CIRCULAR

REGULATIONS ON THE ISSUE AND USE OF BIRTH CERTIFICATES

Circular No. 17/2012/TT-BYT dated October 24, 2012, issued by the Minister of Health on the issuance and use of Birth Certificates, which took effect from January 1, 2013, has been amended and supplemented by:

1. Circular No. 34/2015/TT-BYT dated October 27, 2015, issued by the Minister of Health to amend and supplement Article 2 of Circular No. 17/2012/TT-BYT dated October 24, 2012, issued by the Minister of Health on the issuance and use of Birth Certificates, which took effect from December 14, 2015;

2. Circular No. 27/2019/TT-BYT dated September 27, 2019, issued by the Minister of Health to amend certain provisions of Circular No. 17/2012/TT-BYT dated October 24, 2012, issued by the Minister of Health on the issuance and use of Birth Certificates, which took effect from December 1, 2019;

Pursuant to Decree No. 63/2012/NĐ-CP dated August 31, 2012, promulgated by the Government on the functions, tasks, powers, and organizational structure of the Ministry of Health;

Decree No. 1Decree No. 58/2005/NĐ-CP dated December 27, 2005, promulgated by the Government on registration and management of household registration records;

Decree No. 06/2012/NĐ-CP dated February 2, 2012, promulgated by the Government amending and supplementing certain articles of decrees on household registration, marriage, family relations, and notarization;

Appendix 02 attached to this Circular.

The Minister of Health hereby issues this Circular on the issuance and use of Birth Certificates as follows:1

Article 1. Scope of Regulation

This Circular stipulates the authority and procedures for issuing and reissuing Birth Certificates; printing and providing models of Birth Certificates; recording Birth Certificates and reporting statistical data on Birth Certificate issuance.

Article 2. Authority and Procedures for Issuing and Reissuing Birth Certificates

1. Authority for Issuing and Reissuing Birth Certificates

a) General hospitals with obstetric departments; specialized obstetric hospitals; maternity and pediatric hospitals;

b) Midwifery houses;

c) Commune health centers;

d) Other legitimate medical examination and treatment facilities permitted to provide delivery services.

2. Procedures for Issuing Birth Certificates

a)2 Prior to the newborn's return home, the medical examination and treatment facility specified in Clause 1 of this Article shall be responsible for fully filling out the Birth Certificate model at Appendix 01 or Appendix 01A attached hereto. The father, mother, or close relative of the child must read and check the information before signing. The Birth Certificate shall be made in two copies of equal legal value, one copy given to the father, mother, or close relative of the child for birth registration purposes and one copy retained by the medical examination and treatment facility.No.The mother or close relative of the child shall handle the birth registration procedures and retain one copy at the medical facility.

b)3 In cases where the child is born outside a medical examination and treatment facility but delivered by a healthcare worker or midwife, rock commune rock the father, mother, or caregiver of the child must fill out the Application Form for Birth Certificate according to the model prescribed in Appendix 02 attached hereto and submit it to the commune health center where the child was born to request a Birth Certificate for the child. If verification is required, the verification period shall not exceed five working days. c)4 In cases where the child is born through assisted reproductive technology, the Couple Seeking Surrogacy or the Surrogate Mother must submit the Confirmation of Birth by Assisted Reproductive Technology according to Appendix 05 attached hereto and a certified copy or a copy with the original for comparison of the Agreement on Altruistic Surrogacy between the Couple Seeking Surrogacy and the Surrogate Mother to the medical examination and treatment facility where the child was born. surrogacy, the Surrogate Couple Party or the Surrogate Mother Party must submit a confirmation regarding the birth of the child through k The child born through assisted reproductive technology will be issued a Birth Certificate according to Model 01A attached hereto. This Birth Certificate serves as proof of surrogacy when registering for birth registration.

The child born from the implementation of k The issuance of the Birth Certificate shall be carried out in accordance with Point a of Clause 2 of this Article.

3. Procedures for Reissuing Birth Certificates

a) In cases where a Birth Certificate has already been issued but errors were found in the recording of the Birth Certificate: the father, mother, or close relative of the child must submit an Application for Reissuance of Birth Certificate according to the model prescribed in Appendix 03 attached hereto, along with evidence of the error to the medical examination and treatment facility that initially issued the Birth Certificate. Within two working days from the date of receipt of valid documents, the medical examination and treatment facility shall be responsible for recalling and canceling the erroneous Birth Certificate, and the application form and evidence of the error shall be kept together with the old retained copy at the medical examination and treatment facility. The reissued Birth Certificate must clearly indicate the number and volume number of the previous Birth Certificate and bear the stamp "Reissued". If verification is required, the verification period shall not exceed three working days.

