister of Construction issues this Circular to regulate the dossier for planning tasks and planning projects for regional construction, urban planning, and special functional area construction planning,

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

This Circular regulates the content of the dossier for planning tasks and planning projects for regional construction, urban planning, and special functional area construction planning.

All organizations and individuals within Vietnam and foreign entities directly participating or related to construction planning work on Vietnamese territory must comply with the provisions of this Circular.

Article 2. Content and presentation format

1. The presentation content for the explanatory notes and drawings of planning tasks and planning projects for regional construction, urban planning, and special functional area construction planning must be appropriate to each type of planning and comply with the provisions of Chapter II of this Circular.

2. The system of drawing symbols for planning tasks and planning projects for regional construction, urban planning, and special functional area construction planning must comply with the regulations set forth in the Appendix attached to this Circular.

Chapter II

CONTENT OF THE DOSSIER FOR PLANNING TASKS AND PLANNING PROJECTS FOR CONSTRUCTION

Section 1

Regional construction planning

The dossier for regional construction planning for inter-provincial regions, provincial regions, inter-district regions, district regions, special function regions, regions along expressways, and inter-provincial economic corridors shall be implemented according to the provisions of Section 1 of this Circular.

Article 3. Content of the dossier for regional construction planning tasks

1.   Drawings including: Diagram of location and relationship of the region; map of boundaries and scope of research for regional construction planning. Presented on a suitable topographic base map.

2.   Explanatory notes for regional construction planning tasks:

a)    Reasons and necessity for establishing the planning; basis for establishing the planning task; foundation for determining the scale, scope, and boundaries of the region for construction planning.

b)   Determination of viewpoints, goals of the planning; nature, function, and role of the region.

c)   Basic requirements for content, level of investigation, data collection, statistics, and evaluation of the current status of the region for planning.

d)   Basis and methods for determining the driving forces of development of the region; preliminary forecast on population, land, urbanization rate, socio-economic development...; proposal for selecting indicators for infrastructure, social infrastructure in the construction planning project.

e)    Requirements for spatial development orientation of the region for planning: System of cities, rural areas; special function zones (national level, provincial level); social infrastructure system, technical infrastructure at the regional level, and requirements for strategic environmental assessment in the construction planning project.

g) Determination of list of drawings, explanatory notes, appendices; quantity and format of dossier products; plan and schedule for organizing the planning.

3.   Draft Memorandum and draft Decision on approval of the planning task.

Article 4. Content of the urban planning master plan dossier

1. Components of the drawings:

a) Scheme of location and relationship of the region: The location, boundaries of the region, natural, economic-societal, and environmental relationships affecting the planned region. To be presented on a suitable scale topographic map.

b) Current condition schemes of the region: Natural conditions; current distribution of population and land use; current status of social infrastructure, technical infrastructure, and regional environment. To be presented on a topographic map at a scale of 1/100,000 or 1/250,000 for inter-provincial regions and a scale of 1/25,000 or 1/50,000 for other regions.

c) Schemes on spatial zoning and development orientation of the region: Identification of development areas, conservation areas, restricted development areas, prohibited development areas; description of the system of cities and rural residential areas; distribution and determination of the scale of industrial, agricultural, forestry development spaces; rest and tourism areas, natural resource exploitation and protection areas, cultural heritage areas, and other functions; distribution of regional economic-technical facilities. To be presented on a topographic map at a scale of 1/100,000 or 1/250,000 for inter-provincial regions and a scale of 1/25,000 or 1/50,000 for other regions.

d) Technical infrastructure orientation schemes at the regional level: Transportation, ground elevation, surface drainage, energy supply, telecommunications, water supply, waste management, and cemeteries. To be presented on a topographic map at a scale of 1/100,000 or 1/250,000 for inter-provincial regions and a scale of 1/25,000 or 1/50,000 for other regions.

đ) Drawings on strategic environmental assessment. To be presented on a suitable scale topographic map.

2. Explanation.

a) Reasons and necessity for establishing the regional construction planning; planning bases; viewpoints and development goals of the region.

b) Analysis and evaluation of natural conditions, current economic-societal status of the region; current distribution of urban and rural areas, demographic changes within the planned region; current land use and management; current status of social infrastructure, technical infrastructure, resources, and environment of the region; current status of investment programs and projects for the planned region; evaluation of the implementation of planning, resource management, and environmental protection work.

For inter-provincial, inter-district regions, along expressway corridors, and provincial economic corridors: Evaluation of cooperation and linkage development among provinces and districts within the region; clearly state the effectiveness and shortcomings in implementing development linkages in terms of planning management, serving as a basis for proposing solutions in the planning project.

The above contents must be clearly, concisely, comprehensively, and clearly presented, accompanied by illustrative diagrams and tables.

c) Determination of the driving forces and potential for development of the region.

d) Forecasting of economic-societal, demographic, labor force, urbanization rate, land use, and environmental conditions; risks related to fluctuations, natural disasters, etc.

