||| The Minister of Home Affairs issues Circulars guiding the functions, tasks, powers, and organizational structure of the Department of Home Affairs under the People's Committee of provinces and centrally governed cities (hereinafter referred to collectively as the Provincial People's Committee); the Department of Home Affairs under the People's Committee of districts, towns, provincial cities (hereinafter referred to collectively as the District People's Committee).
||| Article 1. The Department of Home Affairs is a specialized agency under the Provincial People's Committee with the function of advising and assisting the Provincial People's Committee in state management over: Organizational structures; job positions; civil servant quotas, civil servant grade structures within administrative agencies and organizations; job positions, vocational career-based staff structures, and the number of personnel working in public service units; salaries for cadres, civil servants, staff, and contractual workers in administrative agencies and organizations, public service units; administrative reform, civil service system reform, civil servant reform; local administration; administrative boundaries; cadres, civil servants, staff, and village-level civil servants (hereinafter collectively referred to as village-level); training and capacity building for cadres, civil servants, staff, and village-level civil servants; non-professional workers at the village level; organizations, non-governmental organizations; state archives; religion; commendation and rewards, and youth work.

The Department of Home Affairs has legal personality, its own seal and separate account; it implements the leadership and management of the Provincial People's Committee regarding organization and operation, while also implementing the guidance, inspection, and professional supervision of the Ministry of Home Affairs.
PART I
Form 3. Application for issuance of the Archival Profession Practice Certificate
Article 1. Position and Functions
||| Article 1. Submit draft decisions, directives; long-term, five-year, and annual plans; projects, programs, and measures to organize the implementation of administrative reform tasks within the scope of state management of the Department of Home Affairs on the provincial territory to the Provincial People's Committee and the Chairman of the Provincial People's Committee.
||| Article 2. Implement normative legal documents, plans, projects, programs that have been approved; provide information, propaganda, guidance, inspection, dissemination, education, and monitoring of the enforcement of laws in fields under the assigned state management.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
||| Article 3. On organizational structures:
||| a) Propose the Provincial People's Committee to decide on the delegation of management of organizational structures for specialized agencies and public service units under the Provincial People's Committee and the District People's Committee;
||| b) Propose the Provincial People's Committee to submit proposals for establishing, merging, splitting, or dissolving specialized agencies under the Provincial People's Committee and the District People's Committee to the competent authority for decision-making according to regulations;
||| c) Propose the Provincial People's Committee to issue documents detailing the functions, tasks, powers, and organizational structures of the Department of Home Affairs;
||| d) Assist the Provincial People's Committee in drafting proposals for establishing, restructuring, or dissolving public service units under the Provincial People's Committee to be submitted to the competent authority for decision-making according to regulations;
||| e) Review the content of draft documents stipulating the functions, tasks, powers, and organizational structures of specialized agencies and public service units under the Provincial People's Committee. Review proposals for establishing, restructuring, or dissolving public service units under the Provincial People's Committee's decision-making authority;
||| f) Coordinate with other specialized agencies at the same level to guide the District People's Committee in defining the functions, tasks, powers, and organizational structures of specialized departments and public service units under the District People's Committee;
||| g) Take the lead and coordinate with relevant provincial functional agencies to guide, monitor, and inspect the implementation of classification and ranking of public service units in the province according to legal regulations.
||| Article 4. On the management and use of civil servant quotas and the number of personnel working in public service units:
||| a) Review and propose the Provincial People's Committee and the Chairman of the Provincial People's Committee to approve annual civil servant quota plans and personnel number plans of agencies, organizations, and public service units under the Provincial People's Committee's management for submission to the Ministry of Home Affairs according to regulations;
||| b) Assist the Provincial People's Committee and the Chairman of the Provincial People's Committee in proposing the Provincial People's Council to decide on the total civil servant quota in the People's Council, People's Committee agencies, and public service units under the Provincial People's Committee and the District People's Committee within the civil servant quota allocated by the Ministry of Home Affairs;
||| c) Based on the review opinions of the Ministry of Home Affairs, assist the Provincial People's Committee and the Chairman of the Provincial People's Committee in proposing the Provincial People's Council to approve the total number of personnel working in public service units; take the lead in advising and assisting the Provincial People's Committee in organizing implementation and inspecting the execution after approval by the Provincial People's Council;
||| d) Guide the management and use of civil servant quotas and personnel numbers for specialized agencies under the Provincial People's Committee and the District People's Committee and public service units according to regulations;
||| e) Aggregate, statistically compile, and report on civil servant quotas, personnel numbers, and the implementation of civil servant quotas and personnel numbers in administrative agencies and organizations, public service units according to legal regulations.
||| Article 5. On the management of job positions, civil servant grade structures, and staff vocational career-based structures (collectively referred to as civil servant and staff position structures):
||| a) Propose the Provincial People's Committee to issue directive documents guiding agencies, organizations, and units under the province to manage the construction of job position proposals, civil servant and staff position structures, or adjustment proposals for job positions and civil servant and staff position structures according to regulations.
đ) Compile, statistically analyze, and report on staffing, the number of employees, and the implementation of civil servant staffing plans, as well as the number of employees in administrative agencies, organizations, and public service units in accordance with the law.
