CIRCULAR

Guidelines for the tasks of the District Offices and affiliated public institutions

under the Department of Agriculture and Rural Development

Pursuant to Decree No. 24/2014/NĐ-CP dated April 4, 2014 of the Government on the organization of specialized agencies under provincial People's Committees and municipal People's Committees directly under the Central Government;

BASED ON THE DECREE NO. 199/2013/NĐ-CP OF NOVEMBER 26, 2013 OF THE GOVERNMENT PROVIDING FOR THE FUNCTIONS, TASKS, POWERS, AND ORGANIZATIONAL STRUCTURE OF THE MINISTRY OF AGRICULTURE AND RURAL DEVELOPMENT;

Pursuant to Decree No. 36/2012/NĐ-CP dated April 18, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Pursuant to Circular No. 14/2015/TTLT-BNNPTNT-BNV dated March 25, 2015 of the Ministry of Agriculture and Rural Development and the Ministry of Home Affairs guiding the functions, tasks, powers, and organizational structure of specialized agencies on agriculture and rural development under provincial and district People's Committees;

The Minister of Agriculture and Rural Development issues guidelines for the tasks of the District Offices and affiliated public institutions under the Department of Agriculture and Rural Development.

PART I
TASKS OF THE DISTRICT OFFICES UNDER THE DEPARTMENT OF AGRICULTURE AND RURAL DEVELOPMENT AND RURAL DEVELOPMENT

1. Assist the Director of the Department of Agriculture and Rural Development in drafting and submitting to competent authorities for promulgation legal instruments, plans, programs, projects, technical standards, procedures, and economic-technical norms concerning crop production, agricultural plant seeds, agricultural land use, organic fertilizers and other fertilizers, plant protection, plant quarantine, and management of plant protection chemicals at the local level.

2. Implement approved legal instruments, plans, programs, projects, technical standards, and economic-technical norms. Provide information, disseminate, and popularize laws related to the assigned areas of management.

3. Draft or submit for approval by the Director of the Department of Agriculture and Rural Development individual legal instruments within the scope of work managed by the District Office.

4. Regarding crop production:

a) Implement annual and seasonal crop production plans; lead and evaluate the implementation of these plans;

b) Implement approved concentrated crop production area planning;

c) Guide, inspect, and implement safe production procedures, apply technological advancements, and promote good agricultural practices (GAP) in the locality;

d) Organize training and issue certificates to producers for safe vegetable, fruit, and tea production; assess and submit applications to the Director of the Department for certification and public announcement of food safety compliance;

đ) Guide, inspect, and implement crop and seed variety restructuring according to planting seasons in the locality;

e) Implement measures to mitigate natural disasters in crop production.

5. Regarding seed management:

a) Guide seed structure and usage; manage and exploit mother plants and mother plant gardens; apply technology and scientific advancements in seed management within the crop production sector in the locality;

b) Monitor and supervise seed trials, experimental production, and propose recognition of new varieties;

c) Propose recognition, reissuance, or revocation of mother plant and mother plant garden recognition certificates; report and publicly announce according to regulations;

d) Guide and inspect the issuance of identification codes for organizations and individuals producing and trading agricultural seeds; manage and guide organizations and individuals participating in household seed production in the locality;

đ) Guide and inspect the implementation of state management regulations regarding seeds.

6. Regarding fertilizer management:

a) Forecast demand and develop annual fertilizer usage plans for the locality;

b) Monitor, supervise, evaluate the results of new fertilizer trials; accept and publish conformity declarations for organic and other fertilizers from organizations and individuals as prescribed; c) Guide the correct and efficient use of fertilizers, ensuring food safety and minimizing environmental pollution.

7. Regarding agricultural land use management:

a) Manage and implement effective land use plans and solutions to protect and prevent soil erosion, enhancing soil fertility for agricultural production;

b) Guide the construction and assessment of surface soil utilization plans;开荒并翻译剩余的内容

b) Guide the development and review of plans for using surface soil layers; plans for reclamation, revitalization, and improvement of rice cultivation land and other crop cultivation land;

c) Guide the development and implementation of plans to adjust the structure of crops and aquaculture on rice fields;

8. On plant protection:

a) Organize the implementation of surveys, experimental investigations, detection, forecasting the time of occurrence, scope, and severity of damage caused by plant pests within the province; promptly report and propose policies, technical measures to prevent and control plant pests. Establish, maintain a system for investigation, detection, warning, database, and preventive measures against plant pests;

b) Inspect, verify, and advise the Director of the Department of Agriculture and Rural Development to report to the Provincial People's Committee to decide on declaring a pest outbreak and declaring the end of a pest outbreak according to the laws on plant protection and quarantine;

c) Advise local authorities and management agencies on organizing, directing, and policies for preventing and controlling plant pests;

d) Receive, process information, and guide measures for handling plant pests reported by plant owners, organizations, and individuals;

đ) Propose measures to mitigate the consequences caused by natural disasters and pest outbreaks to restore agricultural production and stabilize people's lives;

9. On plant quarantine:

a) Investigate pests of stored plant products in warehouses; monitor and evaluate pests of planting materials, beneficial organisms imported from abroad; monitor regulated articles, pest foci, and pest-infested areas under regulation;

b) Inspect and monitor consignments of regulated articles from pest-infested areas or passing through such areas according to the law;

c) Organize and manage the fumigation of locally stored plant products according to the law;

10. On management of plant protection chemicals:

a) Implement management of production, trade, use, storage, transportation, advertising, and recall of plant protection chemicals within the jurisdiction; accept declarations of conformity regarding plant protection chemicals from organizations and individuals as prescribed;

b) Guide the collection and disposal of packaging materials of plant protection chemicals after use in accordance with regulations;

c) Guide and inspect the use of plant protection chemicals on crops in accordance with regulations.

11. Issue, reissue, extend, and revoke certificates, licenses, and professional certificates, and collect fees and charges as prescribed by law. 12. Organize and implement food safety management, environmental protection activities in crop cultivation and plant protection fields according to the division of labor by the Department Director and relevant laws.

