DECREE
Regulations on the Allocation of Authority for Two Levels of Local Administration in the Fields of Culture, Sports, and Tourism

Pursuant to Resolution No. 190/2025/QH15 dated February 19, 2025 of the National Assembly on handling certain issues related to the restructuring of the state apparatus;
At the proposal of the Minister of Culture, Sports and Tourism;
The Government issues this Decree to regulate the allocation of authority for two levels of local administration in the fields of culture, sports, and tourism; the procedures and formalities for administrative procedures when allocating authority from the district level to the commune level or from the provincial level.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Decree stipulates the allocation of authority for two levels of local administration in the fields of culture, sports, and tourism; the procedures and formalities for implementing administrative procedures when allocating authority from the district level to the commune level or from the provincial level.
Article 2. Principles for Allocating Authority
1. Ensuring compliance with the Constitution, consistent with the principles and regulations on the allocation of authority under the Law on the Organization of the Government 2025 and the Law on the Organization of Local Administration 2025.
2. Ensuring the allocation of tasks and powers between different levels of local administration is appropriate to the tasks, powers, and capabilities of the agencies and individuals responsible for carrying out the allocated tasks and powers.
3. Ensuring clear allocation of authority between People's Committees and their Chairpersons.
4. Clearly defining the content and scope of tasks and powers that local administrations are authorized to decide, implement, and be accountable for the results; avoiding overlap and duplication of tasks and powers among different levels of local administration and between agencies and organizations within local administrations.
5. Ensuring a legal basis for the normal, continuous, and smooth operation of agencies; preventing interruptions in work, overlapping, duplication, omission of functions, tasks, sectors, and areas; meeting the requirements of local governance; applying science, technology, innovation, and digital transformation.
6. Ensuring human rights and citizens' rights; ensuring transparency and creating favorable conditions for individuals and organizations to access information, exercise their rights and obligations, and follow legal procedures without affecting the normal activities of society, citizens, and businesses.
7. Ensuring no impact on the implementation of international treaties and agreements to which the Socialist Republic of Vietnam is a party.
8. Ensuring consistency in the organization of constitutional and legal enforcement; ensuring transparency, accountability, and effective control of power linked to supervisory inspection and oversight by higher-level state agencies.
9. The budget for implementing transferred tasks shall be guaranteed by the state budget according to the provisions.
Article 3. Fees and Charges
When handling administrative procedures requiring payment of fees and charges as prescribed by laws on fees and charges, individuals and organizations must submit these fees and charges simultaneously with their application forms to the receiving agency. The amount of fees and charges, management, and utilization thereof shall comply with the relevant laws on fees and charges.
Chapter II
ALLOCATION OF AUTHORITY WHEN ORGANIZING TWO LEVELS OF LOCAL ADMINISTRATION IN THE FIELDS OF CULTURE, SPORTS, AND TOURISM
Section 1
FIELD OF CULTURE AND FAMILY
Article 4. Registration for Organizing Festivals
1. The registration for organizing festivals as provided for in point b, Clause 3, Article 9 of Decree No. 110/2018/NĐ-CP dated August 29, 2018 of the Government on the management and organization of festivals shall be handled by the People's Committee of the province where the festival is organized.
The procedures and formalities for registering to organize festivals shall be carried out in accordance with Article 12 of Decree No. 110/2018/NĐ-CP.
2. The registration for organizing festivals as provided for in points a, c, and d, Clause 3, Article 9 of Decree No. 110/2018/NĐ-CP shall be handled by the People's Committee of the commune where the festival is organized.
The procedures and formalities for registering to organize festivals shall be carried out in accordance with Clause 1 of the Appendix attached to this Decree.
Article 5. Approval of plans for organizing observance days
The approval of plans for organizing observance days at the commune level as stipulated in point b, Clause 3, Article 14 of Government Decree No. 111/2018/NĐ-CP dated August 31, 2018 on the establishment day, traditional day, and observance day of ministries, sectors, and localities shall be carried out by the People's Committee of the commune.