5. Regarding job position management, the structure of civil servant ranks, and the structure of vocational titles for civil servants and officials (collectively referred to as the structure of civil servant and official positions):
a) Propose the People's Committee of the province to issue directives and guidelines for provincial agencies, organizations, and units to manage the development of job position proposals, structures of civil servant and official positions, or proposals to adjust job positions and structures of civil servant and official positions in accordance with regulations;
b) Assist the Chairman of the Provincial People's Committee and the Provincial People's Committee in reviewing the job position plan, the structure of civil servant and public official positions, or the adjustment plan for job positions and the structure of civil servant and public official positions in agencies, organizations, and units under provincial management as prescribed;
c) Assist the Provincial People's Committee in compiling the list of job positions, drafting the job position plan, the structure of civil servant and public official positions, or the adjustment plan for job positions and the structure of civil servant and public official positions of agencies, organizations, and units under provincial management to be submitted by the Provincial People's Committee to the Ministry of Home Affairs for approval as prescribed;
d) Submit to the Provincial People's Committee for decision on decentralization or delegation of authority to implement the use and management of job positions and the structure of civil servant and public official positions in agencies, organizations, and units under provincial management in accordance with the provisions of the law;
6. On administrative organization:
a) Guide the organization and operation of agencies within the local administrative machinery at all levels within the territory in accordance with the provisions of the law;
b) Advise and assist the Provincial People's Committee in organizing and guiding election work for National Assembly deputies and People's Council deputies at all levels;
c) Advise and assist the Provincial People's Committee in submitting to the Provincial People's Council for election, removal from office, and dismissal of the Chairman, Vice Chairmen, and other members of the Provincial People's Committee;
d) Advise and assist the Provincial People's Committee in presenting to the competent authority for approval of the election results, approval of removal from office, and dismissal of elected positions in accordance with the provisions of the law;
đ) Review and submit to the Chairman of the Provincial People's Committee for approval of the election results, approval of removal from office, and dismissal of members of the District People's Committee in accordance with the provisions of the law;
e) Advise and submit to the Chairman of the Provincial People's Committee for appointment and reappointment of the positions of Chairman, Vice Chairmen, and members of the District People's Committee where there is no People's Council established in accordance with the provisions;
g) Advise and assist the Provincial People's Committee in statistics, compilation, and reporting on the number and quality of People's Council deputies and members of the People's Committees at all levels in accordance with the provisions;
h) Advise and assist the Provincial People's Committee in guiding, inspecting, compiling, and reporting on the implementation of democracy at communes, wards, towns, administrative agencies, public service units, enterprises within the province, and the implementation of mass mobilization work of the government in accordance with the provisions of the law;
i) Guide and inspect the activities of villages and residential groups in accordance with the provisions of the law;
k) Advise and assist the Provincial People's Committee in directing, guiding, and inspecting the District People's Committees and Commune People's Committees in the development and implementation of documents and plans related to the construction of new rural areas according to the division of labor by the Provincial People's Committee and in accordance with the provisions of the law;
7. On territorial administrative boundaries and classification of administrative units:
a) Advise and assist the Provincial People's Committee in managing territorial administrative boundaries within the territory in accordance with the provisions of the law and the guidance of the competent state agency;
b) Review and submit to the Provincial People's Committee and the Chairman of the Provincial People's Committee for plans and documents related to the establishment, dissolution, merger, division, adjustment of territorial administrative boundaries, renaming of administrative units, and classification of administrative units within the province for the Provincial People's Committee to submit to the competent authority for decision, or for the Chairman of the Provincial People's Committee to decide in accordance with the provisions of the law;
c) Guide and organize the implementation of plans and documents related to the management of territorial administrative boundaries, renaming of administrative units, and classification of administrative units within the province after approval by the competent authority;
d) Assist the Provincial People's Committee in managing files, maps, markers, and territorial administrative boundaries of the province in accordance with the provisions of the law;
8. On cadres, civil servants, public officials; commune-level cadres and non-professional staff at the commune level:
a) Submit to the Provincial People's Committee for issuance of documents on recruitment, utilization, and management of the cadre, civil servant, and public official workforce and commune-level cadres in accordance with the provisions of the law; advise and assist the Provincial People's Committee in issuing or submitting to the competent authority for issuance of documents on the management and utilization of non-professional staff at the commune level in accordance with the provisions of the law;
b) Submit to the Provincial People's Committee for issuance of documents specifying the conditions, standards, and titles for the heads and deputy heads of departments and units under the Provincial Department of Home Affairs and for the heads and deputy heads of the Civil Service Department within the province;
c) Submit to the Chairman of the Provincial People's Committee for decisions on the acceptance, utilization, appointment, reappointment, transfer, rotation, assignment, salary increase, promotion to rank, change of occupational title, evaluation, classification, commendation, disciplinary action, training, and other systems and policies for cadres, civil servants, and public officials under the management authority of the Provincial People's Committee in accordance with the regulations of the Party and State and the decentralization of cadre management by the Provincial People's Committee;
d) Advise and assist the Provincial People's Committee in recruiting civil servants and public officials; piloting competitive examinations for leadership and management positions; examinations for promotion to higher ranks for civil servants; examinations or evaluations for promotion to higher occupational titles for public officials in accordance with the provisions of the law and the decentralization of cadre management by the Provincial People's Committee;
đ) Manage the files of cadres, civil servants, and public officials under the management authority of the Provincial People's Committee in accordance with the provisions of the law;
e) Guide and inspect the implementation of regulations on the standards for cadre, civil servant, and public official positions; the structure of cadres and the structure of civil servant and public official positions in accordance with the provisions of the law;
g) Guide and inspect the implementation of regulations on the recruitment, utilization, and management of cadres, civil servants, and public officials and commune-level cadres and non-professional staff at the commune level; the implementation of systems and policies and the management of files for cadres, civil servants, and public officials in accordance with the provisions of the law;
h) Guide, compile statistics, inspect the implementation of policies and regulations for non-professional cadres at village, ward, and town levels.
9. Regarding training and capacity building for cadres, civil servants, and public officials (referred to collectively in this clause as cadres, civil servants, and public officials):
a) Submit to the provincial People's Committee for issuance of policies and incentives encouraging cadres, civil servants, and public officials of the province to study and improve their work qualifications and capabilities;
b) Coordinate with relevant agencies to submit to the provincial People's Committee for decision on the allocation and distribution of funds for the training and capacity building activities of cadres, civil servants, and public officials of the province as prescribed;
c) Submit to the provincial People's Committee for issuance of planning and training programs for cadres, civil servants, and public officials within its jurisdiction; assist the provincial People's Committee in implementing these plans and programs after approval;
d) Assist the provincial People's Committee in guiding and inspecting the implementation of training and capacity building policies for cadres, civil servants, and public officials as prescribed; compile and report annually on the results of training and capacity building activities to the Ministry of Home Affairs as prescribed.