13. Advise the Department Director on managing local reserves of agricultural crop seeds, plant protection chemicals, and goods in the crop cultivation and plant protection fields after approval by the provincial People's Committee.

14. Develop, submit for approval, and implement basic research projects on crop varieties, conservation of crop varieties; conduct surveys, statistics, and manage databases on crop cultivation and plant protection within the province.

15. Carry out agricultural extension work on crop cultivation and plant protection according to the division of labor by the Department Director; experiment and transfer application of scientific and technological advancements in crop cultivation and plant protection into production.

16. Provide technical services related to crop cultivation and plant protection within the province in accordance with the law.

17. Conduct inspection and supervision; handle complaints and accusations; prevent and combat corruption and malpractice, and deal with violations of laws in the field of crop cultivation and plant protection within the province as prescribed.

18. Implement international cooperation in areas under the management scope as delegated by the Department of Agriculture and Rural Development and as prescribed by law.

19. Implement reporting and regular or urgent situation updates on crop cultivation, plant protection, and other related activities at the local level as required by direct supervisory agencies and higher specialized agencies; update, store, and utilize databases on crop cultivation and plant protection as prescribed to serve directive work; summarize and evaluate crop cultivation and plant protection activities within the province.

20. Organize and implement administrative reform tasks; manage organizational structure, staffing, number of employees, finance, and assets assigned according to the delegation of the Department of Agriculture and Rural Development and relevant laws. Implement contracts and guide and manage grassroots-level crop cultivation and plant protection technical staff as prescribed by law.

21. Perform other tasks as prescribed by law and assigned by the Department Director of Agriculture and Rural Development.

Duties of the Livestock and Veterinary Service Bureau

2. Implement regulatory legal documents, strategies, plans, programs, projects, standards, technical norms, procedures, regulations, economic-technical quotas concerning livestock breeding and veterinary medicine that have been approved; disseminate and promote laws concerning the specialized and managed fields.

3. Submit to the Department Director of Agriculture and Rural Development for issuance or issue independently according to authority individual documents concerning the specialized and managed fields.

4. Regarding guidance on livestock breeding production:

a) Advise and assist the Department Director of Agriculture and Rural Development in guiding livestock breeding production, disease prevention, and disaster recovery for livestock breeding; develop, organize implementation, and summarize and evaluate annual livestock breeding production plans;

b) Develop livestock breeding planning linked to slaughterhouses, processing facilities, and product preservation systems in the locality;

c) Develop and organize implementation of livestock breeding procedures applicable within the province. Inspect and audit livestock production facilities certified with VietGAP and activities of certification bodies designated to certify VietGAP for livestock breeding; resolve complaints related to VietGAP certification for livestock breeding within the locality as prescribed by law; train VietGAP for organizations and individuals engaged in production and preliminary processing within the locality;

d) Organize implementation of programs and plans for quality and safe food production activities in the livestock breeding field;

đ) Propose plans for construction and development of safe livestock breeding zones;

e) Supervise, inspect, and guide the implementation of management regulations for safe livestock production facilities; technical standards and norms for safe livestock production ensuring food safety.

5. Regarding management of livestock breeds:

a) Implement planning and development of livestock breeds suitable for the overall socio-economic development plan of the locality;

b) Participate in managing the livestock genetic fund and microorganisms used in livestock breeding as prescribed by law;

c) Participate in managing livestock breed trials as prescribed;

d) Implement management according to regulations on permitted lists of livestock breeds for production and trade; rare livestock genetic resources requiring conservation; prohibited export lists of rare livestock breeds within the jurisdiction;

đ) Urge and guide the implementation of conformity declarations, conformity announcements, and establishment of local standards in the livestock breed sector within the jurisdiction;

e) Accept registration files, issue acceptance announcements for conformity declarations, establish tracking and management registers for conformity declaration files in the livestock breed sector under the management of the Department of Agriculture and Rural Development;

g) Issue certificates of free circulation (CFS) for livestock breeds (including embryos, semen, livestock breeding animals); environments for mixing and preserving livestock embryos and semen for export.

g) Issue certificates of free sale (CFS) for livestock breeding stock (including embryos, semen, and livestock breeding stock); breeding environments for livestock semen and embryos for export;

h) Organize the implementation of plans, manage, and use the disaster prevention fund for livestock breeds within the province in accordance with regulations;

i) Organize the implementation of annual plans for the appraisal and selection of livestock breed herds within the province; guide specialized agencies at the district level to organize the implementation of the appraisal and selection of livestock breed herds within the province.

6. On feed management for livestock:

a) Organize the implementation of plans for the development and utilization of livestock feed in the locality after approval by the competent authority; guide the effective use of livestock feed without causing environmental pollution;

b) Organize the implementation of policies to encourage and create conditions for enterprises within the locality to improve the quality and competitiveness of livestock feed, programs to enhance productivity, quality, and competitiveness of livestock feed in the locality;

c) Supervise the testing activities of livestock feed within the locality;

d) Urge and guide the implementation of conformity certification, declaration of conformity, and standard announcement in the field of livestock feed within the locality; accept registration files, issue acceptance notifications for conformity declarations, establish tracking and management registers for conformity declaration files in the field of livestock feed within the locality;

đ) Manage livestock feed items listed in the permitted circulation list of livestock feed in Vietnam within the locality in accordance with regulations;

e) Organize the implementation of management of prohibited substances in production, import, circulation, and use in the production and business of livestock feed in the locality;

g) Issue certificates of free circulation (CFS) for livestock feed for export.

