DECREE

Regulating the functions, tasks, powers, and organizational structure of the Office of the Government

Based on Decree No. 63/2025/QH15 on Organization of the Government;

In accordance with the proposal from the Minister, Director of the Office of the Government;

The Government promulgates this Decree to regulate the functions, tasks, powers, and organizational structure of the Office of the Government.

Article 1. Position and Functions

The Office of the Government is a ministry-level agency of the Government, a strategic advisory body, important and confidential, directly assisting the Government and the Prime Minister (including Deputy Prime Ministers).

The Office of the Government has the function of providing comprehensive advice and coordination to assist the Government and the Prime Minister in organizing joint activities of the Government; leading, guiding, and managing the operations of the Government; performing the function as a central information hub for communication serving the leadership, guidance, and management work of the Government and the Prime Minister, and providing information to the public; ensuring material, technical, and logistical conditions for the operations of the Government and the Prime Minister.

Article 2. Tasks and Powers

The Office of the Government shall perform the tasks and powers stipulated in the Decree on Organization of the Government, as well as specific tasks and powers as follows:

1. Comprehensive advice and coordination to assist the Government

a) To take the lead in formulating and managing the work program of the Government according to legal provisions; supervising, urging, inspecting, summarizing, evaluating the implementation status, results of the work programs of the Government and the Working Rules of the Government by departments, agencies (hereinafter referred to as ministries), provincial people's committees (hereinafter referred to as provincial people's committees) and relevant organizations and entities; summarizing, urging, inspecting, assessing the implementation status, reporting to the Government;

b) To coordinate with ministries, agencies, provincial people's committees, and relevant organizations and entities during the preparation and completion of proposals, projects, draft normative legal documents submitted for examination and decision by the Government in accordance with legal provisions; c) To take the lead in reviewing, providing comments on procedures, formalities, powers, main contents of files to be submitted according to regulations; summarizing different opinions from ministries, agencies, relevant organizations and entities; providing comprehensive advice, independent views on proposals, projects, draft normative legal documents and other matters submitted by ministries, agencies, provincial people's committees, and relevant organizations and entities for the Government; d) To take the lead in preparing content to serve meetings of the Government, conferences, and working sessions of the Government, the Standing Committee of the Government;

d) To provide advice to the Government on its relations with Party organs, National Assembly, Standing Committee of the National Assembly, President, Central Committee of the Vietnam Fatherland Front, central organizations of political-social organizations, Supreme People's Court, and Supreme People's Procuratorate;

e) To take the lead in preparing proposals, projects, draft normative legal documents and reports as assigned by the Government.

2. Comprehensive advice and coordination to assist the Prime Minister

a) To take the lead in formulating and managing the work program of the Prime Minister according to legal provisions; supervising, urging, inspecting, summarizing, evaluating the implementation status, results of the work programs of the Prime Minister;

b) To take the lead in reviewing, providing comments on procedures, formalities, powers, main contents of files to be submitted according to regulations; summarizing different opinions from ministries, agencies, relevant organizations and entities; providing comprehensive advice, independent views on proposals, projects, draft normative legal documents and other matters submitted by ministries, agencies, provincial people's committees, and relevant organizations and entities for the Prime Minister;

c) To take the lead in completing content, formalities, files, and draft documents to be submitted to the Prime Minister for examination and decision on routine matters submitted by ministries, agencies, provincial people's committees, and relevant organizations and entities;

d) To proactively grasp the situation, report, provide advice to the Prime Minister on key tasks that require focused leadership and guidance; propose solutions, responses to urgent issues requiring prompt resolution;

e) To serve as a liaison for the Government and the Prime Minister in implementing work programs assigned by the Central Committee of the Party, Secretariat of the Central Committee, National Assembly, Standing Committee of the National Assembly, Government Party Committee;

f) To assist the Prime Minister in coordinating the implementation of the work program of the Government and the Prime Minister; coordinate activities among members of the Government consistent with the work programs of the Government and the Prime Minister;

g) To coordinate activities among ministries, agencies, provincial people's committees in formulating and implementing policies, laws, and work programs;

h) To coordinate the operations of inter-ministerial task forces, working groups, advisory organizations headed or established by the Prime Minister;

