Amending and supplementing certain provisions of the Working Regulations for General Education Teachers issued together with concerning the classification and determination of state management authority in the field of crop production and plant protectionDecision No. 28/2009/TT-BGDĐT October 21, 2009 of The Minister of Education and Training

On the basis of Decree No. 69/2017/NĐ-CP dated May 25, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;

Pursuant to Decree No. 75/2006/NĐ-CP dated August 2, 2006 of the Government detailing and guiding the implementation of certain provisions of the Education Law; Decree No. 31/2011/NĐ-CP dated May 11, 2011 of the Government amending and supplementing certain provisions of Decree No. 75/2006/NĐ-CP dated August 2, 2006 of the Government detailing and guiding the implementation of certain provisions of the Education Law; Decree No. 07/2013/NĐ-CP dated January 9, 2013 of the Government amending point b, Clause 13, Article 1 of Decree No. 31/2011/NĐ-CP dated May 11, 2011 of the Government amending and supplementing certain provisions of Decree No. 75/2006/NĐ-CP dated August 2, 2006 of the Government detailing and guiding the implementation of certain provisions of the Education Law;

Pursuant to Decision No. 188/1999/QĐ-TTg dated September 17, 1999 of the Prime Minister on the 40-hour workweek system;

At the proposal of the Director of the Department of Teachers and Educational Management Staff;

The Minister of Education and Training promulgates concerning the classification and determination of state management authority in the field of crop production and plant protectionAmending and supplementing certain provisions of the Working Regulations for General Education Teachers issued together with concerning the classification and determination of state management authority in the field of crop production and plant protectionDecision No. 28/2009/TT-BGDĐT October 21, 2009 4. Amending and supplementing Clause 2 of Article 14 as follows:

Circular No. 03/2023/TT-BCA The Working Regulations for General Education Teachers issued together with Circular "7. A flexible power plant is a thermal power plant using reciprocating internal combustion engines (RICE) or aeroderivative gas turbines (Aero-GT) with fast start-up capabilities, designed in modular form to generate electricity for balancing capacity and maintaining power system stability."Pursuant to Decree No. 24/2018/NĐ-CP dated February 27, 2018 of the Government on handling complaints and reports in the fields of labor, vocational education, dispatching Vietnamese workers abroad under contracts, employment, occupational safety and health;Decision No. 28/2009/TT-BGDĐT October 21, 2009 of the Minister of Education and Training

1. Clause 1, Article 2 shall be amended and supplemented as follows:

"1. This document applies to teachers at public educational institutions, including: primary schools, secondary schools, high schools, multi-grade schools, boarding schools for ethnic minorities, semi-boarding schools for ethnic minorities, specialized schools, and schools for persons with disabilities (hereinafter referred to collectively as general education schools) and preparatory universities."

2. Article 3 shall be amended and supplemented as follows:

"Article 3. Duties of teachers

The duties of teachers shall be carried out in accordance with the Charter of Primary Schools, the Charter of Secondary Schools, High Schools, and Multi-Grade Schools; the Regulation on the Organization and Operation of Boarding Schools for Ethnic Minorities, Semi-Boarding Schools for Ethnic Minorities, Specialized Schools, and Preparatory Universities."

3. Clause 2a, Article 5 shall be added as follows:

"2a. The working time of teachers at preparatory universities is 42 weeks, including:

1. 28 weeks dedicated to teaching and educational activities according to the annual plan;
2. 12 weeks dedicated to studying, enhancing qualifications, building materials, conducting scientific research, and other activities according to the annual plan;
3. 01 week dedicated to preparing for the new academic year;
4. 01 week dedicated to concluding the academic year."

4. Point a, Clause 3, Article 5 shall be amended and supplemented as follows:

"a) The annual summer vacation period for teachers is two months (including the annual leave prescribed by the Labor Code), during which they receive full salary and allowances (if applicable)."

5. Clause 2a, Article 6 shall be added as follows:

"2a. The teaching load standard for teachers at preparatory universities is 12 periods."

