Guidelines on job positions, staff structure according to occupational titles and staffing norms for the number of personnel

On the basis of Government Decree No. 86/2022/Decree-CP dated February 24 the 10 Pursuant to Decree No. 32/2019/NĐ-CP dated April 10, 2019 of the Government on assigning tasks, procurement or tendering for the supply of products and services using state budget from regular operating expenses;22 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;
Pursuant to Decree No. 106/2020/NĐ-CP dated September 10, 2020 of the Government on job positions and the number of personnel in public service units; dated October 7, 2020 of the Government
Pursuant to the Government Decree number Decree No. 120/2020/NĐ-CP on the establishment, reorganization, and dissolution of public service units; No. 111/2022/NĐ-CP;
Decree No. dated December 30, 2022 on contracts for certain types of work in administrative agencies and public service units;December 30, 2022 Decision No. 249/2025/NĐ-CP on contracts for certain types of work in administrative agencies and public service units;

The Minister of Education and Training issues this Circular guiding on job positions, staff structure according to occupational titles and staffing norms for the number of personnel in public preschool education institutions.
Article 1. Scope of Regulation and Applicability
Article 1. This Circular guides on leadership and management job positions, specialized occupational titles, staff structure according to occupational titles, and staffing norms for the number of personnel in public preschool education institutions.
Article 2. This Circular applies to public preschool education institutions including public kindergartens, public nursery schools, and public pre-schools (hereinafter referred to as public preschool education institutions).
Article 3. Private and non-state preschool education institutions shall apply the provisions of this Circular based on their actual conditions.
Article 2. Principles for determining job positions and staffing norms for the number of personnel in public preschool education institutions
Clause 1. Determining job positions and staffing norms for the number of personnel in public preschool education institutions shall be carried out in accordance with Article 3 of Decree No. 106/2020/NĐ-CP dated September 10, 2020 of the Government on job positions and the number of personnel in public service units (hereinafter referred to as Decree No. 106/2020/NĐ-CP).
Clause 2. Job positions and staffing norms for the number of personnel in public preschool education institutions must ensure:
a) Sufficient personnel according to the staffing norms stipulated in this Circular to fulfill the tasks of nurturing, caring for, and educating children according to the Preschool Education Program issued by the Ministry of Education and Training and to perform common professional tasks, supporting tasks, and services of public preschool education institutions;
b) For job positions that do not have sufficient workload to be performed by one person within the prescribed time, they shall be assigned to兼任的任务。尚未编制岗位的工作岗位,应签订劳动合同或兼任。被安排兼任的人员必须接受培训和培养,以满足兼任工作岗位的专业能力和业务要求。
Clause 3. The number of teachers in public preschool education institutions includes teachers recruited as civil servants and those under labor contracts. If a public preschool education institution currently has fewer civil servant teachers than the maximum staffing norm stipulated in this Circular (due to insufficient allocated positions or failure to recruit), it shall determine the number of teachers to enter into labor contracts in accordance with the maximum staffing norm stipulated in this Circular, pursuant to Decree No. 111/2022/NĐ-CP dated December 30, 2022 of the Government on contracts for certain types of work in administrative agencies and public service units.
Article 3. List of job positions and guidelines for describing job positions in public preschool education institutions
1. The list of leadership and management job positions and specialized vocational titles in public preschool education institutions is specified in Appendix I attached to this Circular.
2. The list of common professional job positions and support and service job positions in public preschool education institutions is specified in Appendix II attached to this Circular.
3. Guidelines for describing job positions:
a) The description of leadership and management job positions and specialized vocational titles in public preschool education institutions is guided in Appendix III attached to this Circular;
b) The description of common professional job positions and support and service job positions in public preschool education institutions is guided in Circular No. 12/2022/TT-BNV dated December 30, 2022, issued by the Minister of Home Affairs on job positions for civil servant leaders and managers; common professional skills; support and service job positions in administrative agencies and organizations; and common professional job positions and support and service job positions in public service units (hereinafter referred to as Circular No. 12/2022/TT-BNV).
4. Based on the guidelines for describing leadership and management job positions and specialized vocational titles and common professional job positions and support and service job positions as stipulated in Clause 3 of this Article, public preschool education institutions shall develop specific and appropriate job position descriptions for each job position within their unit and submit them to the competent authority for approval in accordance with regulations.
Article 4. Staffing Standards for Leadership and Management Job Positions
1. Principal: Each public preschool education institution shall be allocated 01 principal.
2. Deputy Principal: The number of deputy principals shall be implemented according to the regulations on the number of deputies as stipulated in Decree No. 120/2020/NĐ-CP dated October 7, 2020, of the Government on the establishment, restructuring, and dissolution of public service units.
