CIRCULAR

Repeals certain regulatory legal documents issued by the Minister of Agriculture and Rural Development, jointly issued

Pursuant to Decree No. 15/2017/NĐ-CP dated February 17, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Based on the Law on Enactment of Legislative Acts dated June 22, 2015;

Pursuant to the Government's Decree No. 34/2016/NĐ-CP dated May 14, 2016 detailing certain provisions and measures for implementing the Law on Legislative Acts of Regulations;

At the proposal of the Director of the Legal Department;

After reaching consensus with the Minister of Natural Resources and Environment, the Minister of Agriculture and Rural Development issues this Circular to repeal certain regulatory legal documents issued by the Minister of Agriculture and Rural Development, jointly issued.

This Circular takes effect from January 25, 2026.

Repeals all of the following regulatory legal documents issued by the Minister of Agriculture and Rural Development, jointly issued:

1. Decision No. 67/2002/QĐ-BNN dated July 16, 2002 of the Minister of Agriculture and Rural Development on the issuance of temporary economic and technical criteria for livestock breeds;

2. Decision No. 69/2004/QĐ-BNN dated December 3, 2004 of the Minister of Agriculture and Rural Development on the issuance of the list of rare plant species prohibited from export;

3. Decision No. 79/2005/QĐ-BNN dated December 5, 2005 of the Minister of Agriculture and Rural Development on the regulations for international exchange of rare plant germplasm;

4. Decision No. 35/2008/QĐ-BNN dated February 15, 2008 of the Minister of Agriculture and Rural Development on the issuance of regulations on the management of crop seed production in farm households;

5. Decision No. 53/2008/QĐ-BNN dated April 21, 2008 of the Minister of Agriculture and Rural Development on strictly prohibiting the act of adding water and water-retaining additives to fresh frozen fish products for fraudulent trade purposes;

6. Circular No. 61/2000/TT/BNN-KH dated June 6, 2000 of the Minister of Agriculture and Rural Development guiding the preparation of planning for the development of farmstead economies;

7. Joint Circular No. 62/2000/TTLT-BNN-TCĐC dated June 6, 2000 of the Minister of Agriculture and Rural Development and the General Department of Land Administration guiding the transfer of land, lease of land, and issuance of certificates of land use rights for forestry;

8. Circular No. 03/2006/TT-BTS dated April 12, 2006 of the Minister of Fisheries guiding the implementation of the overall planning for the development of the fisheries sector until 2010 and orientation until 2020;

9. Circular No. 55/2014/TT-BNNPTNT dated December 31, 2014 of the Minister of Agriculture and Rural Development guiding the implementation of certain environmental protection activities within the National Target Program on New Rural Areas Development during the period 2010-2020;

10. Circular No. 39/2015/TT-BNNPTNT dated October 20, 2015 of the Minister of Agriculture and Rural Development stipulating certain contents regarding the tendering process for projects using public investment capital managed by the Ministry of Agriculture and Rural Development;

11. Circular No. 18/2016/TT-BNNPTNT dated June 24, 2016 of the Minister of Agriculture and Rural Development stipulating certain contents regarding strategic environmental assessment and environmental impact assessment managed by the Ministry of Agriculture and Rural Development;

12. Circular No. 04/2017/TT-BNNPTNT dated February 24, 2017 of the Minister of Agriculture and Rural Development promulgating the List of wild animal and plant species specified in the Appendices of the Convention on International Trade in Endangered Species of Wild Fauna and Flora;

13. Circular No. 14/2017/TT-BNNPTNT dated July 5, 2017 of the Minister of Agriculture and Rural Development guiding the implementation of certain contents regarding public-private partnership investment in agriculture and rural areas;

Article 2. Repealing part of legal normative documents

Partially repeals the following regulatory legal documents issued by the Minister of Agriculture and Rural Development:

1. Article 3, Article 5, and Article 6 of Circular No. 43/2018/TT-BNNPTNT dated December 28, 2018 of the Minister of Agriculture and Rural Development stipulating certain contents regarding the export, import of plant and animal seeds, plant germplasm; import of plant protection chemicals and import of objects listed in the quarantine object list that require risk analysis before importation into Vietnam;

2. Article 2 of Circular No. 30/2017/TT-BNNPTNT dated December 29, 2017 of the Minister of Agriculture and Rural Development amending and supplementing certain articles of Circular No. 33/2014/TT-BNNPTNT dated October 30, 2014 on the procedures and formalities for plant quarantine import, export, transit, and post-import quarantine objects and amending Clause 3 of Article 2 of Circular No. 18/2016/TT-BNNPTNT dated June 24, 2016 on strategic environmental assessment and environmental impact assessment managed by the Ministry of Agriculture and Rural Development.

Article 3. Effectiveness

This Circular takes effect from February 16, 2021.

Article 4. Responsibilities for Implementation

The Legal Affairs Department Director, Heads of units under the Ministry, and relevant agencies, organizations, and individuals are responsible for implementing this Circular./.