7. On livestock environment:

a) Organize the implementation of programs, plans, and tasks on environmental protection in livestock farming; periodically organize assessments of the current environmental status in livestock farming;

b) Organize the review and submit to the competent authority for approval environmental impact assessment reports in livestock farming within the locality in accordance with the law;

c) Develop and guide the implementation of measures to handle waste and protect the environment in livestock farming;

d) Guide, supervise, and inspect the implementation of environmental control work in livestock farming;

đ) Supervise and inspect the implementation of national standards and technical regulations on the environment in livestock production within the locality;

e) Urge and guide the implementation of conformity certification, declaration of conformity, and standard announcement in the field of livestock environment and biological products serving livestock farming within the locality; accept registration files, issue acceptance notifications for conformity declarations, establish tracking and management registers for conformity declaration files in the field of livestock environment and biological products serving livestock farming in accordance with the law;

8. Prevention and control of animal diseases, aquatic animal diseases (hereinafter referred to as animal diseases):

a) Organize inspections and supervision of the implementation of projects, programs to control and eliminate animal diseases; disease surveillance programs from animals to humans; plans for the prevention and control of animal diseases and compile, report on the results of implementation;

b) Periodically or randomly inspect animal diseases listed in the mandatory inspection list according to the regulations of the Ministry of Agriculture and Rural Development at livestock farms, breeding facilities within the province (excluding livestock farms managed by the central government, national breeding facilities, breeding facilities with foreign investment);

c) Organize inspections and supervision of the implementation of vaccination plans against compulsory diseases according to the regulations of the Ministry of Agriculture and Rural Development;

d) Carry out diagnosis, testing, and treatment of animal diseases; inspect and supervise the implementation of regulations on the prevention and control of animal diseases; investigate, monitor, and detect outbreaks of animal diseases; guide quarantine, outbreak handling, disinfection, and recovery of livestock and aquaculture environments after the end of the disease;

đ) Guide preventive and control measures for animal diseases; guide the veterinary network at communes, wards, towns (hereinafter referred to as commune-level veterinary services) to monitor, detect, prevent, and handle new outbreaks and control existing outbreaks;

e) Report to the Department of Agriculture and Rural Development to request the Chairman of the Provincial People's Committee to declare an outbreak and announce the end of an animal disease outbreak in accordance with the law;

g) Coordinate with forestry management agencies under the Department in assessing hygiene conditions and monitoring the disease situation of wildlife breeding facilities within the province;

h) Supervise the activities of individuals and organizations practicing veterinary medicine within the province and report on their practice activities in accordance with regulations;

i) Require individuals and organizations practicing veterinary medicine to provide information on the disease situation and mobilize individuals and organizations practicing veterinary medicine within the province to participate in vaccinating animals against diseases and combat animal disease outbreaks in accordance with regulations;

k) Manage and use materials and chemicals for disease prevention and control from national reserves, local sources, and other sources;

9. Establishing disease-free zones and safe premises for animal diseases:

a) Advise and assist the Director of the Department of Agriculture and Rural Development to submit to the Provincial People's Committee for approval projects, programs, and plans to establish disease-free zones and safe premises for animal diseases within the province;

b) Fulfill the responsibilities of the state management agency for veterinary affairs regarding disease-free zones and safe premises for animal diseases in accordance with the regulations of the Ministry of Agriculture and Rural Development;

10. Animal quarantine, product quarantine; slaughterhouse control; veterinary hygiene inspection:

a) Implement quarantine of animals and animal products circulating domestically; control transportation of animals and animal products transported at border quarantine stations; manage and supervise imported animals and animal products after quarantine isolation period;

b) Quarantine animals and animal products for export, import, temporary import for re-export, temporary export for re-import, transshipment, and transit through Vietnam's territory at authorized border gates in accordance with the law;

c) Organize the implementation of animal slaughter control; manage and supervise establishments involved in preliminary processing, manufacturing, packaging, preservation, and domestic sales of animal products.

d) Inspect veterinary hygiene for fresh, preliminarily processed, and manufactured animal products circulating in the market; livestock feed and raw materials for livestock feed originating from animals; animal waste at concentrated livestock farms, quarantine isolation facilities, collection, slaughterhouses, and establishments involved in preliminary processing, manufacturing, preservation, and domestic sales of animal products under its jurisdiction.

e) Inspect veterinary hygiene conditions and issue veterinary hygiene certificates for disease-safe regions and establishments according to the authority delegated by the Department of Animal Health; concentrated livestock farms; establishments producing and trading in breeding stock (excluding those managed centrally and national breeding stock establishments); slaughterhouses; establishments involved in preliminary processing, manufacturing, packaging, and preservation of animal products for domestic consumption; establishments and stores trading in live animals and fresh, preliminarily processed animal products; establishments producing livestock feed and raw materials for livestock feed originating from animals; establishments and areas for concentrated, isolated quarantine of animals and animal products.

f) Inspect veterinary hygiene conditions; guide and supervise or directly implement sanitation, disinfection, and decontamination at locations where animals and animal products participate in exhibitions, sports, and artistic performances.

g) Guide and supervise or directly implement sanitation, disinfection, and decontamination for establishments related to veterinary activities, transportation vehicles, containers holding animals and animal products, and animal waste; handle animals and animal products that do not meet veterinary hygiene standards; handle waste, transportation vehicles, and items related to animals and animal products that do not meet veterinary hygiene standards.

h) Issue and revoke animal quarantine uniforms; revoke animal quarantine officer cards and animal quarantine signs in accordance with regulations.

i) Coordinate with units under the Department of Animal Health to appraise locations and veterinary hygiene conditions during the construction of export-oriented slaughterhouses, preliminary processing, manufacturing, packaging, and preservation establishments of animal products; quarantine isolation zones for imported and exported animals.

11. Manage veterinary drugs, biological preparations, microorganisms, and chemicals (hereinafter referred to as veterinary drugs) used in veterinary practices, excluding products for treating and improving aquaculture environments:

a) Manage the business and use of veterinary drugs within the province in accordance with the law.

b) Guide the use of various types of veterinary drugs for disease prevention, treatment, and control; announce lists of permitted, restricted, and prohibited veterinary drugs in circulation according to the law.

c) Appraise veterinary hygiene conditions for veterinary drug testing and trial establishments and monitor the testing and trial processes according to regulations.

d) Inspect and issue certificates of eligibility for retail outlets and agents selling veterinary drugs within the province.

e) Handle counterfeit, substandard, banned, unlisted veterinary drugs in Vietnam's permitted list, or those without labels or with incorrect labels as stipulated by the law.

