CIRCULAR

Issuing the Regulation on Continuous Professional Development for Teachers and Management Staff of Preschool Education Institutions, General Education Institutions and Continuing Education Centers

 

Pursuant to the Education Law dated June 14, 2005; the Law Amending and Supplementing Certain Provisions of the Education Law dated November 25, 2009;

Pursuant to Decree No. 69/2017/NĐ-CP dated May 25, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;

Pursuant to Decree No. 75/2006/NĐ-CP dated August 2, 2006 of the Government detailing and guiding the implementation of certain provisions of the Education Law; Decree No. 31/2011/NĐ-CP dated May 11, 2011 of the Government amending and supplementing certain provisions of Decree No. 75/2006/NĐ-CP dated August 2, 2006 of the Government detailing and guiding the implementation of certain provisions of the Education Law; Decree No. 07/2013/NĐ-CP dated January 9, 2013 of the Government amending Point b Clause 13 Article 1 of Decree No. 31/2011/NĐ-CP dated May 11, 2011 of the Government amending and supplementing certain provisions of Decree No. 75/2006/NĐ-CP dated August 2, 2006 of the Government detailing and guiding the implementation of certain provisions of the Education Law;

Pursuant to Decree No. 101/2017/NĐ-CP dated September 1, 2017 of the Government on cadre, civil servant, and public official training;

At the proposal of the Director of the Department of Teachers and Educational Management Staff;

The Minister of Education and Training issues this Circular to issue the Regulation on Continuous Professional Development for Teachers and Management Staff of Preschool Education Institutions, General Education Institutions and Continuing Education Centers.

Article 1. This Circular promulgates the Regulation on Continuous Professional Development for Teachers and Management Staff of Preschool Education Institutions, General Education Institutions and Continuing Education Centers.

Article 2. This Circular takes effect from December 28, 2019. This Circular replaces Circular No. 26/2012/TT-BGDĐT dated July 10, 2012 of the Minister of Education and Training issuing the Regulation on Continuous Professional Development for Preschool, Primary and Secondary School Teachers and Continuing Education Teachers.

Article 3. The Director of the Office, the Director of the Department of Teachers and School Management Staff, Heads of units under the Ministry of Education and Training, Directors of provincial Departments of Education and Training, relevant organizations and individuals are responsible for implementing this Circular.

REGULATIONS

Continuous Professional Development for Teachers and Management Staff of Preschool Education Institutions, General Education Institutions and Continuing Education Centers

(Annexed to Circular No. 19/2019/TT-BGDĐT dated November 12, 2019of the Minister of Education and Training)

  

PART I

GENERAL PROVISIONS

 

Article 1. Scope of Regulation

This Regulation stipulates the continuous professional development (CPD) for teachers and management staff of preschool education institutions, general education institutions and continuing education centers, including: Organization of CPD; assessment and recognition of CPD results for teachers and management staff of preschool education institutions, general education institutions and continuing education centers.

Article 2. Applicability

This Regulation applies to:

  1. Teachers currently caring for, nurturing, and educating at preschool institutions such as kindergartens, nursery schools, group childcare facilities, independent kindergarten classes (hereinafter referred to collectively as preschool education institutions); teachers currently teaching at primary schools, lower secondary schools, upper secondary schools, multi-grade general education schools, specialized schools, boarding schools for ethnic minorities, and semi-boarding schools for ethnic minorities (hereinafter referred to collectively as general education institutions), and teachers currently teaching at continuing education centers. Hereinafter, teachers currently caring for, nurturing, and educating at preschool education institutions, teachers currently teaching at general education institutions, and continuing education centers shall be collectively referred to as teachers.
  2. Principals and vice-principals of preschool education institutions and general education institutions (hereinafter referred to collectively as management staff).
  3. Relevant organizations and individuals.

Article 3. Purpose of BDTX

1. Training according to the requirements of job positions; annual training on mandatory specialized knowledge and skills for teachers and managers; serving as a basis for managing, directing, organizing training, self-training to improve the professional qualities and capabilities of teachers and managers; enhancing the level of meeting the requirements of job positions for teachers and managers; meeting the requirements for the development of preschool education, general education, and continuing education; and meeting the requirements of occupational standards.

2. Developing self-study, self-training, and self-assessment capabilities for teachers and managers' BDTX work; organizational and management capabilities for teachers and managers' BDTX activities at preschool education institutions, general education institutions, continuing education centers, district education and training departments, and provincial education and training departments.