đ) Spatial development orientation according to the region's development goals and nature. Specific content includes: Urban, industrial, economic zone, tourism, social infrastructure, conservation (natural scenery and cultural-historical heritage), rural, and land use zoning.

e) Orientation for developing the regional technical infrastructure system concerning transportation, ground elevation, surface drainage, energy supply, telecommunications, water supply, waste management, and cemeteries.

g) Identification of priority programs and projects for investment in technical infrastructure, social infrastructure, and environmental protection; projects must specify the scale of construction investment, forecast capital requirements, and propose funding sources.

h) Proposals for implementing the plan after approval by the competent authority. For regions including multiple provincial administrative units, it is necessary to propose management models and mechanisms for inter-provincial development linkage.

i) Strategic Environmental Assessment: Content as stipulated in Clause 1, Point g, Article 8 of Decree No. 44/2015/ND-CP dated May 6, 2015 of the Government detailing certain aspects of urban planning (hereinafter referred to as Decree No. 44/2015/ND-CP).

The explanatory report must include statistical tables, calculation appendices, illustrative images, and a system of diagrams and reduced-size A3 drawings with clear symbols and annotations, arranged alongside each section of the explanatory report.

3. Management regulations according to the regional urban planning: Content as stipulated in Article 9 of Decree No. 44/2015/ND-CP and must include accompanying diagrams.

4. Draft proposal and draft decision approving the planning project.

5. Appendices accompanying the explanatory report (additional explanations, arguments, and supporting data for the explanatory report; illustrative drawings; computational data). Appendices attach relevant legal documents.

Section 2

Urban Planning

Article 5. Content of the Master Plan Task File for Urban Areas

The master plan tasks for central cities directly under the Central Government, provincial cities, towns, and urban areas of type V that have not been recognized as towns shall be carried out in accordance with the provisions of this Article.

1. Drawings including: Diagram of location and regional connections, map of boundaries and scope of research for the overall urban planning. To be presented on a topographic map at an appropriate scale.

2. Explanation:

a) Reasons, necessity, basis for planning; location, scale, and boundaries of the overall urban planning.

b) Summarize the current status of the city, ongoing plans and projects; requirements for data collection; requirements for spatial development orientation, natural landscape conservation, heritage, historical sites, infrastructure projects, technical infrastructure, social infrastructure, and strategic environmental assessment. Propose some basic indicators regarding economic and social aspects to be studied at the project planning stage, meeting the goals, characteristics, and development orientation of the city.

c) Determine the nature, driving forces, and role of the city in the region and nationwide; planning viewpoints and objectives; identify issues to be addressed in the planning.

d) Preliminary forecast on socio-economic development, population, labor force, professions, land development in urban and rural areas, and technical infrastructure.

đ) Identify the list of drawings, explanations, and accompanying appendices; quantity and specifications of the file products; schedule and progress of organizing the planning process suitable for each type of city.

3. Draft Memorandum and draft Decision approving the planning task.

Article 6. Content of the Master Plan Project File for Urban Areas

1. For central cities directly under the Central Government

a) Drawing components:

- Location and regional connection diagram including: Location, scale, planning boundaries; relationship between the city and rural areas concerning natural conditions, socio-economic conditions; urban development space; key technical infrastructure. To be presented on a topographic map at an appropriate scale.

- Current status map: Land use, architectural landscape, social infrastructure system (education, healthcare, culture, commerce, green spaces, housing, etc.); transportation, power supply and lighting, telecommunications, water supply, ground level and stormwater drainage, sewage drainage; solid waste management, cemeteries, and environment. To be presented on a topographic map at a scale of 1/25,000 or 1/50,000.

- Map evaluating the suitability of construction land based on criteria such as terrain, current conditions, hydrogeology; evaluation of land use value (determining favorable, less favorable, and unfavorable areas for urban functions, etc.); identification of restricted and prohibited development zones. To be presented on a topographic map at a scale of 1/25,000 or 1/50,000.

- Urban development structure diagram (current status analysis diagrams and proposed options accompanied by explanations on selection criteria). To be presented at an appropriate scale.

- Overall urban spatial development orientation map. To be presented on a topographic map at a scale of 1/25,000 or 1/50,000.

- Overall urban technical infrastructure development orientation map. To be presented on a topographic map at a scale of 1/25,000 or 1/50,000.

- Land use planning and functional zoning map for the central urban area according to planning phases. To be presented on a topographic map at a scale of 1/10,000 or 1/25,000.

- Maps outlining the development orientation of the central urban area's technical infrastructure and environmental protection systems. To be presented on a topographic map at a scale of 1/10,000 or 1/25,000.