12. Manage fees and charges; issue and revoke veterinary practice licenses and certificates as follows:

a) Vaccination, laboratory testing (including non-clinical testing), disease diagnosis, prescription writing, treatment, and animal health care;

b) Animal surgery;

c) Veterinary drug trade;

d) Consulting services and other activities related to veterinary practices;

e) Issue and revoke veterinary-related certificates according to the law;

f) Organize the management of fee and charge collection and utilization according to the law.

13. Conduct training and professional skill enhancement for civil servants, employees engaged in animal husbandry and veterinary work at the commune level, and individuals and organizations involved in such activities within the province.

14. Implement technical services in animal husbandry and veterinary practices as prescribed by law.

15. Implement international cooperation and trade promotion activities in animal husbandry and veterinary practices as prescribed; research and apply scientific and technological advancements in animal husbandry and veterinary practices; conduct specialized reviews of programs and projects in these fields within the province as prescribed by law. on the territory according to the law.

16. Perform specialized inspection functions in animal husbandry and veterinary practices as prescribed by law. Resolve disputes, complaints, accusations, and prevent corruption and wastefulness in these fields.

17. Report regularly and urgently on the situation of animal husbandry and veterinary production as guided by the Livestock Production Department and the Department of Animal Health.

18. Organize the implementation of administrative reform activities; manage organizational structure, staffing, job positions, civil servants, financial resources, assets, and other assigned resources according to the classification of the Provincial Department of Agriculture and Rural Development and the law.

19. Perform other tasks as prescribed by law and assigned by the Director of the Provincial Department of Agriculture and Rural Development.

1. Regarding forest management:

a) Advise and assist the Director of the Provincial Department of Agriculture and Rural Development in submitting to competent authorities for approval normative legal documents, strategies, plans, programs, projects, standards, technical regulations, procedures, norms, and economic-technical quotas concerning the specialized field and sector under their jurisdiction;

b) Implement approved normative legal documents, strategies, plans, programs, projects, standards, technical regulations, procedures, norms, and economic-technical quotas concerning forestry; provide information, promote, and disseminate laws concerning the specialized field and sector under their jurisdiction;

c) Submit to the Director of the Provincial Department of Agriculture and Rural Development for issuance or issue according to their authority normative documents concerning the specialized field and sector under their jurisdiction.

2. Regarding forest development:

a) Guide, inspect the implementation of planning, plans, programs, projects on afforestation, forest improvement, natural regeneration promotion, nurturing, and enriching forests;

b) Guide, inspect the implementation of standards, norms, procedures, regulations, economic-technical quotas on afforestation, forest improvement, natural regeneration promotion, nurturing, and enriching forests;

c) Review and submit to competent authorities for approval projects on forest protection and development, forestry demonstration models, non-timber forest product development according to laws;

d) Implement scattered tree planting work within the province;

đ) Monitor, compile, and report on the results of forest protection and development projects;

3. Regarding forest tree seedlings:

a) Guide, inspect the implementation of planning and developing the system of seedling gardens and forest seedling areas within the province;

b) Advise the Director of the Department of Agriculture and Rural Development on managing seeds, seed sources, forest tree seedling gardens; organize the selection and recognition of mother trees, leading trees, and forest seedling areas within the province. Develop plans, measures, guide, inspect, and be responsible for producing forest tree seedlings according to regulations;

4. Regarding forest utilization:

a) Advise on building, submitting to competent authorities for approval, and guiding, inspecting the implementation of plans for natural forest management, sustainable forest management, timber harvesting plans, other forest products, and forest product processing;

b) Review and submit to the Director of the Department of Agriculture and Rural Development for approval design documents for natural forest timber harvesting, thinning of planted forest timber, and resin tapping according to regulations;

c) Guide, inspect the implementation of policies, programs, plans regarding payments for forest environmental services;

5. Nature conservation:

a) Guide, inspect the construction of special-use forests and protective forests within the area;

b) Advise on managing special-use forests, biodiversity conservation, endangered, precious, rare plant and animal species according to laws;

c) Guide, inspect handling violations in activities of breeding, artificial planting of wild animals and plants, and protecting forest environment according to laws;

d) Guide, inspect nature conservation; environmental education linked with communities in nature reserves;

6. Forest protection:

a) Advise the Director of the Department to mobilize armed forces units; mobilize personnel and equipment from organizations and individuals stationed in the area to promptly prevent and rescue forest fires and serious deforestation when necessary and urgent situations arise;

b) Organize the implementation of measures against illegal logging and other unlawful acts that harm forests and forest land;

c) Forecast forest fire risks; build specialized firefighting forces; inventory and census forests and forest land; participate in preventing and controlling forest pests;

d) Protect special-use forests and protective forests under local management;

đ) Coordinate forest protection activities with forest protection forces of forest owners and community forest protection forces in the area;

7. Ensuring compliance with laws on forest protection and development at the local level:

a) Guide, inspect the implementation of state management responsibilities over forests and forest land within the area;

b) Organize the implementation of administrative violation handling, punishment activities; initiate and investigate criminal cases involving violations of forest management, forest protection, and forest product management laws;

c) Protect the rights and legitimate interests of forest owners when their forests are infringed upon;

8. Building forces and propaganda:

a) Train and enhance professional knowledge, policies, and laws for forestry civil servants, employees, and organizations and individuals involved in forestry activities within the area;

b) Issue, manage uniforms, insignia, badges, signs, flags, forest inspection cards, military weapons, support tools, specialized equipment of local forest inspectors; seals for administrative violation handling in forest management and forest product management fields according to laws;

9. Organize the implementation of forestry technical services according to laws; organize eco-tourism activities consistent with special-use forest planning and laws;

10. Implement international cooperation, scientific research, and application of advanced technology in forest protection and development within the area according to laws;

11. Conduct specialized forestry inspections according to laws. Resolve disputes, complaints, denunciations, and anti-corruption efforts in the forestry field; implement regular and ad hoc reporting as prescribed;

