CIRCULAR

Issuing the List of Objects Subject to Plant Quarantine; the List of Objects Subject to Plant Quarantine Risk Analysis Before Importing into Vietnam

must undergo a pest risk analysis

before being imported into Vietnam

Pursuant to Decree No. 105/2022/NĐ-CP dated December 22, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to the Law on Plant Protection and Quarantine dated November 25, 2013;

At the proposal of the Director of the Plant Protection Department;

The Minister of Agriculture and Rural Development issues the List of Objects Subject to Plant Quarantine; the List of Objects Subject to Plant Quarantine Risk Analysis Before Importing into Vietnam.

Article 1. List of Objects Subject to Plant Quarantine

1. Plants: Trees and parts of trees.

2. Plant Products:

a) Roots, fruits, seeds, flowers, leaves, stems, branches, roots, tree bark;

b) Sheets, bran, oil cakes, cassava slices, raw natural fibers, plant fibers;

c) Plant-based flour, cassava starch;

d) Tobacco stems, raw cotton, cotton waste, straw, rice straw, and aquatic plants (excluding seaweeds, algae, and marine aquatic plants);

đ) Round wood, sawn timber, wooden pallets, wood shavings, coconut shavings;

e) Plant-based animal feed materials (excluding finished packaged and labeled feed);

g) Plant-based growing media.

3. Fungi (excluding salted, frozen, canned fungi, yeast).

4. Silkworm cocoons, silkworm reeling waste.

5. Insects, spiders, plant pathogens, nematodes, bacteria, viruses, phytoplasmas, viroids, and weeds (excluding specimens) for identification, training, biological control, and scientific research purposes.

6. In cases where objects not listed in this Article are exported, plant quarantine shall be conducted according to the requirements of the importing country and international treaties to which Vietnam is a party.

Article 2. List of Objects Subject to Plant Quarantine Risk Analysis Before Importing into Vietnam

1. Propagating Materials: Seedlings, seeds, tubers, and other plant parts capable of being used as propagating material (excluding tissue-cultured plants, cruciferous seeds, rice seeds, corn seeds, millet seeds, onion seeds, garlic seeds).

2. Fresh fruits, fresh sweet potatoes, fresh potatoes.

3. Grasses, grass seeds for planting purposes.

4. Beneficial organisms used in plant protection (excluding biological pesticide products).

5. Other objects subject to plant quarantine that pose a high risk of carrying quarantine pests, as determined and reported by the Plant Protection Department to the Minister of Agriculture and Rural Development for decision.

Article 3. Objects Subject to Plant Quarantine Exempt from Risk Analysis

Objects subject to plant quarantine as stipulated in Article 2 of this Circular are exempt from risk analysis in the following cases:

1. Propagating materials imported for scientific research or laboratory testing and evaluation.

2. Beneficial organisms used in plant protection imported for scientific research or laboratory testing and evaluation.

3. Other cases, the Plant Protection Department reports to the Minister of Agriculture and Rural Development for decision.

4. The importation of objects specified in Clauses 1, 2, and 3 of this Article must have a Plant Quarantine Import Permit and comply with plant quarantine regulations.

Article 4. Transitional Provisions

1. Applications for issuance of a Plant Quarantine Certificate for objects in the List of Objects Subject to Plant Quarantine; Plant Quarantine Import Permit for objects in the List of Objects Subject to Plant Quarantine Risk Analysis Before Importing into Vietnam submitted before the effective date of this Circular shall be processed in accordance with Circular No. 30/2014/TT-BNNPTNT dated September 5, 2014 issued by the Minister of Agriculture and Rural Development on the List of Objects Subject to Plant Quarantine; the List of Objects Subject to Plant Quarantine Risk Analysis Before Importing into Vietnam.

2. For objects subject to plant quarantine risk analysis before importing into Vietnam that were permitted to import before the effective date of this Circular, if there is evidence that new quarantine pests have appeared in the exporting country, the plant quarantine authority of the exporting country must provide information to the Plant Protection Department to take necessary measures to prevent the entry of quarantine pests.

Article 5. Implementation Provisions

1. This Circular takes effect from December 15, 2024.

2. Circular No. 30/2014/TT-BNNPTNT dated September 5, 2014 of the Minister of Agriculture and Rural Development on the issuance of the List of Objects Subject to Plant Quarantine; the List of Objects Subject to Plant Quarantine Risk Analysis Before Importing into Vietnam ceases to be effective from the date this Circular takes effect.

Article 6. Responsibility for Implementation

1. The Director of the Ministry's Office, the Director of the Plant Protection Department, relevant organizations, and individuals are responsible for implementing this Circular.

2. During the implementation of this Circular, if there are difficulties or obstacles, agencies, units, organizations, and individuals should promptly report to the Ministry of Agriculture and Rural Development (Plant Protection Department) for consolidation and submission to the Minister for consideration and decision./.
