REGULATIONS ON THE SYSTEM, POLICIES AND CONDITIONS TO ENSURE THE OPERATIONS OF NATIONAL ASSEMBLY DELEGATES

On the basis of the Constitution of the Socialist Republic of Vietnam;
Pursuant to the Law on Local Administration Organization No. 77/2015/QH13;

RESOLUTION:
Article 1. Scopei đAdjustment
This Resolution stipulates the system, policies, and conditions to ensure the operations of People's Council delegates at provincial level, centrally governed cities (hereinafter referred to collectively as provincial level); district, town, urban districts, centrally governed city districts (hereinafter referred to collectively as district level); commune, ward, town (hereinafter referred to collectively as commune level).
Article 2. Applicability
1. The People's Council delegates mentioned in Article 1 of this Resolution include: full-time People's Council delegates and part-time People's Council delegates at provincial, district, and commune levels.
2. Relevant agencies, organizations, and units involved in implementing the system, policies, and conditions to ensure the operations of People's Council delegates at all levels.
Article 3. System and Policies for People's Council Delegates
1. Regarding Salary
a) Full-time People's Council delegates who are civil servants under the scope of application of the Civil Servants Law shall be paid salaries, allowances, and other benefits from the State budget according to the regulations of the Standing Committee of the National Assembly and other laws;
b) Part-time People's Council delegates working in agencies, organizations, or units during their term as delegates shall be guaranteed payment of salary, allowances, and other benefits as prescribed in Clause 2, Article 103 of the Law on Local Administration Organization;
c) Part-time People's Council delegates who are not entitled to a salary (including those receiving pension) or monthly allowances from the State budget or social insurance fund shall be compensated with labor remuneration based on the actual days they perform delegate duties:
Commune-level People's Council delegates: 0.1 times the minimum wage/day;
District-level People's Council delegates: 0.12 times the minimum wage/day;
Provincial-level People's Council delegates: 0.14 times the minimum wage/day;
Actual days performing delegate duties refer to days participating in People's Council activities according to the planned program.
2. Regarding Activity Fees
People's Council delegates (including both full-time and part-time delegates) shall be entitled to monthly activity fees as follows:
a) Commune-level People's Council delegates: 0.3 times the minimum wage;
b) District-level People's Council delegates: 0.4 times the minimum wage;
c) Provincial-level People's Council delegates: 0.5 times the minimum wage;
3. Other Systems and Policies
a) People's Council delegates shall participate in social insurance and health insurance according to the laws on social insurance and health insurance;
b) If a People's Council delegate passes away and the person responsible for funeral arrangements does not meet the conditions to receive funeral allowance from the Social Insurance Fund or is not eligible for funeral allowance from the State budget, then the delegate shall be entitled to a one-time funeral allowance equal to ten times the minimum wage, paid by the relevant People's Council from the State budget;
c) People's Council delegates who excel in their duties shall be considered for awards according to the Law on Encouragement and Rewards.
Article 4. Conditions for ensuring activities
In addition to the conditions for ensuring the activities of People's Council delegates stipulated in Clauses 1, 2, 3, and 4 of Article 103 of the Law on Local Administration, People's Council delegates shall be ensured the following activities:
1. Full-time People's Council delegates shall be provided with a workplace and office equipment as prescribed for civil servants in state agencies by the Government.
2. People's Council delegates shall be supplied with reports from the Standing Body of the People's Council, the People's Committee at the same level, and other materials related to the activities of the People's Council.
The supply of press and other necessary information to People's Council delegates shall be decided by the Provincial People's Council.
3. People's Council delegates shall be allocated operating funds for meeting voters, supervision; travel expenses support; regular health check-ups and care; ceremonial attire; research; training and professional development in representative work, as decided by the Provincial People's Council.
Article 5. Source of funds for implementation
1. The items of expenditure (including the systems and policies specified in Point c Clause 1 Article 3 of this Resolution) shall be covered by the State budget for People's Council delegates at which level, shall be included in the budget estimate of that level of People's Council.
2. For part-time People's Council delegates whose salaries, allowances, and other systems and policies are not covered by the State budget, the costs shall be borne by the agency, organization, or unit where the delegate works.
Article 6. Effectiveness
1. This Resolution shall take effect from July 1, 2016.
2. This Resolution replaces the provisions in Articles 75 and 77 of Resolution No. 753/2005/NQ-UBTVQH11 dated April 2, 2005 issued by the Standing Committee of the National Assembly on the Operation Regulations of the People's Council.
Article 7. Implementation Organization
1. The Standing Committee of the National Assembly, the Committee on Finance and Budget, the National Ethnic Committee, and the Committees of the National Assembly within their respective functions and duties shall supervise the implementation of this Resolution.
2. The Government shall specify the levels of expenditure for provincial, district, and commune-level People's Council delegates as stipulated in Clause 1 of Article 4 of this Resolution.
3. The Provincial People's Council shall decide and implement the systems and policies and conditions for ensuring the activities of provincial, district, and commune-level People's Council delegates as prescribed by law./.
