Circular No. 17/2023/TT-BNNPTNT promulgates the Harmonized System (HS) code list for goods that are endangered, precious, and rare forest plants and animals, and animals and plants listed in the Appendices of the Convention on International Trade in Endangered Wild Fauna and Flora.

CIRCULAR

ISSUING THE HS CODE TABLE FOR WILDLIFE PLANTS AND ANIMALS IN DANGER OF EXTINCTION, RARE AND PRECIOUS SPECIES, AND WILDLIFE ANIMALS AND PLANTS LISTED IN THE APPENDICES OF THE CONVENTION ON INTERNATIONAL TRADE IN ENDANGERED SPECIES OF WILD FAUNA AND FLORA

Pursuant to Decree No. 105/2022/NĐ-CP dated December 22, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to the Convention on International Trade in Endangered Species of Wild Fauna and Flora;

Pursuant to Decree No. 69/2018/NĐ-CP dated May 15, 2018 of the Government detailing certain provisions of the Law on Management of Foreign Trade;

Pursuant to Decree No. 84/2021/NĐ-CP dated September 22, 2021 of the Government amending and supplementing certain articles of Decree No. 06/2019/NĐ-CP dated January 22, 2019 of the Government on management of endangered wildlife plants and animals, rare and precious species, and enforcement of the Convention on International Trade in Endangered Species of Wild Fauna and Flora;

At the proposal of the Director of the Forest Protection Department;

The Minister of Agriculture and Rural Development issues this Circular on the HS Code Table for wildlife plants and animals in danger of extinction, rare and precious species, and wildlife animals and plants listed in the Appendices of the Convention on International Trade in Endangered Species of Wild Fauna and Flora.

Article 1. Attached to this Circular is the HS Code Table for wildlife plants and animals in danger of extinction, rare and precious species, and wildlife animals and plants listed in the Appendices of the Convention on International Trade in Endangered Species of Wild Fauna and Flora.

Article 2. Effective Date

1. This Circular takes effect from January 30, 2024.

2. Decision No. 924/QĐ-BNN-TCLN dated March 24, 2017 of the Minister of Agriculture and Rural Development on the HS Code Table for endangered wildlife animals and plants, rare and precious species ceases to be effective from the date this Circular takes effect.

3. In cases where new regulatory legal documents change the names and groups of species in the List of Endangered Wildlife Plants and Animals, Rare and Precious Species, and Appendices of the Convention on International Trade in Endangered Species of Wild Fauna and Flora, such changes shall be applied according to those regulatory legal documents.

4. In cases where there is a change in the HS code or type of goods, such changes shall be applied according to the regulations of the Minister of Finance regarding the List of Goods for Export and Import of Vietnam.

Article 3. Responsibility for Implementation

1. The Director of the Ministry's Office, the Director of the Forest Protection Department, Deputy Ministers of units under the Ministry of Agriculture and Rural Development, and related organizations and individuals are responsible for implementing this Circular.

2. During the implementation of this Circular, if there are any difficulties, they should be promptly reported to the Ministry of Agriculture and Rural Development for guidance and resolution./.
