DECREE
Amending and supplementing certain Articles of Decree No. 158/2007/NĐ-CP dated October 27, 2007 of the Government on the list of job positions and regular rotation periods for cadres, civil servants, and public officials
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Law on Prevention and Combating Corruption No. 55/2005/QH11 amended and supplemented by some Articles according to Law No. 01/2007/QH12 and Law No. 27/2012/QH13;
Pursuant to the Law on Public Officials and Civil Servants dated November 13, 2008;
Pursuant to the Civil Servant Law dated November 15, 2010;
At the request of the Minister of Home Affairs,
The Government promulgates this Decree amending and supplementing certain Articles of Decree No. 158/2007/NĐ-CP dated October 27, 2007 of the Government on the list of job positions and regular rotation periods for cadres, civil servants, and public officials.
Article 1. Amending and supplementing certain Articles of Decree No. 158/2007/NĐ-CP dated October 27, 2007 of the Government on the list of job positions and regular rotation periods for cadres, civil servants, and public officials, as follows:
1. Clause 2 shall be amended and supplemented as follows:
"Article 2. Scope of Application
1. This Decree applies to cadres, civil servants, and public officials who do not hold leadership or management positions working at the following agencies, organizations, and units:
a) Ministries, ministerial-level agencies, and government-affiliated agencies;
b) Office of the President; Office of the National Assembly; State Audit Agency; People's Courts, People's Procuratorates at all levels; Military Courts, Military Procuratorates at all levels;
c) People's Councils, People's Committees at all levels; specialized agencies under provincial and district-level People's Committees;
d) Agencies of political organizations, political-social organizations from commune level upwards;
đ) Public service units of the Party, state, and political-social organizations;
e) Agencies, organizations, and units under the armed forces;
g) Social-political occupational organizations, social organizations, social-occupational organizations, and other agencies, organizations, and units using state budget and assets.
2. The rotation of cadres, civil servants, and public officials holding leadership or management positions shall be carried out in accordance with regulations on cadre rotation.”
2. Clause 1 of Article 3 shall be amended and supplemented as follows:
“1. "Regular rotation of job positions" means the head of the agency, organization, or unit with authority decides to transfer, arrange, and reassign job positions for cadres, civil servants, and public officials who have reached the regular rotation period at job positions within the fields, industries, and professions specified in this Decree.”
3. Supplement Point e Clause 1 Article 4 as follows:
“e. The implementation of regular rotation of job positions for public officials, in addition to complying with the general provisions of this Decree, must also be based on the employment contracts signed with public service units.”
4. Article 7 shall be amended and supplemented as follows:
Article 7. Regular Rotation Period
The rotation period for job positions ranges from two years (24 months) to five years (60 months) depending on the characteristics of each industry and field.
The Minister, Head of a ministerial-level agency, Head of a government-affiliated agency, and Heads of agencies specified in Point b Clause 1 Article 2 of this Decree shall issue documents specifying the specific regular rotation periods for job positions within their respective areas of national administration.”
5. Clause 1 Article 11 is amended and supplemented as follows:
“1. For agencies, organizations, and units that only have one position in the list of regular rotation of job positions, and this position has different professional requirements than other positions within the agency, organization, or unit, the regular rotation of job positions shall be proposed by the head of the agency, organization, or unit using cadres, civil servants, and public officials to the competent authority at the immediate higher level for decision on rotation.”
Article 2. Effective Date
This Decree takes effect from December 20, 2013.
Article 3. Responsibility for Implementation
Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairmen of provincial People's Committees, and directly affiliated city People's Committees, and related agencies and organizations are responsible for implementing this Decree./.