12. a) Investigate and assess fishery resources; provide information on fishing ground forecasts, fishing areas, seasons, and fishing periods according to laws;

b) Organize production and occupational restructuring in fishing activities; guide disaster prevention and mitigation in fishing operations;

c) Manage fishing vessel activities within the jurisdiction according to the laws and分级管理规定；采取措施确保从事捕捞作业的人员和渔船的安全；

d) Guide, inspect, organize the implementation of national standards, national technical regulations, technical norms, economic and technical quotas; provisions on the classification management of fishing vessels, fish ports, fish wharfs, primary fish markets, fishing areas, fishing routes, anchorage zones for fishing vessels to withstand typhoons, registration, and inspection of fishing vessels within the provincial jurisdiction under the scope of administrative management assigned;

đ) Guide and inspect the implementation of the fishing zone regime in rivers, lakes, lagoons, swamps, and other natural water bodies within the provincial jurisdiction according to the guidance of the Ministry of Agriculture and Rural Development;

7. Regarding the conservation and development of aquatic resources:

a) Promote and disseminate legal provisions regarding the list of aquatic species that need to be conserved, protected, and replenished; measures to protect the environment of aquatic ecosystems, conserve genetic funds, and aquatic biodiversity; the list of aquatic species recorded in the Red Book of Vietnam and other prohibited or temporarily prohibited from fishing; regulations on fishing methods, occupations, means, seasons, and areas to protect and develop aquatic resources;

b) Guide and inspect the implementation of the provincial People's Committee's decision on establishing marine conservation areas and inland water conservation areas; management regimes of marine conservation areas and inland water conservation areas managed by localities within the provincial jurisdiction according to the guidance of the Ministry of Agriculture and Rural Development;

c) Guide the establishment and management of species conservation areas, habitats, and natural resource reserves; provisions on criteria for classifying species conservation areas, habitats, and natural resource reserves according to the level of authority; organize the management of conservation areas of national and international importance according to the law;

8. Regarding guidance on aquaculture production:

a) Guide the season, objects, and structure of aquaculture at the local level, production procedures, harvesting, coordination with relevant agencies to regulate water for aquaculture; participate in implementing prevention, control, and remediation of diseases in aquaculture;

b) Guide and inspect the implementation of production and business conditions, product quality according to regulations;

c) Statistics, inspect, evaluate, classify, and announce inspection results according to regulations to serve traceability of products;

d) Implement VietGap and good farming practices in aquaculture, number and implement traceability of aquaculture products within the provincial jurisdiction according to the law;

đ) Appraise investment projects in aquaculture, leasing, extension, and recovery of land and water surfaces for aquaculture according to the law;

e) Guide and inspect the production of aquatic seedlings according to the law. Coordinate with relevant agencies to implement disease prevention and control measures in aquaculture according to the law;

9. Regarding aquatic seedlings:

a) Guide and inspect seedling production and trading entities to comply with production and trading conditions and seedling quality requirements;

b) Statistics, inspect, evaluate, classify, and announce inspection results of seedling production and trading entities according to regulations;

c) Inspect and supervise seedling quality;

d) Implement traceability and quality management of aquatic seedlings within the provincial jurisdiction according to the law;

10. Regarding feed, raw materials, and feed supplements for aquaculture:

a) Guide feed production and trading entities to comply with production and trading conditions and feed quality requirements;

b) Statistics, inspect, evaluate, classify, and announce inspection results of feed production and trading entities according to regulations;

c) Inspect feed quality and production and trading activities within the provincial jurisdiction according to the law;

d) Implement traceability management of products in feed production and trading within the provincial jurisdiction according to the law;

11. Regarding environmental management in aquaculture and treatment and improvement products for aquaculture environments:

a) Guide entities producing and trading environmental treatment and improvement products for aquaculture to comply with production and trading conditions and feed quality requirements;

b) Statistics, inspect, evaluate, classify, and announce inspection results of entities producing and trading environmental treatment and improvement products for aquaculture according to regulations;

c) Inspect the quality of environmental treatment and improvement products for aquaculture and production and trading activities within the provincial jurisdiction according to the law;

d) Implement traceability management of products in the production and trading of environmental treatment and improvement products for aquaculture within the provincial jurisdiction according to the law;

đ) Manage the environment and water quality in aquaculture areas, carry out monitoring and warning tasks for aquatic disease environments;

e) Coordinate with relevant agencies to organize the implementation of quality control and food safety hygiene;

12. Issue, reissue, extend, and revoke certificates, licenses, and certificates and collect fees and charges within the jurisdiction of the Inspection Office according to the law;

13. Conduct inspections, handle complaints and reports; prevent and combat corruption and handle violations of fisheries laws according to the law; coordinate with fishery patrol forces to implement patrol, inspection, supervision, detection, and handling of violations of the law and specialized fisheries inspections;

14. Organize the implementation of international cooperation activities in fisheries according to regulations; research and implement the application of scientific and technological progress in fisheries; coordinate to implement disaster prevention and control. Adhere to reporting, statistical systems or when there are urgent requests from the General Fisheries Administration, Director of the Department of Agriculture and Rural Development.

15. Implement administrative reform tasks; manage organizational structure, staffing, job positions, civil servants, public officials, finance, assets, and other resources assigned according to the分级权限的市农业和农村发展局局长的规定和法律规定。

16. Perform other tasks as prescribed by law and assigned by the Director of the Department of Agriculture and Rural Development.

2. Implement regulatory legal documents, strategies, plans, programs, projects, standards, technical norms, procedures, regulations, economic-technical quotas concerning livestock breeding and veterinary medicine that have been approved; disseminate and promote laws concerning the specialized and managed fields.

2. Implement legal normative documents, strategies, plans, programs, projects, standards, technical regulations, procedures, norms, economic-technical quotas concerning water resources management, dyke management, disaster prevention and mitigation, rural clean water within the scope of provincial state management after approval; disseminate and popularize laws related to the specialized field under its jurisdiction.

4. Regarding guidance on livestock breeding production:

4. Conduct investigations, statistics, and manage databases on water resources management, dyke management, disaster prevention and mitigation, and rural clean water within the province in accordance with the law.