Article 4. Principles of BDTX

  1.  Meeting the requirements of the school year's tasks, occupational standards, job positions, and development needs of preschool education institutions, general education institutions, continuing education centers, localities, and the sector.
  2.  Ensuring high awareness of self-study and continuous training at preschool education institutions, general education institutions, and continuing education centers; selecting training programs based on occupational standards and job position requirements for teachers and managers.
  3.  Implementing division of responsibilities, hierarchical management, and coordination mechanisms in organizing BDTX.
  4.  Ensuring practicality, quality, transparency, and effectiveness.

 

Chapter II

ORGANIZATION OF CONTINUOUS TRAINING

 

Article 5. Continuous Training Program

    Implementing the Continuous Training Programs issued by the Minister of Education and Training (hereinafter referred to as the Continuous Training Programs), including: Continuous Training Program for teachers and managers of preschool education institutions; Continuous Training Program for teachers and managers of general education institutions; Continuous Training Program for teachers of continuing education centers.

Article 6. Methods and types of organization for BDTX

  1.  Implementing training through positive methods, strengthening self-study, promoting initiative, proactivity, and creative thinking among teachers and managers; increasing practical activities at preschool education institutions, general education institutions, and continuing education centers; discussing, exchanging, and sharing information, knowledge, and experience between lecturers and teachers and managers, between teachers, and among managers.
  2.  Types of organization for BDTX:
  1.  Concentrated: Conducting concentrated training; guiding teachers and managers to self-study, practice, systematize knowledge, answer questions, and guide training contents that meet the needs of teachers and managers during their BDTX studies; creating opportunities for teachers and managers to exchange, share, and discuss about professional matters and practice skills.

    The duration, number of teachers and managers participating in concentrated training shall be implemented according to hierarchical management but must ensure the requirements regarding the purpose, expected outcomes, content, methods, and duration of training specified in the Continuous Training Programs and the regulations stipulated in this Regulation.

  1.  Remote: Conducting remote training, strengthening the application of information technology in training activities through the internet for teachers and managers to ensure the requirements regarding the purpose, expected outcomes, content, methods, and duration of training specified in the Continuous Training Programs and the regulations stipulated in this Regulation;

c) Semi-concentrated: Combining the types of concentrated and remote training organizations as stipulated in points a and b of this Clause to ensure effectiveness and meet the requirements of teacher and manager BDTX.

Article 7. Materials BDTX

  1.  Compilation of BDTX materials:
  1.  BDTX materials must be compiled in accordance with the requirements for teacher training and management staff according to professional standards, job positions, demands for educational reform and quality improvement, and the development needs of human resources at preschool education institutions, general education institutions, and regular education centers, as well as local and sectoral plans;
  2.  Materials must ensure a combination of theory and practice, knowledge and experience with practical skills;
  3.  Compiled materials must comply with the BDTX Program and the provisions of this Regulation;
  4.  BDTX materials are organized for compilation in accordance with the type of BDTX organization:
    •  Concentrated BDTX materials: Are compiled and published in the form of publications, audio tapes, video tapes, and other information storage devices in compliance with the BDTX Program and the provisions of this Regulation.
    •  Distance BDTX materials: Are compiled in the form of learning materials (video discs recording images, sounds, short films; radio programs, television programs; printed books, teaching and learning guides assisted by computers; online exercises and remote conference discussion sessions; virtual internships, simulated internships, and actual internships or other suitable learning materials) ensuring the provision and transmission of all content and requirements of the BDTX Program so that learners can self-study and self-train in accordance with this Regulation.
    •  Semi-concentrated BDTX materials: Combine concentrated BDTX materials and distance BDTX materials.
  1. Educational institutions responsible for BDTX tasks are responsible for organizing the compilation and review of BDTX materials. Teachers and management staff may use BDTX training materials compiled by educational institutions responsible for BDTX tasks or may utilize other suitable materials.

Article 8. Plan BDTX

1. The BDTX plan is developed annually, including: The BDTX plan for teachers and management staff, preschool education institutions, general education institutions, regular education centers, district education and training departments, and provincial education and training departments.

2. The BDTX plan must clearly state the objectives, content, type of BDTX organization, and expected outcomes to meet the continuous professional development requirements for teachers and management staff.

