Amending and supplementing certain provisions of Circular No. 41/2020/TT-BGDĐTdated November 3, 2020 issued by the Minister of Education and Training

Repealing certain legal normative documents issued by the Minister of Education and Training

in the field of education Pursuant to Decree No. 34/2016/NĐ-CP dated May 14, 2016 of the Government detailing certain provisions and measures for implementing the Law on Enacting Legal Normative Documents; Decree No. 154/2020/NĐ-CP dated December 31, 2020 of the Government amending and supplementing certain provisions of Decree No. 34/2016/NĐ-CP dated May 14, 2016 of the Government detailing certain provisions and measures for implementing the Law on Enacting Legal Normative Documents;

Pursuant to Decree No. 86/2022/NĐ-CP dated October 24, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;

Pursuant to the Law on Legislative Regulatory Documents dated June 22, 2015; the Law Amending and Supplementing Certain Provisions of the Law on Legislative Regulatory Documents dated June 18, 2020;

The Minister of Education and Training issues this Circular amending and supplementing certain provisions of Circular No. 41/2020/TT-BGDĐT dated November 3, 2020 issued by the Minister of Education and Training, which repeals certain legal normative documents issued by the Minister of Education and Training in the field of education.

Article 1. Supplementing Clause 1a into Circular No. 41/2020/TT-BGDĐT dated November 3, 2020 issued by the Minister of Education and Training, which repeals certain legal normative documents issued by the Minister of Education and Training in the field of education, as follows:

At the proposal of the Director of the Legal Department;

"Clause 1a. Transitional Provisions

For preschool and general education institutions subject to conversion according to the provisions of Circular No. 11/2009/TT-BGDĐT dated May 8, 2009 issued by the Minister of Education and Training regarding the procedures and formalities for converting public-private partnership preschool and general education institutions, private preschool and general education institutions, and public-private partnership preschool and general education institutions into private preschool and general education institutions, public preschool institutions into public preschool institutions, and public-private partnership preschool and general education institutions into public preschool and general education institutions (Circular No. 11/2009/TT-BGDĐT), if such conversion has not been completed, it must be completed in accordance with the provisions of Circular No. 11/2009/TT-BGDĐT before June 30, 2025."

1. This Circular takes effect from November 20, 2023.

2. The Director of the Office, Heads of Departments under the Ministry of Education and Training; Chairpersons of People's Committees of provinces and centrally governed cities; Directors of Departments of Education and Training, and related organizations and individuals are responsible for implementing this Circular./.

Article 2. Effective Date

1. This Circular takes effect from November 20, 2023.

2. The Head of the Office, the Director of the Legal Department, the Heads of relevant units under the Ministry of Education and Training; the Chairpersons of the People's Committees of provinces and centrally governed cities; the Directors of Departments of Education and Training and related organizations and individuals are responsible for implementing this Circular./.