Evidence of the error: in cases of errors regarding the mother's or caregiver's name, year of birth, place of permanent residence registration, ID card number, or ethnicity, a photocopied ID card (with the original for comparison) must be submitted; in cases of errors regarding temporary residence registration, a confirmation from the local police station about the place of temporary residence must be submitted.on may request to reissue the Birth Certificate according to the model prescribed in Appendix 03 issued together with this Circular, along with proof of the error sent to the medical facility that initially issued the Birth Certificate for the child. Within two working days from receiving valid documents, the medical facility is responsible for recalling and canceling the erroneous Birth Certificate, and storing the application form and supporting documents together with the old retained copy at the medical facility. The reissued Birth Certificate must clearly state the number and volume number of the original Birth Certificate and bear the stamp "Reissued". In cases requiring verification, the verification period shall not exceed three working days.

b) In cases where the Birth Certificate is lost, torn, or damaged: the father, mother, or close relative of the child must submit an Application for Reissuance of Birth Certificate according to the model prescribed in Appendix 03 attached hereto, accompanied by a confirmation from the Ward People's Committee Head or Village Chief about the birth and current residence status within the residential area, to be submitted to the medical examination and treatment facility that initially issued the Birth Certificate. Within two working days from the date of receipt of the application, the medical examination and treatment facility shall be responsible for reissuing a new Birth Certificate as in the case of an erroneous Birth Certificate. If verification is required, the verification period shall not exceed three working days.No.(ID card); in cases of confusion regarding the temporary residence registration, a confirmation from the local police station about the temporary residence registration must be attached.

b) In case of loss, damage, or deterioration of the Birth Certificate: the father, mother, or close relative of the child must submit an Application for Reissuance of the Birth Certificate according to the model prescribed in Appendix 03 issued together with this Circular, accompanied by a confirmation from the Ward Chief or Village Head regarding the birth and current residence of the child within the residential area. Within two working days from receiving the application, the medical facility is responsible for issuing a new Birth Certificate as in the case of reissuing a Birth Certificate with errors. Article 3. Printing and Providing Sample Birth Certificates

1. The Birth Certificate is pre-printed and bound into books. The size of the Birth Certificate is A4 paper (210 x 297 mm). Each page in the book is divided into two identical parts to record information related to live-born children. In cases where healthcare facilities are using management software, it is not necessary to bind them into books, but they must ensure that Birth Certificates are printed and provided according to the model specified in this Circular. Article 4. Recording Birth Certificates

The recording of Birth Certificates shall be carried out in accordance with the guidelines set forth in Appendix No. 04 issued together with this Circular.

Article 5. Reporting Statistics on Issued Birth Certificates

1. The content of the report on statistics for issued Birth Certificates includes:

a) Total number of live-born children;

b) Total number of live-born children issued Birth Certificates;

c) Difficulties and issues encountered when recording and issuing Birth Certificates.

2.5 The reporting of the contents stipulated in Clause 1 of this Article shall be conducted in accordance with the regulations of the Minister of Health regarding health statistics reporting.

Article 6. Implementation Provisions

This Circular takes effect from January 1, 2013.

GUIDELINES FOR FILLING OUT THE BIRTH CERTIFICATE

(Annexed to Circular No. 56/2017/TT-BYT dated December 29, 2017 of the Minister of Health)policies)

1.(i) Name, headquarters address, contact phone number of the parties signing the contract; KB, CB: Clearly state the name of the medical facility. Example: Health Station A or County B General Hospital.

In cases where the mother or foster parent is temporarily residing at the place where the child was born, clearly indicate temporary residence according to the four-level administrative division.

5. Year of birth: In cases where foreign nationals have registered permanent or temporary residence in Vietnam, write it similarly to Vietnamese citizens. In cases where foreign nationals have not registered permanent or temporary residence in Vietnam but reside in border areas and give birth at Vietnamese healthcare facilities, write the name of the province and country where they are currently living.

6. Place of permanent residence: Social Insurance Number/Health Insurance Card Number:

Write the social insurance book number or social insurance number. If there is none, clearly state None.

The application of writing the social insurance number only applies when the social insurance agency officially announces the use of the social insurance number instead of the social insurance book number..National ID (ID)/Citizen Identity Card/Passport Number:

Clearly state the ID number or citizen identity card number or passport number of the mother or foster parent. In cases where there is no ID or citizen identity card or passport, leave blank.

7. Only apply the rule of writing the ID number or citizen identity card number or passport number until the social insurance agency officially announces the use of the social insurance number instead of the health insurance card number. Issuing Date:

Write the number of children born this time. In cases of twins or more births, specify the number of children and issue separate Birth Certificates for each child. (Weight of Child:Write the weight of the newborn measured within the first hour after birth in grams. Example: The newborn weighs 3500 grams.;

If not weighed, clearly state Not Weighed. (Write the proposed name for the child. This proposed name may change during birth registration.