- Map outlining the development orientation of the central urban area's commercial, cultural, educational, healthcare, sports, training systems; green spaces, and central squares.

- Urban design drawings as stipulated by the Ministry of Construction in Circular No. 06/2013/TT-BXD dated May 13, 2013, guiding the content of Urban Design (hereinafter referred to as Circular No. 06/2013/TT-BXD).

- Strategic Environmental Assessment drawings: Current status and strategic environmental assessment. To be presented on a topographic map at an appropriate scale.

b) Explanation: The explanation content of the master plan project file for central cities directly under the Central Government includes:

- Analysis of location, evaluation of natural conditions; current population and land use status. Detailed evaluation of urban architectural landscape, social infrastructure, technical infrastructure, and environment; assessment of planning implementation and management; determination of fundamental issues to be resolved. Data must be summarized and presented through diagrams and tables accompanied by concise and clear explanations.

- Determination of objectives, nature, and driving forces of urban development.

- Determination of economic and technical indicators for the entire city, individual urban areas, and functional zones.

- Forecasting impacts of natural conditions, socio-economic factors, urban development, urbanization rate; population size, land, social infrastructure, technical infrastructure for the entire city, individual urban areas, and functional zones.

- Spatial development orientation: Determination of the structure of functional zones, regions, and other areas within the city (administrative centers, commercial centers, training centers, cultural and sports centers, entertainment centers, industrial centers, tourism centers, ecological centers, conservation centers, etc.); rural residential areas; determination of urban development axes and corridors; orientation for redevelopment of existing urban areas.

- Spatial development orientation for the central urban area: Development, renovation, and expansion direction of the central urban area; determination of the scope and scale of functional zones, density and land use planning indicators; principles for managing development of functional zones.

- Orientation for the development of infrastructure systems for commerce, culture, education, healthcare, sports, and training; green park systems, public spaces, and urban squares.

- Urban design in accordance with the provisions of the Ministry of Construction in Circular No. 06/2013/TT-BXD.

- Orientation for the planning and land use throughout the city and the central urban area according to different planning phases.

- Orientation for the development of urban technical infrastructure including: orientation for the development of technical infrastructure throughout the city and orientation for the development of technical infrastructure for the central urban area as a basis for implementing specialized urban technical infrastructure planning projects for centrally-administered cities.

- Strategic environmental assessment: Content as stipulated in Clause 7, Article 15 of Decree No. 37/2010/NĐ-CP dated April 7, 2010 of the Government on the establishment, review, approval, and management of urban planning (hereinafter referred to as Decree No. 37/2010/NĐ-CP).

- Urban economy: Arguments for determining the list of priority investment programs and projects according to different planning phases; proposals and recommendations for resources to implement these projects.

The explanatory report of the general urban planning project for centrally-administered cities must include statistical tables, calculation appendices, illustrative images, and a system of small-scale drawings at A3 size with clear symbols and annotations, arranged alongside the relevant sections of the explanatory report.

c) Appendices accompanying the explanatory report (further explanations, arguments, and supporting evidence for the explanatory report; illustrative drawings; calculation data). Appendices attached to related legal documents.

d) Management regulations according to the general urban planning project; Content as stipulated in Clause 1, Article 35 of the Urban Planning Law and must include small-scale drawings attached.

đ) Draft Memorandum and draft Decision approving the planning project.

2. For cities and towns under provinces

a) Drawing components:

- Location map and regional relationships: Determine the location and boundaries for planning; show economic and social relationships between the city and related regions; topographical conditions and areas affecting the urban architectural landscape; key technical infrastructure and other issues impacting urban development. Displayed on a suitable scale topographic map.

- Current status map; Land use, architectural landscape, social infrastructure system (education, healthcare, culture, commerce, greenery, housing, etc.); current traffic, power supply and lighting, water supply, ground level and stormwater drainage, sewage drainage; solid waste collection, cemeteries, environment. Displayed on a topographic map at a scale of 1/10,000 or 1/25,000.

- Map evaluating the suitability of construction land based on criteria such as topography, current conditions, hydrogeology; evaluation of land use value: Identify favorable, less favorable, and unfavorable areas for urban functions; identify restricted and prohibited development zones. Displayed on a topographic map at a scale of 1/10,000 or 1/25,000.

- Diagram of urban development structure (current status analysis diagrams and proposed options with explanations about selection criteria). Displayed at a suitable scale.

- Map of spatial urban development orientation. Displayed on a topographic map at a scale of 1/10,000 or 1/25,000.

- Map of land use planning and functional zoning according to different planning phases. Displayed on a topographic map at a scale of 1/10,000 or 1/25,000.

- Maps of infrastructure development orientation. Displayed on a topographic map at a scale of 1/10,000 or 1/25,000.

- Urban design drawings in accordance with the provisions of the Ministry of Construction in Circular No. 06/2013/TT-BXD.

