The Minister of Finance issues this Circular regulating the financial mechanism for implementing Decision No. 50/2014/QĐ-TTg dated September 4, 2014 of the Prime Minister on support policies to improve the efficiency of smallholder livestock farming during the period 2015-2020 (hereinafter referred to as Decision No. 50/2014/QĐ-TTg).
Article 1. Scope of Regulation and Applicability
Article 1. Scope of regulation: This Circular guides the financial mechanism for supporting the improvement of the efficiency of smallholder livestock farming during the period 2015-2020 according to Decision No. 50/2014/QĐ-TTg.

a) Households directly engaged in pig, buffalo, cattle, and poultry farming (excluding households engaged in contract farming for enterprises); individuals providing artificial insemination services for livestock.
b) Agencies, organizations, and individuals related to the management and use of funds for implementing the policy to improve the efficiency of smallholder livestock farming during the period 2015-2020 according to Decision No. 50/2014/QĐ-TTg.
Article 2. Financial Mechanism and Support Methods for Policies to Improve the Efficiency of Smallholder Livestock Farming
1. Regarding annual support for artificial insemination for pigs, buffaloes, and cattle:
a) Based on registration forms of household livestock farmers with confirmation from the People's Committee at the commune level (hereinafter referred to as the Commune People's Committee); confirmation from the household livestock farmers regarding the type of semen actually received; periodically monthly or quarterly, designated facilities producing and selling livestock breeding materials or livestock breeding supplies in the locality (hereinafter referred to as Semen Supply Facilities) shall be responsible for compiling summary tables of the number of livestock farming households, types of semen, quantities of semen doses, and breeding supplies provided according to each commune and submit them to the Commune People's Committee for confirmation.
b) Based on the unit price of semen doses and breeding supplies according to the standard set by the Provincial People's Committee; the content and level of support specified in Clause 1, Article 3 of Decision No. 50/2014/QĐ-TTg and the actual support provided to livestock farming households regarding the type of semen, semen doses, and breeding supplies; the Semen Supply Facilities shall determine the funding needs for the support provided to livestock farming households, consolidate these, and send them to the Department of Agriculture and Rural Development for review and submission to the Provincial Finance Department for examination and approval by the Provincial People's Committee as the basis for payment and support according to regulations.
c) The funding for artificial insemination support under this Circular shall be allocated to the Semen Supply Facilities (not directly to livestock farming households).
2. Regarding support for purchasing male breeding pigs, buffaloes, and cattle, and female parent chickens and ducks:
a) Households residing in areas with extremely difficult socio-economic conditions and areas with difficult socio-economic conditions, as defined by the competent authority, directly engaged in livestock farming for service insemination shall be supported part of the cost of purchasing breeding pigs, buffaloes, and cattle.
b) Households engaged in breeding male pigs, buffaloes, and cattle for service insemination; and raising parent chickens and ducks (linked to hatching and supplying chicks) ensuring all conditions for support as specified in Point b, Clause 2, Article 3 of Decision No. 50/2014/QĐ-TTg who have purchased breeding animals and have valid financial invoices shall be supported part of the cost of purchasing breeding animals. The content and level of support for purchasing male breeding pigs, buffaloes, and cattle, and parent chickens and ducks shall be implemented according to Point a, Clause 2, Article 3 of Decision No. 50/2014/QĐ-TTg.
c) Based on the application for breeding animal support submitted by the livestock farmer and confirmed by the Commune People's Committee; financial invoices for purchasing male breeding pigs, buffaloes, and cattle; parent chickens and ducks; periodically monthly or quarterly, the Commune People's Committee shall be responsible for reviewing and compiling lists of livestock farming households (by commune), types of breeding animals, quantities of breeding animals, purchase prices according to invoices, and support funding according to regulations, consolidate and submit them to the specialized agencies under the District People's Committee for consolidation, examination, and submission to the District People's Committee for decision; simultaneously send to the Department of Agriculture and Rural Development and the Department of Finance for examination and submission to the Provincial People's Committee for approval as the basis for payment and support according to regulations.
d) The funding for purchasing male breeding pigs, buffaloes, and cattle, and parent chickens and ducks under this Circular shall be paid directly to the livestock farming households after they have purchased breeding animals and have valid financial invoices for the purchase of breeding animals according to regulations. Each livestock farming household can only be supported once to purchase either male breeding pigs, or male breeding buffaloes, or male breeding cattle; or parent chickens, or parent ducks.
