Pursuant to the Customs Law dated June 23, 2014;
WHEREAS, Decree No. 08/2015/ND-CP dated January 21, 2015 of the Government detailing and providing implementation measures for the Law on Customs regarding customs procedures, inspection, supervision, and control;
WHEREAS, Decree No. 59/2018/ND-CP dated April 20, 2018 of the Government amending and supplementing certain articles of Decree No. 08/2015/ND-CP dated January 21, 2015 of the Government detailing and providing implementation measures for the Law on Customs regarding customs procedures, inspection, supervision, and control;
WHEREAS, Decree No. 98/2021/ND-CP dated November 8, 2021 of the Government on medical device management;
WHEREAS, Decree No. 07/2023/ND-CP dated March 3, 2023 of the Government amending and supplementing certain articles of Decree No. 98/2021/ND-CP dated November 8, 2021 of the Government on medical device management;
Pursuant to Decree No. 96/2023/NĐ-CP dated December 30, 2023 of the Government detailing certain provisions of the Law on Medical Examination and Treatment;
Pursuant to Decree No. 95/2022/NĐ-CP dated November 15, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health;
The Minister of Health issues this Circular regulating the economic and technical characteristics of medical devices subject to price declaration.
The Minister of Health issues this Circular to issue the List of medical devices for export and import with determined commodity codes according to the Vietnam Export and Import Commodity List.
Article 1. Scope of Regulation
This Circular issues the List and principles for applying the List of medical devices for export and import with determined commodity codes (hereinafter referred to as HS code) according to the Vietnam Export and Import Commodity List issued together with Circular No. 31/2022/TT-BTC dated June 8, 2022 of the Minister of Finance on issuing the Vietnam Export and Import Commodity List.
Article 2. Issuing the List
This Circular issues the List of medical devices for export and import with determined HS codes according to the Vietnam Export and Import Commodity List.
Article 3. Principles for Applying the List
Clause 1. In cases where there are discrepancies or inconsistencies in classification and determination of HS codes for goods listed in this Circular, the determination of HS codes shall be carried out in accordance with the laws on customs.
Clause 2. For medical devices for export and import not listed and determined HS codes in this List, the determination of HS codes shall be carried out in accordance with the laws on customs. After clearance, organizations and individuals exporting and importing such devices shall submit written reports to the Ministry of Health (Department of Infrastructure and Medical Devices) to serve as a basis for cooperation with the Ministry of Finance to review, unify, update, and issue supplementary lists.
Clause 3. The List of medical devices with determined HS codes issued together with this Circular serves as a basis for organizations and individuals to carry out activities of exporting and importing medical devices into Vietnam.
Clause 4. The List includes items identified as medical devices and managed in accordance with Decree No. 98/2021/ND-CP dated November 8, 2021 of the Government on medical device management, amended and supplemented by Decree No. 07/2023/ND-CP dated March 3, 2023 and other legal regulations on medical devices.
Article 4. Effective date
Clause 1. This Circular takes effect from November 16, 2024.
Clause 2. Circular No. 14/2018/TT-BYT dated May 15, 2018 of the Minister of Health on issuing the List of medical devices with determined commodity codes according to the Vietnam Export and Import Commodity List ceases to be effective from the date this Circular takes effect.
Article 5. Responsibilities for Implementation
Heads of the Department of Infrastructure and Medical Devices; Heads of units under and affiliated to the Ministry of Health, Directors of Provincial Health Departments, Heads of health agencies of Ministries and sectors, and relevant agencies, organizations, and individuals are responsible for implementing this Circular. During the implementation process, if there are difficulties or obstacles, agencies, organizations, and individuals should report to the Ministry of Health (Department of Infrastructure and Medical Devices) for consideration and resolution.