In cases of surgical childbirth or childbirth under 32 weeks gestation or both, note one of the following in the remarks section: "surgical childbirth", "birth under 32 weeks gestation", or "surgery, birth under 32 weeks gestation". (Date:

22. Midwife: (for births at healthcare facilities). In cases of home births or births at places other than healthcare facilities but assisted by healthcare workers or midwives, the specific name and position of the person assisting should be recorded. Example: Midwife

In cases of home births or births at places other than healthcare facilities but assisted by healthcare workers or midwives, if the health station issues the Birth Certificate through village health workers, the health station director records and confirms, signs, stamps, and clearly states full name.

Pursuant to Article 16 of the Law on Household Registration dated November 20, 2014;

Pursuant to Decree No. 10/2015/NĐ-CP dated January 28, 2015 of the Government on Assisted Reproductive Technology and Conditions for Humanitarian Surrogacy;logoPursuant to Decree No. 63/2012/NĐ-CP dated August 31, 2012 of the Government on the Functions, Tasks, and Organizational Structure of the Ministry of Health;

At the proposal of the Director of the Department of Maternal and Child Health, the Director of the Legal Department,

The Minister of Health issues this Circular amending and supplementing Article 2 of Circular No. 17/2012/TT-BYT dated October 24, 2012 issued by the Minister of Health regarding issuance and use of Birth Certificates" The Minister of Health,

Circular No. 27/2019/TT-BYT dated September 27, 2019 issued by the Minister of Health amends some provisions of Circular No. 17/2012/TT-BYT dated October 24, 2012 issued by the Minister of Health regarding issuance and use of Birth Certificates, based on the following grounds:

Pursuant to Article 16 of the Law on Household Registration dated November 20, 2014;

Pursuant to Article 5 of Decree No. 123/2015/NĐ-CP dated November 15, 2015 of the Government detailing certain provisions and implementation measures of the Law on Household Registration;

Implementing Decision No. 101/QĐ-TTg dated January 23, 2017 of the Prime Minister approving the National Program on Household Registration and Population Statistics for the period 2017-2024;

Pursuant to the Government's Decree No. 75/2017/NĐ-CP dated June 20, 2017 stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health;

The Minister of Health issues this Circular amending some provisions of Circular No. 17/2012/TT-BYT dated October 24, 2012 issued by the Minister of Health regarding issuance and use of Birth Certificates.No.This Point is amended pursuant to Clause 1, Article 1 of Circular No. 34/2015/TT-BYT, effective from December 14, 2015.

The model of Birth Certificate will be published on the Ministry of Health's website. Provincial Departments of Health and healthcare facilities can access it on the Ministry of Health's website to print and use.

The Director of the Department of Maternal and Child Health; the Director of the Legal Department; Heads of units under and affiliated with the Ministry of Health; Directors of Provincial Departments of Health and relevant agencies, organizations, and individuals shall be responsible for implementing this Circular.FUNCTIONS, DUTIES, POWERS, ORGANIZATIONAL STRUCTURE, OPERATIONAL REGULATIONS, AND RELATIONSHIPS OF MANAGEMENT BOARDS; DUTIES, POWERS OF THE CHAIRPERSON, VICE CHAIRPERSON (IF ANY), SECRETARY, AND MEMBERS OF MANAGEMENT BOARDSDuring the implementation process, if there are difficulties or obstacles, agencies, organizations, and individuals are requested to promptly report them to the Department of Maternal and Child Health, Ministry of Health for consideration and resolution.” Cthe electronic portal of the Ministry of Health. Article 2 of Circular No. 27/2019/TT-BYT takes effect from December 1, 2019, and is stipulated as follows:

Article 2. Implementation clause

1. This Circular takes effect from December 1, 2019.

2. Point b Clause 2, Article 2, Clause 2 Article 5, and Appendix 02 of Circular No. 17/2012/TT-BYT dated October 24, 2012, of the Minister of Health on the issuance and use of Birth Certificates are abolished from the date this Circular takes effect.No. The Director of the Maternal and Child Health Department; Heads of units under and directly under the Ministry of Health; Directors of Health Departments of provinces and centrally governed cities; and related agencies, organizations, and individuals are responsible for implementing this Circular.

3. The Head of the Maternal and Child Health Department; Heads of units under and directly under the Ministry of Health; Directors of Health Departments of provinces and centrally governed cities; and related agencies, organizations, and individuals shall be responsible for implementing this Circular.

During the process of implementation, if there are difficulties or obstacles, it is requested that agencies, organizations, and individuals promptly report to the Ministry of Health (Maternal and Child Health Department) for consideration and resolution./.
