REGULATIONS AND GUIDELINES FOR IMPLEMENTING CERTAIN PROVISIONS OF THE GOVERNMENT DECREE NO. 68/2017/NĐ-CP OF MAY 25, 2017 ON MANAGEMENT AND DEVELOPMENT OF INDUSTRIAL ZONES

Pursuant to Decree No. 98/2017/NĐ-CP dated August 18, 2017, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;

Pursuant to Government Decree No. 68/2017/NĐ-CP dated May 25, 2017 on management and development of industrial zones;

At the proposal of the Director of the Department of Local Industry and Trade,

The Minister of Industry and Trade issues this Circular regulating and guiding the implementation of certain provisions of Government Decree No. 68/2017/NĐ-CP dated May 25, 2017 on management and development of industrial zones.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular regulates and guides on planning for the development of industrial zones; investment in construction of technical infrastructure for industrial zones; reporting systems, databases, and templates of documents and management regulations for industrial zones as stipulated in Government Decree No. 68/2017/NĐ-CP dated May 25, 2017 on management and development of industrial zones.

Article 2. Applicability

1. Enterprises, cooperatives, and units investing in the construction of technical infrastructure for industrial zones.

2. Organizations and individuals producing and trading within industrial zones.

3. Other agencies, organizations, and individuals related to the management and operation of industrial zones.

Chapter II

SPECIFIC PROVISIONS

Chapter 1. PLANNING FOR THE DEVELOPMENT OF INDUSTRIAL ZONES

Article 3. Planning for the Development of Industrial Zones

1. Planning for the development of industrial zones shall be established at the provincial level (hereinafter referred to as "Planning") and falls under the category of industry-related infrastructure planning; it shall be prepared for each ten-year period, with consideration given to prospects for the subsequent ten years.

2. The review and adjustment of Planning shall be conducted every five years; except in cases where it is necessary for the People's Committee of the province to consult and reach agreement with the Ministry of Industry and Trade.

Article 4. Outline and Budget for Preparing Planning

1. The outline and budget for preparing Planning shall be carried out in accordance with Article 5 of Government Decree No. 68/2017/NĐ-CP and Circular No. 01/2012/TT-BKHĐT dated September the 02 year 2012 of the Ministry of Planning and Investment guiding the determination of cost standards for the preparation, review, and publication of planning for industry,policies sector,u and sub-sector, amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CPDecisiondevelopment until 2010, development planning. 2. The Department of Industry and Trade shall organize the preparation and review of the outline and budget for preparing Planning, submitting them to the People's Committee of the province for approval. The review of the outline and budget shall be conducted through soliciting opinions from relevant departments, agencies,n ln phrime Minister cand authorities..

3. In cases where it is necessary to adjust the outline and budget for preparing Planning, the Department of Industry and Trade shall report to the People's Committee of the province for decision.Article 5. Preparation of Planning 1. The Department of Industry and Trade shall take the lead and coordinate with relevant departments, agencies, and the People's Committee of the district to prepare Planning. The Department of Industry and Trade may invite experts or hire consultants to prepare Planning. If hiring consultants, the Department of Industry and Trade shall organize the selection of consulting agencies or organizations in accordance with the bidding laws. 2. During the preparation of Planning, the Department of Industry and Trade shall organize intermediate reports, solicit opinions from relevant departments, agencies, the People's Committee of the district, and related organizations and individuals, and complete Planning..

Article 6. Documentation for Planning

Documentation for Planning includes:

Article 7. Review of the Master Plan

1. The review of the Master Plan's dossier shall be carried out by the Master Plan Review Board. The Review Board shall convene to review the File Master Plan, prepare a report and bear responsibility before the Provincial People's Committee regarding the review results. fruits for review.

2. The Department of Industry and Trade shall be responsible for::

1. After completing

the Master Plan dossier according to the conclusions of the Review Board, the Department of Industry and Trade shall report to the Provincial People's Committee to sign a document requesting the Ministry of Industry and Trade to agree. 2. The procedures, dossier for agreement and approval of the Master Plan shall be implemented in accordance with the provisions of Clauses 3, 4, and 5 of Article 6 of Decree No. 68/2017/ND-CP.Section 2. INVESTMENT IN CONSTRUCTION OF TECHNICAL INFRASTRUCTURE FOR INDUSTRIAL ZONES

Article 9. Detailed Construction Planning for Industrial Zones

The establishment, review, and approval of detailed construction planning for industrial zones shall be carried out

in accordance with the regulations on detailed planning for special function areas under the Law on Construction, Decree No. 44/2015/ND-CP dated May 6, 2015 of the Government detailing certain contents on construction planning, Circular No. 12/2016/TT-BXD dated June 29, 2016 of the Ministry of Construction on the dossier for tasks and projects of regional construction planning, urban planning, and detailed planning for special function areas.