6. Clause 2, Article 7 shall be amended and supplemented as follows:

"2. Teaching load standards for principals and deputy principals.

The annual teaching load for principals is calculated as: 2 periods/week x the number of weeks allocated for teaching and educational activities according to the annual schedule;

The annual teaching load for deputy principals is calculated as: 4 periods/week x the number of weeks allocated for teaching and educational activities according to the annual schedule."

7. Clause 2a, Article 7 shall be added as follows:

"2a. Principals and deputy principals of general education schools and preparatory universities shall not convert the reduced teaching load for兼任职务的定额课时规定为本通函规定的定额课时标准。

8. 增加第8条第2a、5a、5b款如下：

“2a. 班主任在预科大学每星期减少3节。”

“5a. 教研组副组长每星期减少1节。”

“5b. 兼任职能处室主任的教师在预科大学每星期减少3节；

兼任职能处室副主任的教师在预科大学每星期减少1节。”

9. 第9条第1款、第2款修改补充如下：

“1. 兼任党部书记或支部书记（未成立党部）的一级学校教师每星期减少4节，其他级别学校教师每星期减少3节。”

1a. 兼任工会工作的教师按《关于非专职工会工作者的教师和讲师的课时定额减免规定》通函第08/2016/TT-BGDĐT号2016年3月28日教育部部长的规定执行。非专职工会工作者的教师和讲师在公立教育机构中的课时定额减免规定》

“2. 兼任团委书记、团委副书写的教师享受按照政府总理第13/2013/QĐ-TTg号2013年2月6日决定关于共青团员和学生会干部在教育和职业培训机构中的待遇和政策的规定。”

10. 第10条增加第2a款如下：

“2a. 在预科大学有12个月以下婴儿的女教师每周减少3节。”

11. 第11条第2款修改补充如下：

“2. 除主要课堂教学任务外，教师还必须完成校长分配的专业活动和其他活动。这些活动转换成课时以计算每位教师的实际授课时间，具体如下：

a) 对于被动员担任教育监察员的教师，工作时间转换按《关于修订和补充<教育监察员规定>若干条款》通函第31/2014/TT-BGDĐT号2014年9月16日教育部部长的规定进行。

b) For teachers mobilized to participate in guidance, training, and professional development activities organized by the Department of Education and Training, the Provincial Department of Education and Training, or the Ministry of Education and Training, each actual guidance, training, and professional development session is counted as 1.5 standard teaching periods;

c) Reports on extracurricular activities and creative experience activities for students organized by the school (with lesson plans or teaching schedules or report outlines) shall be counted as 1.5 standard teaching periods for each actual reporting period;

d) The principal of the school shall base on the actual situation to define the conversion of teaching periods for other professional tasks after obtaining the agreement of the Director of the Department of Education and Training, the Director of the Provincial Department of Education and Training, and the Minister of Education and Training according to the management hierarchy for educational institutions;

12. Supplement Clause 2a of Article 11 as follows:

“2a. Teaching periods of the principal and deputy principals shall be implemented in accordance with the following provisions:

1.  Teaching contents within the general education program and specific contents (if any) for secondary schools and preparatory university programs issued by the Minister of Education and Training, and providing guidance;

b) Ensuring the number of teaching periods as prescribed in the standard teaching period regulations for principals and deputy principals stipulated in this Circular and publicly disclosed at the annual civil servant and staff conference of the school”.

13. Article 13 is amended and supplemented as follows:

“Article 13. Responsibilities of the Principal of Secondary Schools and Preparatory Universities.

The principal of secondary schools and preparatory universities is responsible for organizing the implementation of working hours regulations and creating conditions for teachers to implement working hours according to this Regulation”.

Article 2. Responsibility for implementation

The Heads of the Office, Inspectorate, Director of the Teacher and Educational Management Bureau, Heads of units related to the Ministry of Education and Training, Chairpersons of People's Committees of provinces and centrally governed cities, and Directors of provincial Departments of Education and Training are responsible for enforcing this Circular.

Article 3. Effectiveness

This Circular takes effect from August 1, 2017./.