- Maps of strategic environmental assessment: Current status and strategic environmental assessment. Displayed on a suitable scale topographic map.

b) Explanatory Report: The content of the explanatory report of the general urban planning project for cities and towns under provinces includes:

- Analysis and evaluation of current natural conditions, population, land use, urban space, social infrastructure, technical infrastructure, and the environment; assessment of management and implementation according to approved plans; identification of fundamental issues to be addressed.

- Determination of objectives, nature, and driving forces of urban development.

- Determination of economic and technical indicators for the city and each functional zone.

- Forecasting the impact of natural conditions, socio-economic factors, urban development, urbanization rates; population size, land, social infrastructure, and technical infrastructure for the city and functional zones.

- Orientation for urban spatial development including: urban structure and direction of development (existing urban areas and new urban areas); determination of systems of centers (including underground space usage for underground construction), parks, green corridors, open spaces, central urban squares; orientation for rural residential area development; proposals for organizing space and architecture for architectural and scenic areas, main spatial axes, squares, city gates, urban landmarks; identification of the relationship between old and new urban spaces.

- Orientation for the development of infrastructure systems for commerce, culture, education, healthcare, sports, and training; green park systems, urban squares.

- Urban design in accordance with the provisions of the Ministry of Construction in Circular No. 06/2013/TT-BXD.

- Orientation for urban land use planning according to different planning phases.

- Orientation for the development of technical infrastructure including transportation, ground elevation, stormwater drainage, energy supply, telecommunications, water supply, wastewater treatment, solid waste management, and cemeteries.

- Strategic environmental assessment: Content as prescribed in Clause 7, Article 15 of Decree No. 37/2010/NĐ-CP.

- Urban economy: Arguments for determining the list of priority investment programs and projects according to different planning phases; proposals and recommendations for resources to implement these projects.

The explanatory report of the general urban planning scheme for cities under provinces and towns must include statistical tables, calculation appendices, illustrative images, and a system of small-scale drawings on A3 paper with symbols and annotations, arranged alongside the relevant sections of the explanatory report.

c) Appendices accompanying the explanatory report (explanations, additional arguments supporting the explanatory report; illustrative drawings; calculation data). Appendices attached to related legal documents.

d) Management regulations according to the general urban planning scheme: Content as prescribed in Clause 1, Article 35 of the Urban Planning Law and must include small-scale drawings attached.

đ) Draft Memorandum and draft Decision approving the planning project.

3. For towns and fifth-tier cities not yet recognized as towns.

a) Drawing components;

- Location and relationship diagram: Determine the planning location and boundaries; demonstrate economic and social relationships between the city and the region; geographical conditions, topography, significant areas affecting urban landscape architecture; key technical infrastructure and other issues impacting urban development. Presented on an appropriate scale topographic map.

- Current status map: Land use, architectural landscape, social infrastructure systems (education, healthcare, culture, commerce, green spaces, housing, etc.); current traffic, urban power supply and lighting, water supply, ground elevation, stormwater drainage, sewage; solid waste collection, cemeteries, environment. Presented on a 1/2,000 or 1/5,000 scale topographic map.

- Comprehensive evaluation map of construction land based on criteria from the explanatory report suitable for topography, current conditions, hydrogeology; evaluation of land use value: Identify favorable, less favorable, and unfavorable areas for urban functions; determine restricted and prohibited development zones. Presented on a 1/2,000 or 1/5,000 scale topographic map.

- Urban development structure diagram (current status analysis diagrams and proposed options with explanations about selection criteria). Presented at an appropriate scale.

- Urban spatial development orientation map. Presented on a 1/2,000 or 1/5,000 scale topographic map.

- Land use planning map and functional zoning according to planning phases. Presented on a 1/2,000 or 1/5,000 scale topographic map.

- Technical infrastructure development orientation maps. Presented on a 1/2,000 or 1/5,000 scale topographic map.

- Urban design drawings as stipulated by the Ministry of Construction in Circular No. 06/2013/TT-BXD.

- Maps of strategic environmental assessment: Current status and strategic environmental assessment. Displayed on a suitable scale topographic map.

b) Explanatory report:

The content of the explanatory report for the general urban planning scheme of towns and fifth-tier cities not yet recognized as towns includes:

- Analysis and evaluation of current natural conditions, population, land use, urban architectural landscape space, social infrastructure, technical infrastructure, and the environment; assessment of management and implementation according to approved plans; identification of fundamental issues to be addressed in the plan.

- Determination of objectives, nature, and driving forces of urban development.

- Selection of economic and technical indicators applicable in the plan.

- Forecasting of socio-economic trends, urbanization rates, population size, land, technical infrastructure, and social infrastructure.

- Orientation for urban spatial development including urban expansion and renovation directions; scope and scale of functional zones; determination of central areas, green parks, central squares, and open spaces; organization of architectural and landscape space for functional zones and main axes.

