Regulations on Detailed Implementation of Certain Provisions of the Road Traffic Law

THE GOVERNMENT

Pursuant to the Law on Organization of the Government dated December 25, 2001;

WHEREAS, the Road Traffic Law dated June 29, 2001;

At the proposal of the Minister of Transport.

DECREE:

Chapter 1:

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Decree stipulates detailed provisions of the Road Traffic Law concerning certain traffic rules on roads; about signals for priority vehicles; about organizing cultural, sports, parade, and festival activities on roads; about the responsibilities of ministries, sectors, provincial people's committees, and centrally governed city people's committees (hereinafter referred to collectively as provincial-level people's committees) in ensuring road traffic order and safety.

Article 2. Handling Violations

Individuals and organizations that violate the provisions of this Decree shall be subject to administrative penalties, disciplinary measures, or criminal prosecution depending on the nature and severity of the violation, as prescribed by law.

Chapter 2:

DETAILED PROVISIONS ON CERTAIN TRAFFIC RULES ON ROADS

Article 3. Distance Between Vehicles When Running in a Group

When running in a group with organization, each group of motor vehicles shall not exceed 250 meters in length in a single file; if there are multiple groups, the minimum distance between two groups shall be 100 meters. The provisions of this Article shall not apply to groups of vehicles led by police cars.

Article 4. Stopping and Parking Vehicles on Roads in Urban Areas

When stopping or parking vehicles on roads in urban areas, the driver must comply with the provisions of Article 19 of the Road Traffic Law and the following specific regulations:

1. Must stop or park the vehicle close to the curb or sidewalk on the right side, with the nearest wheel not exceeding 0.25 meters from the curb or sidewalk, and without causing obstacles or dangers to traffic.

2. It is prohibited to stop or park vehicles over manholes for drainage, telephone tunnel entrances, high-voltage power lines, and designated areas for fire trucks to draw water.

Article 5. Loading Goods on Transportation Vehicles

1. Goods loaded on vehicles must be neatly arranged and securely fastened, preventing spillage along the road, dragging goods on the road surface, and obstructing vehicle control. The loading dimensions are specified as follows:

a) For cargo trucks, the goods must not extend more than 10% beyond the front and rear ends of the truck bed; must not exceed the width of the truck bed, and must not exceed the permitted height for each type of vehicle as prescribed;

b) For passenger trucks, goods and luggage must not protrude beyond the outer dimensions of the vehicle;

c) Motorcycles, motorbikes, bicycles must not load goods or luggage exceeding 0.30 meters on either side of the load-bearing area, exceeding 2 meters in height from the ground, and extending more than 0.50 meters behind the load-bearing area;

d) Three-wheeled motor vehicles (including lam cars) and non-motorized vehicles must not load goods extending more than one-third of the vehicle body length in front and behind; must not exceed the width of the vehicle body. Specifically, for three-wheeled transport vehicles, goods and luggage must not exceed 0.40 meters on either side of the wheels, and must not extend more than 1 meter in front and behind the vehicle. It is prohibited to load goods on the roof of three-wheeled motor vehicles (including lam cars).

2. When loading goods extending in front of and behind the vehicle, red flags must be displayed during the day, and red lights must be displayed at night or in dark conditions.

Article 6. Certain Cases Permitting the Carriage of Passengers on Cargo Trucks

1. Cargo trucks may only carry passengers in the following cases:

a) Transporting personnel for disaster prevention and control tasks or urgent missions; when transporting military personnel on duty; when transporting injured persons for emergency care;

b) Transporting road maintenance workers; when transporting students practicing driving on training vehicles; when transporting participants in parades;

c) Evacuating people from dangerous areas or other emergencies as prescribed by law.

2. Cargo trucks carrying passengers under the circumstances specified in Clause 1 of this Article must have fixed cargo compartments to ensure safety while participating in traffic..

Article 7. Pedestrians

In addition to complying with the provisions set forth in Article 30 of the Road Traffic Law, pedestrians must also comply with the following provisions:

1. They shall not cling onto moving vehicles; when carrying bulky objects, they must ensure safety and not obstruct other persons and vehicles participating in traffic.

