CIRCULAR
Amending and supplementing certain articles of normative legal documents within the competence to issue of the Minister of National Defense related to the declaration of personal information when performing administrative proceduresPursuant to the Law on Citizen Identity Cards dated November 20, 2014;Pursuant to Decree No. 131/2021/NĐ-CP dated December 30, 2021 of the Government detailing and providing implementation measures for the Ordinance on Preferential Treatment for Persons Contributing to the Revolution;

Based on the Law on Enactment of Legislative Acts dated June 22, 2015;
Based on the Law Amending and Supplementing Certain Provisions of the Law on Enactment of Legislative Acts dated June 18, 2020;
The Minister of National Defense hereby issues this Circular amending and supplementing certain articles of normative legal documents within the competence to issue of the Minister of National Defense related to the declaration of personal information when performing administrative procedures.
Based on the Residence Law dated November 13, 2020;
Pursuant to Decree No. 01/2022/NĐ-CP dated November 30, 2022 of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of National Defense;
Article 1. Amending and supplementing certain articles of the Regulations on Medical Examination and Treatment for Officers Resigning from Military Service with at Least 15 Years of Service in the Military, issued together with Decision No. 33/2003/QĐ-BQP dated April 7, 2003 of the Minister of National Defense, which has been amended and supplemented by Circular No. 139/2011/TT-BQP dated August 1, 2011 of the Minister of National Defense.
At the proposal of the Director of the General Political Department;
1. Replacing the phrase "Identity Card" with the phrase "Citizen Identity Card" in Clause 2, Article 8.
2. Clause 2, Article 15 shall be amended and supplemented as follows:
"2. The medical examination and treatment record shall be printed according to Model No. 01/2024/KB-SQPV issued together with this Circular, specifically as follows:
a) The record shall be printed on A5 size paper, consisting of 34 pages (including covers);
b) Printing regulations for cover pages;
Cover page 1: Print the name of the medical examination and treatment record for officers resigning from military service;
Cover page 34: Print the usage regulations for the medical examination and treatment record for officers resigning from military service.
c) Printing regulations for inner pages (from page 3 to page 32);
Page 3: Print the brief resume section;
Pages 4 to 32 shall print page numbers for hospitals to fill in when officers resigning from military service undergo medical examinations and treatments.
d) When issuing the medical examination and treatment record to officers resigning from military service, it shall be stamped by the hospital at the edge joining each page."
3. Replacing Model No. 01/2011/KB-SQPV issued together with Circular No. 139/2011/TT-BQP with Model No. 01/2024/KB-SQPV Appendix I issued together with this Circular.
Article 2. Amending and supplementing certain articles of Circular No. 158/2011/TT-BQP dated August 15, 2011 of the Minister of National Defense on implementing some benefits and policies contributing to the care of retired military personnel.
1. Replacing the phrase "05 working days" with the phrase "02 working days" in point b, Clause 4, Article 6.
2. Replacing the phrase "05 working days" with the phrase "03 working days" in point c, Clause 4, Article 6.
3. Replacing the phrase "10 working days" with the phrase "07 working days" in point d, Clause 4, Article 6.
4. Replacing Model No. 01/2011/BHN Appendix II issued together with Circular No. 158/2011/TT-BQP with Model No. 01/2024/BHN Appendix II issued together with this Circular.
Article 3. Amending and supplementing certain articles of Circular No. 202/2013/TT-BQP dated November 7, 2013 of the Minister of National Defense guiding the procedures and formalities for confirmation; organizing the implementation of preferential policies for persons contributing to the revolution under the responsibility of the Ministry of National Defense.
"For military personnel who have been discharged and suffer from reoccurrence of old diseases leading to mental illness as stipulated in point h, Clause 1, Article 33 of Decree No. 31/2013/NĐ-CP.