- Orientation for the development of commercial, cultural, educational, health, sports, training systems; park green spaces, public spaces, and urban squares.

- Urban design as stipulated by the Ministry of Construction in Circular No. 06/2013/TT-BXD.

- Orientation for urban land use planning according to different planning phases.

- Orientation for urban technical infrastructure development including transportation, ground elevation, stormwater drainage, energy supply, telecommunications, water supply, sewage treatment, solid waste management, and cemeteries.

- Strategic environmental assessment: Content as prescribed in Clause 7, Article 15 of Decree No. 37/2010/NĐ-CP.

- Urban economy: Arguments for determining the list of priority investment programs and projects according to different planning phases; proposals and recommendations for resources to implement these projects.

The explanatory report of the general urban planning scheme for towns and fifth-tier cities not yet recognized as towns must include statistical tables, calculation appendices, illustrative images, and a system of small-scale drawings on A3 paper with clear symbols and annotations, arranged alongside the relevant sections of the explanatory report.

c) Appendices accompanying the explanatory report (explanations, additional arguments supporting the explanatory report; illustrative drawings; calculation data). Appendices attached to related legal documents.

d) Management regulations according to the general urban planning scheme: Content as prescribed in Clause 1, Article 35 of the Urban Planning Law and must include small-scale drawings attached.

đ) Draft Memorandum and draft Decision approving the planning project.

Article 7. Content of the planning dossier for urban area zoning tasks

1.    Drawings including: Location map of the planned zoning area extracted from the general urban planning and map defining the research boundary, scope of the zoning planning area. To be presented on a topographic map at an appropriate scale.

2. Explanation:

a)   Reasons and necessity for establishing the zoning plan; boundaries, area, nature, preliminary status of the zoning planning area. Identify key issues to be addressed in the zoning plan. The urban zoning plan must be consistent and specific to the approved general urban plan.

b)   State basic indicators expected to be applied in the project regarding population, land use, social infrastructure, and technical infrastructure based on the approved general urban plan; requirements for detailing the approved general urban plan.

c)  Preliminary determination of population size, land, and technical infrastructure needs, social infrastructure needs for the planned area.

d)   Requirements for current status investigation and survey work, data collection, spatial organization, functional zoning, architecture, technical infrastructure connection, and strategic environmental assessment.

đ) Determine the list of drawings, descriptions, and appendices; quantity and specifications of the project dossier products; plan and schedule for organizing the zoning task.

3. Draft report and draft decision approving the zoning task.

Article 8. Content of the planning dossier for urban area zoning projects

1. Components of the drawings include:

a)   Location and boundary map of the land. To be presented on a topographic map at a scale of 1/10,000 or 1/25,000.

b)   Current state architectural landscape map and construction land evaluation map. To be presented on a topographic map at a scale of 1/2,000 or 1/5,000.

c)   Maps of current technical infrastructure systems and environmental protection. To be presented on a topographic map at a scale of 1/2,000 or 1/5,000.

d)   Land use master plan map. To be presented on a topographic map at a scale of 1/2,000 or 1/5,000.

đ) Spatial organization architectural landscape scheme map. To be presented on a topographic map at a scale of 1/2,000 or 1/5,000.

e)   Traffic planning map and red line, construction boundary map. To be presented on a topographic map at a scale of 1/2,000 or 1/5,000.

g)    Other technical infrastructure system planning maps. To be presented on a topographic map at a scale of 1/2,000 or 1/5,000.

h)   Integrated utility lines and pipelines map. To be presented on a topographic map at a scale of 1/2,000 or 1/5,000.

i)    Map identifying underground construction areas: Underground public facilities, high-rise buildings with basement construction (if any). To be presented on a topographic map at an appropriate scale.

k) Urban design drawings as prescribed by the Ministry of Construction in Circular No. 06/2013/TT-BXD.

2.    Description: The content of the description in the urban area zoning planning dossier includes:

a)   Objectives and scope of planning.

b)   Determination of urban planning land use indicators, social infrastructure, and technical infrastructure for the entire planning area; forecast of population, land, technical infrastructure needs, social infrastructure needs for the planning area.

c)   Determination of principles and proposals for spatial organization, architecture, landscape, land use, and social infrastructure, technical infrastructure for each functional zone, each block, main streets, open space areas, public space areas, focal areas within the planning area; regulations on land use.

d)     Urban design as prescribed by the Ministry of Construction in Circular No. 06/2013/TT-BXD.

đ) Determination of investment construction projects and resources for implementation.

e)   Environmental impact analysis consistent with the strategic environmental assessment content in the approved general plan.

g) Urban economics: Justification for determining the priority programs and projects; proposals and recommendations for mechanisms to mobilize and create resources for implementation.

