Regulations on Classification and Ranking of Public Service Organizations and Public Services This Decision stipulates the classification and ranking of public service organizations and public services established by competent state agencies with legal personality, separate bank accounts, and seals, performing functions to serve state management or provide public goods and services in various sectors and fields as prescribed by law.

PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on the Salary System for Civil Servants, Public Officials, and Military Personnel;

At the request of the Minister of Home Affairs,

Chapter I GENERAL PROVISIONS

Article 1. Scope and objects regulated

Implementing the classification and ranking of public service organizations and public services aims at:

Article 2. Purpose

1. Continuing to improve and strengthen management over public service organizations and public services; addressing inconsistencies in classification and ranking and the tendency to upgrade the ranking of these organizations.

2. Implementing decentralized management for ministries, ministerial-level agencies, government agencies, and provincial people's committees in classifying and ranking public service organizations and public services under their respective jurisdictions.

3. Serving the implementation of salary systems for civil servants, public officials, and armed forces personnel, where the classification and ranking of public service organizations and public services serve as a basis for applying position allowances for leaders and managers of each type of organization according to corresponding ranking levels, ensuring uniformity nationwide.

4. Enhancing the effectiveness of operations of public service organizations and public services in each sector and field; innovating investment methods for each type of public service organization and public service according to the classification system.

The classification and ranking of public service organizations and public services shall be carried out based on the following principles:

Article 3. Principles

1. Consistency with the functions and tasks of public service organizations and public services as prescribed by competent state agencies, consistent with the leadership position allowance coefficient according to the salary reform policy stipulated in Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on the salary system for civil servants, public officials, and armed forces personnel. On the basis of classification, ranking is conducted according to the principle that public service organizations and public services belonging to a particular classification system are ranked within the same classification system.

2. Ensuring appropriate hierarchical relationships and reasonable connections between the leadership position allowance coefficients of public service organizations and public services and those of advisory and law enforcement organizations within the administrative state agency system.

3. Based on the classification criteria groups and ranking frameworks prescribed in this Decision and specific criteria issued by ministries, ministerial-level agencies, and government agencies in accordance with the characteristics and features of each sector and field.

4. For newly established public service organizations and public services, the competent state agency deciding on establishment shall prescribe the classification and ranking of such organizations in the Establishment Decision.

Article 4. Time Limit for Re-ranking Public Service Organizations and Public Services

1. The review period for re-ranking public service organizations and public services at each level of management is five years, starting from the date of the previous ranking decision.

2. In special cases, if public service organizations and public services continuously develop and meet higher criteria, the time limit may be shortened and they may be re-ranked to the next higher category.

In special cases, organizations in the public service and public services that are continuously developed to ensure higher standards may have their time shortened and be reclassified into the next category.

Article 5. Groups of criteria for classification and ranking

The classification and ranking of public service organizations and state-owned enterprises shall be based on the following groups of criteria:

1. Groups of criteria for classification include:

a) Group of criteria regarding the type and nature of public service organizations and state-owned enterprises; industry and field of operation regulated by corresponding specialized laws and ordinances;

b) Group of criteria regarding management level, functions, and tasks serving state administration or public services for each type of public service organization and state-owned enterprise;

c) Group of criteria regarding profession, specialty, and business operations.

2. Groups of criteria for ranking include:

a) Group of criteria regarding organizational scale and workload;

b) Group of criteria regarding labor structure, labor proficiency level, and complexity of management;

c) Group of criteria regarding infrastructure, material and technical facilities, technological equipment, and working tools;

d) Group of criteria regarding the efficiency of resource utilization, results of activities with revenue, and the degree of meeting the needs for state administration and provision of public products and services; actual role and impact.

Chapter 2 SPECIFIC PROVISIONS ON CLASSIFICATION AND RANKING OF PUBLIC SERVICE ORGANIZATIONS AND STATE-OWNED ENTERPRISES

Article 6. Ranking Framework

1. The ranking framework for public service organizations and state-owned enterprises in various industries and fields includes eleven ranks: special rank, first rank, second rank, third rank, fourth rank, fifth rank, sixth rank, seventh rank, eighth rank, ninth rank, tenth rank.

