Decree No. 17/2026/NĐ-CP amending and supplementing certain articles of Decree No. 162/2018/NĐ-CP dated November 30, 2018 of the Government on administrative penalties in the civil aviation sector, which has been amended and supplemented by Decree No. 123/2021/NĐ-CP dated December 28, 2021 of the Government on amending and supplementing certain articles of decrees on administrative penalties in the maritime sector; road traffic; railway traffic; civil aviation and Decree No. 282/2025/NĐ-CP dated October 30, 2025 of the Government on administrative penalties in the field of security, public order, social safety; prevention and control of social evils; prevention and control of domestic violence (Decree No. 162/2018/NĐ-CP) regarding the authority to impose administrative penalties.

AMENDING AND COMPLEMENTING ARTICLE 31 OF DECREE NO. 162/2018/NĐ-CP "ARTICLE 31. AUTHORITY OF INSPECTORS 1. Inspectors of the Ministry of Public Security's Inspectorate, Vietnam Civil Aviation Authority's Inspectorate within the inspection period have the right to:

THE VIETNAM CIVIL AVIATION LAW NO. 66/2006/QH11 a) Issue a warning; THE GOVERNMENT ENACTS THE DECREE AMENDING AND COMPLEMENTING SEVERAL ARTICLES OF DECREE NO. 162/2018/NĐ-CP b) Impose a fine up to 10,000,000 VND;

c) Confiscate contraband items, means of transportation for administrative violations with a value not exceeding two times the amount of the fine prescribed in point b clause of this article.

2. The head of the inspection team of the Vietnam Civil Aviation Authority's Inspectorate, the Director of the Fire Prevention and Fighting Police Department, the provincial police chief within the inspection period have the right to: b) Impose a fine up to 50,000,000 VND; c) Confiscate contraband items, means of transportation for administrative violations; d) Apply measures to remedy consequences prescribed in clause 3 Article 4 of this Decree. 3. The Chief Inspector of the Vietnam Civil Aviation Authority's Inspectorate; the Chief Inspector of the Fire Prevention and Fighting Police Department; the Chief Inspector of the provincial police have the right to: b) Impose a fine up to 80,000,000 VND; c) Suspend the use of a license for a limited time or suspend operations for a limited time; d) Confiscate contraband items, means of transportation for administrative violations;

đ) Apply measures to remedy consequences prescribed in clause 3 Article 4 of this Decree.

4. The Chief Inspector of the Ministry of Public Security; the head of the inspection team established by the Chief Inspector of the Ministry of Public Security within the inspection period have the right to:

b) Impose a fine up to 100,000,000 VND;

đ) Apply measures to remedy consequences prescribed in clause 3 Article 4 of this Decree.".

ARTICLE 2. COMPLEMENTING ARTICLE 31a AFTER ARTICLE 31 OF DECREE NO. 162/2018/NĐ-CP

"ARTICLE 31a. AUTHORITY OF HEADS OF STATE MANAGEMENT AGENCIES

1. The Director of the Vietnam Civil Aviation Administration has the right to:

đ) Apply measures to remedy consequences prescribed in clause 3 Article 4 of this Decree.".

2. The head of the inspection team established by the Director of the Vietnam Civil Aviation Administration within the inspection period has the right to:

3. The head of the inspection team established by the Minister of Construction, the Minister of Public Security within the inspection period has the right to impose administrative sanctions according to the provisions of clause 1 of this Article.".

ARTICLE 3. AMENDING AND COMPLEMENTING ARTICLE 32 OF DECREE NO. 162/2018/NĐ-CP

"ARTICLE 32. AUTHORITY OF AIRPORT CONTROL STATIONS

đ) Apply measures to remedy consequences prescribed in clause 3 Article 4 of this Decree.".

1. The representative of the Airport Control Station has the right to:

b) Impose a fine up to 25,000,000 VND;

d) Confiscate contraband items, means of transportation for administrative violations with a value not exceeding two times the amount of the fine prescribed at point b clause of this article;

Article 2. Supplement Article 31a following Article 31 of Decree No. 162/2018/NĐ-CP

“Article 31a. Authority of the Heads of State Management Agencies

1. The Director of the Civil Aviation Administration of Vietnam shall have the right to:

đ) Apply measures to remedy consequences prescribed in clause 3 Article 4 of this Decree.".

b) Impose a fine up to VND 100,000,000;

b) Impose a fine up to 25,000,000 VND;

d) Confiscate contraband items, means of transportation for administrative violations with a value not exceeding two times the amount of the fine prescribed at point b clause of this article;

