CIRCULAR

DETAIL REGULATIONS ON DELEGATION, GRADATION, AND DETERMINATION OF STATE ADMINISTRATIVE AUTHORITY IN THE FIELD OF RIVER AND DAM MANAGEMENT

Pursuant to the Law on Government Organization 2025;

Pursuant to the Law on Local Government Organization 2025;

Pursuant to Resolution No. 190/2025/QH15 dated February 19, 2025 of the National Assembly on handling certain issues related to the restructuring of the state apparatus;

Pursuant to Decree No. 35/2025/NĐ-CP dated February 25, 2025 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

BASED ON THE GOVERNMENT DECREE NO. 131/2025/NĐ-CP OF JUNE 12, 2025, PROVIDING FOR THE DELINEATION OF LOCAL ADMINISTRATIVE AUTHORITY AT TWO LEVELS IN THE FIELD OF MINISTRY OF AGRICULTURE AND RURAL DEVELOPMENT'S STATE ADMINISTRATION;

Pursuant to Decree No. 136/2025/NĐ-CP dated June 12, 2025 of the Government on the delegation and decentralization in the agricultural and environmental sectors;

AT THE PROPOSAL OF THE DIRECTOR OF THE DEPARTMENT OF RIVER AND DAM MANAGEMENT;

THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT ISSUES THIS CIRCULAR TO PROVIDE DETAIL REGULATIONS ON DELEGATION, GRADATION, AND DETERMINATION OF STATE ADMINISTRATIVE AUTHORITY IN THE FIELD OF RIVER AND DAM MANAGEMENT.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

THIS CIRCULAR PROVIDES DETAIL REGULATIONS ON DELEGATION, GRADATION, AND DETERMINATION OF STATE ADMINISTRATIVE AUTHORITY IN THE FIELD OF RIVER AND DAM MANAGEMENT, INCLUDING:

1. DETAIL REGULATIONS AND GUIDELINES FOR IMPLEMENTATION OF GOVERNMENT DECREES ON DELEGATION, GRADATION, AND DETERMINATION OF AUTHORITY IN THE FIELD OF AGRICULTURE AND ENVIRONMENT.

2. AMENDMENTS AND SUPPLEMENTS TO CERTAIN ARTICLES OF LEGAL DOCUMENTS WITHIN THE AUTHORITY OF THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT TO IMPLEMENT DELEGATION, GRADATION, AND DETERMINATION OF AUTHORITY.

Article 2. Applicability

THIS CIRCULAR APPLIES TO CENTRAL ADMINISTRATIVE AUTHORITIES, LOCAL GOVERNMENTS, AND OTHER ORGANIZATIONS AND INDIVIDUALS RELATED IN THE FIELD OF RIVER AND DAM MANAGEMENT.

Chapter II

DETAIL REGULATIONS ON GOVERNMENT DECREES ON DELEGATION, GRADATION, AND DETERMINATION OF AUTHORITY IN THE FIELD OF AGRICULTURE AND ENVIRONMENT

ARTICLE 3. COMPONENTS OF APPLICATION FILES AND FORMS FOR ADMINISTRATIVE PROCEDURES ARE PROVIDED IN GOVERNMENT DECREE NO. 131/2025/NĐ-CP OF JUNE 12, 2025, PROVIDING FOR THE DELINEATION OF LOCAL ADMINISTRATIVE AUTHORITY AT TWO LEVELS IN THE FIELD OF MINISTRY OF AGRICULTURE AND RURAL DEVELOPMENT'S STATE ADMINISTRATION.

Article 4. The components of the administrative procedure file and forms are prescribed in Clause 1, Clause 2 of Article 27 of Decree No. 136/2025/NĐ-CP dated June 12, 2025 of the Government on decentralization and delegation of authority in the agriculture and environment sector.

Clause 1, Article 27 of Decree No. 136/2025/NĐ-CP provides for the file requesting approval of the dam and water reservoir protection plan within the scope delegated by the Ministry of Agriculture and Rural Development, including:

Clause 2, Article 27 of Decree No. 136/2025/NĐ-CP provides for the forms to implement the procedures for issuing, reissuing, extending, and amending the contents of permits for activities within the protected area of irrigation works, including:

Form of application for "issuing permit; extending, amending the content of permit; reissuing permit for new construction projects, underground construction projects, blasting operations, and other explosive activities within the protected area of irrigation works" as prescribed in Appendix I attached to this Circular.

AMENDMENTS AND SUPPLEMENTS TO CERTAIN ARTICLES OF CIRCULARS IN THE IRRIGATION SECTOR

Article 5. Amendments and supplements to certain articles of Circular No. 05/2018/TT-BNNPTNT dated May 15, 2018 of the Minister of Agriculture and Rural Development detailing certain provisions of the Law on Irrigation amended and supplemented in 2022.