2. When walking in a group, there must be someone guiding them.

Article 8. Wearing helmets when sitting on motorcycles and motorbikes

The driver and passengers sitting on two-wheeled motorcycles, three-wheeled motorcycles, and motorbikes must wear helmets when traveling on roads where helmet wearing is required.

Chapter 3:

SIGNALS OF PRIORITY VEHICLES

Article 9. Signals of fire trucks

Fire trucks have rotating lights on top of the vehicle emitting red or blue light and a siren for priority signals.

Article 10. Signals of military and police vehicles on urgent missions

1. Military vehicles have rotating lights on top of the vehicle emitting red light, military flags attached to the left side of the front of the vehicle, and a siren for priority signals.

2. Police vehicles have rotating lights on top of the vehicle emitting green or red light, police flags attached to the left side of the front of the vehicle, and a siren for priority signals.

Article 11. Signals of ambulances

Ambulances have a red cross symbol on the sides of the vehicle, rotating lights on top of the vehicle emitting red light, and a siren for priority signals.

Article 12. Signals of dike protection vehicles and vehicles performing emergency disaster relief tasks

1. Dike protection vehicles have the sign "DIKE PROTECTION VEHICLE" attached to the front window of the vehicle and a dike protection flag.

2. Vehicles performing emergency disaster relief tasks or rescue operations:

a) Vehicles performing emergency disaster relief tasks have specific signs;

b) Rescue operation vehicles have rotating lights on top of the vehicle emitting yellow light and a siren for priority signals.

Article 13. Signals of traffic escort vehicles

1. Cars have rotating lights on top of the vehicle emitting green-red light, police flags attached to the left side of the front of the vehicle, and a siren for priority signals.

2. Motorcycles have lights emitting green or red light attached to the front or rear fork of the motorcycle, police flags attached to the front of the vehicle, and a siren for priority signals.

Article 14. Use of priority vehicle signals

1. Priority vehicles may only use priority vehicle signals when performing urgent missions.

2. Strictly prohibited from using sirens, flags, lights, and signs of priority vehicles as specified in Articles 9, 10, 11, 12, and 13 of this Decree for non-priority road traffic mechanical vehicles.

Article 15. Implementation Organization

Ministries managing priority vehicles shall coordinate with the Ministry of Science and Technology to specify standards for sirens and lights of priority vehicles; inspect the use of priority vehicle signals under their management according to the provisions of this Decree.

Chapter 4:

ORGANIZATION OF CULTURAL, SPORTS, PARADE, AND FESTIVAL ACTIVITIES ON ROADS

Article 16. Uniform traffic assurance plan

Organizations and entities requiring the use of roads for cultural, sports, parade, and festival activities must obtain approval in writing from the competent road management authority regarding the traffic assurance plan before applying for permission to organize such activities in accordance with the law.

Article 17. Traffic Diversion

1. In cases where traffic needs to be restricted or roads need to be closed for organizing cultural, sports, parade, and festival activities, the road management agency must issue a traffic diversion notice, and the organizing unit must conduct announcements on mass media.

2. When cultural, sports, parade, and festival activities take place on the road alongside other traffic activities, the organizers must ensure order and safety for people and vehicles participating in traffic.

3. The People's Committee at the location where cultural, sports, parade, and festival activities are organized shall be responsible for directing local functional agencies to properly organize traffic diversion and ensure traffic flow in the areas where such activities take place.

Article 18. Other Provisions

1. Agencies and organizations conducting cultural, sports, parade, and festival activities on roads must comply with regulations regarding the scope and duration of road usage; adhere to regulations ensuring traffic order and safety, protecting road infrastructure, and maintaining environmental hygiene.

2. After completing cultural, sports, parade, and festival activities on roads, the organizing unit must clean up all equipment and restore the road surface to its original condition.

3. In cases where cultural, sports, parade, and festival activities require repairs or enhancements to road infrastructure outside the existing maintenance plan or cause damage to road infrastructure that requires repair and restoration, the costs for these works shall be included in the budget for organizing cultural, sports, parade, and festival activities according to the law.