2. For specific industries and fields, the number of ranks within the ranking framework for public service organizations and state-owned enterprises may differ.

Article 7. Ranking Framework for Public Service Organizations under the Government

Public service agencies under the Government shall be ranked at one common rank: special rank.

Article 8. Ranking Framework for Public Service Organizations and State-Owned Enterprises in the Education and Training Sector

The ranking framework for public service organizations and state-owned enterprises in the education and training sector managed by central and local authorities includes eleven ranks: special rank, first rank, second rank, third rank, fourth rank, fifth rank, sixth rank, seventh rank, eighth rank, ninth rank, tenth rank. Specifically:

1. Universities are ranked into three categories, including:

a) National universities, National Academy of Administration: special rank;

b) Regional universities, key universities: first rank;

c) Other universities: second rank.

2. Colleges (including vocational colleges) are ranked into two categories: third rank, fourth rank.

3. Secondary vocational schools (including general secondary schools) are ranked into three categories: fourth rank, fifth rank, sixth rank.

4. Vocational schools, vocational training centers, vocational training and employment centers are ranked into two categories: sixth rank, seventh rank.

5. General schools, including:

a) High schools are ranked into three categories: sixth rank, seventh rank, eighth rank;

b) Junior high schools are ranked into three categories: seventh rank, eighth rank, ninth rank;

c) Elementary schools are ranked into three categories: eighth rank, ninth rank, tenth rank;

d) For types of schools that include both high schools and junior high schools, they are ranked according to high schools; for types of schools that include both junior high schools and elementary schools, they are ranked according to junior high schools.

6. Kindergartens are ranked into two categories: ninth rank, tenth rank.

7. Comprehensive Technical Centers - Vocational Guidance Centers, Continuing Education Centers, other types of centers managed by provincial and district levels are ranked into five categories: third rank, fourth rank, fifth rank, sixth rank, seventh rank.

Article 9. Classification Framework for Public Health Services Organizations and Institutions

The classification framework for public health services organizations and institutions managed by the Central Government, localities, and State-owned Corporations is divided into five levels: special level, first level, second level, third level, and fourth level. Specifically as follows:

1. Healthcare Treatment System includes hospitals, medical centers, and other healthcare treatment organizations classified into four levels: special level, first level, second level, and third level;

2. Preventive Healthcare System includes institutes, centers, and other preventive healthcare organizations classified into four levels: first level, second level, third level, and fourth level;

3. District, urban district, town, and provincial city-level medical centers are classified according to hospital ranking standards and additionally include a percentage (%) of preventive healthcare work.

Article 10. Classification Framework for Public Science and Technology Services Organizations and Institutions

The classification framework for public science and technology services organizations and institutions managed by the Central Government and localities is divided into five levels: special level, first level, second level, third level, and fourth level. Specifically as follows:

1. National-level research and development organizations: special level.

2. Sectoral and base-level research and development, science and technology service organizations are classified into four levels: first level, second level, third level, and fourth level.

Article 11. Classification Framework for Public Cultural and Information Services Organizations and Institutions

The classification framework for public cultural and information services organizations and institutions managed by the Central Government, localities, and State-owned Corporations is divided into four levels: first level, second level, third level, and fourth level. Specifically as follows:

1. Museums are classified into three levels: first level, second level, and third level;

2. Libraries are classified into four levels: first level, second level, third level, and fourth level;

3. Theatres, art troupes, and other artistic organizations are classified into three levels: first level, second level, and third level;

4. Management Boards of Heritage Sites and Heritage Sites are classified into four levels: first level, second level, third level, and fourth level;

5. Creative Zones, Cultural Art Exhibition Centers, and Ho Chi Minh Chairman’s Residence Heritage Sites are classified into two levels: first level and second level.

6. Print newspapers, radio broadcasts, television broadcasts, magazines, and other public press services organizations are classified into four levels: first level, second level, third level, and fourth level.