2. The Director of the Airport Control Station has the right to:

Article 3. Amend and supplement Article 32 of Decree No. 162/2018/NĐ-CP

“Article 32. Authority of Air Traffic Control Units

1. The Head of the Air Traffic Control Unit representative shall have the right to:

đ) Apply measures to remedy consequences prescribed in clause 3 Article 4 of this Decree.".

b) Impose a fine up to VND 25,000,000;

b) Impose a fine up to 25,000,000 VND;

d) Confiscate contraband items, means of transport violating administrative regulations with a value not exceeding two times the amount of the fine stipulated in point b of this clause;

Article 4. Amending and supplementing Article 33 of Decree No. 162/2018/NĐ-CP

"Article 33. Authority of the Chairman of the People's Committee

1. The Chairman of the People's Committee at the commune level has the authority:

đ) Apply measures to remedy consequences prescribed in clause 3 Article 4 of this Decree.".

2. The head of the inspection team established by the Director of the Vietnam Civil Aviation Administration within the inspection period has the right to:

b) Impose a fine up to 25,000,000 VND;

d) Confiscate contraband items, means of transportation for administrative violations with a value not exceeding two times the amount of the fine prescribed at point b clause of this article;

2. The Director of the Airport Control Station has the right to:

Article 5. Amending and supplementing Article 34 of Decree No. 162/2018/NĐ-CP

"Article 34. Authority of the People's Public Security

1. Public Security officers performing their duties have the authority:

đ) Apply measures to remedy consequences prescribed in clause 3 Article 4 of this Decree.".

ARTICLE 2. COMPLEMENTING ARTICLE 31a AFTER ARTICLE 31 OF DECREE NO. 162/2018/NĐ-CP

c) Seize objects and means of administrative violation with a value not exceeding two times the amount of fine prescribed in point b of this clause.

2. Head of the Mobile Police Company has the authority:

đ) Apply measures to remedy consequences prescribed in clause 3 Article 4 of this Decree.".

b) Impose a fine up to VND 20,000,000;

c) Seize objects and means of administrative violation with a value not exceeding two times the amount of fine prescribed in point b of this clause;

d) Apply measures to remedy consequences prescribed in points c and đ of Clause 3, Article 4 of this Decree.

3. Head of Police Station, Head of the Mobile Police Company at battalion level, Head of Station, Team Leader have the authority:

đ) Apply measures to remedy consequences prescribed in clause 3 Article 4 of this Decree.".

b) Impose a fine up to VND 30,000,000;

b) Impose a fine up to 25,000,000 VND;

d) Confiscate contraband items, means of transport violating administrative regulations with a value not exceeding two times the amount of the fine stipulated in point b of this clause;

đ) Apply measures to remedy consequences prescribed in points c and đ of Clause 3, Article 4 of this Decree.

4. Head of Public Security at the commune level has the authority:

đ) Apply measures to remedy consequences prescribed in clause 3 Article 4 of this Decree.".

2. The head of the inspection team established by the Director of the Vietnam Civil Aviation Administration within the inspection period has the right to:

c) Revoke the right to use permits or suspend activities for a period of time;

d) Confiscate contraband items, means of transportation for administrative violations with a value not exceeding two times the amount of the fine prescribed at point b clause of this article;

Head of International Airport Customs Office; Head of functional departments under the Department of Administrative Management of Social Order; Head of functional departments under the Traffic Police Department; Head of functional departments under the Fire Prevention and Control Department; Head of functional departments under the Immigration Management Department; Head of the Mobile Police Company at regiment level; Head of Provincial Police Departments including: Head of the Administrative Management of Social Order Police Department, Head of the Social Order Crime Investigation Police Department, Head of the Traffic Police Department, Head of the Mobile Police Department, Head of the Economic Crime Investigation Police Department, Head of the Environmental Protection Police Department, Head of the Fire Prevention and Control Department, Head of the Mobile Police Department, Chief of the Office of the Criminal Investigation Department of the Provincial Public Security have the authority:

đ) Apply measures to remedy consequences prescribed in clause 3 Article 4 of this Decree.".

b) Impose a fine up to 25,000,000 VND;

d) Confiscate contraband items, means of transportation for administrative violations with a value not exceeding two times the amount of the fine prescribed at point b clause of this article;

6. Head of the Exit and Entry Administration Department under the Provincial Public Security has the authority to impose fines as provided for in Clause 5 of this Article.