Article 6. Acceptance of notification files for the establishment, merger, consolidation, division, separation, dissolution, and cessation of library operations
1. The acceptance of notification files for the establishment, merger, consolidation, division, separation, dissolution, and cessation of library operations for commune-level libraries; kindergartens, primary and secondary schools, vocational education institutions, and other educational institutions' libraries; private libraries serving the community with headquarters within the administrative area as stipulated in point c, Clause 5, Article 23 of the Library Law shall be carried out by the People's Committee of the commune where the library's headquarters is located.
2. The procedures and formalities for accepting notification files shall be implemented according to Clause 2 of the Appendix issued together with this Decree.
Article 7. Acceptance of notifications for organizing artistic performances, contests, and art performance festivals, beauty pageants, and modeling contests
1. The acceptance of notifications for organizing artistic performances as stipulated in point b, Clause 3, Article 9 of Government Decree No. 144/2020/NĐ-CP dated December 14, 2020 on artistic performance activities shall be carried out by the People's Committee of the commune where the artistic performance takes place.
2. The acceptance of notifications for organizing contests and art performance festivals as stipulated in point b, Clause 2, Article 12 of Government Decree No. 144/2020/NĐ-CP shall be carried out by the People's Committee of the commune where the contest or festival takes place.
3. The acceptance of notifications for organizing beauty pageants and modeling contests as stipulated in Clause 1, Article 15 of Government Decree No. 144/2020/NĐ-CP shall be carried out by the People's Committee of the commune where the contest takes place.
4. The procedures and formalities for accepting notifications under Clauses 1, 2, and 3 of this Article shall be implemented according to Clause 4, Article 9, Clause 3, Article 12, and Clause 2, Article 15 of Government Decree No. 144/2020/NĐ-CP.
Article 8. Acceptance of notifications for public film screenings
1. The acceptance of notifications for public film screenings by accommodation service providers, food and beverage service providers, nightclubs, shops, stores, and other public places as stipulated in Clause 2, Article 18 of Government Decree No. 131/2022/NĐ-CP dated December 31, 2022 on detailed provisions of certain articles of the Cinema Law shall be carried out by the People's Committee of the commune where the public film screening takes place.
2. The notification form for public film screenings follows Model No. 04 in the List attached to the Appendix issued together with this Decree.
Article 9. Establishment of the Council to Determine the Level of Support for Damage Suffered by Individuals Participating in Domestic Violence Prevention and Control
The establishment of the Council to Determine the Level of Support for Damage Suffered by Individuals Participating in Domestic Violence Prevention and Control as stipulated in point b, Clause 2, Article 39 of Government Decree No. 76/2023/NĐ-CP dated November 1, 2023 on detailed provisions of certain articles of the Law on Prevention and Control of Domestic Violence shall be carried out by the Chairman of the People's Committee of the commune where the domestic violence act causing property damage occurred. The composition of the Council shall be decided by the Chairman of the People's Committee of the commune.
Section 2
FIELD OF TOURISM
Article 10. Application for recognition of provincial-level tourist areas
1. The submission of application files for recognition of provincial-level tourist areas as stipulated in point a, Clause 2, Article 27 of the Tourism Law shall be carried out by the People's Committee of the commune where the tourist area is located or the organization managing the tourist area.
2. The preparation of application files for recognition of provincial-level tourist areas located on the territory of two or more communes as stipulated in Clause 3, Article 27 of the Tourism Law shall be carried out by the specialized agency on tourism at the provincial level.
3. The application files, procedures, and formalities for recognizing provincial-level tourist areas shall be implemented according to the provisions of Clause 1 and Clause 2, Article 27 of the Tourism Law.
