CIRCULAR

Announcement of the port waters within the jurisdiction of Kiên Giang Province, Cà Mau Province, and the management area of the Kiên Giang Maritime Port Office

Pursuant to the Vietnam Maritime Code on November 25, 2015;

Pursuant to Decree No. 12/2017/NĐ-CP dated February 10, 2017, issued by the Government on the functions, tasks, powers, and organizational structure of the Ministry of Transport;

1. Amending Clause 2 Article 2 as follows:

At the proposal of the Director of the Legal Department and the Director General of the Vietnam Maritime Administration;

The Minister of Transport issues this Circular to announce the port waters within the jurisdiction of Kiên Giang Province, Cà Mau Province, and the management area of the Kiên Giang Maritime Port Office.

Article 1. Announcement of the port waters within the jurisdiction of Kiên Giang Province and Cà Mau Province

The port waters within the jurisdiction of Kiên Giang Province and Cà Mau Province include the following areas:

1. The port waters of Kiên Giang Province include:

a) The port waters of Kiên Giang Province at Hòn Chông area;

b) The port waters of Kiên Giang Province at Bình Trị area;

c) The port waters of Kiên Giang Province at Hà Tiên area;

d) The port waters of Kiên Giang Province at An Thới area;

đ) The port waters of Kiên Giang Province at Bãi Vòng area;

e) The port waters of Kiên Giang Province at Đá Chồng area;

g) The port waters of Kiên Giang Province at Rạch Giá area.

2. The port waters of Cà Mau Province include:

a) The port waters of Cà Mau Province at Năm Căn area;

b) The port waters of Cà Mau Province at offshore oil port area near the Sông Đốc field.

Article 2. Scope of the port waters within the jurisdiction of Kiên Giang Province and Cà Mau Province

The scope of the port waters within the jurisdiction of Kiên Giang Province and Cà Mau Province is defined according to the highest tide level as follows:

1. The scope of the port waters of Kiên Giang Province includes:

a) The scope of the port waters of Kiên Giang Province at Hòn Chông area:

The seaward boundary is limited by straight lines connecting points HC1, HC2, HC3, HC4, and HC5 with the following coordinates:

HC1: 10°09'03" N, 104°36'00" E;

HC2: 10°09'12" N, 104°34'00" E;

HC3: 10°00'00" N, 104°33'36" E;

HC4: 10°00'00" N, 104°35'36" E;

HC5: 10°08'41" N, 104°35'58" E. (Adjoining the southern side of the Hòn Chông lighthouse)

The landward boundary runs from point HC1 along the coastline southwards to point HC5.

b) The scope of the port waters of Kiên Giang Province at Bình Trị area:

The seaward boundary is limited by straight lines connecting points BT1, BT2, BT3, BT4, and BT5 with the following coordinates:

BT1: 10°14'18" N, 104°35'12" E;

BT2: 10°14'24" N, 104°24'00" E;

BT3: 10°10'36" N, 104°24'00" E;

BT4: 10°11'36" N, 104°32'36" E;

BT5: 10°11'00" N, 104°35'20" E.

The landward boundary runs from point BT1 along the coastline southwards to point BT5.

c) The scope of the port waters of Kiên Giang Province at Hà Tiên area:

The seaward boundary is limited by straight lines connecting points HT1, HT2, HT3, and HT4 with the following coordinates:

HT1: 10°21'56" N, 104°26'36" E;

HT2: 10°18'24" N, 104°24'12" E;

HT3: 10°17'30" N, 104°25'36" E;

HT4: 10°21'59" N, 104°28'36" E.

