Article 24||| Prescribes and guides the training and capacity building for civil servants

Pursuant to the Civil Servant Law dated November 15, 2010;
||| On the basis of Decree No. 58/2014/NĐ-CP dated June 16, 2014 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry"b) In addition to the lists of public services issued according to the provisions of Clause 2, Article 4 of this Decree, specialized agencies under provincial People's Committees shall report to the provincial People's Committee for decision-making on amending, supplementing, or issuing the list of public services funded by the state budget within their jurisdiction and consistent with the local budget capacity within the approved budget by the Provincial People's Assembly, and send it to the Ministry of Finance and relevant ministries and sectors for supervision during implementation."||| of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry the Ministry of Home Affairs;

||| The Minister of Home Affairs issues this Circular to prescribe and guide the training and capacity building for civil servants.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation and Applicability
1. Scope of regulation: This Circular stipulates and guides the forms, contents, programs, and management of issuance and use of certificates for the activities of training and capacity building for civil servants.
2. Applicability: Ministries, agencies at the ministerial level, People's Committees of provinces and centrally governed cities assigned to manage state administration in fields of professional activities of civil servants, public service units, and civil servants working in public service units.
Article 2. Forms of capacity building
1. Capacity building according to occupational position standards.
2. Capacity building for leadership and management skills.
3. Mandatory annual capacity building for updating professional knowledge and skills.
Chapter II
CONTENTS AND PROGRAMS OF CAPACITY BUILDING
Article 3. Contents of capacity building
1. Political theory.
2. Specialized knowledge and vocational skills.
3. Administrative state management knowledge, laws; leadership and management capabilities and skills; principles of professional activities, professional ethics.
4. Supplementary knowledge according to occupational position standards.
5. International integration knowledge.
Article 4. Types of programs, materials, and implementation time
1. Programs and materials for capacity building according to occupational position standards, with a minimum implementation period of 6 (six) weeks and a maximum of 8 (eight) weeks - one week is calculated as 5 (five) days of study, one day of study consists of 8 (eight) sessions, including:
a) Programs and materials for capacity building according to occupational position standards of Grade I;
b) Programs and materials for capacity building according to occupational position standards of Grade II;
c) Programs and materials for capacity building according to occupational position standards of Grade III;
d) Programs and materials for capacity building according to occupational position standards of Grade IV.
2. Programs and materials for capacity building for leadership and management skills, with a maximum implementation period of 4 (four) weeks, including:
a) Programs and materials for capacity building for leadership and management skills for heads and deputy heads of public service units directly under ministries, agencies at the ministerial level, government agencies, central-level agencies; heads and deputy heads of organizations constituting public service units that are government agencies (hereinafter referred to as the Leadership and Management Capacity Building Program for Public Service Units under Ministries);
b) Programs and materials for capacity building for leadership and management skills for heads and deputy heads of public service units under provincial party committees, municipal party committees, provincial people's committees, political-social organizations at the provincial level, specialized agencies under provincial people's committees (hereinafter referred to as the Leadership and Management Capacity Building Program for Public Service Units at the Provincial Level);
c) Programs and materials for capacity building for leadership and management skills for heads and deputy heads of public service units under county party committees, district party committees, town party committees, municipal party committees under provincial party committees, county people's committees (hereinafter referred to as the Leadership and Management Capacity Building Program for Public Service Units at the County Level);
d) Programs and materials for capacity building for leadership and management skills for heads and deputy heads of departments, divisions, bureaus, or equivalent units at the departmental level in public service units (hereinafter referred to as the Leadership and Management Capacity Building Program at the Departmental Level in Public Service Units).
3. Annual mandatory capacity building programs for updating professional knowledge and skills.
Based on the specific nature of the profession, ministries managing occupational positions of specialized civil servants shall stipulate programs, times, contents, organize compilation, review programs and materials, organize capacity building, types of certificates for annual mandatory capacity building programs for updating professional knowledge and skills, ensuring feasibility; creating conditions for proactive implementation by agencies and units managing and using civil servants.
Article 5. Implementation of training programs
Training programs for civil servants working in administrative, general, office management, planning, and finance departments of public service units shall be implemented according to the training standards corresponding to their civil servant ranks.
Article 6. Requirements for compiling training programs and materials
1. Training programs and materials shall be compiled based on occupational title standards for civil servants, leadership position standards, management requirements, and practical needs at each stage.
2. The contents of the training programs and materials must ensure a combination of theoretical knowledge and practical experience; knowledge, experience, and practical skills; and avoid duplication.
3. Training programs and materials must be regularly updated, supplemented, and improved to be consistent with current realities.
Article 7. Structure and Content Duration of Training Programs
1. Training Programs According to Occupational Title Standards
a) Part I: Political knowledge, state administration management, and general skills account for approximately 30% of the program duration.
b) Part II: Professional knowledge, skills, and occupational ethics according to the requirements of each occupational title grade account for approximately 70% of the program duration.