The urban area zoning planning project description must have statistical tables, calculation appendices, illustrative images, and a system of small-scale drawings on A3 paper with clear symbols and annotations, arranged alongside relevant sections of the description.

3.   Management regulations according to the urban area zoning planning project: Content as stipulated in Clause 2, Article 35 of the Urban Planning Law and must include accompanying small-scale drawings.

4. Draft proposal and draft decision approving the planning project.

5.    Appendices accompanying the description (explanations, appendices attached, explanations, additional justifications for the description; illustrative drawings; calculation data). Legal documents related appendices attached.

Article 9. Content of the planning dossier for detailed urban planning tasks

The detailed urban planning project description must include statistical tables, calculation appendices, illustrative images, and schematic diagrams, small-scale A3 drawings with clear symbols and annotations, arranged alongside relevant sections of the description.

a) Reasons, necessity for establishing the general construction planning, scope, scale, and boundaries of the planning; summarize the current status of the planned area and existing issues.

b)   Determine the scale and nature of the planned area, viewpoints and objectives of the planning.

c)   Propose basic economic and technical criteria to apply, preliminary forecast about population, land, and technical infrastructure within the planning scope.

d)   Requirements for current condition surveys and data collection; development direction of the special function zone, spatial structure, key projects, social infrastructure, organization of the technical infrastructure system framework, strategic environmental assessment.

đ) Preliminarily determine the issues to be resolved in the general construction planning dossier for the special function zone.

5.    Special function zones with an area of 500 hectares or more, located within areas that have already been approved for general construction planning, do not need to establish a general construction planning but should proceed with detailed planning steps according to Decree No. 44/2015/NĐ-CP.

Article 14. Content of the planning dossier for the general construction planning of special function zones

1. Components of the drawings:

a)     Location and relationship diagram: Show the relationships between the planned area and related regions in terms of economy and society; terrain conditions, regions significantly affecting space, architectural landscape within the planned area; key technical infrastructure and other factors impacting the development of the special function zone. To be presented on a topographic map at an appropriate scale.

b)     Current status maps including: Land use, architectural landscape, social infrastructure, transportation, ground level and stormwater drainage, energy supply, telecommunications, wastewater treatment, solid waste management, and cemeteries. To be presented on a topographic map at a scale of 1/5,000 or 1/10,000.

c)   Comprehensive evaluation and selection map for construction land: Identify favorable, less favorable, and unfavorable areas for development; determine restricted and prohibited development zones within the special function zone. To be presented on a topographic map at a scale of 1/5,000 or 1/10,000.

d)    Development structure diagram of the planned area (current status analysis diagrams and proposals for solutions with explanations on criteria for selecting solutions).

đ) Spatial development orientation diagram: Define the spatial development structure of the planned area according to functional zones; emphasize public spaces, main axes, open spaces, squares, parks, water bodies; connections between zones regarding transportation and technical infrastructure. For general construction planning of economic zones, high-tech zones, must define and present the boundaries of intervention control zones such as conservation, renovation, new development areas, and other architectural landscape zones requiring protection. To be presented on a topographic map at a scale of 1/5,000 or 1/10,000.

e) Land use planning map: Define areas based on spatial structure and land use functions; propose key economic and technical parameters, land use indicators for each area. For the main spatial areas of economic zones, high-tech zones, research and training zones, maximum and minimum building heights must be specified. To be presented on a topographic map at a scale of 1/5,000 or 1/10,000.

g)   Architectural and landscape control orientation drawings: Define architectural and landscape zones within the planned area; propose organization of key axes and functional zones (central area, gateway area, main axis, square, green space, water body, and focal points). To be presented on a topographic map at an appropriate scale.

h)    Technical infrastructure development orientation maps: Transportation, ground level and stormwater drainage, energy supply, telecommunications, water supply, sewage treatment, solid waste management, and cemeteries. To be presented on a topographic map at a scale of 1/5,000 or 1/10,000.

i)    Strategic environmental assessment drawings: Current status and strategic environmental assessment. To be presented on a topographic map at an appropriate scale.

2. Description: The description content of the general construction planning dossier for the special function zone includes:

a)    Analysis and evaluation of natural conditions and current status; determination of fundamental issues to be addressed.

b)    Determination of development goals and driving forces; forecast of population and labor force size; selection and determination of land use, social infrastructure, and technical infrastructure indicators for the entire zone, urban and rural areas (if applicable), and each functional zone.

c)    Proposal and selection of spatial development structure of the planned area including orientation for development of urban and rural residential systems and social infrastructure; orientation for other functional zones for the entire area (industrial, tourism, ecological, conservation, etc.).

d)   Control regulations on architecture and landscape within the planned area: Orientation for development of spatial axes and development corridors of the planned area, serving as the basis for determining population density indicators, land use planning indicators, and development principles for functional zones of the planned area.

