RESOLUTION
Regarding the use of experts by the President of the National Assembly,
Vice Presidents of the National Assembly, Secretary-General of the National Assembly, and agencies under the National Assembly,của National Assembly,

THE STANDING COMMITTEE OF THE NATIONAL ASSEMBLY
On the basis of the Constitution of the Socialist Republic of Vietnam;
BASED ON THE LAW ON THE ORGANIZATION OF THE NATIONAL ASSEMBLY NO. 57/2014/QH13, AS AMENDED BY SOME ARTICLES IN LAW NO. 65/2020/QH14;
Based on the Model Working Regulations of the Ethnic Council and Committees of the National Assembly issued together with Decision No. 283/2021/UBTVQH15 dated August 27, 2021 of the Standing Committee of the National Assembly;
Considering the proposal of the Representative Work Committee Chairperson in the Report No. 14/TTr-BCTĐB dated January 7, 2022 and the letter No. 93/BCTĐB-CTĐB of the Representative Work Committee dated February 12, 2022;
RESOLUTION:
Article 1. Scope and Applicability
Article 1. This Decision stipulates the use of experts by the President of the National Assembly, Vice Presidents of the National Assembly, Secretary-General of the National Assembly, the Ethnic Council, Committees of the National Assembly, agencies under the Standing Committee of the National Assembly, and the National Assembly Office (hereinafter referred to as "the agency, person with authority").
Article 2. Experts include former National Assembly deputies, scientists, managers, researchers, and practitioners both domestically and internationally; meeting the conditions and criteria specified in Article 3 of this Decision.
Article 3. Principles for using experts
Clause 1. The use of experts must be based on the requirements and tasks of each agency, person with authority, ensuring transparency, fairness, and compliance with established standards and conditions.
Clause 2. Depending on the nature of the work, the agency, person with authority may use experts on a regular basis or for specific tasks at designated times, ensuring practicality and effectiveness.
Clause 3. Based on actual circumstances, work needs, and specific fields, the agency, person with authority shall determine the number of experts required.
Article 4. Standards and Conditions for Experts
Having a bachelor's degree or higher, possessing relevant expertise in the field requiring consultation; having a clear record, good political and moral qualities, good health, passion, practical experience, broad knowledge, intelligence, and reputation in advisory and policy-making work; being able to provide proficient consultations in certain fields confirmed by practice; willing to accept and complete assigned tasks.
Article 5. Duties and Rights of Experts
Clause 1. Studying, providing information, completing reports, articles, speeches, comments, remarks, opinions, and suggestions according to assigned tasks and fields.
Advising the agency, person with authority on legislative activities; other issues related to the operation of the National Assembly and its agencies; matters concerning the drafting of laws and ordinances that the agencies, persons with authority are concerned about; supervising state machinery operations and deciding important national issues.
Clause 2. Experts may be invited to attend plenary sessions of committees, expanded standing committee meetings; specialized annual meetings, other meetings of National Assembly agencies, Standing Committee agencies, and the National Assembly Secretariat as decided by the convocation; provided with relevant information and materials; allowed to participate and express their views in meetings, seminars, conferences, hearings, working groups, surveys, and supervision related to their assigned sectors and fields; compensated according to regulations.
Clause 3. Experts have the obligation to comply with confidentiality regulations and other obligations as prescribed by law.
Clause 4. Performing other tasks directly assigned by the agency, person with authority.
Article 5. System, form, and remuneration level for experts
1. The agency or person with authority to hire experts shall enter into a work contract with them.
2. The remuneration for experts may be paid monthly, weekly, daily, hourly, or on a lump-sum basis for specialized tasks. The expenditure limit for each specific content must not exceed the limits stipulated in current regulations.
3. Settlement documentation includes: Contract, handover and acceptance records, and other related documents accompanying the advisory results and completed products which must meet quality standards and be evaluated as satisfactory by the agency or person with authority.
Article 6. Funding sources and conditions ensuring the operation of experts
1. The cost of using experts and the conditions ensuring their operations are included in the annual operating budget of the agency or person with authority.
2. Depending on specific conditions, office space, transportation means, and necessary conditions to ensure the operation of experts can be arranged.
3. The National Assembly Office shall coordinate and unify with the Ministry of Finance to establish: annual budget estimates; detailed guidelines on content and expenditure limits; settlement documentation for hiring experts in accordance with regulations.
Article 7. Implementation Provisions
1. The Secretary-General of the National Assembly, the Ethnic Council, the Committees of the National Assembly, agencies under the Standing Committee of the National Assembly, the National Assembly Office, and other relevant units and individuals are responsible for implementing this Resolution.
2. This Resolution takes effect forty-five days from the date of issuance./.