Article 5. Staffing Standards for Specialized Vocational Job Positions
1. Preschool Teachers:
a) For infant groups: For every 15 children/group from 03 months to 12 months old; 20 children/group from 13 months to 24 months old; 25 children/group from 25 months to 36 months old, up to 2.5 teachers/group shall be allocated;
b) For kindergarten classes: For every 25 children/class from 3 years to 4 years old; 30 children/class from 4 years to 5 years old; 35 children/class from 5 years to 6 years old, up to 2.2 teachers/class shall be allocated;
c) For preschool education institutions that do not have enough children to allocate according to the infant group or kindergarten class standards stipulated in points a and b of Clause 1 of this Article, or after allocating infant groups and kindergarten classes according to the provisions of points a and b of Clause 1 of this Article, there are remaining children, then the staffing standard for preschool teachers will be calculated based on the average number of children per age group as follows: For every 06 children from 3 to 12 months old or 08 children from 13 to 24 months old or 10 children from 25 to 36 months old, 11 children from 3 to 4 years old or 14 children from 4 to 5 years old or 16 children from 5 to 6 years old, 1 additional teacher shall be allocated;
d) For combined infant groups and combined kindergarten classes as stipulated in the Kindergarten Charter, the staffing standard for teachers shall be determined according to the provisions of points a and b of Clause 1 of this Article;
đ) For branch schools with only 01 infant group or 01 kindergarten class that do not have enough children to allocate according to the infant group or kindergarten class standards stipulated in points a and b of Clause 1 of this Article, 2.0 teachers/group or class shall be allocated;
2. Job positions supporting education for persons with disabilities:
a) For preschool education institutions with children with disabilities learning in inclusive settings: Institutions with fewer than 20 children with disabilities learning in inclusive settings shall be allocated 01 person; institutions with 20 or more children with disabilities learning in inclusive settings shall be allocated up to 02 persons. When an infant group or kindergarten class has 01 child with disabilities learning in an inclusive setting, the number of children in the group or class shall be reduced by 05 children. Each infant group or kindergarten class shall not have more than 02 children with disabilities learning in inclusive settings;
b) In cases where it is not possible to allocate personnel to perform the task of supporting education for persons with disabilities, labor contracts or part-time teachers shall be allocated.
Article 6. Staffing standards for positions of common professional work (accounting, clerical work, cashier, library)
1. Preschool education establishments shall be allocated two staff members to perform accounting, clerical, cashier, and library duties.
2. For preschool education establishments with five or more branch schools or fifteen or more groups of children or kindergarten classes, three staff members shall be allocated to perform accounting, clerical, cashier, and library duties.
3. Positions that cannot be allocated regular staff shall be filled through labor contracts or by teachers and staff performing additional duties. Preschool education establishments shall determine the number of staff and additional duties based on the nature, workload, and actual conditions.
Article 7. Staffing standards for positions of support and service (school health, security, maintenance, cooking)
1. Preschool education establishments shall allocate at least one contractual worker to perform school health duties, at least one contractual worker to perform security duties, and at least one contractual worker to perform maintenance duties. Based on the nature, workload, and actual conditions, preschool education establishments shall determine the number of contractual workers for each support and service position.
2. Preschool education establishments that provide boarding services may allocate contractual workers to perform cooking duties for children. Based on the number of children, workload, and actual conditions, preschool education establishments shall determine the appropriate number of contractual workers to perform cooking duties.
3. The signing of labor contracts shall be carried out in accordance with current laws.
Article 8. Structure of civil servants by occupational title
The determination of the structure of civil servants by occupational title shall be implemented according to the provisions of Clause 5, Article 3, and Clause 3, Article 4 of Decree No. 106/2020/NĐ-CP.
Article 9. Transitional Provisions
1. For the position of school health:
a) Civil servants who were recruited into the position of school health staff before Circular No. 12/2022/TT-BNV took effect (before February 15, 2023) and currently receive salary according to their rank, grade, and occupational title category shall continue to do so until new guidelines on salary regulations are issued.
b) From the date Circular No. 12/2022/TT-BNV took effect (from February 15, 2023), the position of school health falls under the category of support and service positions, thus staffing standards for the position of school health shall be implemented according to the provisions of Clause 1, Article 7 of this Circular.
2. Common professional positions stipulated in this Circular shall continue to implement regulations on job code, occupational title standards, and apply salary systems, hazardous duty allowances, and other allowances as prescribed by ministries managing civil servants and specialized personnel in relevant fields.
3. Preschool teachers who fall within the scope of implementing the training qualification upgrade prescribed in Decree No. 71/2020/NĐ-CP dated June 30, 2020 of the Government regarding the implementation timeline for upgrading the training qualification of preschool, primary, and lower secondary school teachers, or those within the scope prescribed in Circular No. 24/2020/TT-BGDĐT dated August 25, 2020 of the Minister of Education and Training regarding the use of teachers and educational management personnel in preschool, primary, and lower secondary schools not meeting the training qualification requirements shall be determined to belong to the list and counted in the number of staff for the position of occupational title specialty, where the job description for this group shall be applied according to the job description for preschool teachers of Grade III, without requiring educational qualifications.
Article 10. Effective Date
1. This Circular takes effect from December 16, 2023.
2. Circular Joint Circular No. 06/2015/TTLT-BGDĐT-BNV dated March 16, 2015 of the Minister of Education and Training and the Minister of Home Affairs on the framework of job positions and staffing standards in public preschool education establishments shall cease to be effective from the date this Circular takes effect.
3. In case the referenced documents in this Circular are amended, supplemented, or replaced, they shall be implemented according to the new documents.
Article 11. Responsibility for Implementation
1. The Director of the Office, the Director of the Department of Teachers and Educational Management Personnel, heads of units related to the Ministry of Education and Training; Chairpersons of People's Committees of provinces and centrally-administered cities; relevant agencies, organizations, units, individuals, and heads of public preschool education establishments shall be responsible for implementing this Circular.
2. During the implementation process, if there are any difficulties, they should be reported to the Ministry of Education and Training for consideration and resolution./.
