Provisions on the framework of job positions and staffing norms
in public preschool educational institutions

Pursuant to Decree No. 58/2014/NĐ-CP dated June 16, 2014, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;
Pursuant to Decree No. 75/2006/NĐ-CP dated August 2, 2006 of the Government detailing and guiding the implementation of certain provisions of the Education Law; Decree No. 31/2011/NĐ-CP dated May 11, 2011 of the Government amending and supplementing certain provisions of Decree No. 75/2006/NĐ-CP dated August 2, 2006 of the Government detailing and guiding the implementation of certain provisions of the Education Law; Decree No. 07/2013/NĐ-CP dated January 9, 2013 of the Government amending Point b Clause 13 Article 1 of Decree No. 31/2011/NĐ-CP dated May 11, 2011 amending and supplementing certain provisions of Decree No. 75/2006/NĐ-CP dated August 2, 2006 of the Government detailing and guiding the implementation of certain provisions of the Education Law;

The Minister of Education and Training and the Minister of Home Affairs issue this Joint Circular stipulating the framework of job positions and staffing norms for public preschool education institutions.
Article 1. Scope of Regulation and Applicability
1. This Joint Circular stipulates the framework of job positions and staffing norms for public preschool education institutions, including: kindergartens, nursery schools, childcare centers; group childcare facilities, independent kindergarten classes.
2. Private preschool education institutions shall apply the provisions of this document based on the actual conditions of their units.
Article 2. Principles for determining the framework of job positions and staffing norms for public preschool education institutions
1. Implement according to the provisions of Article 3 of Decree No. 41/2012/NĐ-CP dated May 8, 2012 of the Government on job positions in public service units.
2. Ensure the performance of tasks at public preschool education institutions as prescribed by law.
3. The number of children in group childcare facilities and kindergarten classes specified in Article 3 of this Joint Circular serves as the basis for determining the staffing norms for preschool teachers in public preschool education institutions.
Article 3. Group Childcare Facilities and Kindergarten Classes
1. For group childcare facilities: Children from 3 months old to 36 months old are organized into groups. The maximum number of children in one group is as follows:
a) From 3 months old to 12 months old: 15 children;
b) From 13 months old to 24 months old: 20 children;
c) From 25 months old to 36 months old: 25 children.
2. For kindergarten classes: Children from 3 years old to 6 years old are organized into kindergarten classes. The maximum number of children in one kindergarten class is as follows:
a) From 3 years old to 4 years old: 25 children;
b) From 4 years old to 5 years old: 30 children;
c) From 5 years old to 6 years old: 35 children.
3. When a group childcare facility or kindergarten class has one child with disabilities who is integrated into regular classes, the class size is reduced by five children. Each group childcare facility or kindergarten class shall not have more than two children with disabilities.
Article 4. Framework of Job Positions
The framework of job positions in childcare centers, nursery schools, kindergartens includes:
1. Job positions related to management and administrative tasks (two positions):
a) Principal;
b) Deputy Director.
2. Job positions related to professional activities (one position): Preschool teacher.
3. Job positions related to support and service tasks (four positions):
a) Accounting;
b) Secretary;
c) Health care;
d) Cashier.
Based on the workload and nature of work in childcare centers, nursery schools, and kindergartens, all job positions specified in Points a, b, c, and d of this Clause must be concurrently held.
Based on the actual workload of accounting, secretarial, health care, and cashier tasks, preschools, nursery schools, and childcare centers shall develop job position plans and submit them to competent authorities for approval.
Article 5. Staffing Standards for Number of Employees
1. Principal:
Each kindergarten, preschool, or early childhood education center shall have 01 Principal.
2. Deputy Principal:
a) The number of Deputy Principals for each kindergarten, preschool, or early childhood education center shall be as follows:
- Kindergartens shall be allocated 01 Deputy Principal;
- Preschools or early childhood education centers with fewer than 09 groups or classes in midland, delta, urban areas or fewer than 06 groups or classes in mountainous, remote, and island areas shall be allocated 01 Deputy Principal;
- Preschools or early childhood education centers with 09 groups or classes or more in midland, delta, urban areas or 06 groups or classes or more in mountainous, remote, and island areas shall be allocated 02 Deputy Principals.
b) For kindergartens, preschools, or early childhood education centers with 05 branch schools or more, an additional 01 Deputy Principal may be allocated.
3. Early Childhood Teachers:
a) In places where the maximum number of children per group or class is fully arranged according to the regulations stipulated in Article 3 of this Joint Circular, the staffing standard for early childhood teachers shall be determined as follows:
- For groups: Maximum 2.5 teachers/group;
- For two-session/day preschool classes: Maximum 2.2 teachers/class;
- For one-session/day preschool classes: Maximum 1.2 teachers/class.
b) In places where the number of children does not meet the requirements for arranging groups or classes as stipulated in Article 3 of this Joint Circular, the staffing standard for early childhood teachers will be calculated based on the average number of children per age group within each group or class, specifically:
- For groups: 01 teacher cares for 06 children aged 3 to 12 months or 08 children aged 13 to 24 months or 10 children aged 25 to 36 months;
- For two-session/day preschool classes: 01 teacher cares for 11 children aged 3 to 4 years or 14 children aged 4 to 5 years or 16 children aged 5 to 6 years;
- For one-session/day preschool classes: 01 teacher cares for 21 children aged 3 to 4 years or 25 children aged 4 to 5 years or 29 children aged 5 to 6 years.
c) For independent groups or classes, the staffing standard for early childhood teachers shall be applied as specified in Points a and b of this Clause.
4. Accountant, Secretary, Health Care Worker, and Cashier:
Based on actual workload, needs, and positions approved by the competent authority, preschools, kindergartens, and nurseries shall determine the maximum number of employees not exceeding 02 persons to perform tasks related to accounting, secretarial work, health care, and cashier duties.
Article 6. Contracted Workers
1. Food Preparation: If kindergartens, preschools, or early childhood education centers organize boarding services, they shall enter into labor contracts to fulfill food preparation tasks as follows: For every 35 children in nurseries or 50 children in kindergartens, 01 contracted worker shall be hired to fill the food preparation position.
2. Security: Based on financial conditions and needs, kindergartens, preschools, or early childhood education centers shall enter into labor contracts to fulfill security tasks, but not exceeding 02 persons.
Article 7. Effective Date
1. This Circular takes effect from May 1, 2015.
2. This Circular replaces Joint Circular No. 71/2007/TTLT-BGDĐT-BNV dated November 28, 2007, issued by the Ministry of Education and Training and the Ministry of Home Affairs guiding the staffing standards for public early childhood education institutions.
Article 8. Responsibility for Implementation
1. Responsibilities of the People's Committee of provinces and centrally-administered cities:
a) Based on the guidelines of this Joint Circular and relevant laws, each year, the People's Committee of provinces and centrally-administered cities shall direct the determination of the number of employees by job position in public early childhood education institutions;
b) Submit to the People's Council at the same level for approval of the total number of employees in public early childhood education institutions after receiving the review opinion of the Ministry of Home Affairs and implement after approval.
2. During implementation, if there are issues arising or difficulties encountered, provinces and centrally-administered cities shall promptly report to the Ministry of Education and Training and the Ministry of Home Affairs for consideration and resolution./.
