CIRCULAR

REGULATIONS ON THE CONSIDERATION FOR AWARDED MEMORIAL MEDAL "FOR THE FINANCE OF VIETNAM"

Pursuant to the Law on Competition and Reward dated November 26, 2003, the Law Amending and Supplementing Certain Articles of the Law on Competition and Reward in 2005 and 2013;

Pursuant to Decree No. 87/2017/NĐ-CP dated July 26, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

Pursuant to Decree No. 91/2017/NĐ-CP dated July 31, 2017 of the Government detailing the implementation of certain articles of the Law on Competition and Reward;

At the proposal of the Director of the Department of Competition and Reward,

The Ministry of Finance issues this Circular stipulating the principles, subjects, criteria, procedures for proposing, deciding to award, organizing the presentation, and rights and responsibilities of individuals awarded the Memorial Medal "For the Finance of Vietnam".

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular stipulates the principles, subjects, criteria, procedures for proposing, deciding to award, organizing the presentation, and rights and responsibilities of individuals awarded the Memorial Medal "For the Finance of Vietnam". Finance of Vietnam”.

Article 2. Applicability

1. Individuals eligible for consideration for the Memorial Medal "For the Finance of Vietnam" Finance of Vietnam”.

2. The Ministry of Finance and other relevant agencies and organizations involved in proposing the consideration for the Memorial Medal "For the Finance of Vietnam" Finance of Vietnam”.

Article 3. Memorial Medal "For the Finance of Vietnam"

1. The Memorial Medal "For the Finance of Vietnam" (hereinafter referred to as the Memorial Medal) is a form of award granted by the Ministry of Finance to recognize the achievements and contributions of individuals who have made significant contributions to the construction and development of the Finance sector in Vietnam.

2. The Memorial Medal has an emblem, shape, size, and color that reflect the characteristics of the Finance sector in Vietnam, consistent with the general regulations of the State, accompanied by the Memorial Medal is a Certificate of Awarding the Memorial Medal "For the Finance of Vietnam".

Article 4. Principles for awarding Commemorative Medals

1. The Memorial Medal is awarded once to individuals meeting the conditions and criteria; it is not awarded to those who have already been awarded the Medal "For the Finance of Vietnam".

2. The Memorial Medal is awarded annually in August each year, except in cases of urgency decided by the Minister of Finance.

3. The consideration for the Memorial Medal must be carried out in accordance with the subjects, criteria, procedures prescribed in this Circular.

Chapter II

RECIPIENTS AND CRITERIA FOR AWARDING COMMENDATION MEDALS

Article 5. Subjects eligible for consideration for the Memorial Medal

1. Civil servants, public officials, employees currently working in agencies and units under the Finance sector, or engaged in financial and accounting work, including:

a) Civil servants, public officials, employees working at agencies and units, enterprises under, directly under the Ministry of Finance;

b) Public officials, employees working at agencies and units under the Provincial Finance Departments; of centrally governed cities and provinces;

c) Public officials engaged in financial and accounting work at District Financial Planning Departments of provincial-level cities, districts, towns under central provinces (hereinafter collectively referred to as District Financial Departments);

d) Public officials engaged in financial and accounting work at People's Committees of communes, wards, towns;

đ) Public officials engaged in financial and accounting work at the Finance Departments of Ministries, sectors, central agencies; Finance Departments of General Bureaus under Ministries.

2. Civil servants, public officials, employees in the Finance sector who die while performing their duties are recognized as Martyrs.

3. Individuals with outstanding achievements in leading and directing, contributing to the construction and development of the Finance sector in Vietnam, including:

a) Leaders of the Party and State; Leaders of central political social organizations (Vietnam Fatherland Front, Vietnam Women's Union, Vietnam General Confederation of Labor, Ho Chi Minh Communist Youth Union, Vietnam Farmers' Association, Vietnam Veterans' Association);

b) Leaders of central ministries, sectors (Ministers, Deputy Ministers (and equivalents) responsible for finance work);

c) Leaders of provinces and centrally-administered cities (Secretaries, Deputy Secretaries of provincial and municipal Party Committees; Chairmen, Vice Chairmen of Provincial People's Councils, Chairmen, Vice Chairmen of Provincial People's Committees).