10. Regarding salary policies:
a) Compile lists and files, submit to the Chairman of the provincial People's Committee for issuance of documents requesting the Ministry of Home Affairs to provide comments before signing decisions on early promotion of salary grades for cadres, civil servants, and public officials of the province who are classified under the senior specialist grade and equivalent grades according to regulations;
b) Decide within its authority or submit to the competent authority for decision on regular promotion, early promotion, leap promotion, and other salary policies for cadres, civil servants, public officials, and workers in accordance with laws and the分级授权体系,请直接提供翻译内容,不要解释或添加任何额外信息。

11. Regarding administrative reform; reform of the civil service system:
a) Submit to the provincial People's Committee and the Chairman of the provincial People's Committee for leadership and direction in implementing provincial administrative reform work in accordance with government resolutions, programs, and plans for administrative reform;
b) Submit to the provincial People's Committee and the Chairman of the provincial People's Committee for decision on assigning specialized agencies under the provincial People's Committee to lead or coordinate in implementing administrative reform tasks, including institutional reform, administrative procedure reform, administrative organization reform, building and improving the quality of the cadre, civil servant, and public official workforce, financial reform, and modernizing the administrative system;
c) Submit to the provincial People's Committee and the Chairman of the provincial People's Committee for decision on measures to promote administrative reform and civil service system reform;
d) Guide, urge, and inspect specialized agencies under the provincial People's Committee; district-level People's Committees; and commune-level People's Committees in implementing administrative reform and civil service system reform tasks according to approved administrative reform programs and civil service system reform plans;
đ) Guide, urge, and inspect the implementation of one-stop services, interlinked one-stop services, and modernized interlinked one-stop services at local state administrative agencies;
e) Assist the provincial People's Committee in monitoring, evaluating, and compiling comprehensive results of administrative reform and civil service system reform tasks carried out by agencies, organizations, and units under the provincial People's Committee, district-level People's Committees, and commune-level People's Committees; establish and implement reporting systems on administrative reform and civil service system reform as prescribed;
g) Lead and coordinate with relevant agencies to guide professional and technical matters in the field of administrative reform for dedicated administrative reform civil servants in agencies, organizations, and units under the provincial People's Committee and district-level People's Committees.
12. Regarding organizational meetings; social funds, charitable funds (collectively referred to as funds):
a) Review and submit to the Chairman of the provincial People's Committee for decision on permitting establishment, division, separation, merger, consolidation, dissolution, name change, and approval of charters for associations operating within the province according to the law;
b) Review and submit to the Chairman of the provincial People's Committee for issuance of permits for establishment and recognition of charters, permission for mergers, consolidations, divisions, separations, dissolutions, name changes, suspension, temporary suspension of operations, resumption of operations after temporary suspension, recognition of eligibility for operation, recognition of members of the fund management board, permission for changes or reissuance of establishment permits, revocation of establishment permits, resolution of complaints and reports against funds operating within the province and foreign individual or organizational funds established and operating within the scope of districts and communes;
c) Based on actual conditions in the locality, submit to the Chairman of the provincial People's Committee for authorization to the Chairman of the district People's Committee to decide on management tasks for associations operating within communes and funds operating within districts and communes according to the law;
d) Submit to the provincial People's Committee for decision on permitting national associations and inter-provincial associations to set up representative offices in the locality according to the law;
đ) Guide and inspect the implementation of laws on associations and funds for associations and funds operating within the province. Handle violations within its authority or submit to the competent authority for handling according to the law.
e) Chair and coordinate with relevant specialized agencies at the same level to submit to the People's Council and the Chairman of the People's Council of the province for consideration and decision on support and implementation of other policies for associations and funds in accordance with the provisions of the law.

c) Submit to the competent authority for approval of the List of Documents Expiring Value in Historical Archives of the province, decide to destroy expired documents in Historical Archives of the province in accordance with the provisions of the law;
d) Review the List of Documents Expiring Value that need to be destroyed in agency archives for agencies and organizations submitting documents to Historical Archives of the province; decide to destroy duplicate information documents in Historical Archives of the province in accordance with the provisions of the law;
đ) Study and apply science and technology to archival work;
e) Organize training and professional development for civil servants and employees engaged in archival work;
g) Inspect the implementation of regulations and systems related to archival work: resolve according to their authority or report to the competent authority for consideration and resolution of complaints and violations of the law on archival work;
h) Implement reporting and statistics on archival work in accordance with the provisions of the law;
i) Perform the tasks of Historical Archives of the province, including: Submit to the competent authority for issuance of the List of Agencies and Organizations submitting documents and approve the List of Documents submitted to Historical Archives of the province; guide agencies and organizations submitting documents to prepare documents for submission; collect, organize, determine value, statistics, repair, restore, insure, preserve, declassify historical archival documents and organize exploitation and utilization of archival documents in accordance with the provisions of the law;
k) Issue, reissue, and revoke certificates of practice in archival work for individuals meeting the conditions stipulated by law;
l) Carry out archival service activities in accordance with the provisions of the law.
14. Regarding religious affairs:
Organize propaganda and dissemination of policies and laws on religion to cadres, civil servants, employees, believers, religious leaders, religious workers, monks, and intellectuals of religions under the management of the province;
b) Resolve according to their authority or submit to the competent authority for resolution of specific issues regarding religion in accordance with the law. Chair and coordinate with departments and sectors in advising and submitting to the People's Council of the province for resolution of emerging issues in religion in accordance with the law; serve as the point of contact between local authorities and religious organizations in the province;
c) Implement inspection, supervision, complaint, and accusation handling in the field of religion in accordance with the provisions of the law;
d) Implement training and professional development for civil servants engaged in religious work under the management of the Department of Home Affairs;
đ) Submit to the People's Council of the province for implementation of policies towards religious organizations and individuals engaging in religious activities in accordance with the law;
e) Implement scientific research in the field of religion, summarize practical experiences, and provide scientific evidence for the formulation and implementation of policies and laws of the Party and State towards religion;
g) Guide the Departments of Home Affairs under the People's Councils of districts to resolve specific issues regarding religion in accordance with the law;
15. Regarding commendation and reward work:
a) Advise and assist the People's Council, the Chairman of the People's Council of the province, and the Commendation and Reward Council of the province in organizing commendation movements; guide, urge, and inspect departments, sectors, People's Councils of districts, People's Councils of communes, the United Front, political organizations, socio-political organizations, and economic organizations in implementing commendation movements and reward policies of the Party and State within the province. Chair and coordinate with the United Front, political organizations, socio-political organizations, social organizations at the local level, and mass media to discover, publicize, and promote exemplary models;