5. Regarding the exploitation, utilization, and protection of water conservancy works:

a) Advise and submit to the competent authority for issuance operation procedures and safety assurance schemes for water conservancy works under provincial state management; guide and inspect implementation after approval;

b) Implement comprehensive, economical, safe, and effective exploitation and utilization of water from water conservancy works; resolve disputes arising in accordance with the law;

c) Advise the Department and submit to the competent authority for issuance, revocation, extension of permits for activities requiring permission within the protected area of water conservancy works and discharging wastewater into the water conservancy system in accordance with the law;

d) Be a member of the handover council for water conservancy works; review, examine, or participate in reviewing new construction, repair, and upgrade projects of water conservancy works upon assignment by the competent authority;

đ) Review projects for regular maintenance and repair of water conservancy works;

e) Detect, prevent, and coordinate with local authorities in handling violations related to the exploitation, utilization, and protection of water conservancy works.

6. Regarding rural clean water work:

a) Guide and manage the exploitation, utilization, and protection of rural clean water works; cooperate in reviewing, adjusting, supplementing, and preparing economic-technical reports for investment construction, upgrading, and repair projects of rural clean water works as assigned by the Director of the Department of Agriculture and Rural Development;

b) Be a member of the handover council for rural clean water works in the province. Participate in reviewing new construction, repair, and upgrade projects of rural clean water works.

7. Regarding dyke management:

a) Implement planning, investment construction, repair, reinforcement, protection, and utilization of dykes and embankments; plans and solutions for preventing and mitigating riverbank and coastal erosion within the scope of management;

b) Carry out dyke protection work, handle technical issues of dyke accidents, coordinate with relevant sectors and localities to propose measures to prevent, avoid, handle, and mitigate the consequences of dyke accidents. Propose solutions to mobilize resources for rescue and protect dykes and ensure the safety of residents when dyke collapse occurs;

c) Advise the Director of the Department of Agriculture and Rural Development on licensed activities related to dykes as prescribed; guide localities in organizing people's dyke management forces;

d) Organize the marking of boundary markers on-site and develop plans and measures for relocating structures and residences related to the protected areas of dykes and riverbanks as prescribed;

đ) Guide, inspect, and be responsible for the construction, exploitation, and protection of dykes, protection of flood and storm prevention works; develop plans, measures, and organize the implementation of flood and storm prevention, bank erosion control along rivers and coasts within the jurisdiction;

e) Monitor all investment funds for the repair, reinforcement, maintenance, and repair of dyke and flood prevention works; implement development, repair, and maintenance plans for dykes and manage their implementation after approval by the competent authority;

g) Manage and inspect the use of reserve materials and equipment for flood and storm prevention;

h) Organize evaluations of the current status of dykes, warn areas at risk of erosion, flash floods, flooding, and propose measures to prevent, handle, and mitigate the consequences of accidents;

i) Detect, prevent, and coordinate with local authorities in handling violations of the Dyke Law;

k) Perform tasks, powers, and responsibilities stipulated in Article 38, Article 39, and Article 40 of the Dyke Law and Clause 2, Article 7 of Decree 113/2007/NĐ-CP detailing and guiding the implementation of certain provisions of the Dyke Law.

8. Regarding disaster prevention, mitigation, and water damage prevention:

a) Advise and submit to the Director of the Department of Agriculture and Rural Development measures to mobilize resources, materials, and means to prevent, combat, and mitigate the consequences of typhoons, floods, droughts, waterlogging, saline intrusion, erosion, and other natural disasters and water pollution; handle accidents in water conservancy works and dykes; organize, guide, and inspect implementation after approval by the competent authority;

b) Organize monitoring and updating information on weather, typhoons, floods, storms, earthquakes, tsunamis; coordinate with relevant sectors, organizations, and localities to promptly propose to the Provincial Steering Committee for Disaster Prevention and Mitigation and Search and Rescue plans to handle accidents in water conservancy works and dykes and deal with situations and mitigate the consequences of natural disasters within the scope of management;

c) Guide and inspect compliance with emergency situations requiring flood diversion, delayed flooding, evacuation measures, ensuring production and livelihoods of residents, mitigating flood damage, providing assistance to residents; measures to prevent, avoid, and mitigate natural disasters;

d) Perform the duties of the Office of the Provincial Steering Committee for Disaster Prevention and Mitigation and Search and Rescue as required by the Provincial Steering Committee for Disaster Prevention and Mitigation and Search and Rescue.

9. Perform the functions, duties, and powers of the investor in construction projects (upgrading, repairing water conservancy works; upgrading, maintenance, repair, restoration, and new construction of dykes and flood control works; upgrading and repairing rural clean water works) when authorized by the competent authority.

10. Organize international cooperation activities in the fields of water resources management, dyke construction, flood prevention, drought mitigation, and rural clean water supply in accordance with regulations; conduct research and apply scientific and technological advancements in specialized management fields.

11. Carry out inspection and specialized supervision functions, resolve disputes, complaints, and denunciations in the fields of water resources management, dyke construction, flood prevention, drought mitigation, and rural clean water supply in accordance with the law.

12. Implement information dissemination and regular or ad hoc reporting on the implementation of state management tasks assigned according to the regulations of the Department of Agriculture and Rural Development and the General Department of Water Resources.

13. Train, enhance, and improve the professional expertise of civil servants and employees under the Water Resources Management Agency.

14. Manage organizational structure, staffing, job positions, financial resources, assets, and other resources allocated by the Director of the Department of Agriculture and Rural Development in accordance with the law.

15. Develop and implement administrative reform programs within the scope of state management of the Water Resources Management Agency in accordance with the objectives and content of the administrative reform program of the Department of Agriculture and Rural Development.

16. Perform other tasks as prescribed by law and assigned by the Director of the Department of Agriculture and Rural Development.

1. Assist the Director of the Department of Agriculture and Rural Development in drafting and submitting to the competent authority for issuance of legal normative documents, strategies, plans, programs, projects, standards, technical regulations, procedures, norms, and economic-technical quotas regarding cooperative economy in agriculture; farm economy; household economy; rural planning and resettlement of population; rural development; social security; vocational training for rural labor; agricultural electromechanics and rural industry development.

