Abolishing certain regulatory legal documents issued by the Minister of Agriculture and Rural Development

On the basis of Law on Legislative Regulatory Documents dated June 22, 2015;

On the basis of Law Amending and Supplementing Certain Articles of the Law on Legislative Regulatory Documents dated June 18, 2020;

Pursuant to Decree No. 34/2016/NĐ-CP dated May 14, 2016 of the Government detailing certain provisions and implementing measures of the Law on Legislative Regulatory Documents;

Pursuant to Decree No. 154/2020/NĐ-CP dated December 31, 2020 of the Government amending and supplementing some articles of Decree No. 34/2016/NĐ-CP dated May 14, 2016 of the Government detailing some provisions and measures for implementing the Law on Enacting Regulatory Legal Documents;

Pursuant to Decree No. 15/2017/NĐ-CP dated February 17, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

At the proposal of the Director of the Legal Department;

The Minister of Agriculture and Rural Development issues this Circular to abolish certain regulatory legal documents issued by the Minister of Agriculture and Rural Development.

Article 1. Abolish entirely 15 regulatory legal documents

1. Directive No. 03/2005/CT-BTS dated March 7, 2005 of the Minister of Fisheries on strengthening the control of harmful chemical and antibiotic residues in aquaculture activities.

2. Directive No. 77/2007/CT-BNN dated September 6, 2007 of the Minister of Agriculture and Rural Development on continuing to intensify the control of banned chemicals and antibiotics in aquaculture, harvesting, post-harvest preservation of aquatic products, and chemical and antibiotic residue control in exported and imported aquatic product consignments.

3. Decision No. 54/2003/QĐ-BNN dated April 7, 2003 of the Minister of Agriculture and Rural Development on promulgating the List of Plant Varieties Required to Publish Quality Standards.

4. Decision No. 59/2004/QĐ-BNN dated November 4, 2004 of the Minister of Agriculture and Rural Development on promulgating the List of Plant Varieties Required to Certify Quality in Accordance with Standards.

5. Decision No. 60/2004/QĐ-BNN dated November 4, 2004 of the Minister of Agriculture and Rural Development on promulgating the List of Plant Varieties Required to Apply Industry Standards.

6. Decision No. 14/2005/QĐ-BNN dated March 15, 2005 of the Minister of Agriculture and Rural Development on promulgating the List of Forestry Plant Varieties Permitted for Production and Business.

7. Decision No. 62/2006/QĐ-BNN dated August 16, 2006 of the Minister of Agriculture and Rural Development on approving the Strategy for Developing Forestry Plant Varieties for the Period 2006-2020.

8. Decision No. 68/2006/QĐ-BNN dated September 13, 2006 of the Minister of Agriculture and Rural Development on promulgating the Supplementary List of Plant Varieties Required to Apply Industry Standards.

9. Decision No. 02/2007/QĐ-BTS dated March 8, 2007 of the Minister of Fisheries on promulgating the Action Program of the Ministry of Fisheries to Implement Resolution No. 25/2006/NQ-CP dated October 9, 2006 of the Government on Developing the Aquatic Economic Sector for 2006-2010.

10. Decision No. 26/2007/QĐ-BNN dated April 9, 2007 of the Minister of Agriculture and Rural Development on promulgating the Supplementary List of Forestry Plant Varieties Permitted for Production and Business.

11. Decision No. 78/2008/QĐ-BNN dated July 1, 2008 of the Minister of Agriculture and Rural Development on approving the Strategy for Forestry Research in Vietnam until 2020.

12. Circular No. 15/2010/TT-BNNPTNT dated March 22, 2010 of the Minister of Agriculture and Rural Development on promulgating the Supplementary List of Forestry Plant Varieties Permitted for Production and Business.

13. Circular No. 32/2010/TT-BNNPTNT dated June 17, 2010 of the Minister of Agriculture and Rural Development stipulating the designation and management of sampling and testing activities, testing laboratories, quality certification organizations for plant varieties and crop products and fertilizers.

14. Circular No. 27/2015/TT-BNNPTNT dated August 7, 2015 of the Minister of Agriculture and Rural Development stipulating the standards for the positions of Director and Deputy Director of Departments of Agriculture and Rural Development under Provincial People's Committees.

15. Circular No. 15/2016/TT-BNNPTNT dated June 10, 2016 of the Minister of Agriculture and Rural Development guiding the conditions and criteria for benefiting from investment support to develop infrastructure for agricultural cooperatives.

Article 2. Repeal part of certain regulatory legal documents

1. Repeal Article 3, Article 4 of Circular No. 22/2011/TT-BNNPTNT dated April 6, 2011, issued by the Minister of Agriculture and Rural Development to amend and supplement some provisions on administrative procedures in the field of cooperative economics and rural development, commendation and reward, management of scientific research topics pursuant to Resolution No. 57/NQ-CP dated December 15, 2010.

2. Repeal Article 18 of Circular No. 16/2013/TT-BNNPTNT dated February 28, 2013, issued by the Minister of Agriculture and Rural Development guiding the protection of rights for plant varieties.

3. Repeal certain provisions set forth in Article 10, Article 21 of Circular No. 21/2015/TT-BNNPTNT dated June 8, 2015, issued by the Minister of Agriculture and Rural Development on the management of plant protection chemicals:

a) Repeal the phrase "In case the dossier meets the requirements stipulated in this Circular, the Plant Protection Department shall submit to the Minister of Agriculture and Rural Development;" at Point a Clause 3, Article 10; repeal Point b Clause 3, Article 10; repeal the phrase "from the date of receiving the approval opinion of the Minister" at Point c Clause 3, Article 10;

b) Repeal the phrase "submit to the Minister of Agriculture and Rural Development" at Point a Clause 3, Article 21; repeal Point b Clause 3, Article 21; repeal the phrase "from the date of receiving the approval opinion of the Minister" at Point c Clause 3, Article 21.

Article 3. Implementation Provisions

This Circular takes effect from February 10, 2022./.