b) Organize the implementation of training plans, professional guidance for staff engaged in commendation and reward work in departments, sectors, districts, communes, and enterprises within the province; apply science and technology in the field of commendation and reward. Implement inspection and supervision of issues related to commendation and reward work and handle complaints and accusations in the field of commendation and reward in accordance with the law;
c) Review the files of reward proposals from departments, sectors, districts, communes, the United Front, political organizations, socio-political organizations, social organizations, and economic organizations at the grassroots level, submit to the People's Council of the province for decision on rewards or propose to the competent authority for decision on rewards in accordance with the law;
d) Manage and store reward files in accordance with the provisions of the law; build and manage a database on commendation and reward; compile and report regularly on commendation and reward in accordance with the law. 16. Regarding youth work:

Conduct inspection, supervision, handling complaints and denunciations related to internal affairs work as prescribed by law and as assigned or authorized by the Provincial People's Committee; implement regulations on preventing corruption and wastefulness; handle violations within the authority granted, or advise competent authorities to handle violations in the assigned fields as prescribed by law;
19. Provide professional guidance on internal affairs work and other assigned fields to administrative agencies, public service units under the province, People's Committees of districts and communes. Assist the Provincial People's Committee in performing state management functions in the assigned fields concerning organizations of central ministries and localities located within the province;
20. Aggregate and statistically analyze organizational structures of administrative agencies and public service units, number of district and commune administrative units, number of villages and residential wards, quantity and quality of cadres, civil servants, officials, commune-level civil servants, non-professional staff at the commune level, national archival work, religious work, commendation and reward work, youth work, and other assigned fields according to the guidelines of the Ministry of Home Affairs;
21. Organize research and application of scientific and technological advancements; build information and archival systems to serve state management and professional tasks;
22. Direct and guide the organization of public services activities in fields under the management of the Department of Home Affairs;
23. Perform information and periodic reporting duties to the Provincial People's Committee and the Ministry of Home Affairs on the implementation of assigned tasks as prescribed by law;
24. Manage organizational structure, civil servant quota, job grade structure, position staffing, vocational cadre structure, and number of workers in units under the Department of Home Affairs; manage files and decisions regarding recruitment, acceptance, utilization, appointment, reappointment, transfer, detail assignment, salary increment, job grade promotion, job change, career title change, evaluation, reward, punishment, training, and other systems and policies for civil servants, officials, and employees under the Department of Home Affairs' jurisdiction as prescribed and as assigned or authorized by the Provincial People's Committee;
25. Manage and be responsible for financial resources and assets allocated according to the law and as assigned, delegated, or authorized by the Provincial People's Committee;
26. Specify the working relationships and responsibilities of heads of units under the Department of Home Affairs as prescribed by law;
27. Perform other tasks and powers assigned by the Provincial People's Committee, the Chairman of the Provincial People's Committee, and as prescribed by law.
Article 3. Director and Deputy Directors of the Department of Home Affairs
1. The Department of Home Affairs has a Director and not more than three Deputy Directors. For the Department of Home Affairs of Hanoi City and Ho Chi Minh City, there shall be a Director and not more than four Deputy Directors.
2. The Director of the Department of Home Affairs is the head of the Department of Home Affairs, responsible before the People's Committee, the Chairman of the People's Committee at the provincial level, and before the law for performing the functions, tasks, and powers of the Department of Home Affairs; implementing the responsibilities and tasks of the Director of the Department as stipulated in Article 7 of Decree No. 24/2014/NĐ-CP dated April 4, 2014 of the Government on the organization of specialized agencies under the People's Committees of provinces and centrally-run cities.
3. The Deputy Director of the Department of Home Affairs assists the Director of the Department in managing and directing certain aspects of work of units subordinate to the Department of Home Affairs; is responsible before the Director of the Department and before the law for the assigned tasks. In the absence of the Director of the Department, one Deputy Director is authorized by the Director to manage the activities of the Department of Home Affairs.
4. The Director and Deputy Directors of the Department of Home Affairs are appointed by the Chairman of the People's Committee at the provincial level according to the regulations of the Party and State.
5. Reappointment, dismissal, transfer, rotation, commendation, disciplinary action, resignation, retirement, and implementation of other policies for the Director and Deputy Directors of the Department of Home Affairs are decided by the Chairman of the People's Committee at the provincial level according to the regulations of the Party and State.
Article 4. Organizational Structure of the Department of Home Affairs
The Department of Home Affairs is organized uniformly throughout the country, including units subordinate to and directly under the Department as follows:
1. Units subordinate to the Department of Home Affairs:
a) Personnel Organization and Non-Governmental Organizations Division;
b) Civil Servants and Public Officials Division;
c) Local Administration Construction and Youth Work Division;
d) Administrative Reform Division;
đ) Department of Home Affairs Office;
e) Department of Home Affairs Inspectorate.
For the Department of Home Affairs of Hanoi City and Ho Chi Minh City: There is an additional unit subordinate to the Department of Home Affairs, which is the Non-Governmental Organizations and Youth Work Division; the name of the Division specified in Point a Clause 1 of this Article is the Personnel Organization and Non-Governmental Organizations Division; the name of the Division specified in Point c Clause 1 of this Article is the Local Administration Construction Division.
2. Units directly under the Department of Home Affairs:
a) Awards and Commendations Board;
b) Religious Board;
c) Archival Management Service.
3. For provinces and centrally-run cities that have not yet met the conditions to establish a Religious Board as prescribed, if they have a Religious Division, then the Religious Division is a unit subordinate to the Department of Home Affairs without independent legal status and does not have internal organizations subordinate to the Religious Division.
4. The Director of the Department of Home Affairs is responsible for issuing specific regulations on the functions, tasks, powers, and organizational structure of units subordinate to and directly under the Department of Home Affairs.
Article 5. Heads and Deputies of Heads of Units Subordinate to and Directly Under the Department of Home Affairs
1. The heads and deputies of heads of units subordinate to and directly under the Department of Home Affairs are appointed and dismissed by the Director of the Department of Home Affairs according to the regulations of the Party and State, except in cases where the Director of the Department of Home Affairs assigns concurrent positions as stipulated in Clause 5, Article 8 of this Circular.
2. The heads of units subordinate to and directly under the Department of Home Affairs (collectively referred to as heads) are responsible before the Director of the Department of Home Affairs and before the law for performing the assigned responsibilities and tasks and for carrying out the functions and tasks of the units they are responsible for.
3. The deputies of heads of units subordinate to and directly under the Department of Home Affairs (collectively referred to as deputies of heads) assist the heads in managing and directing certain aspects of work, are responsible before the Director of the Department of Home Affairs, before the heads, and before the law for the assigned tasks. In the absence of the head, the head authorizes one deputy to manage the activities of the unit.
The number of deputies of heads of units subordinate to and directly under the Department of Home Affairs is not more than two people; for the number of deputies of heads of units subordinate to and directly under the Department of Home Affairs of Hanoi City and Ho Chi Minh City, it is not more than three people.
4. Reappointment, dismissal, transfer, commendation, disciplinary action, resignation, retirement, and implementation of other policies for the heads and deputies of heads of units subordinate to and directly under the Department of Home Affairs are decided by the Director of the Department of Home Affairs according to the regulations, except in cases where the Director of the Department of Home Affairs assigns concurrent positions as stipulated in Clause 5, Article 8 of this Circular.