i) To propose to the Government and the Prime Minister that relevant ministries, agencies, provincial people's committees, and organizations be tasked with developing mechanisms, policies, proposals, projects, draft normative legal documents for submission to competent authorities for decision-making; or proactively study and propose new initiatives, mechanisms, and policies for consideration by the Government and the Prime Minister;

k) In cases where relevant ministries have exchanged views but there are differing opinions on matters submitted to the Government and the Prime Minister, the Office of the Government shall report and provide advice to the Government and the Prime Minister for examination and decision or propose that the Prime Minister convene a meeting with leaders of relevant ministries, agencies, provincial people's committees, and organizations to examine and decide on the handling plan.

h) Coordinating the activities of inter-ministerial coordination organizations, task forces, and advisory organizations headed or established by the Prime Minister;

i) Recommending to the Government and the Prime Minister to delegate tasks to ministries, sectors, people's committees at provincial level, relevant agencies, and organizations to develop mechanisms, policies, programs, projects, draft normative legal documents for submission to the competent authority for decision-making; or proactively studying and proposing new initiatives, mechanisms, and policies for submission to the Government and the Prime Minister for consideration and decision; k) In cases where relevant ministries have exchanged views but still have differing opinions on matters to be submitted to the Government and the Prime Minister, the Office of the Government reports and advises the Government and the Prime Minister to examine and decide or proposes that the Prime Minister convene a meeting with leaders from relevant ministries, sectors, people's committees at provincial level, and related agencies and organizations to examine and decide on the handling方案

k) In the event that relevant ministries and agencies have exchanged views but the matter submitted to the Government and the Prime Minister still has differing opinions, the Office of the Government reports to, advises, and assists the Government and the Prime Minister in examining, deciding, or proposing for the Prime Minister to chair a meeting with the leaders of the ministries, sectors, people's committees at provincial level, and relevant agencies and organizations to examine and decide on the handling plan;

l) Shall be in charge of and coordinate with ministries, sectors, People's Committees at provincial level, relevant agencies and organizations to prepare reports on work, explanatory reports, and responses to questions from the Government, Prime Minister before the National Assembly, Standing Committee of the National Assembly, President, competent authorities, and the people as per instructions from the Prime Minister;

m) Shall be in charge of drafting and editing articles, speeches, interviews with media, documents (including both paper and video materials) for use by the Prime Minister and other reports and documents according to instructions from the Prime Minister; shall revise, supplement, and complete such documents after the Prime Minister has spoken or provided comments; simultaneously implement long-term storage in accordance with the regulations of the Party and the State;

n) Shall organize work related to monitoring, urging, and evaluating the implementation of tasks assigned by the Government and the Prime Minister to ministries, sectors, People's Committees at provincial level, relevant agencies, organizations, and individuals; propose necessary measures to ensure administrative discipline in task execution;

o) Shall propose evaluations from the Prime Minister regarding members of the Government and chairpersons of People's Committees at provincial level on their performance of tasks assigned by the Government and the Prime Minister; shall propose forms of handling cases where duties under the Working Regulations of the Government are not fulfilled;

p) Shall act as a coordinating body with ministries, sectors, People's Committees at provincial level, relevant agencies and organizations to prepare content for meetings, visits, and local inspections by the Prime Minister;

q) May attend meetings and conferences of ministries, sectors, people's councils, and people's committees at provincial level, relevant agencies and organizations; may request ministries, sectors, people's committees at provincial level, relevant agencies and organizations to provide documents, data, and texts related to reports on tasks assigned by the Government and the Prime Minister; shall participate in inter-ministerial coordination bodies headed by the Prime Minister according to regulations; shall proactively work with ministries, sectors, People's Committees at provincial level, relevant agencies and organizations to gather information for leadership, guidance, and management of the Government and the Prime Minister;

r) May propose the establishment of specialized task forces, strategic advisory councils, and committees to advise on and provide solutions to major, urgent, and pressing issues from the Prime Minister;

s) Shall return documents immediately to the sender with reasons or forward them to competent authorities for processing if they are incomplete, do not follow procedures, have not been fully implemented in accordance with relevant regulations, exceed the authority of the Government and the Prime Minister, fail to propose clear solutions; shall report to the Prime Minister and inform the agency concerned;

t) Shall be in charge of drafting proposals, projects, draft legal documents, and other texts as assigned by the Prime Minister.