Chapter 5:

RESPONSIBILITIES OF MINISTRIES, SECTORS, AND PROVINCIAL PEOPLE'S COMMITTEES IN ENSURING ROAD TRAFFIC ORDER AND SAFETY

Article 19. Responsibilities of the Ministry of Transport

1. Issuing technical standards for road infrastructure and regulations on management, operation, use, safety assurance, and lifespan of infrastructure; organizing and guiding the installation of sufficient road signs; managing infrastructure quality, periodically inspecting, and promptly reporting on the technical safety status of road infrastructure; organizing safety assessments for road infrastructure from project planning, design, construction, and during operation; implementing special technical measures to ensure traffic safety at dangerous locations prone to accidents or traffic congestion; directing traffic safety work during rainy and flood seasons.

2. Setting quality and technical safety standards for motorized vehicle traffic; organizing inspections and issuing certificates of technical safety inspection and environmental protection for motor vehicles.

3. Organizing registration and technical safety inspections for specialized motorcycles participating in road traffic.

4. Specifying conditions, standards, and issuing permits for vehicle inspection facilities.

5. Specifying training programs, conditions, standards, and issuing permits for driving schools.

6. Specifying the organization and management of driving test centers; organizing driving tests and issuing, renewing driving licenses.

7. Specifying the organization and management of passenger and cargo transportation by road; specifying standards and organizational activities of bus stations.

8. Inspecting, supervising, and handling violations within their authority; organizing, directing, and supervising the activities of Road Traffic Inspection throughout the country.

9. Cooperating with the Ministry of Public Security to monitor, analyze causes of serious and particularly serious traffic accidents, and propose effective measures to reduce traffic accidents or congestion.

10. Cooperating with the Ministry of Public Security and the Ministry of National Defense to protect important economic and social road infrastructure and national defense security.

11. Cooperating with relevant ministries and sectors in promoting, disseminating, and guiding laws on road traffic and ensuring road traffic order and safety.

12. Taking the lead and cooperating with the Ministry of Public Security to specify the procedures for exchanging driving licenses when they are marked with the number of traffic law violations.

Article 20. Responsibilities of the Ministry of Public Security

1. To stipulate and organize the registration, issuance, recovery of registration certificates and license plates for all types of road motor vehicles, except military vehicles used for national defense purposes and special-purpose motorcycles; to stipulate and organize vehicle inspections, training, examination, issuance of driver's licenses, and management of vehicles and drivers within the public security sector.

To dispatch traffic police officers as examiners to participate in examination boards for issuing driver's licenses in the transportation sector.

2. To guide the command and control of traffic on roads; to organize and direct patrol, inspection, violation handling activities concerning persons and vehicles participating in traffic.

3. To take the lead and coordinate with the Ministry of Transport to specify the details regarding marking the number of traffic law violations on driver's licenses of drivers of road motor vehicles.

4. To organize traffic accident investigations and handling; to take the lead and coordinate with the Ministry of Transport to compile statistics, monitor, analyze, and conclude causes of traffic accidents; to propose and implement preventive measures against traffic accidents.

5. To organize guidance, inspection, correction of activities, and strengthening of traffic police forces to ensure traffic order and safety on roads. To regularly educate traffic police forces to enhance their sense of responsibility, moral qualities, and professional skills; to promptly reward and strictly deal with police officers who engage in negative behaviors while performing their duties.

6. To participate in safety assessment of road construction projects before they are put into operation according to the law.

7. To coordinate with relevant ministries and sectors in disseminating, popularizing, and guiding traffic laws and ensuring traffic order and safety on roads.

8. To organize the protection of particularly important road infrastructure from both economic and social perspectives, as well as national security.

Article 21. Responsibilities of the Ministry of National Defense

1. To organize the management and inspection of military motor vehicles and their drivers used for national defense purposes.

2. To disseminate, popularize, and educate military personnel about traffic laws, ensuring that military vehicles and their drivers strictly comply with traffic regulations and cooperate with traffic order and safety enforcement forces.

3. To organize, guide, and inspect the implementation of tasks by military control forces in traffic order and safety work.

4. To participate in protecting particularly important road infrastructure.

Article 22. Responsibilities of the Ministry of Finance

1. To ensure funding for traffic order and safety work based on proposals from the Ministry of Transport, the Ministry of Public Security, and provincial people's committees.

2. To take the lead and coordinate with the Ministry of Public Security, the Ministry of Transport, and related ministries and sectors to guide and organize the collection of fines for administrative violations related to traffic on roads.