3. Regarding support for constructing new waste treatment facilities for livestock farming:
a) Based on the registration form for building biogas plants or making biological bedding of the livestock farmer with confirmation from the Commune People's Committee; confirmation from the Commune People's Committee regarding the construction of new biogas plants or making biological bedding that has applied waste treatment technology meeting the requirements of the Ministry of Agriculture and Rural Development; unit price and support quota set by the Provincial People's Committee; periodically monthly or quarterly, the Commune People's Committee shall be responsible for compiling summary tables of the number of livestock farming households, types of facilities, quantities of facilities, completed facility value, and support funding according to regulations, consolidate and submit them to the specialized agencies under the District People's Committee for consolidation, examination, and submission to the District People's Committee for decision; simultaneously send to the Department of Agriculture and Rural Development and the Department of Finance for examination and submission to the Provincial People's Committee for approval as the basis for payment and support according to regulations.
Households that have built biogas plants for livestock waste treatment or made biological bedding for livestock waste treatment before January 1, 2015 (the effective date of Decision No. 50/2014/QĐ-TTg) shall not be eligible for support under this Circular.
b) The state budget supports once for households engaged in animal husbandry after they have newly constructed biogas facilities or made biological bedding in accordance with technical guidelines issued by the Ministry of Agriculture and Rural Development.
4. Regarding training and instruction support:
a) Training and instruction funds for artificial insemination embryo techniques for livestock shall be used to implement the training course contents on artificial insemination embryo techniques for livestock. Specifically: direct support costs for trainees; printing and distribution costs for materials, stationery, lecture halls, teaching equipment, and practical supplies (if applicable); instructor and guide training costs, and practical operation technique costs.
- Instructor support costs shall be implemented according to Decision No. 1956/QĐ-TTg dated November 7, 2009 of the Prime Minister approving the "Vocational Training Program for Rural Laborers until 2020".
- Direct support costs for participants in the artificial insemination livestock training course: maximum meal allowance not exceeding 70,000 VND/person/day of actual training; travel allowance at the maximum rate not exceeding 150,000 VND/person/course. In cases where accommodation is rented for trainees, full support for accommodation costs will be provided (if applicable).
b) Based on the guidance of the Ministry of Agriculture and Rural Development in Circular No. 09/2015/TT-BNNPTNT dated March 3, 2015 regarding the implementation of point a, Clause 1, Article 6 of Decision No. 50/2014/QĐ-TTg and specific provisions in this Circular, provincial People's Committees shall establish one-time training and instruction cost support standards for artificial insemination livestock techniques to apply within their province (support level not exceeding 6 million VND/person).
c) On the basis of the list of units meeting the conditions for training and instruction on artificial insemination livestock techniques announced by the Ministry of Agriculture and Rural Development; individuals who need training and instruction on artificial insemination livestock techniques (confirmed by the People's Commune People's Committee) shall register for courses and pay their own training fees to the training institutions; after completing the training course, those with training certificates shall go to the agencies or units assigned by the People's Committee (according to the provincial classification) to claim reimbursement for training and instruction cost support.
d) Based on the registration form of individuals requiring training and instruction on artificial insemination livestock techniques confirmed by the People's Commune People's Committee; actual training and instruction time; training and instruction certificates issued by the training institution; training and instruction cost support standards and support levels stipulated in Clause 1, Article 4 of Decision No. 50/2014/QĐ-TTg; the agencies or units assigned by the provincial People's Committee to provide training and instruction cost support shall compile lists and support needs for training and instruction costs, submit them to the Department of Agriculture and Rural Development for review and approval by competent authorities as the basis for payment and support for training and instruction costs.