3. Information Center for Serving Leadership, Guidance, and Management of the Government and the Prime Minister

a) Shall implement daily, periodic, special topic reporting according to regulations and other reports as required by the Government and the Prime Minister;

b) Shall receive information from ministries, sectors, People's Committees at provincial level, relevant agencies, organizations, and individuals regarding leadership, guidance, and management of the Government and the Prime Minister; shall proactively monitor, coordinate, and gather practical information to timely advise and propose solutions for urgent, prominent, and socially concerned issues;

c) Shall provide information to members of the Government, chairpersons of people's councils at provincial level, relevant Party and State agencies, and other organizations as per regulations regarding socio-economic conditions in the country and leadership, guidance, and management activities of the Government and the Prime Minister;

d) Shall collect, compile media information, public concerns, daily reports, advise and propose solutions to issues that require resolution from the Prime Minister;

d) Shall be in charge of monitoring, compiling, and preparing regular and ad hoc social opinion reports on mechanisms and policies; shall advise and propose solutions for guidance and management from the Prime Minister;

e) Shall be in charge of guiding and urging ministries, sectors, People's Committees at provincial level to send and receive electronic documents; shall implement reporting procedures according to instructions from the Government and the Prime Minister;

g) Shall be in charge of guiding and urging ministries, sectors, People's Committees at provincial level regarding sending and receiving electronic documents; shall implement reporting procedures for guidance and management by the Government and the Prime Minister as per legal regulations.

4. Providing Information to the Public

a) Shall provide information to the public about major activities, important decisions in leadership, guidance, and management of the Government and the Prime Minister, prominent political, economic, social events, and other information according to legal regulations and instructions from the Prime Minister;

b) Shall organize communication and guide media communication on policies related to leadership, guidance, and management of the Government and the Prime Minister; shall build and manage multi-platform communication channels for activities of the Government and the Prime Minister;

c) Shall perform the functions of a government spokesperson;

d) Shall be in charge of organizing press conferences by the Government, providing information to the media regularly or on an ad hoc basis; advise the Prime Minister to answer media interviews according to legal regulations.

(d) Coordinate with central information and communication agencies to disseminate and provide information on economic and social conditions; guidance and management activities; policy orientation falling within the functions and responsibilities of the Government and the Prime Minister;

(e) Request relevant agencies and media organizations to correct and revise inaccurate or inappropriate information; promptly address and handle false or distorted information; serve as a point of contact for providing authoritative information to support leadership, guidance, and management activities of the Government and the Prime Minister;

(g) Develop and issue daily and urgent press releases on the guidance and management activities of the Government and the Prime Minister; provide standardized information to ministries, sectors, provincial people's committees, and media organizations for dissemination;

(h) Coordinate inter-ministerial and sectoral information to ensure consistency; provide comments on draft press releases from ministries and sectors with important, sensitive, cross-sectoral content related to Government guidance and management activities;

(i) Implement state management over the Official Gazette; manage, publish, and distribute the Official Gazette of the Socialist Republic of Vietnam; guide, inspect the provincial Official Gazettes in their professional and operational publishing and distribution of electronic Official Gazettes; monitor, urge, evaluate, hold regular meetings, review, and summarize the state management situation and implementation of legal provisions related to the Official Gazette; manage and operate the system of electronic Official Gazettes;

(k) Manage and operate the Government's Electronic Information Portal; guide professional procedures, connect and integrate information with the electronic information portals of ministries, sectors, provincial people's committees.

5. Ensure physical, technical, and logistical conditions for the activities of the Government and the Prime Minister in accordance with the provisions of the Party and the State.

6. Develop and issue normative legal documents and other documents within the authority of the Office of the Government in accordance with legal provisions.

7. Perform self-inspection tasks for normative legal documents, review documents, and handle those that violate the law according to authority and legal provisions.