Chapter III

1. Amend and supplement Clause 2, Clause 3 of Article 7 as follows:

"c) Solicit opinions from relevant organizations, agencies, and units

The Department of Irrigation Management and Construction is responsible for soliciting opinions from the People's Committee of the province and relevant units regarding the operation procedures of particularly important irrigation works and those involving two provinces or more;

“c) A Level 3 budget unit is a Bureau-level unit or equivalent directly under the Ministry of Public Security shall appoint a department-level leader responsible for financial and accounting functions to appoint an accounting manager; for a Level 3 budget unit that is a department-level unit or equivalent, if the organizational structure includes a team-level unit directly subordinate with at least 20 officers performing financial, accounting, logistics, or political-logistics functions, then a team-level commander should be appointed to appoint an accounting manager.”

The Department of Agriculture and Rural Development is responsible for soliciting opinions from the People's Committee of the commune and relevant agencies regarding the draft operation procedures of irrigation works approved by the People's Committee of the province;

The specialized agency with state management functions over agriculture and rural development at the commune level is responsible for soliciting opinions from related organizations and individuals and relevant agencies within its jurisdiction regarding the draft operation procedures of irrigation works approved by the People's Committee of the commune."

"c) The specialized agency with state management functions over agriculture and rural development at the commune level is the entity responsible for receiving files and organizing the review of operation procedures of irrigation works approved by the People's Committee of the commune."

2. Amend and supplement Clause 2 of Article 9 as follows:

b) Amend and supplement Point c of Clause 3 as follows:"

"2. The People's Committee of the province shall approve the operation procedures of irrigation works or delegate the approval to the People's Committee of the commune for the operation procedures of irrigation works within its territory, except for those specified in Clause 1 and small-scale irrigation works."

3. Amend Clause 2 of Article 15 as follows:

"2. The Ministry of Agriculture and Rural Development manages or delegates management of irrigation works whose exploitation and protection involve two provinces or more according to the Delegation Management List attached as Appendix II to this Circular.

The Minister of Agriculture and Rural Development decides to adjust the Delegation Management List in any of the following cases:

a) Completion of the initial investment construction phase;

b) Occurrence of accidents affecting the safety of the works and downstream areas due to subjective reasons;

c) The unit exploiting the irrigation work is evaluated by the owner or superior management agency as failing to complete assigned tasks;

d) Serious violations occur in implementing regulations on issuing permits for activities within the protected area of irrigation works."

4. Amend and supplement Clause 3 of Article 15 as follows:

"3. The People's Committee of the province manages or delegates management of irrigation works within its territory based on specific local conditions, except in the cases stipulated in Clauses 1, 2, and 4 of this Article."

5. Amend and supplement the name and point a of Clause 2 of Article 17 as follows:

"2. For irrigation works managed by the People's Committee of the province or delegated to the People's Committee of the commune for management:

a) The Department of Agriculture and Rural Development shall take the lead and coordinate with relevant organizations and individuals to submit to the People's Committee of the province for decision on delegating management of irrigation works within the province and the scale of communal irrigation;"

"1. The project investor, organization, or individual exploiting the irrigation work is responsible for taking the lead and coordinating with the People's Committee of the commune where the work is located to publicly announce the boundary marking plan, organize the physical marking of boundaries, and hand over the boundary markers to the People's Committee of the commune for joint management and protection."

7. Replace the phrase "Ministry of Agriculture and Rural Development" with "Ministry of Agriculture and Rural Development" in Clause 1 of Article 9, Clause 1 of Article 15, Clause 1 of Article 15a, Point c of Clause 2 of Article 15a, Clause 1 of Article 15b, Clause 1 of Article 16, Clause 1 of Article 17, Clause 6 of Article 21, Clause 4 of Article 22, Clause 2 of Article 33; replace the phrase "Water Resources Administration" with "Department of Irrigation Management and Construction" in Point a of Clause 3 of Article 7, Clause 4 of Article 12, Point a of Clause 1 of Article 17, Clause 3 of Article 28 Chapter V Model 02 Appendix I; replace the phrase "Department of Agriculture and Rural Development" with "Department of Agriculture and Rural Development" in Point b of Clause 3 of Article 7, Clause 4 of Article 12, Clause 2, Clause 3 of Article 22, Clause 4 of Article 28 Chapter V Model 02 Appendix I; replace the term "delegation" with "management delegation" in the name of Chapter III, Article 15, Article 15a, Article 15b, Clause 1 of Article 16, Point a of Clause 1 of Article 17 of Circular No. 05/2018/TT-BNNPTNT amended and supplemented in 2022.

6. Amend and supplement Clause 1 of Article 24 as follows:

8. Replace Appendix II issued together with Circular No. 05/2018/TT-BNNPTNT amended and supplemented in 2022 with Appendix II issued together with this Circular.