Section 3
FIELD OF PRINTING, BASIC INFORMATION AND ELECTRONIC INFORMATION
Article 11. Management of declaration and operation of photocopier service facilities
1. The management of declaration and reporting on the operation of photocopier service facilities as stipulated in Clause 2, Article 7 of Decree No. 60/2014/NĐ-CP dated June 19, 2014 of the Government on printing activities, amended and supplemented by Decree No. 25/2018/NĐ-CP dated February 28, 2018 and Decree No. 72/2022/NĐ-CP dated October 4, 2022 of the Government shall be carried out by the People's Committee of the commune.
2. The reporting system on the operation of photocopier service facilities shall be implemented according to the provisions of Clauses 1, 2, and 4, Article 8 of Decree No. 60/2014/NĐ-CP, amended and supplemented by Decree No. 25/2018/NĐ-CP and Decree No. 72/2022/NĐ-CP. The report format shall be as prescribed in the Appendix attached to Decree No. 72/2022/NĐ-CP.
3. The procedures for declaring the operation of photocopier service facilities shall be implemented according to the provisions of Article 25 of Decree No. 60/2014/NĐ-CP, amended and supplemented by Decree No. 25/2018/NĐ-CP and Decree No. 72/2022/NĐ-CP.
Article 12. Basic Information Activities
The implementation of strategies, programs, plans for developing basic information in localities and the execution of information systems, reporting, and statistical activities on basic information operations as stipulated by law and guidelines of the People's Committee of the province according to Clause 1 and Clause 5, Article 39 of Decree No. 49/2024/NĐ-CP dated May 10, 2024 of the Government on basic information activities shall be carried out by the People's Committee of the commune.
Article 13. Management of public electronic game service provision points
1. The issuance, amendment, supplementation, extension, reissuance, and revocation of certificates of eligibility for operating public electronic game service provision points within the territory as stipulated in point a, Clause 3, Article 62 of Decree No. 147/2024/NĐ-CP dated November 9, 2024 of the Government on the provision and use of Internet services and information on networks shall be managed, provided, and used by the People's Committee of the commune.
2. The application files, procedures, and formalities for issuing, amending, supplementing, extending, reissuing, and revoking certificates of eligibility for operating public electronic game service provision points within the territory shall be carried out by the People's Committee of the commune according to the provisions of Articles 64, 65, 66, and 67 of Decree No. 147/2024/NĐ-CP.
Chapter III
IMPLEMENTING PROVISIONS
Article 14. Effective Date
1. This Decree takes effect from July 1, 2025.
2. This Decree shall cease to take effect from March 1, 2027, except for the following cases:
a) Ministries and agencies at the ministerial level report to the Government to propose and obtain the National Assembly's decision to extend the application period of this Decree in whole or in part;
b) Laws, resolutions of the National Assembly, ordinances, resolutions of the Standing Committee of the National Assembly, decrees, and resolutions of the Government, decisions of the Prime Minister that provide for administrative management authority, responsibilities, procedures stipulated in this Decree adopted or issued from July 1, 2025 and become effective before March 1, 2027 shall render the corresponding provisions in this Decree ineffective upon the effectiveness of such legal documents.
3. During the time the provisions of this Decree are in effect, if the provisions on administrative management authority, responsibilities, procedures in this Decree differ from related legal documents, they shall be implemented according to the provisions of this Decree.
Article 15. Transitional Provisions
1. In cases where applications have been accepted but not yet resolved or have been resolved but subsequently issues arise requiring further handling, the People's Committee of the province and the Chairman of the People's Committee of the province shall be responsible for assigning the People's Committee of the commune or the Chairman of the People's Committee of the commune where the individual resides or where the business entity's office is located to continue resolving or handling the pending matters.
2. For districts where administrative functions have ceased, if public services were previously conducted by the district People's Committee, amendments, supplements, cancellations, corrections of errors in recording, typing, or printing shall be carried out by the People's Committee of the province or the commune where the public services were received.
3. Documents and papers issued and granted by competent authorities before the date this Decree takes effect and which remain valid or within their usage period shall continue to be applied and used according to the law until their expiration or until they are amended, supplemented, replaced, abolished, or canceled by the receiving authority or person with the relevant functions, powers, or authority.