8. Organize timely receipt and processing of documents from ministries, sectors, provincial people's committees, relevant organizations, individuals submitted to the Government Party Committee, the Standing Committee of the Government Party Committee, the Government, and the Prime Minister in accordance with regulations and instructions from the Prime Minister; issue and manage documents from the Standing Committee of the Government Party Committee, the Government Party Committee, the Government, and the Prime Minister; develop, manage, and operate an electronic document storage system at the Office of the Government according to cybersecurity, data security, cryptology, state secrets protection, and legal provisions.

9. Strictly and effectively implement inspection and supervision tasks; receive citizens, handle complaints and reports; prevent and combat corruption, practice thrift, and fight waste in accordance with legal provisions.

10. Summarize and guide professional and operational work for the offices of ministries, sectors, provincial people's committees.

11. Regarding civil servants

(a) Civil servants at the Office of the Government must have a firm political stance, good morals, high professional expertise, and deep understanding of the field assigned to them; incentives and protection mechanisms are applied for proactive, innovative civil servants who dare to think, act, and take responsibility for the common good;

(b) The Office of the Government has priority in mobilizing, rotating, and assigning civil servants from ministries, sectors, agencies, and localities to work at the Office of the Government and vice versa. Ministries, sectors, agencies, and localities are responsible for prioritizing the allocation, mobilization, rotation, and assignment of civil servants according to requests from the Office of the Government.

12. Manage organizational structure, staffing, number of employees, job positions; decide on recruitment, utilization, management, and implementation of other policies related to cadres, civil servants, and staff within authority.

13. Decide and implement programs and plans for administrative reform, application of information technology, digital transformation, and the Digital Government at the Office of the Government in line with national administrative reform goals, overall program, and legal provisions.

14. Manage finances, assets, and other resources allocated; manage scientific research activities; carry out international cooperation according to legal provisions.

15. Perform other tasks and authorities assigned by the Government Party Committee, the Government, and the Prime Minister or in accordance with legal provisions.

Article 3. Organizational Structure

The organizational structure of the Prime Minister's Office includes the following units:

1. General Department.

2. Legal Department.

3. Economic General Department.

4. Industry Department.

5. Agriculture Department.

6. Science and Culture Department.

7. International Relations Department.

8. Internal Affairs Department.

9. Civil Service Organization Department.

10. Supervision Work Tracking Department (Department I).

11. National Assembly, Localities and Organizations Work Department.

12. Secretariat - Editing Department.

13. Administrative Department.

14. Cadre Organization Department.

15. Digital Transformation Bureau.

16. Management - Finance Bureau.

17. Government Information and Communication Bureau.

The units belonging to the organizational structure of the Prime Minister's Office are administrative organizations as determined by the Minister, Chairman of the Prime Minister's Office in terms of functions, tasks, powers, and organizational structure.

The Government Information and Communication Bureau is a Level 1 Bureau and uses the National Emblem seal.

The Administrative Department has three sections.

The Minister, Chairman of the Prime Minister's Office shall submit to the Prime Minister a list of public sector units directly subordinate to the Prime Minister's Office.

Article 4. Transitional Provisions

The Government Portal (as provided in the Decree of the Government on the functions, tasks, powers, and organizational structure of the Prime Minister's Office) shall continue to perform its functions, tasks, and powers as stipulated under current regulations until the Decision on the functions, tasks, powers, and organizational structure of the Government Information and Communication Bureau issued by the Minister, Chairman of the Prime Minister's Office comes into effect.

Article 5. Effectiveness and Implementation Responsibility

1. This Decree shall take effect from June 1, 2026.

2. This Decree replaces: Decree No. 36/2025/NĐ-CP dated February 25, 2025 of the Government on the functions, tasks, powers, and organizational structure of the Prime Minister's Office; Decree No. 369/2025/NĐ-CP dated December 31, 2025 of the Government amending and supplementing certain provisions of Decree No. 36/2025/NĐ-CP dated February 25, 2025 of the Government.

3. The Minister, Chairman of the Prime Minister's Office, Ministers, heads of agencies at the same level as ministries, chairmen of people's committees of provinces and municipalities directly under the central government shall be responsible for implementing this Decree./.