Article 6. Civil servants, officials, and employees in agencies and units under and directly subordinate to the Department of Home Affairs
1. Civil servants, officials, and employees in agencies and units under and directly subordinate to the Department of Home Affairs shall be responsible before the Director of the Department of Home Affairs, before the heads of agencies and units, and before the law for performing assigned tasks.
2. The civil servant establishment quota and the number of employees working in agencies and units under and directly subordinate to the Department of Home Affairs shall be decided by the Director of the Department of Home Affairs within the total civil servant establishment quota and the total number of employees working in the Department of Home Affairs that have been approved by the competent authority.
3. Recruitment, utilization, salary increment, job classification change, job grade appointment, job title change, transfer, reward, disciplinary action, retirement, and implementation of other policies and systems for civil servants, officials, and employees in agencies and units under and directly subordinate to the Department of Home Affairs shall be decided by the Director of the Department of Home Affairs according to the level of authority delegated or submitted to the Chairman of the People's Committee at the provincial level for consideration and decision in accordance with the provisions of the law.
4. Job assignment for civil servants and officials of the Department of Home Affairs must be based on job positions, qualification standards for civil servants and officials, taking into account their qualities, capabilities, and specialties, ensuring compliance with all legal regulations.
5. Based on the characteristics, nature, and actual workload at the local level, the Director of the Department of Home Affairs shall decide or delegate authority to the heads of subordinate agencies of the Department of Home Affairs to enter into labor contracts in accordance with the law to perform specific tasks and duties at the Department of Home Affairs and its subordinate agencies.
Article 7. Organization of Units under the Department of Home Affairs
1. Personnel, Establishment, and Non-Governmental Organizations Division.
The Personnel, Establishment, and Non-Governmental Organizations Division is an organization under the Department of Home Affairs, having the function of assisting the Director of the Department of Home Affairs in advising the Provincial People's Committee on state management regarding: Administrative organizational structure, public service organizations; civil servant establishment quotas, the number of employees working in public service organizations; associations and non-governmental organizations.
For the Department of Home Affairs of Hanoi City and Ho Chi Minh City, the Personnel and Establishment Division is an organization under the Department of Home Affairs, having the function of assisting the Director of the Department of Home Affairs in advising the Provincial People's Committee on state management regarding: Administrative organizational structure, public service organizations; civil servant establishment quotas, the number of employees working in public service organizations.
2. Civil Servants and Officials Division.
The Civil Servants and Officials Division is an organization under the Department of Home Affairs, having the function of assisting the Director of the Department of Home Affairs in advising the Provincial People's Committee on state management regarding: Cadres, civil servants, and officials; job positions, cadre and civil servant position structures; civil service system reform; training and capacity building for cadres, civil servants, and officials, including village-level cadres and civil servants; salary systems and incentives for cadres, civil servants, officials, and contractual employees in administrative agencies and public service organizations.
3. Local Government Construction and Youth Work Division.
The Local Government Construction and Youth Work Division is an organization under the Department of Home Affairs, having the function of assisting the Director of the Department of Home Affairs in advising the Provincial People's Committee on state management regarding: Local government administration, administrative boundaries; village-level cadres and civil servants; non-professional workers at the village level and youth work.
For the Department of Home Affairs of Hanoi City and Ho Chi Minh City, the Local Government Construction Division is an organization under the Department of Home Affairs, having the function of assisting the Director of the Department of Home Affairs in advising the Provincial People's Committee on state management regarding: Local government administration, administrative boundaries; village-level cadres and civil servants and non-professional workers at the village level.
4. Administrative Reform Division.
The Administrative Reform Division is an organization under the Department of Home Affairs, having the function of assisting the Director of the Department of Home Affairs in advising the Provincial People's Committee on state management regarding administrative reform work.
5. Department of Home Affairs Office.
The Department of Home Affairs Office is an organization under the Department of Home Affairs, having the function of advising and assisting the Director of the Department of Home Affairs on information work, activity coordination, and internal affairs of the Department of Home Affairs according to the program and plan, including: personnel organization; legal affairs; administrative reform, civil service system reform; gender equality; archives and records management; commendation and reward; finance, accounting, asset management, and administrative support.
6. Department of Home Affairs Inspectorate.
The Department of Home Affairs Inspectorate is an organization under the Department of Home Affairs, having the function of advising and assisting the Director of the Department of Home Affairs in conducting administrative inspections and specialized inspections, handling complaints and denunciations, and preventing corruption in accordance with the law.
The Department of Home Affairs Inspectorate is subject to the direction and management of the Director of the Department of Home Affairs; it is also subject to the direction on inspection work and guidance on administrative inspection procedures from the Provincial Inspectorate and specialized inspection procedures from the Ministry of Home Affairs Inspectorate.
7. The Non-Governmental Organizations and Youth Work Division of the Department of Home Affairs of Hanoi City and Ho Chi Minh City is an organization under the Department of Home Affairs, having the function of assisting the Director of the Department of Home Affairs in advising the Provincial People's Committee on state management regarding: Associations, non-governmental organizations, and youth work.
Article 8. Organization of subordinate agencies under the Department of Home Affairs
1. The Archive and Records Management Agency:
a) The Archive and Records Management Agency is an organization under the Department of Home Affairs, with the function of assisting the Director of the Department of Home Affairs to advise the Provincial People's Committee on state management of archives and records of the province; directly managing historical archival materials of the province and implementing archival service activities in accordance with the law;
b) The Archive and Records Management Agency is subject to the direction and management of organizational structure, staffing, and operations by the Department of Home Affairs, while also being subject to the direction and guidance on specialized matters and professional activities by the National Archive and Records Management Agency under the Ministry of Home Affairs.
2. The Commendation and Reward Board:
a) The Commendation and Reward Board is an agency equivalent to an agency under the Department of Home Affairs, with the function of assisting the Director of the Department of Home Affairs to advise the Provincial People's Committee on state management of commendation and reward work;
b) The Commendation and Reward Board is the permanent office of the Provincial Commendation and Reward Council, subject to the direction and management of organizational structure, staffing, and operations by the Department of Home Affairs, while also being subject to the direction and guidance on specialized matters and professional activities by the Central Commendation and Reward Board under the Ministry of Home Affairs.