2. Training Programs for Leadership and Management Skills
a) Part I: Political knowledge, state administration management, and general skills account for approximately 50% of the program duration.
b) Part II: Leadership and management capabilities and skills according to the requirements of each management level account for approximately 50% of the program duration.
Article 8. Management of Training Programs
1. The Ministry of Home Affairs manages training programs for leadership and management skills.
2. Ministries manage training programs according to occupational title standards for specialized civil servants; mandatory annual training programs to update professional knowledge and skills.
Training programs according to occupational title standards must have the approval of the Ministry of Home Affairs before implementation. If implemented without such approval, certificates issued under these training programs will not be valid for use.
3. Tasks in managing training programs include:
a) Organizing compilation;
b) Organizing review and evaluation;
c) Approving, issuing, and guiding implementation.
Article 9. Organization of Compiling Training Materials
1. The Ministry of Home Affairs organizes the compilation of training materials for leadership and management of public service units under ministries, provinces, counties, and department-level units within public service institutions; guides and supports ministries managing specialized civil servant occupational titles in compiling training programs and materials according to occupational title standards.
2. Ministries managing specialized civil servant occupational titles organize the compilation of the following types of materials:
a) Training materials according to occupational title standards;
b) Training materials for department-level leadership and management within public service institutions in specialized fields based on the framework of department-level programs issued by the Ministry of Home Affairs;
c) Mandatory annual training materials to update professional knowledge and skills.
Article 10. Reviewing training programs and materials
1. Training programs and materials according to occupational standards and leadership and management capacity and skill training programs must be reviewed before issuance.
2. Organizations for reviewing training programs and materials
a) The Minister of Ministries managing the programs and organizing the compilation of materials in accordance with Articles 8 and 9 of this Circular shall issue a Decision to establish a Review Board for the training programs and materials within their jurisdiction.
b) The Review Board shall consist of seven members, including the Chairman of the Board, the Secretary of the Board, and two members兼任反批评委员。
c) Members of the Board must be experienced and reputable managers and scientists with expertise relevant to the content of the training programs and materials under review; among them, there shall be four managerial members and three scientific members。
3. Duties of Review Board members, working regulations of the Review Board, and meetings of the Review Board shall apply the provisions stipulated in Articles 5, 6, and 7 of Circular No. 03/2011/TT-BNV dated January 25, 2011, issued by the Ministry of Home Affairs guiding the implementation of certain provisions of Government Decree No. 18/2010/NĐ-CP dated March 5, 2010 on civil servant training and development。
4. Supporting agencies for the organization of reviews
a) The supporting agency for the review of training programs and materials under the jurisdiction of the Ministry of Home Affairs is the Department of Civil Servant Training and Development。
b) The supporting agency for the review of training programs and materials under the jurisdiction of Ministries managing specialized personnel is the Cadre Organization Department or other advisory and management units for specialized personnel。
Chapter III
TRAINING ORGANIZATION, METHODS, AND FORMS
Article 11. Training Organization
1. The National Academy of Public Administration organizes training for the following programs:
a) Leadership and management training programs for public service units under ministries, provinces, districts, and departments within public service units.
b) Other training programs assigned by competent authorities.
2. Based on proposals from ministries, ministerial-level agencies, government agencies, central agencies, provincial People's Committees, and municipal People's Committees directly under the Central Government, the Minister of Home Affairs decides to assign specific training program tasks to training and development institutions of ministries, ministerial-level agencies, government agencies, central agencies; municipal Party Schools; and educational and research institutions within the national education system that have the necessary capabilities and relevant expertise.
3. Ministers, heads of ministerial-level agencies, government agencies, central agencies, and chairpersons of provincial and municipal People's Committees directly under the Central Government decide to assign organizations to conduct mandatory annual knowledge and professional skills updating training programs for training institutions with the necessary capabilities and relevant expertise.
Article 12. Training Methods
Utilize active methods that encourage learners' self-awareness, initiative, and creative thinking, enhance information, knowledge, and experience exchange between lecturers and students, and among students.
Article 13. Forms of Training
1. Concentrated.
2. Semi-concentrated.
3. Work-study.
4. Distance.
Chapter IV
CERTIFICATES FOR TRAINING
Article 14. Training certificates for civil servants
1. Training certificates for civil servants include:
a) Certificates for training according to occupational standards;
b) Certificates for training leadership and management capabilities and skills;
c) Compulsory annual certificates for updating professional knowledge and skills.
2. Training institutions issue certificates for training programs they are assigned to implement.
Article 15. Issuance, issuance, and management of certificates
1. A training certificate is issued once after the completion of the course.
2. In case the certificate is lost or damaged, the holder may request the training institution to issue a certificate of completion of the course.