đ) Orientation for development of technical infrastructure system of the special function zone including transportation, preparation technology, energy supply, telecommunications, water supply, solid waste management, and cemeteries.

e) Strategic environmental assessment: Content as prescribed in Point g Clause 1 Article 12 Decree 44/2015/NĐ-CP.

a)    Reasons, basis, and necessity for establishing district construction zoning planning. Arguments regarding the boundary, area, and nature of the planning area. Determination of key issues and basic contents to be resolved in the district construction zoning planning project.

b)   Proposals and selection of basic criteria to apply, population projections, land use, social infrastructure, and technical infrastructure of the planned area, based on analysis and synthesis from approved related plans.

c)   Requirements for current status surveys, data collection, spatial organization, functional zoning, architectural landscape, technical infrastructure connection, and strategic environmental assessment.

d)   Determination of drawing, explanation, and accompanying appendix lists; quantity and specifications of planning project dossier products; planning and schedule for organizing the zoning planning.

5.    For industrial zones and export processing zones with a scale of 200 ha to 500 ha: District construction zoning planning is established on a map at a scale of 1/2,000 with all required contents to serve as a basis for investment project planning for technical infrastructure construction and building permits. In cases where district construction zoning planning for industrial zones and export processing zones is established in areas already having approved general construction master plans, there is no need to establish a planning task.

Article 16. Contents of the planning project dossier for district construction zoning.

e)   Map identifying underground construction areas: Underground public facilities, high-rise buildings with basement floors (if applicable). At an appropriate scale.

2.   Description:

a) Arguments regarding the necessity, bases for planning; determination of the boundaries, area, and function of the detailed urban planning area.

b)   Determination of the contents and issues to be addressed in the detailed urban planning project.

c)   Indication of basic criteria applied concerning scale, land use, social infrastructure, and technical infrastructure based on the approved district planning or general urban planning, standards, and other related plans.

d)   Requirements for current status surveys, data collection, spatial organization, architectural landscape, technical infrastructure connection, strategic environmental assessment, and other research requirements.

đ) Preliminary proposal on structure and principles of spatial organization of the detailed planning area based on the list of construction projects to be invested within the detailed planning area.

e)    Determination of the list of drawings, explanatory reports, and accompanying appendices; quantity and specifications of the project dossier products; plan and schedule for organizing the detailed planning.

3.   Draft Memorandum and draft Decision on approval of the planning task.

4.    Detailed planning for industrial zones, industrial clusters, and export processing zones does not require the establishment of an assignment of detailed planning. Industrial zones, export processing zones with an area under 200 hectares, and industrial clusters shall immediately establish detailed urban planning to serve as a basis for investment projects in technical infrastructure.

Article 18. Contents of the dossier for the detailed urban planning project of special functional areas

1. Components of the drawings:

a)    Diagram of location and boundaries of the land plot, extracted from the district planning or general urban planning. Based on a topographic map at a scale of 1/2,000.

b)    Current condition map of architecture, landscape, and land evaluation. Based on a topographic map at a scale of 1/500.

c)    Maps of current technical infrastructure systems. Displayed on a topographic map at a scale of 1/500.

d)   Map of spatial organization, architecture, and landscape. Based on a topographic map at a scale of 1/500.

đ) Master plan map of land use: Determining the boundaries of each plot and lot according to the nature and function of land use for civil and public buildings, transportation systems, green spaces, key infrastructure facilities; management requirements for land use (building height, building density, land use coefficient, etc.). Based on a topographic map at a scale of 1/500.

e) Drawing of underground construction areas: Underground public facilities, high-rise buildings with basement floors (if any). At an appropriate scale.

g)    Red line map, construction boundary map, and protection zones for technical infrastructure lines. Based on a topographic map at a scale of 1/500.

h)    Maps of technical infrastructure and environmental planning systems: Transportation, power supply and lighting, telecommunications, water supply, ground level and stormwater drainage, sewage drainage, solid waste collection, cemetery. Based on a topographic map at a scale of 1/500.

i) Map of integrated utility lines and pipelines. Based on a topographic map at a scale of 1/500.

k) Drawings specifying architectural and landscape control measures in the planning area: Determining landmark buildings in the planning area according to directions and views; determining building heights, setbacks for each plot along streets and intersections; determining the form, color, and architectural style of buildings; green space, water bodies, squares. At an appropriate scale.

1) Drawings on strategic environmental assessment: Current conditions and strategic environmental assessment. Based on a topographic map at an appropriate scale.

2. Explanatory Report: The content of the explanatory report of the detailed urban planning project includes:

a)   Analysis and evaluation of natural conditions and current status of the land for detailed urban planning; identification of issues to be resolved in the detailed urban planning project.

b)   Determination of population criteria, social infrastructure, technical infrastructure, and spatial organization, architectural requirements for the planning area; land use criteria and architectural requirements for each plot; arrangement of technical infrastructure networks up to plot boundaries.

c)   Determination of the location, scale, and regulation of specific areas requiring control.

d)   Regulation or proposal of specific design solutions.