3. Developing the annual BDTX plan:

a) The BDTX plan for teachers and management staff: Based on the training module needs, training forms, and guidance from the current workplace educational institution; teachers and management staff develop their individual BDTX plans and submit them for approval by the competent authority before May 31 each year;

b) The BDTX plan for preschool education institutions, general education institutions, and regular education centers: Based on guidance from the provincial education and training department, district education and training department, and the hierarchical management level, and the BDTX plans of teachers and management staff; preschool education institutions, general education institutions, and regular education centers develop their BDTX plans and report to the higher-level education management agency in June each year;

c) The BDTX plan for district education and training departments: Based on guidance from the provincial education and training department and the BDTX plans of preschool education institutions, primary schools, and junior high schools under their jurisdiction; district education and training departments develop their BDTX plans and report to the provincial education and training department in June each year;

d) The BDTX plan for provincial education and training departments: Based on guidance from the Ministry of Education and Training, the BDTX plans of district education and training departments, secondary schools, general education institutions under their jurisdiction, and regular education centers; provincial education and training departments develop their BDTX plans for implementation starting from July each year.

Article 9. Reporters BDTX

1. Reporters for Continuing Professional Development (CPD): Are teachers from educational institutions implementing CPD tasks, specialists, education management officials, teachers, and early childhood education institution and general secondary education institution management officials who meet the standards prescribed in Clause 2 of this Article.

2. Standards for CPD reporters:

a) Hold a bachelor's degree or higher and possess good professional qualities and capabilities;

b) Be proficient in the CPD Program, capable of delivering CPD material content suitable to the target audience;

c) Have at least three years of experience in teacher CPD work and management staff CPD work; have a sense of responsibility, ability to collaborate with colleagues; be able to guide and advise teachers and management staff on self-study; be familiar with the organization procedures, content, techniques, methods, and evaluation forms for CPD results according to regulations;

d) Possess basic information technology skills as stipulated in Circular No. 03/2014/TT-BTTTT issued on March 11, 2014 by the Ministry of Information and Communications regarding Basic Information Technology Skill Standards; be capable of building and developing digital learning materials for teacher CPD and management staff CPD.

3. Responsibilities of CPD reporters: Carry out assigned tasks by the competent authority, the institution implementing CPD tasks, under a visiting lecturer system or labor contract.

Article 10. Educational Institutions Implementing Tasks BDTX

1. Educational institutions implementing CPD tasks include:

a) Educational institutions for teacher CPD: Teacher training schools, educational institutions with a teacher training department, educational institutions permitted to train and develop teachers;

b) Educational institutions for management staff CPD: Teacher training schools, university departments with an education management faculty, educational institutions permitted to train and develop education management staff.

2. Educational institutions permitted to implement CPD tasks must meet the following requirements:

a) Be an educational institution as defined in Clause 1 of this Article;

b) Ensure the capability to develop CPD materials as prescribed in Article 7 of this Regulation;

c) Ensure a team of reporters meeting the standards set forth in Article 9 of this Regulation;

d) Have physical facilities, equipment, technical infrastructure, and practical training bases that can support CPD activities, including ensuring an integrated information system to periodically collect and process data on reporters, teachers, and management staff; a feedback recording and processing system from related parties about progress in CPD to improve and enhance the quality of teacher and management staff CPD; hardware and software technology systems maintained regularly and always ready for reporters and teachers, management staff to use effectively.

3. Educational institutions implementing CPD tasks operate through task assignment or contract signing.

 

Chapter III

EVALUATION AND RECOGNITION OF CPD RESULTS

REGULAR CPD

 

Article 11. Evaluation and Classification of CPD Results

  1.  Evaluation of the application of CPD knowledge in teaching practice, child education, student education; practical management of early childhood education institutions, general secondary education institutions, and continuing education centers. Evaluation is conducted through a test question system (for theoretical content), research assignments, and reflective essays (for practical content) ensuring compliance with the objectives, required achievements, and content of the CPD Program and regulations stipulated in this Regulation.

2. Theoretical and practical tests are scored out of ten points and are considered satisfactory when achieving five points or more.

3. Classification of Results:

a) Completion of the CPD Plan: Teachers and management staff are classified as having completed the CPD plan when they fully comply with the provisions of the CPD course; complete all tests with satisfactory results according to the provisions of Clause 2 of this Article;

b) Failure to Complete the CPD Plan: Teachers and management staff who do not meet the requirements specified in point a of this Clause.

4. Teachers and management staff classified as having completed the CPD plan will be issued a certificate of completion of the CPD plan. The CPD assessment results will be recorded in their files and serve as the basis for implementing development policies and teacher and management staff utilization.

Article 12. Issuance of BDTX Certificates

The issuance of BDTX certificates shall be carried out in accordance with regulations on training and capacity building for civil servants, public officials, and employees.

