CIRCULAR

REGULATING THE FRAMEWORK OF FEES FOR AIRPORT SERVICES CONCESSIONS

Pursuant to the Civil Aviation Law of Vietnam No. 66/2006/QH11 dated June 29, 2006, and the Law Amending and Supplementing Certain Provisions of the Civil Aviation Law of Vietnam No. 61/2014/QH13 dated November 21, 2014;

Pursuant to the Price Law No. 11/2012/QH13 dated June 20, 2012;

Pursuant to Decree No. 177/2013/NĐ-CP dated November 14, 2013 of the Government detailing and guiding the implementation of certain provisions of the Price Law, and Decree No. 149/2016/NĐ-CP dated November 11, 2016 of the Government amending and supplementing certain provisions of Decree No. 177/2013/NĐ-CP dated November 14, 2013 of the Government detailing and guiding the implementation of certain provisions of the Price Law;

Pursuant to Decree No. 05/2021/NĐ-CP dated January 25, 2021 of the Government on management and operation of airports and airfields;

Pursuant to Decree No. 12/2017/NĐ-CP dated February 10, 2017, issued by the Government on the functions, tasks, powers, and organizational structure of the Ministry of Transport;

PURSUANT TO THE PROPOSAL OF THE DIRECTOR OF THE TRANSPORT DEPARTMENT AND THE DIRECTOR OF THE VIETNAM CIVIL AVIATION ADMINISTRATION;

The Minister of Transport hereby issues this Circular regulating the framework of fees for airport services concessions.

Article 1. Scope of Regulation and Applicability

1. This Circular regulates the framework of fees for airport services concessions at airports.

2. This Circular applies to:

a) Airport enterprises;

b) Enterprises providing air services at airports;

c) Other organizations and individuals related to airport services concessions.

Article 2. Framework of Fees for Airport Services Concessions

2. Regulations on calculating concession fees

a) The concession fee levels specified in Clause 1 of this Article do not include value-added tax;

b) The concession fee levels specified in Points 1 to 5 of Clause 1 of this Article are calculated based on the revenue (excluding value-added tax) of the enterprise participating in the corresponding service provision;

c) Revenue or volume for calculating concession fees does not include revenue or volume from services provided by the enterprise itself and its wholly-owned subsidiaries providing services to the parent company.

3. Airport enterprises and enterprises providing air services at airports shall negotiate and discuss service fees within the framework specified in Clause 1 of this Article.

Article 3. Implementation Organization

1. This Circular takes effect from September 1, 2022.

2. The Director of the Ministry's Office, the Inspector General of the Ministry, Heads of Departments, the Director of the Civil Aviation Administration of Vietnam, Heads of relevant agencies, organizations, and individuals are responsible for implementing this Circular./.