4. Individuals who are overseas Vietnamese or foreigners who have made significant contributions to the construction and development of the Finance sector in Vietnam.

5. Special cases as proposed by departments, bureaus, units under the Ministry of Finance, Provincial Finance Departments of provinces and cities and the Director of the Department of Competition and Reward of the Ministry of Finance.

Article 6. Subjects not eligible for or yet to be considered for the Commendation Medal

1. The Commendation Medal shall not be awarded to individuals who have been disciplined with compulsory dismissal or are being pursued for criminal responsibility.

2. Individuals under disciplinary review, those currently serving a disciplinary measure of reprimand or higher, and those under investigation, prosecution, or trial shall not be considered for the Commendation Medal.

Article 7. Criteria for awarding the Commendation Medal to individuals working in agencies and units under the Finance sector or engaged in finance and accounting work

1. The Minister and Deputy Ministers of the Ministry of Finance shall not be counted for years of service when considering for the Commendation Medal.

2. Individuals falling within the scope defined in Clause 1, Article 5 of this Circular, who have a total period of service in the Finance sector of twenty years or more for males (non-convertible), fifteen years or more for females (non-convertible), and have satisfactorily completed assigned tasks.

3. Individuals transferred from other sectors to work in the Finance sector who have not met the required service period stipulated in Clause 2 of this Article will be considered for the Commendation Medal before retirement if they have thirty years or more of continuous service for males, twenty-five years or more for females, including over five years (sixty months or more) of service in the Finance sector.

4. Calculation of service time for consideration of the Commendation Medal:

a) Service time for current employees is calculated up to June 30 of the year the award is proposed; for retired individuals, it is calculated up to their retirement date; for deceased individuals, it is calculated up to the date of death.

b) For individuals dispatched by competent authorities to work in agencies and units outside the Finance sector or to perform military service, and then return to work in the Finance sector: the time spent working in other sectors and the time spent on military service shall still be counted as service time in the Finance sector.

c) For individuals who have worked in agencies and units that were merged into the Finance sector (Customs, Price Control, National Reserves from central to local levels, and State Securities Commission): the service time in the Finance sector includes the time spent working in these units prior to the merger into the Finance sector.

d) For individuals with non-continuous service time in the Finance sector (transferred out of the sector and later transferred back to units under the Finance sector), the service time in the Finance sector is accumulated based on the total time worked in agencies and units under the Finance sector; twelve months of service is counted as one year of service in the Finance sector.

e) In cases where individuals were previously disciplined, the period of disciplinary execution (including the period before the discipline was removed) shall not be counted towards the service time for the Commendation Medal; such individuals may only be considered for the Commendation Medal three years after the end of the disciplinary period.

Article 8. Criteria for awarding the Commendation Medal to individuals outside the Finance sector who have made significant contributions to the construction and development of the Finance sector in Vietnam

1. Individuals falling within the scope defined in Clause 3, Article 5 of this Circular must have outstanding achievements in leading and directing efforts contributing to the construction and development of the Finance sector in Vietnam.

2. For positions of Deputy Chairpersons of People's Councils and Deputy Chairpersons of People's Committees at provincial and centrally-administered city levels, there must be a minimum of five years of tenure and responsibility for financial and budgetary work.

Article 9. Criteria for awarding Commemorative Medals to individuals who are overseas Vietnamese or foreigners with significant contributions to the construction and development of the Vietnamese Finance sector

1. Individuals falling under the subject defined in Clause 4, Article 5 of this Circular must have outstanding achievements and merits in new rural areas and strengthening relations cooperation international, making positive contributions to the construction and development of the Vietnamese Finance sector.