đ) Strategic environmental assessment: Content as stipulated in Point e, Clause 1, Article 14 of Decree No. 44/2015/NĐ-CP.

e)    Preliminary estimate of total investment cost; proposal on funding sources and implementation organization.

The explanatory report of the detailed urban planning project must include statistical tables, calculation appendices, illustrative images, and a system of diagrams and scaled drawings on A3 paper with clear symbols and annotations, arranged alongside the relevant sections of the explanatory report.

3.    Attachments accompanying the explanatory statement (explanations, clarifications, supplementary arguments for the explanatory statement; illustrative drawings; calculation data and related legal documents).

4.    Management regulations according to the detailed construction planning scheme: Content as prescribed in Clause 3, Article 15 of Decree No. 44/2015/NĐ-CP and must include accompanying diagrams.

5.   Draft Memorandum and draft Decision approving the planning project.

Section 4

Adjustment planning dossier and archival dossier

Article 19. Contents of the adjustment planning dossier

1.  For overall adjustment of construction planning;

The contents and components of the dossier for the task and project of overall adjustment of construction planning as stipulated in Sections 1, 2, and 3 of Chapter II of this Circular.

2.    For partial adjustment of construction planning, the contents and components of the dossier include:

a)    Report from the agency organizing the planning submitted to the competent authority for approval of construction planning, specifying: Reasons and necessity for implementing partial adjustment of planning; content of partial adjustment of planning; analysis and continuous, synchronized assessment of the entire planning scheme and economic-social effectiveness of partial adjustment of planning; proposals for measures to address new issues arising from partial adjustment; implementation schedule and progress following partial adjustment planning approved by the competent authority. Accompanied by relevant legal documents and materials.

b)   Drawings reflecting the contents of partial adjustment, determining planning indicators achieved after partial adjustment of planning; with reference and comparison to planning indicators already approved.

c)   Draft decision of the competent authority deciding on partial adjustment of construction planning.

Article 20. Archival Dossier

1. For Planning Task, the archival dossier includes:

a)    Decision approving the planning task

b)    Explanatory statement of the planning task confirmed by the reviewing agency

c)    All files and related documents stored electronically

2.   For Planning Scheme, the archival dossier includes:

a)    Decision approving the planning scheme

b)    Explanatory statement and drawings confirmed by the reviewing agency

c)    All files stored electronically

3.   For adjustment of planning, the archival dossier includes:

a)    Overall adjustment of planning: As prescribed in Sections 1, 2, and 3 of Chapter II of this Circular.

b)    Partial adjustment of construction planning: Decision approving partial adjustment of construction planning; report on partial adjustment and updated drawings reflecting the contents of partial adjustment; all files stored electronically.

Chapter III

ORGANIZATION AND IMPLEMENTATION

Article 21. Implementation clause

1.    This Circular takes effect from August 15, 2016 and replaces the following legal documents:

a)    Circular No. 07/2008/TT-BXD dated April 7, 2008 of the Minister of Construction guiding the preparation, review, approval, and management of construction planning.

b)    Decision No. 03/2008/QĐ-BXD dated March 31, 2008 of the Minister of Construction promulgating regulations on the content of drawings and explanatory statements for Planning Tasks and Planning Schemes.

c)    Decision No. 21/2005/QĐ-BXD dated July 22, 2005 of the Minister of Construction on the issuance of regulations on the system of drawing symbols in planning schemes.

d)    Circular No. 19/2008/TT-BXD dated November 20, 2008 of the Minister of Construction on guiding the implementation of the preparation, review, approval, and management of industrial zone and economic zone planning.

đ)    Circular No. 10/2010/TT-BXD dated August 10, 2010 of the Minister of Construction on the dossier for each type of urban planning.

2.    After this Circular takes effect, planning schemes for regional construction planning, urban planning, and special function area construction planning that are currently being prepared and not yet completed must be reviewed and completed according to the provisions of this Circular before submission for review.

Article 22. Responsibilities for Implementation

1.    Organizations and individuals participating in the preparation, review, and approval of construction planning shall implement the provisions of this Circular regarding the dossier for planning tasks, planning schemes for regional construction planning, urban planning, and special function area construction planning.

2.    The Department of Planning and Architecture under the Ministry of Construction, Construction Departments of provinces, and the Department of Planning and Architecture of Hanoi and Ho Chi Minh City are responsible for guiding and supervising the implementation of the provisions of this Circular.

3.    During the implementation process, if there are difficulties, organizations and individuals are requested to submit their opinions in writing to the Ministry of Construction for study and resolution./.