2. Guide and organize the implementation of legal normative documents, plans, programs, projects, standards, technical regulations, procedures, norms, and economic-technical quotas that have been approved. Provide information, promote, and disseminate laws in specialized fields within the scope of management.

3. Submit to the Director of the Department of Agriculture and Rural Development for issuance within their authority individual documents concerning specialized fields within the scope of management of the Agency.

4. Regarding cooperative economy in agriculture and rural areas:

a) Guide and organize the implementation of programs, projects, proposals, and plans for developing cooperative economies in agriculture, forestry, fisheries, and salt production, household economies, farm economies, and linkages in agriculture after approval by the competent authority;

b) Summarize and submit to the Director of the Department of Agriculture and Rural Development for submission to the Provincial People's Committee mechanisms, policies, and measures to encourage the development of household economies, farm economies, and cooperative economies in agriculture, forestry, fisheries, and salt production linked to industries and traditional crafts in rural areas at the commune level; guide, inspect, and organize the implementation after approval by the competent authority.

5. Regarding rural development:

a) Implement the national target program for新农村发展建设，按照省农业和农村发展厅主任的分工；

b) Review and audit programs and projects for the development of rural infrastructure; review or participate in reviewing programs and projects related to economic restructuring plans and rural development programs as prescribed.

6. Regarding planning and population resettlement, relocation:

a) Assist the Director of the Department of Agriculture and Rural Development in presenting to the Provincial People's Committee proposals for programs and projects on population resettlement for water conservancy and hydropower projects; stable resettlement of populations in disaster-prone, particularly difficult, border, island, special-use forest, and coastal inundation areas due to climate change, and free migration;

b) Review programs and projects related to population resettlement in rural areas. Construct infrastructure in resettlement areas. Implement basic investigation and design planning projects on population resettlement within their authority;

c) Guide, organize, inspect, and supervise the implementation of permanent settlement and population resettlement work in rural areas as prescribed.

7. Regarding vocational training for rural labor:

a) Develop plans, organize implementation, monitor, urge, and inspect the implementation of vocational training for rural agricultural workers;

b) Implement tasks related to non-agricultural vocational training for workers in rural craft villages as prescribed.

8. Regarding poverty reduction and rural social security:

a) Assist in formulating support policies for agricultural production, industries, and services in rural areas for target groups under national poverty reduction programs, Program 30a, Program 135, eradication of opium poppy cultivation, and substitution; serve as the focal point for consolidating results of national poverty reduction programs, Program 30a, Program 135, eradication of opium poppy cultivation, and substitution at the local level;

b) Organize the implementation of national poverty reduction programs, Program 30a, Program 135, eradication of opium poppy cultivation, and substitution;

c) Guide the implementation of agricultural insurance programs as prescribed.

9. Regarding agricultural electromechanics, rural industry, and craft village development:

a) Guide and inspect the implementation of plans, mechanisms, and policies for the development of agricultural electromechanics, industries, and craft villages linked to households and cooperatives after approval by the competent authority;

b) Guide and organize trade fairs, exhibitions, and product competitions for agricultural, forestry, aquatic products, and rural craft village products.

10. Take the lead and coordinate in organizing professional training and business training in specialized fields within the scope of management of the Agency; serve as the focal point for building and organizing training and capacity building for cooperative management cadres, cooperative groups, and farm owners in agriculture, forestry, fisheries, and salt production at the provincial level.

11. To organize, research, summarize, and expand models for the development of agricultural cooperatives, cooperative economies, household economies, farmstead economies, linkages within agriculture; resettlement of residents, relocation and resettlement of displaced persons; rural development, poverty reduction in agriculture and rural areas; vocational training for agricultural workers in rural areas; eradication and replacement of drug-containing plants.

12. Implement research topics and projects on the application of scientific and technological progress in specialized fields under the jurisdiction of the Agency within the provincial territory.

13. Conduct specialized inspections as prescribed by law; handle complaints, denunciations, prevent corruption, and address violations within the scope of authority as prescribed by law.

14. Take the lead and coordinate with relevant agencies and units to manage the registration and announcement of compliance standards by organizations and individuals in industries and sectors under the management of the Agency.

15. Organize surveys, statistics, build databases, and implement information and reporting systems for managed sectors.

16. Manage organizational structure, staffing, positions, civil servants, financial resources, assets, and other assigned resources according to the分级授权的农业农村和农村发展局局长的规定和法律规定。

17. Develop and implement administrative reform programs within the scope of state management of the Agency according to the goals and contents of the administrative reform program of the Department of Agriculture and Rural Development.

18. Perform other tasks as prescribed by law and assigned by the Director of the Department of Agriculture and Rural Development.

1. Advise and assist the Director of the Department of Agriculture and Rural Development in submitting competent authorities to promulgate normative legal documents, plans, programs, proposals, and projects on quality and food safety for agricultural, forestry, fishery products, and salt at the local level.

2. Implement normative legal documents, plans, programs, proposals, projects, technical standards, economic-technical norms that have been approved; provide information, propaganda, and popularize laws in the assigned management fields.

3. Submit to the Director of the Department of Agriculture and Rural Development for issuance within their authority individual documents belonging to the professional field under the management of the Agency.

4. Serve as the focal point to advise and consolidate to assist the Director of the Department of Agriculture and Rural Development in managing state affairs regarding quality and food safety, specifically as follows:

a) Lead and coordinate in formulating plans for propaganda, dissemination, and education on laws related to quality and food safety within the jurisdiction of the Department of Agriculture and Rural Development;

b) Lead and coordinate in developing plans and organizing training on knowledge and professional skills related to quality and food safety for agricultural, forestry, fishery products, and salt in the locality;

c) Serve as the focal point for evaluating and classifying conditions ensuring quality and food safety for production and business establishments of agricultural inputs, agricultural, forestry, fishery products, and salt;

d) Lead and coordinate in implementing food safety monitoring programs, risk assessments, and tracing causes of food safety incidents within the jurisdiction at the local level; organize the recall and handling of unsafe food according to the law and guidance from the specialized agency;

đ) Manage certification and declaration activities of compliance with quality and food safety standards within the jurisdiction of the Department of Agriculture and Rural Development as prescribed;

e) Organize the management of food safety for food packaging materials and equipment during food production, processing, and trading within the jurisdiction; issue certificates confirming advertising content for food products as prescribed.