Documents: 01 set (to be kept at the Department of Labor, Invalids and Social Affairs where management and implementation of the policy takes place), including:
1. Amending and supplementing Clause 2 of Article 15 as follows:
a) Application form of the subject (Model BB2/2024) or application form of the representative of the subject's relatives (Model BB3/2024);
b) Certificate of illness (Model No. 36 Appendix I of Decree No. 131/2021/NĐ-CP dated December 30, 2021 of the Government detailing and providing implementation measures for the Ordinance on Preferential Treatment for Persons Contributing to the Revolution, hereinafter referred to as Decree No. 131/2021/NĐ-CP);
c) Supporting documents for issuance of the certificate of illness;
d) Certified copy of the decision to resign from military service or original certificate confirming the time served in the military by the Military Command Board of the district;
đ) Minutes of the request for confirmation of war invalid status (Model BB1/2024);
e) Official letter requesting confirmation from the head of the agency or unit as stipulated in point d, Clause 3, Article 3 of this Circular;
g) Assessment form of the Policy Bureau/General Political Department (Model No. 91 Appendix I of Decree No. 131/2021/NĐ-CP);
h) Medical examination report (Model No. 78 Appendix I of Decree No. 131/2021/NĐ-CP)."
2. Amending and supplementing point d, Clause 2, Article 16 as follows:
"d) Minutes of the request for confirmation of war invalid status (Model BB1/2024)."
3. Amending and supplementing point đ, Clause 2, Article 17 as follows:
"đ) The Commander or Political Commissar of the Military Region (for subjects residing within the region of the Military Region); the Director of the Policy Bureau/General Political Department (for subjects residing within the area of Hanoi City), within 10 working days from the date of receipt of the medical examination report (Model No. 78 Appendix I of Decree No. 131/2021/NĐ-CP), shall be responsible for issuing decisions regarding the issuance of certificates of war invalid status and preferential allowances (Model No. 63 Appendix I of Decree No. 131/2021/NĐ-CP); issuing certificates of war invalid status; transferring the decision along with the file to the Provincial Military Command."
4. Replacing Models BB4, BB5, and BB6 Appendix II issued together with Circular No. 202/2013/TT-BQP with Models BB1/2024, BB2/2024, and BB3/2024 Appendix III issued together with this Circular.
"d) The Commander or Political Commissar of the Military Region (for subjects residing within the Military Region's territory); the Director of the Policy Department/General Political Department (for subjects residing within the territory of Hanoi City), within ten working days from the date of receiving the medical examination report (Form No. 78 Appendix I Decree No. 131/2021/NĐ-CP), shall be responsible for issuing a decision on the issuance of the war invalid certificate and preferential allowances and subsidies (Form No. 63 Appendix I Decree No. 131/2021/NĐ-CP); issue the war invalid certificate; transfer the decision along with the file to the Provincial Military Command."
4. Replace Forms BB4, BB5, and BB6 Appendix II issued together with Circular No. 202/2013/TT-BQP with Forms BB1/2024, BB2/2024, and BB3/2024 Appendix III issued together with this Circular.
Article 4. Amend and supplement some provisions of Circular No. 95/2016/TT-BQP dated June 28, 2016, issued by the Minister of National Defense guiding the implementation of certain provisions of Decree No. 27/2016/NĐ-CP dated April 6, 2016, of the Government stipulating certain regimes and policies for non-commissioned officers, conscripts serving on active duty, discharged from active service, and relatives of non-commissioned officers and conscripts on active duty.
1. Replace the phrase "02 days" with the phrase "01 day" at Point b Clause 2 Article 5 and Point c Clause 2 Article 6.
2. Replace the model form attached to Circular No. 95/2016/TT-BQP with Appendix IV attached to this Circular.
Article 5. Effective Date
This Circular takes effect from May 2, 2024.
Article 6. Responsibility for Implementation
The Chief of General Staff, Director of the Political Department, commanders of agencies and units under the Ministry of National Defense, and related organizations and individuals shall be responsible for implementing this Circular.

REGULATIONS ON USE
1. The health examination and treatment booklet for discharged officers who have served for 15 years or more is only valid for health examinations and treatments at military hospitals where the booklet was registered. 2. This booklet is kept by the discharged officer. When seeking medical care at a military hospital within the assigned region, the discharged officer must present the health examination and treatment booklet, identification card, and other required documents. 3. In case of changing the hospital due to relocation, the discharged officer must submit the old health examination and treatment booklet and follow the procedures to register for medical care at the new hospital according to regulations. 4. Each time a discharged officer undergoes a medical examination, the military hospital must record the date, month, and year of the examination; diagnosis and treatment; any exemptions or reductions in fees; full name of the person examined; and stamp of the hospital's outpatient department. Upon exhaustion of the booklet, the hospital will collect the old booklet and issue a new one according to the prescribed price... 5. This health examination and treatment booklet is invalid if it is torn, cut, or has expired. |