The landward boundary runs from point HT1 along the coastline to the mouth of Tô Châu River (foot of Tô Châu Bridge), then follows the left bank of the river (from the sea inward) to the position with coordinates: 10°22'56" N, 104°29'15" E (Dong Ho Ward, Ha Tien City, Kien Giang Province), 760 meters upstream from Tô Châu Bridge, crosses the river to the right bank of Tô Châu River at the position with coordinates: 10°22'50" N, 104°29'19" E (To Chau Ward, Ha Tien City, Kien Giang Province), continues along the embankment to point HT4.

d) The scope of the port waters of Kiên Giang Province at An Thới area:

The seaward boundary is limited by straight lines connecting points AT1, AT2, AT3, AT4, AT5, AT6, and AT7 with the following coordinates:

AT1: 10°14'30" N, 103°56'47" E;

AT2: 10°14'30" N, 103°50'00" E;

AT3: 09°56'12" N, 104°00'00" E;

AT4: 09°56'12" N, 104°02'42" E;

AT5: 09°59'30" N, 104°02'24" E;

AT6: 10°00'18" N, 104°01'42" E;

AT7: 10°00'46" N, 104°00'54" E.

The landward boundary runs from point AT1 along the coastline southwards to point AT7.

đ) The scope of the port waters of Kiên Giang Province at Bãi Vòng area:

The seaward boundary is limited by straight lines connecting points BV1, BV2, BV3, and BV4 with the following coordinates:

BV1: 10°12'48" N, 104°04'24" E;

BV2: 10°12'48" N, 104°07'06" E;

BV3: 10°00'19" N, 104°04'08" E;

BV4: 10°00'19" N, 104°03'08" E (Mr. Đội's Cape).

The landward boundary runs from point BV1 along the coastline southwards to point BV4.

e) The scope of the port waters of Kiên Giang Province at Đá Chồng area:

The seaward boundary is limited by straight lines connecting points ĐC1, ĐC2, ĐC3, and ĐC4 with the following coordinates:

ĐC1: 10°23'00" N, 104°04'18" E;

ĐC2: 10°23'00" N, 104°08'36" E;

ĐC3: 10°20'00" N, 104°08'36" E;

ĐC4: 10°20'00" N, 104°04'36" E.

The landward boundary runs from point ĐC1 along the coastline southwards to point ĐC4.

g) The scope of the port waters of Kiên Giang Province at Rạch Giá area:

The seaward boundary is limited by straight lines connecting points RG1, RG2, RG3, RG4, RG5, and RG6 with the following coordinates:

RG1: 10°00'42" N, 105°04'00" E;

RG2: 09°59'34" N, 105°02'00" E;

RG3: 09°59'34" N, 104°56'00" E;

RG4: 09°58'00" N, 104°56'00" E;

RG5: 09°58'00" N, 105°02'42" E;

RG6: 10°00'28" N, 105°04'36" E. (Adjoining the southwestern side of the Rạch Giá lighthouse)

The landward boundary runs from point RG1 along the embankment of the urban area reclaimed from the sea in the northwest direction (from the sea inward) including Rach Gia port wharf to 50 meters downstream from the Kiên River sluice, crossing the river parallel to the Kiên River sluice, continuing along the embankment of the 16-hectare urban reclaimed area to point RG6.

2. The scope of the port waters of Cà Mau Province includes:

a) The scope of the port waters of Cà Mau Province at Năm Căn area:

The seaward boundary is limited by straight lines connecting points NC1, NC2, NC3, NC4, and NC5 with the following coordinates:

NC1: 08°44'30"N, 105°13'48" E;

NC2: 08°44'30"N, 105°20'00" E;

NC3: 08°40'00"N, 105°20'00" E;

NC4: 08°40'00"N, 105°13'12" E;

NC5: 08°44'30"N, 105°13'12" E.

HK2

The boundary in the Hòn Khoai Island area is the water area limited by circles with a radius of 1.5 nautical miles, centered at points HK1 and HK2 with the following coordinates:

HK1: 08°24'20" N, 104°49'50" E;

HK2: 08°27'20" N, 104°49'36" E.