2. Foreigners working in diplomatic agencies and international organizations in Vietnam, upon completion of their term of service, must have made significant contributions to assisting the Vietnamese Finance sector in various aspects: expanding financial cooperation relationships with other countries and international financial organizations; mobilizing support from international organizations and financiers in terms of spirit and material, or providing advisory, training, technical assistance... contributing to the Vietnamese Finance sector during the process integration and international financial cooperation.

3. Other special cases of diplomatic nature.

Chapter III

DOCUMENTS AND PROCEDURES FOR AWARDS OF COMMENDATION MEDALS

Article 10. Documents for proposing awards of Commemorative Medals

1. The documents for proposing awards of Commemorative Medals include:

a) A proposal from the unit proposing the award of the Commemorative Medal;

b) A list of individuals proposed for the award of the Commemorative Medal according to Model No. 01 issued together with this Circular;

c) A summary of the work history of the individual according to Model No. 02 issued together with this Circular (applicable to individuals specified in Clause 1, Article 5 of this Circular).

For the General Tax Department, the General Customs Department, the State Reserve Administration and the KBNN (hereinafter referred to collectively as the Departments under the Ministry): The documents are sent to the Department of Mobilization and Awards of the Ministry of Finance including the proposal and the list of individuals proposed for the award of the Commemorative Medal; The summary of the work history of the individual is kept at the Department.

2. Heads of agencies, units, enterprises under the Finance sector are responsible for preparing documents and proposing awards of Commemorative Medals for individuals under their management who meet the criteria stipulated in this Circular.

For those who have retired, transferred jobs, passed away... the unit directly managing the staff before retirement, job transfer, death... is responsible for preparing the documents.

3. The documents are prepared in one set and sent to the Ministry of Finance (through the Department of Mobilization and Awards) no later than July 31 each year.

For exceptional cases, the time for submitting documents does not necessarily follow this regulation.

Article 11. Procedures for awarding Commemorative Medals

1. The Department of Mobilization and Awards is responsible for receiving, compiling documents for the proposal of Commemorative Medals; reviewing and appraising the documents and presenting them to the Minister of Finance for decision.

2. For the subjects specified in point a, Clause 3, Article 5 of this Circular: The Office of the Ministry of Finance compiles the list of proposals for awarding and sends it to the Department of Mobilization and Awards..

3. For the Departments under the Ministry of Finance:

a) Heads of units under the Departments are responsible for preparing complete documents according to Article 10 and sending them to the Departments for consolidation and submission to the Ministry of Finance.

b) The Departments are responsible for reviewing and compiling a list of individuals meeting the conditions for awarding Commemorative Medals and sending it to the Ministry of Finance (through the Department of Mobilization and Awards).

4. For the subjects specified in points b, c, d, Clause 1, Article 5 and point c, Clause 3, Article 5 of this Circular:

a) Heads of agencies and units prepare complete documents for individuals meeting the conditions for awarding according to Article 10 and send them to the Provincial Finance Departments.

b) The Provincial Finance Departments are responsible for reviewing, appraising, and compiling a list of individuals meeting the conditions for awarding Commemorative Medals and sending it to the Ministry of Finance (through the Department of Mobilization and Awards).

5. For the subjects specified in Clause 4, Article 5 of this Circular:

a) Heads of units having working relationships with international financial organizations, foreign organizations, and projects consider the achievements of individuals contributing to the Finance sector and propose the award of Commemorative Medals to individuals meeting the conditions for awarding according to Article 9 of this Circular and send them to the Ministry of Finance (through the Department of Mobilization and Awards).

b) The Department of Mobilization and Awards seeks the appraisal opinion of the Department of International Cooperation of the Ministry of Finance before presenting to the Ministry.

6. For the subjects specified in point e, Clause 1, Article 5 and point b, Clause 3, Article 5 of this Circular:

a) Heads of ministries, central agencies, and departments prepare complete documents for individuals meeting the conditions for awarding according to Article 10 of this Circular and send them to the Ministry of Finance (through the Department of Mobilization and Awards).

b) The Department of Mobilization and Awards seeks opinions on the results of collaboration in financial management from the Department of Administrative and Public Service Finance, the Department of Defense and Security Finance, especially (Ministry of Finance) before presenting to the Ministry.

