Pursuant to the Law on Thrift and Prevention of Waste dated February 26, 1998 of the Standing Committee of the National Assembly;
Pursuant to Decree No. 14/1998/NĐ-CP dated March 6, 1998 of the Government on state asset management;
Pursuant to Decree No. 15/CP dated March 2, 1993 of the Government on the tasks, powers, and responsibilities for state management of Ministries and ministerial-level agencies;
Pursuant to the Prime Minister's Decision No. 853/1997/CT-TTg dated October 11, 1997 on combating smuggling under new circumstances;
Pursuant to Decision No. 122/1999/QĐ-TTg dated May 10, 1999 of the Prime Minister on the issuance of standards and norms for the use of motor vehicles in state administrative agencies and state-owned enterprises;
Pursuant to Decision No. 101/1999/QĐ-BTC dated August 28, 1999 of the Ministry of Finance on the issuance of the Regulations on the Management and Use of Means of Transportation at State Administrative Agencies and State-Owned Enterprises;
To create initiative and enhance responsibility of state administrative agencies in purchasing, managing, and using means of transportation effectively for work purposes in accordance with regulations.

Article 1:Amend and supplement Article 5 of the Regulations on the Management and Use of Means of Transportation at State Administrative Agencies and State-Owned Enterprises issued together with Decision No. 101/1999/QĐ-BTC dated August 28, 1999 of the Minister of Finance as follows:
"Procurement of means of transportation for state administrative agencies shall be carried out as follows:"
1- Preparation of the annual budget for procurement of means of transportation:
State budget beneficiaries shall base their determination of the need for purchasing means of transportation on the current status of existing means of transportation and the standards set forth by the Prime Minister, and report to their immediate superior authority.
Ministries, agencies, and organizations at the central level shall compile the needs for purchasing means of transportation (according to the attached form) and report to the Ministry of Finance for review and consolidation into the annual state budget expenditure plan of central-level state administrative organizations, to be submitted to the competent authority for decision in accordance with the laws on the State Budget.
Departments, agencies, and units at local levels and People's Committees at district level shall compile the needs for purchasing means of transportation and submit them to the Department of Finance and Prices for review and to the Chairman of the People's Committee at provincial level for consideration and decision to include in the annual local state budget expenditure plan of local state administrative organizations, to be submitted to the competent authority for decision in accordance with the laws on the State Budget.
2- Authority to decide on procurement of means of transportation:
Annually, based on the allocated state budget, the Ministers, Heads of ministries equivalent to ministries, and heads of government agencies at the central level; Chairmen of Provincial People's Committees under the central government shall issue written notifications allowing the purchase and provision of means of transportation for state administrative organizations under their management, and send copies to the Ministry of Finance for monitoring and management, and to the State Treasury at the same level for coordination in implementation.
3. The State Treasury shall only implement payment for the procurement of means of transportation for state administrative organizations according to the prescribed price level upon receipt of written permission from the competent authority as stipulated in point 2 above.
Article 2:This Decision takes effect from January 1, 2002. Previous regulations contrary to this Decision are abolished.
Article 3:The Ministers, Heads of ministries equivalent to ministries, government agencies, political organizations, political-social organizations, Chairmen of Provincial People's Committees under the central government are responsible for implementing this Decision.