9. Repeal Clause 2a of Article 15.

"Ministry of Agriculture and Environment" in Clause 1, Article 9, Clause 1, Article 15, Clause 1, Article 15a, Point c, Clause 2, Article 15a, Clause 1, Article 15b, Clause 1, Article 16, Clause 1, Article 17, Clause 6, Article 21, Clause 4, Article 22, Clause 2, Article 33; the phrase "General Department of Water Resources" shall be replaced with the phrase "Department of Water Resources Management and Construction" in Point a, Clause 3, Article 7, Clause 4, Article 12, Point a, Clause 1, Article 17, Clause 3, Article 28, Chapter V, Model No. 02, Appendix I; the phrase "Department of Agriculture and Rural Development" shall be replaced with the phrase "Department of Agriculture and Environment" in Point b, Clause 3, Article 7, Clause 4, Article 12, Clause 2, Clause 3, Article 22, Clause 4, Article 28, Chapter V, Model No. 02, Appendix I; the term "delegation" shall be replaced with the term "assignment of management" in the name of Chapter III, Article 15, Article 15a, Article 15b, Clause 1, Article 16, Point a, Clause 1, Article 17 of Circular No. 05/2018/TT-BNNPTNT amended and supplemented in 2022.

8. Replace Appendix II issued together with Circular No. 05/2018/TT-BNNPTNT amended and supplemented in 2022 with Appendix II issued together with this Circular.

9. Repeal Clause 2a, Article 15.

Article 6. Amend and supplement some provisions of Circular No. 23/2022/TT-BNNPTNT dated December 29, 2022 of the Minister of Agriculture and Rural Development guiding the implementation to ensure safe water supply in rural areas.

1. Amend and supplement Clause 2, Clause 3 of Article 6 as follows:

“2. Before March 30 of the year preceding the planning period, the Department of Agriculture and Environment shall send a guidance document to the People's Committee at the commune level and the water supply units regarding the proposal for the plan content.

3. Before April 30 of the year preceding the planning period, the People's Committee at the commune level and the water supply units shall propose the plan content and the list of works meeting the requirements set forth in Article 4 of this Circular and submit them to the Department of Agriculture and Environment. The proposal content shall be in accordance with Appendix I issued together with this Circular.”

2. Amend and supplement Point a, Point b of Clause 2 of Article 7 as follows:

“a) Before March 30 of the year when the adjustment plan is built, the Department of Agriculture and Environment shall send a guidance document to the People's Committee at the commune level and the water supply units regarding the proposal for the adjustment plan content;

b) Before April 30 of the year when the plan is adjusted, the People's Committee at the commune level and the water supply units shall propose the content of safe water supply implementation and the list of adjustment works meeting the requirements set forth in Article 4 of this Circular and submit them to the Department of Agriculture and Environment. The proposed content and list of works shall be carried out in accordance with Appendix I of this Circular;”

3. Supplement Clause 1a, Clause 1b after Clause 1 and amend and supplement Clause 2 of Article 19 as follows:

“1a. Coordinate and supervise the implementation of the safe water supply plan for centralized rural clean water facilities within the jurisdiction.

1b. Coordinate in building information and data on ensuring safe water supply in rural areas.

2. Annually report the results of implementing safe water supply to the Department of Agriculture and Environment according to Appendix VI issued together with this Circular.”

4. Amend and supplement Clause 3 of Article 20 as follows:

“3. Annually report to the Department of Agriculture and Environment and the People's Committee at the commune level on the results of approving and implementing the safe water supply plan for facilities managed by the unit according to Appendix VI issued together with this Circular.”

5. Replace the phrase "Ministry of Agriculture and Rural Development" with the phrase "Ministry of Agriculture and Environment" in Clause 3 of Article 21; replace the phrase "Water Resources General Department" with the phrase "Water Resources Construction Management Department" in Article 16, Point d of Clause 1 of Article 17; replace the phrase "Department of Agriculture and Rural Development" with the phrase "Department of Agriculture and Environment" in Clause 4 of Article 6, Point c of Clause 2 of Article 7, Clause 1 of Article 11, Clause 1 of Article 17, Clause 3 of Article 2 of Appendix III of Circular No. 23/2022/TT-BNNPTNT.

6. Repeal Article 18.

Chapter IV

IMPLEMENTING PROVISIONS

Article 7. Effective Date

This Circular shall take effect from July 1, 2025.

Article 8. Transitional Provisions

For irrigation works where exploitation and protection involve two or more provinces as specified in Appendix II issued together with Circular No. 05/2018/TT-BNNPTNT amended and supplemented in 2022 but are not included in the management assignment list of irrigation works specified in Appendix II issued together with this Circular, the People's Committee at the provincial level where the work is located shall manage the work in accordance with the laws on irrigation. During the time before the transfer of management, the agency or organization exploiting the irrigation work shall continue to manage and exploit until a decision is made by the competent authority.

Article 9. Responsibility for implementation

The Minister, Heads of Ministries equivalent to Ministries, Agencies under the Government, Chairmen of Provincial People's Committees directly under the Central Government, and relevant organizations and individuals are responsible for implementing this Circular.

In the process of implementing this Circular, if there are difficulties or obstacles, agencies, organizations, and individuals should promptly reflect them to the Ministry of Agriculture and Environment for guidance and research to amend and supplement.