3. Training institutions must maintain records of certificate issuance in accordance with current regulations.
Article 16. Conditions for issuing certificates
A training certificate shall be issued to trainees who meet the following conditions:
1. Participating fully in all prescribed contents of the training program;
2. Completing all mid-term and final examinations as required; each examination must score at least 5 (five) points out of ten (ten);
3. Adhering strictly to the study regulations.
Article 17. Validity of certificates
1. Training certificates according to occupational standards and certificates for training leadership and management capabilities and skills have nationwide validity.
2. Training certificates according to occupational standards are one of the conditions for civil servants to register for promotion exams and appointment to higher ranks and to enroll in higher occupational standard training programs.
3. Training certificates for leadership and management capabilities and skills are one of the conditions for considering and deciding on the appointment of civil servants to leadership and management positions.
Article 18. Handling violations
b) Issued to individuals who do not meet the requirements; issued beyond authority;
a) Issuing certificates illegally;
b) Issuing certificates in violation of the provisions of this Circular.
2. Civil servants and civil servants who violate regulations on printing, issuing, managing, and using training certificates shall be disciplined in accordance with the Law on Public Officials and Civil Servants. If their actions constitute criminal offenses, they will be prosecuted criminally under the law.
Article 19. Certificate format
The Ministry of Home Affairs prescribes a uniform format for civil servant training certificates throughout the country, as detailed in the Appendix attached to this Circular.
Chapter V
RIGHTS AND OBLIGATIONS OF CIVIL SERVANTS AND TRAINING FEES
Article 20. Conditions for civil servants to be sent abroad for training
1. Having at least 1 (one) year of service remaining from the start of the training course.
2. Not being under disciplinary review or punishment of reprimand or higher; or not being in cases where they are not allowed to leave or enter the country according to current laws on exit and entry for Vietnamese citizens.
3. Civil servants sent for training must be confirmed by the agency as having satisfactorily completed their assigned tasks.
4. The assigned tasks of civil servants sent for training must align with the content of the training course.
5. Ensuring good health.
Article 21. Conditions for civil servants to be sent for postgraduate education
1. Ensuring at least twice the duration of the education program in terms of work time after graduation.
2. Committing to performing job duties and professional activities at public institutions for at least twice the duration of the education program after completing it.
3. The field of study must meet the requirements of the occupational standard.
4. Possessing the ability and professional level to meet long-term usage needs and human resource development plans of the agency or unit.
5. Civil servants sent to study under international cooperation programs signed or joined by the Socialist Republic of Vietnam, in addition to the provisions of Articles 1, 2, 3, and 4 of this Article, must comply with the Law on Signing, Joining, and Implementing International Treaties and meet other requirements of the cooperation program.
Article 22. Cases where civil servants are assigned to attend training for intermediate, college, and university levels
1. Due to reorganization of public service units.
2. To meet requirements for development and improve the quality of human resources in specific fields.
Article 23. Benefits of civil servants assigned to attend training and development
1. Civil servants assigned to attend training and development within the country:
a) Are allocated time and funding according to regulations by public service units;
b) Have their training and development period counted towards continuous working time;
c) Receive full salary and other allowances as stipulated by law;
d) Are recognized and rewarded for outstanding results in training and development.
2. Civil servants assigned to attend training and development abroad enjoy benefits as prescribed by law and regulations of the agency or unit.
Article 24. Responsibilities of civil servants
1. Implement regulations on training and development of civil servants.
2. Strictly adhere to training and development regulations and be subject to management by the training and development institution during the course period.
Article 25. Compensation for Training and Development Costs
The compensation for training and development costs for civil servants shall be implemented in accordance with current laws.
Article 26. Funding for Training and Development
Funding for training and development of civil servants comes from sources such as the budget of public service units, personal funds of civil servants; and sponsorship from organizations and individuals both domestically and internationally.
Article 27. Reporting System for Training and Development Activities of Civil Servants
1. Ministries, agencies at the ministerial level, government agencies, central agencies, provincial People's Committees, and municipal People's Committees directly under the Central Government have the responsibility to submit annual reports on the results of training and development of civil servants to the Ministry of Home Affairs before January 31 of the following year.
2. Personnel Departments of ministries, agencies at the ministerial level, government agencies, central agencies; Provincial Departments of Home Affairs, and municipal departments directly under the Central Government, which serve as focal points assisting the Minister, heads of agencies at the ministerial level, heads of government agencies, heads of central agencies, and Chairpersons of provincial People's Committees in managing the training and development of civil servants, are responsible for compiling the results of training and development of civil servants and submitting them to the competent authority.
Chapter VI
IMPLEMENTING PROVISIONS
Article 28. Effective Date
This Circular takes effect from February 2, 2015.
Article 29. Responsibility for Implementation
1. Ministers, heads of agencies at the ministerial level, heads of government agencies, heads of central agencies, and Chairpersons of provincial People's Committees directly under the Central Government are responsible for implementing this Circular.
2. During implementation, if there are difficulties or obstacles, agencies and units are requested to report to the Ministry of Home Affairs for study and resolution./.