3. The Religious Board:
a) The Religious Board is an agency equivalent to an agency under the Department of Home Affairs, with the function of assisting the Director of the Department of Home Affairs to advise the Provincial People's Committee on state management of religious affairs;
b) The Religious Board is subject to the direction and management of organizational structure, staffing, and operations by the Department of Home Affairs, while also being subject to the direction and guidance on specialized matters and professional activities by the Government Religious Board under the Ministry of Home Affairs; in necessary cases, the Head of the Religious Board may report and seek instructions directly from the Chairman of the Provincial People's Committee, and at the same time report to the Director of the Department of Home Affairs.
4. The Archive and Records Management Agency, the Commendation and Reward Board, and the Religious Board are subordinate agencies under the Department of Home Affairs, having legal personality, seals, and separate bank accounts; they have headquarters, means of operation, staffing, and operational funds provided by the state budget according to the law; they are responsible for managing their organizational structures, staffing, finances, and assets assigned; they are responsible for implementing regulations and policies for civil servants, officials, and employees under their authority according to the law and the delegation of the Director of the Department of Home Affairs.
5. Based on the nature, characteristics, and requirements of state management of religious affairs, commendation and reward work of each locality, the Director of the Department of Home Affairs may assign Deputy Directors of the Department of Home Affairs to concurrently serve as Heads of the Religious Board or Heads of the Commendation and Reward Board, but not exceeding the number of Deputy Directors of the Department of Home Affairs stipulated in Clause 1, Article 3 of this Circular.
6. Based on the workload, nature, and characteristics of state management of archive and record management, commendation and reward work, and religious affairs in the locality, the Director of the Department of Home Affairs decides specifically the number and names of organizations under the Archive and Records Management Agency, the Commendation and Reward Board, and the Religious Board to be appropriate and effective. The number of specialized departments under the Commendation and Reward Board and the Religious Board shall not exceed three departments. For the Archive and Records Management Agency, there shall be no more than two specialized departments and one public service unit, which is the Historical Archive Center.
7. Departments under the Archive and Records Management Agency, the Commendation and Reward Board, and the Religious Board have a Department Head, one Deputy Department Head, and civil servants performing specialized and professional tasks. Specifically, for departments under subordinate agencies of the Department of Home Affairs in Hanoi City and Ho Chi Minh City, there shall be a Department Head, no more than two Deputy Department Heads, and civil servants performing specialized and professional tasks.
Based on actual workload and the quota of civil servant staffing assigned, the head of a subordinate agency under the Department of Home Affairs may arrange deputy positions to concurrently hold the position of Head of a specialized department of a subordinate agency under the Department of Home Affairs.
8. The Historical Archive Center under the Archive and Records Management Agency is a public service institution, having legal personality, seals, and separate bank accounts. The Historical Archive Center has a Director, one Deputy Director, and officials performing specialized and professional tasks. Specifically, for the Historical Archive Center under the Archive and Records Management Agency of the Department of Home Affairs in Hanoi City and Ho Chi Minh City, there shall be a Director, no more than two Deputy Directors, and officials performing specialized and professional tasks.
The Archive and Records Management Agency under the Department of Home Affairs shall not arrange for a Deputy Director to concurrently hold the position of Director of the Historical Archive Center.
9. The appointment, reappointment, removal, transfer, commendation, disciplinary action, resignation, retirement, and implementation of other systems and policies for Department Heads and equivalents, Deputy Department Heads and equivalents in subordinate agencies under the Department of Home Affairs shall be carried out in accordance with the regulations of the Party and State and the delegation of management of cadres, civil servants, and officials by the Department of Home Affairs.
Chapter II
DEPARTMENT OF HOME AFFAIRS
Article 9. Position and Functions
1. The Civil Affairs Office is a specialized agency under the People's Committee at the district level with the function of advising and assisting the People's Committee at the district level to manage state administration in the following areas: organizational structure; job positions; civil servant staffing and rank structure in administrative state agencies; job positions, staff structure according to occupational titles and number of personnel working in public service units; salary for cadres, civil servants, public officials, and contractual workers in administrative agencies and public service units; administrative reform; local government; administrative boundaries; cadres, civil servants, public officials; village-level cadres and non-professional staff at the village level; associations, non-governmental organizations; state archives; religion; commendation and reward; youth work.
2. The Civil Affairs Office implements leadership and management over organization, job positions, civil servant staffing, rank structure, and operations of the People's Committee at the district level, while also implementing guidance, inspection, and direction on professional matters from the Provincial Civil Affairs Department.
Article 10. Duties and Authorities
1. Submit to the People's Committee and the Chairman of the People's Committee at the district level for issuance of decisions, directives; long-term, five-year, and annual planning; programs, measures to organize the implementation of state administrative reform tasks within the assigned scope of state management.
2. Implement legal documents, plans, and programs after approval; provide information, propaganda, dissemination, education, and monitoring of legal compliance in fields within the assigned scope of management.
3. Regarding organization and structure:
a) Submit to the People's Committee and the Chairman of the People's Committee at the district level for issuance of specific regulations on the functions, duties, authorities, and organization of the Civil Affairs Office as prescribed and guided by the Provincial People's Committee;
b) Advise and assist the People's Committee at the district level in submitting to competent authorities for decisions on establishing, merging, splitting, or dissolving specialized agencies under the People's Committee at the district level;
c) Review the content of draft regulations on the functions, duties, authorities, and organization of specialized agencies and public service units under the People's Committee at the district level;
d) Review proposals for establishing, restructuring, or dissolving public service units under the decision-making authority of the People's Committee at the district level as stipulated by law and according to the delegation of the Provincial People's Committee;
đ) Advise and assist the People's Committee at the district level in submitting to the Provincial People's Committee for decisions on establishing, restructuring, or dissolving public service units under the People's Committee at the district level as stipulated by specialized laws;
e) Review the establishment, consolidation, merger, or dissolution of inter-sectoral coordination organizations under the decision-making authority of the Chairman of the People's Committee at the district level as stipulated by law.
||| c) Based on the review opinions of the Ministry of Home Affairs, assist the Provincial People's Committee and the Chairman of the Provincial People's Committee in proposing the Provincial People's Council to approve the total number of personnel working in public service units; take the lead in advising and assisting the Provincial People's Committee in organizing implementation and inspecting the execution after approval by the Provincial People's Council;
a) Review and submit to the People's Committee and the Chairman of the People's Committee at the district level for approval of civil servant staffing plans and annual personnel staffing plans of agencies and public service units under the management authority of the People's Committee at the district level for submission to the Provincial People's Committee as prescribed;
b) Submit to the Chairman of the People's Committee at the district level for allocation of civil servant staffing and personnel staffing in public service units after approval by competent authorities;
c) Assist the People's Committee at the district level in guiding and inspecting the management and use of civil servant staffing and personnel staffing in public service units as prescribed by law;
d) Aggregate and report civil servant staffing and personnel staffing in agencies, administrative organizations, and public service units as prescribed by law.