Article 12. Organization of awarding Commemorative Medals

1. The awarding of Commemorative Medals takes place annually on the occasion of the Traditional Day of the Finance Industry of Vietnam (August 28).

2. The Ministry of Finance organizes the awarding of Commemorative Medals to Party and State leaders, and leaders of central political social organizations on the occasion of the anniversary of the establishment of the Finance Industry in even-numbered years.

Leaders of the Ministry of Finance organize the awarding of Commemorative Medals to leaders of ministries, sectors, and localities.

3. The Ministry of Finance requests leaders of ministries, agencies, sectors, and localities to organize the awarding of Commemorative Medals to individuals within their management scope.

4. The Ministry of Finance delegates to heads of agencies and units under the Finance Industry to organize the awarding of Commemorative Medals to individuals within their management.

Chapter IV

RIGHTS AND RESPONSIBILITIES OF ORGANIZATIONS AND INDIVIDUALS PROPOSING TO AWARD COMMENDATION MEDALS

Article 13. Benefits for recipients of Commemorative Medals

Receiving a Commemorative Medal, receiving a Certificate of Commendation Medal "For the Cause of Vietnam's Finance".

Article 14. Responsibilities of recipients of Commemorative Medals

1. Recipients of Commemorative Medals have the responsibility to preserve, maintain, and display the Commemorative Medal and the Certificate of Commendation Medal "For the Cause of Vietnam's Finance" with dignity.

2. Setting an example in implementing well the policies and guidelines of the Party and the laws and policies of the State, continuing to promote the traditions of Vietnam's Finance Industry.

Article 15. Rights and responsibilities of organizations and individuals proposing to award Commemorative Medals

1. Organizations and individuals proposing to award Commemorative Medals bear responsibility for the accuracy and honesty of the proposal files.

2. Organizations and individuals proposing to award Commemorative Medals have the right to appeal and report violations regarding the proposal and awarding of Commemorative Medals according to the provisions of the law on appeals and reports.

Article 16. Handling Violations

When discovering that any individual has reported inaccurately about the criteria for being awarded a Commemorative Medal, that individual will be removed from the Decision to award the Commemorative Medal and the awarding items will be recalled; at the same time, appropriate disciplinary measures will be considered based on the nature and severity of the violation.

The unit proposing to award the Commemorative Medal to that individual has the responsibility to establish procedures to submit to the Ministry of Finance (through the Department of Mobilization and Awards) to revoke the decision to award the Commemorative Medal and recall the awarding items to be handed over to the Ministry of Finance.

Article 17. Handling appeals and reports

The procedures, formalities, deadlines, and authority for handling appeals and reports on the awarding of Commemorative Medals shall be carried out in accordance with the provisions of the law on appeals and reports.

Chapter V

IMPLEMENTING PROVISIONS

Article 18. Effective Date

This Circular takes effect 45 days from the date of signature and replaces the Regulation on awarding Commemorative Medals "For the Cause of Vietnam's Finance" issued together with Decision No. 42/2005/QĐ-BTC dated July 7, 2005 of the Ministry of Finance.

Article 19. Implementation a) Report to the Ministry of Natural Resources and Environment on the results of training and upgrading, including listing the teaching staff participating in teaching, evaluating the participation of trainees in the training process, the results of organizing examinations for completing the training and upgrading program on land valuation business, the issuance of Certificates and the use of Certificate codes, summarizing the feedback from trainees on the quality of the training and upgrading program on land valuation business, and other relevant matters.

1. Heads of agencies, unit under the Ministry of Finance, Directors of Provincial Departments of Finance, and related agencies, units, and individuals are responsible for organizing and implementing this Circular.

2. During the implementation process, if there are difficulties or obstacles, the heads of agencies and units should promptly reflect to the Department of Mobilization and Awards of the Ministry of Finance for reporting to the Ministry of Finance to consider timely amendments and supplements.
