DECISION

Regarding the amendment and supplementation of certain Articles and Clauses in the "Regulations on Bus Terminals" issued together with Decision No. 08/2005/QĐ-BGTVT dated January 10, 2005 of the Minister of Transport

regarding "bus stations" issued together with Decision No. 08/2005/QĐ-BGTVT

dated January 10, 2005 of the Minister of Transport

MINISTER OF TRANSPORT

Pursuant to the Road Traffic Law dated June 29, 2001;

Pursuant to Decree No. 34/2003/NĐ-CP dated April 4, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

Pursuant to Decree No. 110/2006/NĐ-CP dated September 28, 2006 of the Government on conditions for operating passenger transport by road;

Based on the proposal of the Director of the Transport Department.

DECISION:

Article 1. Amending and supplementing certain Articles and Clauses in the "Regulations on Bus Terminals" issued together with Decision No. 08/2005/QĐ-BGTVT dated January 10, 2005 of the Minister of Transport as follows:

1. Clause 2 of Article 15 shall be amended and supplemented as follows:

"2. Implement the contract signed with the business entity operating the bus terminal. Directly sell tickets to vehicles of enterprises engaged in passenger transport at the bus terminal or entrust the business entity operating the bus terminal to sell tickets to passengers traveling on their own enterprise's vehicles."

2. Clause 3 of Article 17 shall be amended and supplemented as follows:

"The bus terminal operator may collect service fees at the terminal in accordance with the provisions of the law. The prices of various services within the bus terminal shall be established by the enterprise itself, in line with the production costs of the enterprise, consistent with the quality of the services provided, and reported to the Department of Transport (Department of Transport and Public Works) of the province or centrally-administered city for monitoring. The price for collecting service fees and renting ticket sales locations shall be agreed upon between the bus terminal enterprise and the transport enterprise and shall be one of the mandatory contents of the economic contract."

Article 2. This Decision shall take effect fifteen days from the date of publication in the Official Gazette.

Article 3. The Head of the Ministry’s Office, the Inspector General of the Ministry, Heads of Departments, Directors of the Vietnam Highway Administration, Directors of Provincial and Central City Departments of Transport (Transport and Public Works), Heads of relevant agencies, units, and individuals are responsible for implementing this Decision./.