5. Regarding management of job positions, civil servant and public official position structures:
a) Submit to the People's Committee at the district level for issuance of directives and guidance to agencies, organizations, and units under the People's Committee at the district level to manage the development of job position plans, civil servant and public official position structures, or adjustment plans for job positions and civil servant and public official position structures as prescribed by law and directed by the Provincial People's Committee;
b) Assist the People's Committee at the district level in urging, monitoring, reviewing, and aggregating the development of job position plans, civil servant and public official position structures, or adjustment plans for job positions and civil servant and public official position structures in agencies, organizations, and units under the management authority of the People's Committee at the district level for submission to the Provincial People's Committee for review; assist the People's Committee at the district level in aggregating lists of job positions and civil servant and public official position structures of the district for submission to the Provincial People's Committee as prescribed;
c) Submit to the People's Committee at the district level for implementation of the use and management of job positions and civil servant and public official position structures in agencies, organizations, and units under the People's Committee at the district level as prescribed, delegated, or authorized by the Provincial People's Committee.
6. Regarding construction of state power:
a) Advise and assist the People's Committee at the district level in organizing and guiding elections for National Assembly deputies and People's Council representatives at all levels on the territory as prescribed by law and directed by the Provincial People's Committee;
b) Assist the People's Committee at the district level in submitting to the People's Council at the district level for election, removal, or dismissal of the Chairman, Vice Chairmen, and other members of the People's Committee at the district level as prescribed by law;
c) Submit to the Chairman of the People's Committee at the district level for approval of election results, approval of removal or dismissal of members of the People's Committee at the commune level as prescribed. Submit to the Chairman of the People's Committee at the district level for appointment and reappointment of the Chairman, Vice Chairmen, and members of the People's Committee at the commune level where pilot projects are conducted without organizing a People's Council as prescribed;
d) Assist the People's Committee at the district level in submitting to the Chairman of the People's Committee at the provincial level for approval of election results, approval of removal or dismissal of members of the People's Committee at the district level as prescribed by law;
d) Assist the People's Committee at the district level to prepare for the Chairman of the People's Committee at the provincial level to appoint, reappoint the positions of Chairperson, Vice-Chairperson, and members of the People's Committee at the district level where the pilot program does not organize the People's Council as prescribed;
e) Develop and submit to the People's Committee at the district level proposals related to the establishment, dissolution, merger, division, adjustment of administrative boundaries, renaming of administrative units, and classification of administrative units within its jurisdiction for the People's Committee at the district level to submit to the competent authority for consideration and decision;
g) Advise and assist the People's Committee at the district level in guiding and organizing the implementation of projects and documents related to administrative boundary work and the classification of administrative units after approval by the competent authority;
h) Assist the People's Committee at the district level in managing files, markers, boundary lines, and administrative boundary maps of the district in accordance with the provisions of the law;
i) Advise and assist the People's Committee at the district level in guiding, inspecting, compiling, and reporting on the implementation of laws concerning democracy at communes, wards, towns, administrative agencies, public service units, enterprises within its jurisdiction, and the implementation of mass mobilization work by the authorities in accordance with the provisions of the law;
k) Advise and submit to the People's Committee at the district level proposals regarding guidance on the establishment, dissolution, merger, inspection, compilation, and reporting on the activities of village associations and residential area associations within the district in accordance with the provisions of the law; implement training programs for village chiefs and deputy chiefs in accordance with the provisions of the law;
l) Advise and assist the People's Committee at the district level in directing, guiding, and inspecting the People's Committees at the commune level in the development and implementation of documents and projects related to new rural construction work in accordance with the division of labor by the People's Committee at the district level and in accordance with the provisions of the law;
7. Regarding cadres, civil servants, and public officials; commune-level cadres and civil servants and non-professional staff at the commune level:
a) Submit to the Chairman of the People's Committee at the district level decisions on recruitment, utilization, management of job positions, transfer, appointment, reappointment, resignation, rotation, assignment, commendation, disciplinary action, evaluation, termination of employment, retirement, implementation of salary systems, incentives, and other policies and regulations for cadres, civil servants, and public officials under the management authority of the People's Committee at the district level in accordance with the law and the delegation of the People's Committee at the provincial level;
b) Implement personnel file management, training, and professional development for cadres, civil servants, and public officials, including commune-level cadres and civil servants, in accordance with the law and the delegated management authority of the People's Committee at the provincial level and the guidelines of the Department of Home Affairs;
c) Assist the People's Committee at the district level in the recruitment and management of commune-level civil servants; implement policies and regulations for commune-level cadres and civil servants and non-professional staff at the commune level in accordance with the law;
8. Regarding administrative reform, civil service system reform:
a) Submit to the People's Committee at the district level proposals for the implementation, supervision, and inspection of specialized agencies at the same level and People's Committees at the commune level in carrying out administrative reform and civil service system reform in their localities;
b) Submit to the People's Committee at the district level measures to promote administrative reform and civil service system reform in the district;
c) Carry out comprehensive reporting on administrative reform and civil service system reform in the locality in accordance with the law;
9. Assist the People's Committee at the district level in managing state administration over the organization and operation of associations, social funds, and charitable funds within its jurisdiction in accordance with the law and the authorization of the Chairman of the People's Committee at the provincial level;
10. Regarding archival work:
a) Guide and inspect the implementation of national and provincial regulations on archival work for agencies and organizations at the district and commune levels in accordance with the law;
b) Carry out reporting and statistical work on archival matters in accordance with the law;
11. Regarding competition and reward work:
a) Advise and propose to the People's Committee at the district level the organization of competitive movements and the implementation of reward policies of the Party and State within the district; serve as the standing body of the District Competition and Reward Council;
b) Guide, inspect, and urge the implementation of competition plans and reward content within the district; establish, manage, and utilize the Competition and Reward Fund in accordance with the law;
12. Regarding religious work:
a) Assist the People's Committee at the district level in directing, guiding, inspecting, and implementing the Party's policies and State laws on religion and religious work within the district;
b) Take the lead and coordinate with relevant agencies at the same level to carry out state management of religious affairs within the district in accordance with the delegation of the People's Committee at the provincial level and the law;
c) Advise and assist the People's Committee at the district level in resolving specific issues related to religion in accordance with the law and the guidelines of the Department of Home Affairs;
13. Regarding youth work:
a) Organize and implement legal documents, strategies, programs, and plans for youth development and youth work;
b) Guide, disseminate, educate, and resolve issues related to youth and youth work in accordance with the law and the delegation of authority; handle specific issues related to youth and youth work in accordance with the law and the delegation of authority;
c) Take the lead and coordinate with relevant agencies and other youth organizations to implement or propose to the competent authority mechanisms and policies for youth and youth work in accordance with the law;
14. Submit to the People's Committee at the district level for issuance of guiding documents on internal affairs within the district; provide professional guidance on internal affairs to agencies and units at the district level and People's Committees at the commune level.