7. Director of the Provincial Public Security has the authority:

đ) Apply measures to remedy consequences prescribed in clause 3 Article 4 of this Decree.".

b) Impose a fine up to 25,000,000 VND;

d) Confiscate contraband items, means of transportation for administrative violations with a value not exceeding two times the amount of the fine prescribed at point b clause of this article;

Director of the Department of Administrative Management of Social Order, Director of the Department of Social Order Crime Investigation, Director of the Traffic Police Department, Director of the Fire Prevention and Control Department, Director of the Environmental Crime Prevention and Control Department, Director of the Internal Security Department, Commander of the Mobile Police Force, Chief of the Office of the Criminal Investigation Bureau of the Ministry of Public Security have the authority:

đ) Apply measures to remedy consequences prescribed in clause 3 Article 4 of this Decree.".

b) Impose a fine up to VND 100,000,000;

b) Impose a fine up to 25,000,000 VND;

d) Confiscate contraband items, means of transportation for administrative violations with a value not exceeding two times the amount of the fine prescribed at point b clause of this article;

2. The Director of the Airport Control Station has the right to:

The People's Public Security force has the authority to impose penalties on acts of administrative violations in the civil aviation sector as stipulated in point a Clause 1, Article 8; point b Clause 4, Clause 6, Article 10; points a, b, c Clause 1, Clause 2, points a, b, c, d, đ Clause 3, Article 11; point a Clause 1, point a Clause 2, Article 12, Article 14, points a, c, e, h Clause 4, points a, c, d, đ, e, g Clause 5, points a, b Clause 6, Articles 25, 26 and 27 of this Decree."

Article 6. Amending and supplementing Article 36 of Decree No. 162/2018/NĐ-CP

"Article 36. Application of other Decrees on Imposing Penalties

1. The person authorized to impose administrative penalties in the civil aviation sector has the authority to issue an administrative violation record; apply main forms of administrative penalties and supplementary forms of administrative penalties; apply measures to remedy consequences for administrative violations stipulated in this Decree and administrative violations occurring in the civil aviation sector as prescribed in other Decrees on imposing penalties related to prices, fees, charges, invoices; construction activities, production of building materials, management of technical infrastructure works, real estate business, management and development of housing; security, social order, public safety; prevention and control of social evils; prevention and control of domestic violence; postal services, telecommunications, radio frequency, information technology and electronic transactions; trade activities, production, sale of fake goods, prohibited goods and consumer protection; vocational education; environmental protection; water resources and minerals; health care.

2. Principles for determining and dividing the authority to impose administrative penalties and applying measures to remedy consequences shall follow Article 52 of the Law on Handling Administrative Violations amended and supplemented by the Law Amending and Supplementing Certain Provisions of the Law on Handling Administrative Violations in 2020 and 2025."

Article 7. Amend and supplement Article 37 of Decree No. 162/2018/NĐ-CP

"Article 37. Preparing administrative violation records

1. The persons authorized to prepare administrative violation records in the civil aviation sector include:

a) Persons authorized to impose administrative penalties in the civil aviation sector who are authorized to prepare administrative violation records for acts of administrative violations within their area of management, scope, and content of inspections and audits;

b) Members of inspection teams when conducting inspections who are authorized to prepare administrative violation records for acts of administrative violations within the scope and content of the inspection;

c) Personnel from the People's Public Security Force while performing official duties and tasks;

d) Civil servants and officials from agencies whose heads have the authority to impose administrative penalties when carrying out inspection, supervision, violation handling, or official duties tasks;

đ) Aircraft commanders and members of flight crews designated by the aircraft commander to prepare administrative violation records for acts of administrative violations occurring on Vietnamese-registered aircraft during flight.

2. The aircraft commander on Vietnamese-registered aircraft shall be responsible for organizing the preparation of administrative violation records for acts of administrative violations occurring during flight.

The aircraft commander shall transfer administrative violation cases on the aircraft to competent state management agencies as follows:

a) For cases of violations related to air traffic order and safety, transfer to the airport security agency at the airport where the aircraft lands;

b) Other violation cases not covered under point a of this clause, transfer to the Civil Aviation Authority at the airport where the aircraft lands."

Article 8. Implementation Provisions

1. This Decree takes effect from March 1, 2026, and abolishes the following provisions:

a) Abolish Article 35 of Decree No. 162/2018/NĐ-CP;

b) Abolish Clause 20, 21, 22, 23, 24 of Article 3 of Decree No. 123/2021/NĐ-CP dated December 28, 2021, of the Government amending and supplementing certain articles of Decrees stipulating administrative penalty regulations in the maritime, road transport, and civil aviation sectors;

c) Abolish Article 67 of Decree No. 282/2025/NĐ-CP dated October 30, 2025, of the Government stipulating administrative penalty regulations in the areas of public order, social safety, prevention and control of social evils, and prevention and control of domestic violence.

2. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial and centrally-administered city People's Committees, and relevant organizations and individuals are responsible for implementing this Decree.