5. One-time support for liquid nitrogen containers to transport and store artificial insemination livestock semen:
a) Based on the registration form of individuals requiring artificial insemination livestock services confirmed by the People's Commune People's Committee; commitment to maintain and use the container for at least five years; financial invoice for purchasing the liquid nitrogen container; monthly or quarterly, the People's Commune People's Committee shall compile lists, types of containers, purchase prices according to invoices, and support funding as prescribed, submit them to the specialized agency under the People's Committee of the district for consolidation and approval by the People's Committee at the same level; simultaneously send to the Department of Agriculture and Rural Development and the Department of Finance for review and approval by the provincial People's Committee as the basis for payment and support according to regulations.
b) The state budget directly supports once liquid nitrogen containers for individuals providing artificial insemination livestock services according to point a, Clause 2, Article 4 of Decision No. 50/2014/QĐ-TTg after purchasing the liquid nitrogen container with a financial invoice.
Article 3. Source of Funding
1. The capital sources for implementing the policy to improve the efficiency of smallholder animal husbandry are integrated from various sources, including: local government budgets; additional targeted funds from the central government budget for local government budgets; funds from central and local programs and projects; funds from other international cooperation programs; and other contributions raised in accordance with the law.
2. The central government budget supports localities receiving supplementary balance transfers from the central government budget 50% of the state budget support funds to implement policies stipulated in Articles 3 and 4 of Decision No. 50/2014/QĐ-TTg (excluding funds from central and local program and project budgets; funds from other international cooperation programs; and other contributions raised in accordance with the law). The remaining localities shall use their local budgets to implement these policies.
3. For localities where annual costs for the above items are not significant (less than 1 billion VND/year), provinces and cities shall proactively use their local budgets to implement these policies.
4. In cases where there is overlap in support policies from different programs and projects, beneficiaries may choose to apply the most beneficial support policy.
Article 4. Organization of Implementation
1. The Chairpersons of the People's Committees of provinces and centrally-administered cities are responsible for:
a) Specifying in detail: Types of semen, support levels for semen doses, and unit prices for semen doses for artificial insemination in pigs; types of semen, support levels for semen doses, unit prices, and material supply standards for artificial insemination in cattle and buffalo; quantities and support levels for households purchasing breeding animals; unit prices and support levels for households constructing biogas facilities and making biological bedding; unit prices and support levels for liquid nitrogen containers for individuals providing artificial insemination livestock services, serving as the basis for implementing the policy in their respective areas.
b) Approving or adjusting local technical standards for implementing the policy to ensure effectiveness and avoid waste.
c) Direct the Department of Agriculture and Rural Development to coordinate with the Department of Finance, relevant agencies, and the People's Committee at lower levels to appraise and confirm the subjects, funding needs for implementing the policy to ensure timely, accurate compliance with policies and regulations, and develop financial plans for implementation. Proactively utilize local government budgets and other lawful financial sources as prescribed by law to effectively organize and implement policies as stipulated in Decision No. 50/2014/QĐ-TTg.
2. The People's Committee at the commune level shall cooperate with related agencies at the local level to publicly disclose state support policies: lists of beneficiaries, contents of support, and support funds before and after the decision on support is made by the competent authority through mass media, posted at the People's Committee office at the commune level and in villages according to Circular No. 54/2006/TT-BTC dated June 19, 2006, issued by the Ministry of Finance, guiding the implementation of regulations on publicizing direct budget support for individuals and residents.
3. At the end of the year, the People's Committees of provinces and centrally-administered cities shall compile the situation and results of policy implementation (as per Appendices 1, 2, 3a, 3b, 4, and 5 attached), report to the Ministry of Finance and the Ministry of Agriculture and Rural Development for consideration of central budget support for each province and centrally-administered city, and consolidate reports to the Prime Minister on the results of implementation.
In cases where there is a large funding need and the local budget faces difficulties in sourcing funds, based on the request of the locality, the Ministry of Finance will advance funds for the locality to implement (up to a maximum of 70% of the central budget support level). After the locality submits its final account report, the Ministry of Finance will process the transfer from advance payment to formal support disbursement for the locality (the portion of central budget support for the locality) and recover the advance payment.
Article 5. Implementation Provisions
1. This Circular takes effect from February 5, 2016.
2. The policies prescribed in this Circular shall be implemented from January 1, 2015.
During the implementation period, if there are any issues, please reflect them to the Ministry of Finance for review and appropriate amendments./.
