Pursuant to Decree No. 15/2017/NĐ-CP dated February 17, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to the Law on Product Quality and Goods Quality dated November 21, 2007;
Pursuant to the Law on Standards and Technical Regulations dated June 29, 2006;
Pursuant to Decree No. 154/2018/NĐ-CP dated November 9, 2018 amending, supplementing, and abolishing certain regulations on investment and business conditions within the scope of state management of the Ministry of Science and Technology and certain inspection regulations;

At the proposal of the Director of the Directorate of Quality Assurance for Agricultural, Forestry, and Aquatic Products;The Minister of Agriculture and Rural Development issues this Circular on the issuance of the List of products and goods with potential to cause safety hazards (Group 2 products and goods) under the management responsibility of the Ministry of Agriculture and Rural Development.Issuing the List of products and goods with potential to cause safety hazards (Group 2 products and goods) under the management responsibility of the Ministry of Agriculture and Rural Development attached as Appendix to this Circular.
1. This Circular takes effect from February 3, 2022.
2. Circular No. 14/2018/TT-BNNPTNT dated October 29, 2018 of the Minister of Agriculture and Rural Development on the issuance of the List of products and goods with potential to cause safety hazards under the management responsibility of the Ministry of Agriculture and Rural Development shall cease to be effective from the date this Circular takes effect.
Article 1. 3. For products and goods that have not yet been issued with National Technical Regulations or National Standards, the management of Group 2 product quality shall not be applied according to this Circular until such National Technical Regulations or National Standards are issued and become effective. Such National Technical Regulations or National Standards must be issued within no more than 24 months from the date this Circular takes effect.
Article 2. Implementation
In case legal documents, National Technical Regulations, National Standards, and documents used as inspection references cited and applied in this Circular are amended, supplemented, replaced, or newly issued, they shall be implemented according to the new documents.
4. The corresponding Harmonized System code for Group 2 products and goods is detailed in Circular No. 11/2021/TT-BNNPTNT dated September 20, 2021 of the Minister of Agriculture and Rural Development issuing the Harmonized System code list for goods under the authority of the Ministry of Agriculture and Rural Development and the list of goods subject to specialized inspections in the agricultural and rural development sector.
5. During the implementation process, if there are any difficulties, agencies, organizations, and individuals shall promptly report to the Ministry of Agriculture and Rural Development for consideration and amendment.