The boundary in the Hòn Chuối area is the water area limited by a circle with a radius of 1.5 nautical miles, centered at point HC with the following coordinates: 08°58'00"N, 104°33'00"E;

The boundary in the Ông Đốc area is the water area limited by a circle with a radius of 1.5 nautical miles, centered at point SD with the following coordinates: 09°02'00"N, 104°46'00"E;

The boundary at the Mui Tram area: is the water area limited by a circle with a radius of 1.5 nautical miles, with its center at point MT having coordinates: 09o14'00"N, 104o45'00"E.

b) The scope of the water area of the Ca Mau sea port in the offshore oil and gas port area of the Song Doc field: is limited by a circle with a radius of 01 nautical mile, with its center at point SD having coordinates: 07o09'39"N, 104o03'21"E.

3. The boundary of the river mouth and creek within the water area defined in points b, d and đ of Clause 1 of this Article is limited by a straight line connecting the two most protruding points on the banks of that river mouth or creek.

4. The boundary of the water area of the sea port specified in this Article is determined on Chart number IA-100-31 published in 2008, Chart IA-100-32, first reprint edition in 2006 and Chart published in the first edition in 2016 (numbers VN300033, VN300034, VN4RG001, VN5AT001, VN4HT001, VN300029, VN300030, VN300031, VN300032, VN4NC001, VN4NC002, VN4NC003) of the Southern Maritime Safety Assurance Corporation which has been updated to the latest version in 2020. The coordinates of the points specified in this Article are applied according to the VN-2000 coordinate system and are converted to corresponding coordinate systems as set out in the Appendix issued together with this Circular.

The Director of the Vietnam Maritime Administration shall organize the announcement of pilot reception areas, quarantine zones, anchorage areas, cargo transfer zones, and storm shelters for vessels entering and leaving the Thai Binh seaport, Nam Dinh seaport, and other related water areas as prescribed.

The Director of the Vietnam Maritime Administration shall organize the announcement of pilot reception areas, quarantine zones, anchorage areas, transshipment areas, and storm shelters for vessels entering and leaving sea ports located in the territories of Kien Giang and Ca Mau provinces and other waters and water areas as prescribed.

Article 4. Responsibilities of the Kien Giang Maritime Port Office and related parties

1. Implement tasks and powers as prescribed by the Vietnam Maritime Code and relevant legal documents regarding maritime activities at wharves and sea port water areas in the territories of Kien Giang and Ca Mau provinces.

2. Based on actual conditions such as weather, waves, tide, ship load capacity, and cargo characteristics, designate specific positions for ships to receive pilots, undergo quarantine, anchor, transship, and avoid storms within the prescribed water areas, ensuring maritime safety, security, and environmental pollution prevention.

3. Outside the sea port water areas defined in Article 2 of this Circular, the Kien Giang Maritime Port Office also bears responsibility for state management of maritime safety, security, and environmental pollution prevention in the territorial seas of Kien Giang, Ca Mau, and Bac Lieu provinces.

4. The Vietnam Inland Waterways Administration is responsible for organizing management, maintenance, ensuring safety, security, and preventing environmental pollution on inland waterway routes within the sea port water areas of Ca Mau and Kien Giang as prescribed by law.

Article 5. Effective Date

1. This Circular takes effect from October 1, 2020.

2. Repeal Circular No. 47/2018/TT-BGTVT dated August 24, 2018 of the Minister of Transport announcing the water areas of sea ports in the territory of Kien Giang province and the management area of the Kien Giang Maritime Port Office and Circular No. 09/2014/TT-BGTVT dated April 18, 2014 of the Minister of Transport announcing the water areas of sea ports in the territory of Ca Mau province and the management area of the Ca Mau Maritime Port Office.

Article 6. Implementation Organization

The Head of the Ministry's Office, the Head of the Ministry's Inspectorate, the Heads of the Departments, the Directors of the Vietnam Maritime Administration, the Vietnam Inland Waterways Administration, the Department of Transport of Kien Giang Province, the Department of Transport of Ca Mau Province, the Department of Transport of Bac Lieu Province, the Director of the Kien Giang Maritime Port Office, the Heads of agencies, organizations, and individuals concerned are responsible for implementing this Circular./.