3. To guide the management and use of fines for administrative violations related to traffic on roads, ensuring that all funds collected from such fines must be used for traffic safety work according to approved plans.

4. To organize the inspection and supervision of the management and use of fine revenue in accordance with regulations.

Article 23. Responsibilities of the Ministry of Culture - Information

1. Develop plans for propaganda and dissemination of laws on road traffic.

8. Propose preferential policies for the development of public passenger transport; organize the management of public passenger transport in urban areas;

3. Guide the issuance of advertising permits without affecting road traffic safety and urban traffic safety.

Article 24. Responsibilities of mass media agencies

Central and local mass media agencies must have special sections for propaganda and dissemination of laws on traffic order and safety.

Article 25. Responsibilities of the Ministry of Education and Training

1. Organize the compilation of textbooks on laws on road traffic, incorporate them into teaching at schools and other training institutions, suitable to the field of study and level of education.

2. Propose measures to educate students and trainees to strictly comply with regulations of laws on traffic order and safety; direct schools to cooperate with relevant agencies to propose measures to end the situation where students under the age stipulated by law ride motorcycles or motorbikes to school, or operate motorcycles without a driving license.

Article 26. Responsibilities of the Ministry of Labor, Invalids and Social Affairs

1. Coordinate with the Ministry of Transport to inspect and check driving schools according to regulations.

2. Guide vocational training institutions in the cultivation of knowledge on laws on road traffic and guide the issuance of certificates for operators of specialized vehicles that participate in road traffic.

Article 27. Responsibilities of the Ministry of Construction

1. Direct urban planning and concentrated residential area planning work to ensure safe and effective exploitation of road networks.

2. Examine and approve or guide the preparation and examination of urban and residential area planning projects ensuring necessary land areas for urban transportation infrastructure construction.

3. Guide the coordination in constructing and repairing underground works to ensure they do not cause traffic congestion and loss of safety in urban traffic.

4. Guide the issuance of construction permits for office buildings, schools, hospitals, commercial service centers, cultural facilities, and residential areas to ensure appropriate parking areas based on the scale and nature of each project.

Article 28. Responsibilities of the Ministry of Health

1. Take the lead and coordinate with the Ministry of Transport to establish health standards and organize regular health checks for drivers.

2. Direct the organization of medical emergency networks on roads prone to traffic accidents.

3. Organize first aid training for traffic police, traffic inspectors, and initial rescue personnel.

4. Establish a system of information on traffic accident emergencies.

Article 29. Responsibilities of provincial People's Committees

1. Direct and organize the implementation of all necessary measures to establish and maintain traffic order and safety in the locality, considering this as a key task, and regularly inspect the implementation at various levels and sectors within their management scope.

2. Implement preventive, blocking, and handling measures against acts of infringing upon road construction projects and encroaching upon road safety zones; assign tasks and supervise lower-level People's Committees in protecting road construction projects and road safety zones in the locality (including national highways passing through the locality).

3. Specify the conditions for temporarily using part of the sidewalk and street but not affecting traffic order and safety; organize the clearance of occupied sidewalks and streets; prohibit renting sidewalks and streets for business activities in any form.

4. Direct lower-level People's Committees to implement planning and arranging markets and trading places for the people but not violating traffic order and safety regulations.

5. Plan and implement plans to renovate and expand roads under local management in accordance with approved planning to alleviate traffic congestion; take measures in organizing traffic such as: Limiting or prohibiting certain types of vehicles; dividing routes and time periods for certain types of vehicles; starting working hours for agencies, organizations, and enterprises.

Propose and implement policies and measures to limit individual transport means applicable to cities and towns in the locality.

6. Plan and direct the implementation of planning for bus stations and parking lots; manage the operation of bus stations and parking lots.

Chapter 6:

IMPLEMENTING PROVISIONS

Article 30. Effective Date

This Decree shall take effect fifteen days after its publication in the Official Gazette.

Repeals Decree No. 36/2001/NĐ-CP dated July 10, 2001 of the Government on ensuring traffic order and safety on roads and urban traffic order and safety.

Article 31. Responsibility for Implementation

Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial and centrally governed city People's Committees are responsible for implementing this Decree.