15. Implement inspection, handle complaints, and process violations related to internal affairs work within the county's jurisdiction according to the authority or report to the competent authority for handling such violations as prescribed. Carry out anti-corruption, thrift, and waste prevention work according to the laws and the division of labor assigned by the provincial People's Committee.
16. Conduct statistical work, provide information, and report to the Chairman of the provincial People's Committee and the Director of the Provincial Department of Internal Affairs on the situation and results of implementing internal affairs work in the locality.
17. Organize the implementation and application of scientific and technological progress; build information and storage systems to serve state management of internal affairs work in the locality.
18. Manage job positions, civil servant quotas, and civil servant grade structures in the Internal Affairs Office according to the provisions of the law.
19. Manage and be responsible for the financial and property resources of the Internal Affairs Office according to the provisions of the law and the division of labor assigned by the provincial People's Committee.
20. Assist the provincial People's Committee in specifying the functions, tasks, and powers of the commune, ward, town People's Committees regarding internal affairs work and other areas of work assigned based on the provisions of the law and guidance from the Provincial Department of Internal Affairs.
21. Perform other tasks assigned by the provincial People's Committee or as prescribed by the law.
Article 11. Organization and Staffing
1. The Internal Affairs Office has a Director, not more than three Deputy Directors, and civil servants performing specialized and professional tasks:
a) The Director of the Internal Affairs Office is responsible before the provincial People's Committee, the Chairman of the provincial People's Committee, and the law for the performance of assigned functions, tasks, and powers and all activities of the Internal Affairs Office;
b) The Deputy Directors of the Internal Affairs Office assist the Director in managing and overseeing certain aspects of work; they are responsible before the Director and the law for the tasks assigned to them. When the Director is absent, one Deputy Director appointed by the Director can manage the office's activities;
c) The appointment, reappointment, transfer, detail assignment, evaluation, reward, punishment, removal, resignation, and implementation of other policies for the Director and Deputy Directors of the Internal Affairs Office are decided by the Chairman of the provincial People's Committee according to the regulations.
2. Staffing:
a) The staffing of civil servants in the Internal Affairs Office is decided by the Chairman of the provincial People's Committee within the total staffing quota of civil servants of the county approved by the competent authority;
b) The allocation of work for civil servants in the Internal Affairs Office must be based on job positions, civil servant grade standards, and the qualities, qualifications, and capabilities of the civil servants.
Chapter III
IMPLEMENTATION
Article 12. Transitional Provisions
1. For those Provincial Departments of Internal Affairs currently having more Deputy Directors than the number specified in this Circular, continue to maintain the current number of Deputy Directors to ensure stability. Additional Deputy Directors may only be appointed when the current number of Deputy Directors does not meet the number specified in this Circular.
2. For the Religious Affairs Board and the Commendation and Reward Board under the Provincial Department of Internal Affairs currently having more Deputy Heads than the number specified in this Circular, continue to maintain the current number of Deputy Heads to ensure stability and additional Deputy Heads may only be appointed when the current number of Deputy Heads does not meet the number specified in this Circular.
3. In cases where individuals have been appointed to head positions or deputy positions in units subordinate to the Provincial Department of Internal Affairs before the effective date of this Circular, if after restructuring and improving the organizational structure of the Provincial Department of Internal Affairs, they retain their leadership position or are appointed to a new position with a lower leadership allowance than the previous one, they shall be entitled to retain their previous leadership allowance according to Decision No. 140/2009/QD-TTg dated December 31, 2009 of the Prime Minister on retaining leadership allowances for leaders during organizational restructuring.
Article 13. Effective Date
1. This Circular takes effect from December 15, 2014.
2. This Circular replaces Circular No. 04/2008/TT-BNV dated June 4, 2008 of the Minister of Internal Affairs guiding the functions, tasks, powers, and organizational structure of the Provincial Department of Internal Affairs and the Internal Affairs Office under the provincial People's Committee; replaces Circular No. 06/2008/TT-BNV dated August 21, 2008 of the Minister of Internal Affairs guiding amendments and supplements to Clause 2, Section III, Part I of Circular No. 04/2008/TT-BNV dated June 4, 2008 of the Minister of Internal Affairs; replaces Circular No. 01/2010/TT-BNV dated April 16, 2010 of the Minister of Internal Affairs guiding the functions, tasks, powers, organization, and staffing of the Commendation and Reward Board under the Provincial Department of Internal Affairs under the provincial People's Committee; replaces Circular No. 04/2010/TT-BNV dated May 20, 2010 of the Minister of Internal Affairs guiding the functions, tasks, powers, organization, and staffing of the Religious Affairs Board under the Provincial Department of Internal Affairs under the provincial People's Committee; replaces Circular No. 04/2011/TT-BNV dated February 10, 2011 of the Minister of Internal Affairs guiding the supplementation of tasks, organization, and staffing of the Provincial Department of Internal Affairs and the Internal Affairs Office under the provincial People's Committee regarding youth work.
3. Abolish the provisions at Chapter 3 of Circular No. 02/2010/TT-BNV dated April 28, 2010 of the Minister of Internal Affairs guiding the functions, tasks, powers, and organization of the archives and record-keeping organizations of ministries, ministerial-level agencies, government agencies, and people's committees at all levels.
1. The Minister, Heads of Ministries equivalent to ministries, Heads of government agencies, Chairmen of provincial People's Committees under the central government, and related agencies, units, and individuals are responsible for implementing this Circular.
The provincial People's Committee and the Chairman of the provincial People's Committee are responsible for:
1. Directing and organizing the implementation of this Circular;
2. Deciding on the functions, tasks, powers, and organizational structure of the Provincial Department of Internal Affairs; Directing and inspecting the establishment, merger, division, and dissolution of units subordinate to the Provincial Department of Internal Affairs according to the guidance provided in this Circular.
3. Directing and guiding the district People's Committees to specify the functions, tasks, powers, and organizational structure of the Internal Affairs Office./.