 

Chapter IV

IMPLEMENTATION

 

Article 13. Coordination Mechanism between Departments of Education and Training, District Education and Training Offices, and Educational Institutions in Implementing BDTX Tasks Departments of Education and Training, District Education and Training Offices, in accordance with their authority, shall take the lead and coordinate with educational institutions to implement BDTX tasks as follows:

  1.  Survey the BDTX needs of teachers and managers to develop appropriate BDTX plans that meet the actual needs and target groups;
  1.  Organize BDTX for teachers and managers according to the BDTX Program and the provisions of this Regulation.
  2.  Educational institutions responsible for implementing BDTX tasks shall take the lead and coordinate with Departments of Education and Training, District Education and Training Offices to perform the following tasks:
  1.  Compile and review BDTX materials to ensure quality and in accordance with regulations;
  1.  Provide BDTX materials and timely information about the BDTX situation of teachers and managers;
  2.  Implement BDTX and evaluate the results of BDTX in accordance with regulations.
  1. Article 14. Responsibilities of Units under the Ministry of Education and Training

 The Department of Teachers and School Management Staff:

  1.  Take the lead and coordinate with functional units under the Ministry: Issue guiding documents related to teacher and manager BDTX work; organize inspections of teacher and manager BDTX work nationwide; periodically conduct mid-term and final reviews of teacher and manager BDTX work;
  1.  Perform other related tasks assigned by the Minister of Education and Training.
  2.  The Inspectorate of the Ministry shall take the lead and coordinate with the Department of Teachers and School Management Staff and relevant functional units under the Ministry to inspect BDTX activities.
  1.  Other units under the Ministry: Coordinate in inspecting and ensuring the quality and effectiveness of BDTX activities.
  2. . Responsibilities of Departments of Education and Training

Article 15 Implement the coordination mechanism as stipulated in Article 13 of this Regulation.

  1.  Direct and inspect the BDTX work of teachers and managers at District Education and Training Offices and educational institutions under their management authority.
    3. Take the lead and decide to select educational institutions with sufficient capacity to carry out BDTX tasks for teachers and managers within their authority and in accordance with the provisions of this Regulation.
  2. 4. Advise provincial People's Committees on BDTX funding sources and related conditions to serve BDTX work as prescribed. BDTX funds are budgeted in the annual regular expenditure budget, from support funds of programs and projects or from other sources as prescribed by law (if applicable).

5. Report on the BDTX work of teachers and managers to the Ministry of Education and Training (through the Department of Teachers and School Management Staff) in June each year (immediately after the school year ends) and as required by competent authorities.

. Responsibilities of District Education and Training Offices

    1. Implement the coordination mechanism as stipulated in Article 13 of this

Article 162. Direct and inspect the BDTX work of teachers and managers at educational institutions under their management authority.

    3. Advise district People's Committees on BDTX funding sources and related conditions to serve BDTX work as prescribed. BDTX funds are budgeted in the annual regular expenditure budget, from support funds of programs and projects or from other sources as prescribed by law (if applicable).
3. Take the lead and decide to select educational institutions with sufficient capacity to carry out BDTX tasks for teachers and managers within their authority and in accordance with the provisions of this Regulation.

4. Report on the BDTX work of teachers and managers to Departments of Education and Training in June each year (immediately after the school year ends) and as required by competent authorities.

    Article 17. Responsibilities of

kindergartens, primary and secondary schools, and continuing education centers

1. Guide teachers and managers to build BDTX plans; develop BDTX plans for teachers and managers and implement these plans. Article 1. This Circular guides the content, measures, inspection, and evaluation of building safe schools, preventing and controlling accidents and injuries in general education institutions and regular educational institutions, and the responsibilities of relevant agencies, organizations, and individuals. 2. Summarize and report on the implementation of BDTX plans for teachers and managers in June each year (immediately after the school year ends), according to the分级任务如下:

1. Guide teachers and management staff to develop BDTX plans; develop BDTX plans for teachers and management staff and organize the implementation of BDTX plans.

Article 18. Responsibilities and benefits of teachers and managers

  2.  Be entitled to full salary, allowances, subsidies (if any), and other policies during the time of implementing the BDTX plan.

Article 19Responsibilities of educational institutions carry out the BDTX tasks

    1. Implement according to the coordination mechanism prescribed in Article 13 of this Regulation; publicly list the panel of lecturers; develop a system of multiple-choice questions (for theoretical contents), research assignments, and final reports (for practical contents) to assess the outcomes of training according to each content of the BDTX Program and submit them to the Ministry of Education and Training (through the Teacher and Educational Manager Department) before organizing the training.

2. The institution carrying out the BDTX tasks may collaborate with other educational institutions responsible for teacher training and manager development when necessary and shall be responsible for the quality, conditions ensuring the implementation of BDTX, and in accordance with the provisions of this Regulation./.
