Circular No. 12/2023/TT-BNV abolishes certain Circulars issued by the Minister of Home Affairs regarding the recruitment of civil servants and officials, the promotion of civil servants, the advancement of officials, and the implementation of employment contracts for certain types of work in state administrative agencies and public service units.

Repealing certain Circulars issued by the Minister of Home Affairs
concerning recruitment of civil servants and public officials, promotion of civil servants' ranks,
promotion of public officials' job titles and implementation of employment contracts for certain types of work
in state administrative agencies and public service units

Based on the Law on Enactment of Legislative Acts dated June 22, 2015;

Based on the Law Amending and Supplementing Certain Provisions of the Law on Enactment of Legislative Acts dated June 18, 2020;

Pursuant to Decree No. 34/2016/NĐ-CP dated May 14, 2016 of the Government detailing certain provisions and implementing measures of the Law on Legislative Regulatory Documents;

Pursuant to Decree No. 154/2020/NĐ-CP dated December 31, 2020 of the Government amending and supplementing some articles of Decree No. 34/2016/NĐ-CP dated May 14, 2016 of the Government detailing some provisions and measures to implement the Law on Enacting Legal Normative Documents;

Pursuant to Decree No. 63/2022/NĐ-CP dated September 12, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs.

At the request of the Director of the Civil Servant and Public Official Department;

The Minister of Home Affairs issues this Circular to repeal certain Circulars issued by the Minister of Home Affairs concerning recruitment of civil servants and public officials, promotion of civil servants' ranks, promotion of public officials' job titles and implementation of employment contracts for certain types of work in state administrative agencies and public service units.

Repeal all of the following Circulars:

1. Circular No. 82/2021/TT-BTC dated September 30, 2021 of the Minister of Finance on customs supervision of imported goods transferred at border gates in cases where imported goods are congested or at risk of congestion at sea ports implementing social distancing according to Directive No. 16/CT-TTg dated March 31, 2020 of the Prime Minister on urgent measures to prevent and control the COVID-19 pandemic.

1. Circular No. 13/2010/TT-BNV dated December 30, 2010 of the Minister of Home Affairs detailing some provisions regarding recruitment and promotion of civil servants' ranks under Decree No. 24/2010/NĐ-CP dated March 15, 2010 of the Government on recruitment, utilization, and management of civil servants.

2. Circular No. 05/2012/TT-BNV dated October 24, 2012 of the Minister of Home Affairs amending and supplementing some articles of Circular No. 13/2010/TT-BNV dated December 30, 2010 of the Minister of Home Affairs detailing some provisions regarding recruitment and promotion of civil servants' ranks under Decree No. 24/2010/NĐ-CP dated March 15, 2010 of the Government on recruitment, utilization, and management of civil servants.

3. Circular No. 06/2013/TT-BNV dated July 17, 2013 of the Minister of Home Affairs abolishing Article 19 of Circular No. 13/2010/TT-BNV dated December 30, 2010 of the Minister of Home Affairs detailing some provisions regarding recruitment and promotion of civil servants' ranks under Decree No. 24/2010/NĐ-CP dated March 15, 2010 of the Government on recruitment, utilization, and management of civil servants.

4. Circular No. 03/2015/TT-BNV dated March 10, 2015 of the Minister of Home Affairs amending and supplementing Article 9 of Circular No. 13/2010/TT-BNV dated December 30, 2010 of the Minister of Home Affairs detailing some provisions regarding recruitment and promotion of civil servants' ranks under Decree No. 24/2010/NĐ-CP dated March 15, 2010 of the Government on recruitment, utilization, and management of civil servants.

5. Circular No. 05/2017/TT-BNV dated August 15, 2017 of the Minister of Home Affairs amending and supplementing some articles of Circular No. 11/2014/TT-BNV dated October 9, 2014 and Circular No. 13/2010/TT-BNV dated December 30, 2010 of the Minister of Home Affairs on professional standards, appointment to grades, and salary classification for administrative specialist civil servant grades and the organization of examinations for promotion of civil servants.

6. Circular No. 12/2012/TT-BNV dated December 18, 2012 of the Minister of Home Affairs stipulating job titles and changes to job titles for public officials.

7. Circular No. 15/2012/TT-BNV dated December 25, 2012 of the Minister of Home Affairs guiding recruitment, signing employment contracts, and compensation for training and development costs for public officials.

8. Circular No. 04/2015/TT-BNV dated August 31, 2015 of the Minister of Home Affairs amending and supplementing Article 6 of Circular No. 15/2012/TT-BNV dated December 25, 2012 of the Minister of Home Affairs guiding recruitment, signing employment contracts, and compensation for training and development costs for public officials.

9. Circular No. 15/2001/TT-BTCCBCP dated April 11, 2001 of the Minister, Head of the Organizational Cadre Department of the Government (now the Minister of Home Affairs) guiding the implementation of Decree No. 68/2000/NĐ-CP dated November 17, 2000 of the Government on implementing employment contracts for certain types of work in state administrative agencies and public service units.

10. Circular No. 03/2019/TT-BNV dated May 14, 2019 of the Minister of Home Affairs amending and supplementing some provisions on recruitment of civil servants and public officials, promotion of civil servants' ranks, promotion of public officials' job titles and implementation of employment contracts for certain types of work in state administrative agencies and public service units.

Article 2. Implementation clause

This Circular takes effect from October 1, 2023./.