5. Implement quality and food safety management for agricultural, forestry, fishery products, and salt:

a) Organize inspection, evaluation, classification, and issuance of certificates confirming compliance with food safety standards for production and business establishments of agricultural, forestry, fishery products, and salt according to the division of labor by the Director of the Department of Agriculture and Rural Development and the law;

b) Lead in organizing inspection and certification of quality and food safety for agricultural, forestry, fishery products, and salt in the locality according to the law.

6. Supervise and recommend measures to ensure quality during the production of non-food agricultural, forestry, fishery products. Organize inspection and certification of quality for non-food agricultural, forestry, fishery products.

7. Regarding processing and trade of agricultural, forestry, fishery products, and salt:

a) Guide and inspect the implementation of planning, policies, mechanisms for the development of processing and preservation industries linked to raw material regions, production, and markets after approval by competent authorities;

b) Guide and inspect the implementation of technological processes and safe production conditions for processing and preservation establishments of agricultural, forestry, fishery products, and salt;

c) Lead and coordinate with relevant units to implement trade promotion work, market research, and forecasting for agricultural, forestry, fishery products, and salt according to the division of labor by the Director of the Department of Agriculture and Rural Development;

d) Guide and inspect processing and preservation of agricultural, forestry, fishery products, and salt according to regulations.

8. Lead and coordinate with departments under the Department of Agriculture and Rural Development to manage the registration of declarations of compliance by organizations and individuals engaged in production and trade according to regulations.

9. Assist the Director of the Department of Agriculture and Rural Development in selecting and evaluating organizations meeting the conditions to be designated by the provincial People's Committee to certify conformity with local technical standards according to the law.

10. Conduct inspections, specialized inspections on quality and food safety for agricultural, forestry, fishery products, and salt according to regulations; handle complaints, denunciations, prevent corruption, and address violations within the scope of authority as prescribed by law.

11. Manage the organization of testing activities and provide public services within the jurisdiction of the Agency according to the law.

12. Conduct investigations, statistics, and implement information and reporting systems regarding the quality and safety of agricultural, forestry, aquatic products, and salt in accordance with regulations.

13. Propose programs and projects for investment in the field of quality and safety of agricultural, forestry, aquatic products, and salt within the scope of management. Participate in the appraisal of planning projects and investment projects related to ensuring the quality and safety of agricultural, forestry, aquatic products, and salt at the local level.

14. Organize the implementation of administrative reform tasks; manage organizational structure, civil servant staffing, job positions, finances, assets, and other resources assigned according to the classification of the Department of Agriculture and Rural Development Director and legal provisions.

15. Perform other tasks as prescribed by law and assigned by the Department of Agriculture and Rural Development Director.

Chapter II
DUTIES OF ENTERPRISE ORGANIZATIONS UNDER THE DEPARTMENT OF AGRICULTURE AND RURAL DEVELOPMENT ENTERPRISE ORGANIZATIONS UNDER THE DEPARTMENT OF AGRICULTURE AND RURAL DEVELOPMENT

1. Propose policies, strategies, long-term plans, five-year plans, annual plans, programs, projects, and regulatory documents on agricultural extension within the jurisdiction to the Department Director.

2. Develop and submit to the Department of Agriculture and Rural Development Director the program, plan, and project on agricultural extension at the local level. Implement after approval by the competent authority.

3. Sign agricultural extension contracts with organizations and individuals in accordance with the law.

4. Lead the implementation of some programs, projects, and agricultural extension tasks assigned by the Department of Agriculture and Rural Development Director.

5. Guide and inspect the implementation of agricultural extension programs and projects in accordance with the law.

6. Provide guidance on the content and methods of agricultural extension activities for agencies and units participating in agricultural extension activities.

7. Lead the development of agricultural extension programs and training materials; organize technical and vocational training for agricultural extension officers and cooperators at all levels and farmers.

8. Organize information dissemination activities on agricultural extension in accordance with the law.

9. Organize and participate in organizing competitions, seminars, exhibitions, forums, study tours, and experience exchanges on agricultural extension.

10. Provide consulting and agricultural extension services in accordance with the law.

11. Participate in rural agricultural vocational training for laborers in the jurisdiction as assigned by the Department of Agriculture and Rural Development Director and in accordance with the law.

12. Coordinate with other organizations under the Department of Agriculture and Rural Development in disease prevention and control, disaster response at the local level.

13. Manage and utilize the agricultural extension activity fund (if any) in accordance with the law.

14. Implement international cooperation in agricultural extension in accordance with the law.

15. Report the results of implementing agricultural extension programs and projects in accordance with the law.

16. Perform other tasks as prescribed by law and assigned by the Director of the Department of Agriculture and Rural Development.

Duties of the Rural Water Supply and Sanitation Center and other enterprise organizations, including: Seed Center (crops, livestock, aquaculture); Fish Port Management Board; Specialized Forest Management Board; Protective Forest Management Board under the Department shall be defined by the Department of Agriculture and Rural Development Director in accordance with the law.

Chapter III
IMPLEMENTATION

Article 10. The General Bureaus, Bureaus, Ministry Inspectorate, and other functional agencies under the Ministry of Agriculture and Rural Development are responsible for guiding and inspecting the implementation of this Circular.

Article 11. The Department of Agriculture and Rural Development shall organize the implementation based on this Circular in accordance with the regulations.

Article 12. Effectiveness and responsibility for enforcement

1. This Circular takes effect from May 12, 2015.

2. During the implementation process, if there are difficulties or need for supplementation or amendment, the Department of Agriculture and Rural Development Director shall report to the Ministry of Agriculture and Rural Development (through the Cadre and Civil Servant Organization Bureau) for research and resolution in accordance with the regulations./.