7. Base-level cultural and information services organizations including cultural houses, cultural and information centers, cultural and information exhibition centers, cultural and information sports centers, and other cultural and information services organizations are classified into four levels: first level, second level, third level, and fourth level.

Article 12. Classification Framework for Public Sports and Physical Training Services Organizations and Institutions

The classification framework for public sports and physical training services organizations and institutions managed by the Central Government and localities is divided into four levels: first level, second level, third level, and fourth level. Specifically as follows:

1. National Sports Complexes, National Sports Training Centers I, II, III: first level;

2. Sports Centers, Cultural and Sports Centers, Stadiums, Training Facilities, and other public sports and physical training services organizations are classified into four levels: first level, second level, third level, and fourth level;

3. Sports and Physical Training Clubs are classified into two levels: third level and fourth level.

Article 13. Classification Framework for Public Service Organizations and Services under the Labor, War Invalids, Social Affairs, and Social Insurance Sector

The classification framework for public service organizations and services under the Labor, War Invalids, Social Affairs, and Social Insurance Sector managed by the central government and localities consists of four levels: Level One, Level Two, Level Three, and Level Four. Specifically, Orthopedic and Rehabilitation Centers, Employment Introduction Centers, Social Welfare Centers, Social Labor Education Centers, Centers for Organizing and Managing Vocational Training for Individuals After Drug Rehabilitation, Convalescent Centers for War Invalids and Those Who Have Made Contributions to the Nation, and other public service organizations and services under the Labor, War Invalids, and Social Affairs Sector are classified into four levels: Level One, Level Two, Level Three, and Level Four.

Article 14. Classification Framework for Public Service Organizations and Services under the Natural Resources and Environment Sector

The classification framework for public service organizations and services under the Natural Resources and Environment Sector managed by the central government and localities consists of six levels: Special Level, Level One, Level Two, Level Three, Level Four, and Level Five. Specifically:

1. Public service organizations and services in the meteorology and hydrology sector are classified into five levels: Special Level, Level One, Level Two, Level Three, and Level Four;

2. Public service organizations and services in the geology and mineral resources sector, including Geological and Mineral Resource Unions and Geological and Mineral Resource Centers, are classified into two levels: Level Two and Level Three;

3. Public service organizations and services serving land management, surveying, mapping, and remote sensing are classified into five levels: Level One, Level Two, Level Three, Level Four, and Level Five;

4. Public service organizations and services in the environmental protection sector, including Environmental Consultation Centers, Environmental Monitoring Centers, Environmental Monitoring Stations, and some other public service organizations and services related to natural resources and environment, are classified into three levels: Level Three, Level Four, and Level Five.

Article 15. Classification Framework for Public Service Organizations and Services under the Agriculture and Rural Development Sectors

The classification framework for public service organizations and services under the Agriculture and Rural Development Sectors managed by the central government, localities, and State-owned Corporations consists of three levels: Level One, Level Two, and Level Three. Specifically:

1. Agricultural Extension Centers, Forestry Extension Centers, Rural Water Supply and Sanitation Centers, Forest Management Boards, National Parks, and other public service organizations and services are classified into three levels: Level One, Level Two, and Level Three;

2. Plant Protection Organizations, Animal Protection Organizations, Veterinary Services are classified into two levels: Level Two and Level Three.

Article 16. Classification Framework for Public Service Organizations and Services under the Transport Sector

The classification framework for public service organizations and services under the Transport Sector managed by the central government, localities, and State-owned Corporations consists of two levels: Level Two and Level Three. Specifically:

1. Vehicle Inspection and Technical Testing Centers, and some other public service organizations and services are classified into two levels: Level Two and Level Three;

2. Civil Aviation Management Center is classified at Level Two;

3. Port Management Boards, Port Clusters, Harbor Authorities, Bridge and Road Management Boards, and other management boards are classified into two levels: Level Two and Level Three.

Article 17. Classification framework for public service organizations and services in various sectors and fields

1. The classification framework for public service organizations and services in the judicial sector managed by the central government and localities includes legal aid organizations and other public service and public service judicial organizations classified into three levels: second level, third level, fourth level.