Determination and management of costsfor detailed construction planning of industrial zones shall be carried out in accordance with Circular No. 05/2017/TT-BXD dated April 5, 2017 of the Ministry of Construction guiding the determination and management of costs for construction planning and urban planning.

3. Selection of consulting units for detailed planning shall comply with the bidding laws Article 10. Investment Project for Construction of Technical Infrastructure for Industrial Zones

2. for industrial zones shall be carried out in accordance with the provisions of Decree No. 59/2015/ND-CP dated June 18, 2015 on management of investment construction projects Technical Specifications and Decree No. 42/2017/ND-CP dated April 5, 2017 of the Government amending and supplementing certain articles of Decree No. 59/2015/ND-CP. amended and supplemented by Law No. 87/2025/QH15; 3. When establishing an investment project for construction works, the investor shall simultaneously prepare an environmental impact assessment report for the project. The contents, procedures for preparing, reviewing, and approving the environmental impact assessment report for the project shall be carried out in accordance with the provisions of Decree No. 18/2015/ND-CP dated February 14, 2015 of the Government on planning for environmental protection, strategic environmental assessment, environmental impact assessment, and environmental protection plans. of the Government on project management and Decree No. 42/2017/ND-CP dated April 5, 2017 of the Government amending and supplementing certain articles of Decree No. 59/2015/ND-CP..

3. When establishing a construction investment project, the investor shall simultaneously prepare an environmental impact assessment report for the project. The contents, procedures for preparation, review, and approval of the environmental impact assessment report for the project shall be carried out in accordance with the provisions of Decree No. 18/2015/ND-CP dated February 14, 2015 of the Government on environmental planning, strategic environmental assessment, environmental impact assessment, and environmental protection plans.

Article 11. The tasks of the unit entrusted to be the main investor in constructing technical infrastructure for industrial clusters as prescribed in

Clause 2, Article 15 of Decree No. 68/2017/NĐ-CP

1. In cases where there is no Industrial Cluster Development Center at the district level and no Industrial Cluster Management Board is established, the Provincial People's Committee shall entrust a public service institution under the Department of Industry and Trade to be the main investor in constructing technical infrastructure for industrial clusters.

2. The tasks of the unit entrusted to be the main investor in constructing technical infrastructure for industrial clusters as prescribed in Clause 2, Article 15 of Decree No. 68/2017/NĐ-CP include: a) Participating in adjusting and supplementing the planning for developing industrial clusters,

reporting on investment establishment and expansion of industrial clusters; organizing the preparation , managementof detailed construction planning b) Organizing implementation, management organizing the preparation

of) and ensuring regular operation of the common technical infrastructure system and organizing provision of services and conveniences within industrial clusters d) Promoting investment, guiding procedures for implementing investment projects, relocating production facilities into industrial clusters in accordance with the law;

; supporting and creating favorable conditions for organizations and individuals engaged in production and business within industrial clusters; e) Performing other tasks assigned by competent authorities and in accordance with the law.Section 3. REPORTING REGIME, DOCUMENT FORMS, MANAGEMENT REGULATIONS ON INDUSTRIAL CLUSTERS

Article 12. Reporting regime on industrial clusters

1. Subjects implementing the reporting regime:

a) Department of Industry and Trade

at local levels;

b) Departments of Industry and Trade AFFAIRS specialized departments managing industry and trade under the People's Committees

at district levels;;

IMPLEMENTATION

projects for production and business activities within industrial parks (including: deciding on investment policies, issuing investment registration certificates, land recovery, land leasing, issuing construction permits, approving fire prevention and firefighting plans, confirming environmental protection plans or approving environmental impact assessment reports) Article 17. Responsibilities of the specialized department managing industry and trade under the district-level People's Committee.

The specialized department managing industry and trade under the district-level People's Committee is the focal point

to assist the district-level People's Committee in managing industrial parks within its jurisdictionas stipulated in Article 44 of Decree No. 68/2017/ND-CP. Supreme People's Court 2. Article 18. Effective Date