2. The classification framework for public service organizations and services in the finance sector managed by the central government, localities, and state-owned corporations includes financial management service organizations related to land and real estate, information, advisory, asset, and real estate service organizations, securities service organizations, and other public service and public service financial organizations classified into three levels: second level, third level, fourth level.

3. The classification framework for public service organizations and services in the postal, telecommunications, and information technology sector managed by the central government, localities, and state-owned corporations includes radio frequency centers, computer centers, and some other public service and public service organizations classified into three levels: second level, third level, fourth level.

4. The classification framework for public service organizations and services in the planning and investment sector managed by the central government and localities includes small and medium enterprise support organizations and some other public service and public service organizations classified into three levels: second level, third level, fourth level.

5. The classification framework for public service organizations and services in the population, family, and children sector managed by the central government and localities includes population communication service organizations, family planning organizations, child care and protection organizations, and some other public service and public service organizations classified into three levels: second level, third level, fourth level.

6. The classification framework for public service organizations and services in the fisheries sector managed by the central government, localities, and state-owned corporations includes fishing promotion centers, aquatic seedling centers, and other public service and public service organizations classified into three levels: first level, second level, third level.

7. The classification framework for public service organizations and services in other sectors and fields not mentioned above is classified into three levels: second level, third level, fourth level.

Chapter 3 DUTIES AND POWERS OF THE MINISTER, HEADS OF GOVERNMENT AGENCIES AT THE MINISTERIAL LEVEL, HEADS OF GOVERNMENT AGENCIES UNDER THE GOVERNMENT, CHAIRS OF PROVINCE PEOPLE'S COMMITTEES DIRECTLY UNDER THE CENTRAL GOVERNMENT

Article 18. Duties and powers of the Minister, Heads of Government Agencies at the Ministerial Level, Heads of Government Agencies under the Government

1. Based on the criteria for classification and ranking and the ranking framework stipulated in this Decision, the Minister, Head of a Government Agency at the Ministerial Level, who oversees the management of a sector or field, shall cooperate with the Minister of Home Affairs and the Minister of Finance to develop specific ranking criteria for the sector or field; direct, guide, and inspect the application of these criteria in ranking public service organizations and services within their respective sectors or fields.

2. Ministers, Heads of Government Agencies at the Ministerial Level, and Heads of Government Agencies under the Government shall rank public service organizations and services under their management based on general classification criteria and specific criteria for each sector or field, and submit reports on the rankings to the Ministry of Home Affairs.

Article 19. Duties and powers of the Chairman of the People's Committee of provinces and centrally governed cities

1. Based on general criteria and specific criteria of each sector and field, the Chairman of the People's Committee of provinces and centrally governed cities shall decide on the ranking of public service organizations and state-owned enterprises under their management and report the ranking to the Ministry of Home Affairs.

2. Direct, guide, and inspect the departments, sectors, and agencies of the province and the People's Committees at the district level in the implementation of classification and ranking of public service organizations and state-owned enterprises according to the分级授权

Article 20. Duties and powers of the Minister of Home Affairs

1. Deciding on the recognition of classification levels for special-grade public service organizations and other public service organizations as decided by the Government,

2. Submitting to the Prime Minister proposals to amend and supplement regulations on classification and ranking for public service organizations and public services.

3. Deciding or guiding the recognition of classification levels for public service organizations not specified in this Decision.

4. Taking the lead and coordinating with relevant ministries and sectors to monitor and inspect the implementation of specific classification and ranking for public service organizations as stipulated in this Decision.

Article 21. Duties and powers of the Minister of Finance

Ensuring the allowance system for leadership and management positions in public service organizations and public services after the decision on classification and ranking has been made; inspecting and supervising the implementation of the allowance system according to the provisions of the law.

Chapter 4: IMPLEMENTATION PROVISIONS

Article 22. Effectiveness

The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.

Article 23. Responsibility for Implementation

The Ministers, Heads of ministerial-level agencies, Heads of government agencies, and Chairpersons of provincial People's Committees and municipal People's Committees directly under the Central Government are responsible for enforcing this Decision./.
