Amending and supplementing certain Articles of Regulations on assessing primary school students issued together with Circular No. 30/2014/TT-BGDĐT dated August 28, 2014of the Minister of Education and Training

Pursuant to Decree No. 36/2012/NĐ-CP dated April 18, 2012, of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

On the basis of Decree No. 32/2008/NĐ-CP dated March 19, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;

On the basis of Decree No. 75/2006/NĐ-CP dated August 2, 2006 of the Government detailing and guiding the implementation of certain provisions of the Education Law; Decree No. 31/2011/NĐ-CP dated May 11, 2011 of the Government amending and supplementing certain provisions of Decree No. 75/2006/NĐ-CP dated August 2, 2006 of the Government detailing and guiding the implementation of certain provisions of the Education Law; Decree No. 07/2013/NĐ-CP dated January 9, 2013 of the Government regarding the amendment of point b Clause 13 Article 1 of Decree No. 31/2011/NĐ-CP dated May 11, 2011 of the Government amending and supplementing certain provisions of Decree No. 75/2006/NĐ-CP dated August 2, 2006 of the Government detailing and guiding the implementation of certain provisions of the Education Law;

Pursuant to the proposal of the Director of the Primary Education Department,

The Minister of Education and Training issues this Circular amending and supplementing certain Articles of The regulations on assessing primary school students issued together with Circular No. 30/2014/TT-BGDĐT dated August 28, 2014 of the Minister of Education and Training.

Article 1. Amending and supplementing certain articles of the regulations on assessing primary school students issued together with Circular No. 30/2014/TT-BGDĐT dated August 28, 2014 of the Minister of Education and Training

1. Amending and supplementing the name of Article 4 and Clause 1, Clause 3 of Article 4 as follows:

a) Amending and supplementing the name of Article 4 as follows:

"Article 4. Requirements for assessment"

b) Amending and supplementing Clause 1, Clause 3 of Article 4 as follows:

"1. Assessment for the progress of students; emphasizing encouragement of efforts in study and training; helping students maximize their potential; ensuring timeliness, fairness, and objectivity."
"3. Regular assessment through comments, periodic assessment combining scores with comments; combining teacher's assessment, student's self-assessment, parent's assessment, with teacher's assessment being the most important."

2. Amending and supplementing Clause 2 Article 5 as follows:

"2. Assessment of the formation and development of students' abilities and qualities:
a) Abilities: self-service, self-management; cooperation; self-study and problem-solving;

3. Amend and supplement Article 6 as follows:

"Article 6. Regular Evaluation
b) Qualities: diligence, responsibility; confidence, honesty; discipline; unity, love."
1. Regular assessment is the evaluation during the learning and training process concerning knowledge, skills, attitudes, and some manifestations of abilities and qualities of students, carried out according to the course content of subjects and educational activities. Regular assessment provides feedback information to teachers and students to support, adjust promptly, and promote the progress of students towards the goals of primary education.
2. Regular assessment of learning:
a) Teachers use verbal communication to inform students about correct and incorrect aspects and ways to improve; write comments in students' notebooks or learning products when necessary, with specific measures to provide timely assistance;
b) Students self-assess and participate in assessing the learning products of peers or groups during the execution of learning tasks to improve performance;
c) Encouraging parents of students to exchange with teachers about assessments of students through appropriate forms and cooperate with teachers to encourage and assist students in learning and training.
3. Regular assessment of abilities and qualities:
a) Teachers base their comments on students' manifestations of understanding, skills, and attitudes at each ability and quality, providing timely assistance;

4. Amend and supplement Article 10 as follows:

"Article 10. Periodic Assessment
1. Periodic assessment is the evaluation of students' educational outcomes after a period of study and training, aimed at determining the extent to which students have fulfilled their learning tasks compared to the standards of knowledge and skills specified in the primary school general education program and the formation and development of students' abilities and qualities.
2. Periodic assessment on learning
a) In the middle of the first semester, at the end of the first semester, in the middle of the second semester, and at the end of the academic year, teachers base their assessments on regular evaluations and the standards of knowledge and skills for each subject or educational activity according to the following levels:

- Completed well: fulfilling all requirements of the subject or educational activity;

- Completed: meeting the requirements of the subject or educational activity;

- Not completed: failing to meet some requirements of the subject or educational activity;
b) At the end of the first semester and at the end of the academic year, for subjects such as Vietnamese, Mathematics, Science, History, Geography, Foreign Language, Information Technology, and Ethnic Languages, there will be periodic tests;

For grades 4 and 5, there will also be periodic tests for Vietnamese and Mathematics in the middle of the first semester and the middle of the second semester;

c) The periodic test questions should align with the standards of knowledge and skills and the direction of developing abilities, including questions and exercises designed at the following levels:

- Level 1: recognizing and recalling learned knowledge and skills;

- Level 2: understanding learned knowledge and skills, explaining them according to personal comprehension;

- Level 3: applying learned knowledge and skills to solve familiar or similar problems in studies and life;

- Level 4: flexibly applying learned knowledge and skills to solve new problems or provide reasonable feedback in studies and life;
d) Teachers correct errors, comment, grade on a scale of 10 points without giving zero or decimal scores, and return the test papers to students. The scores from periodic tests are not used to compare students. If the results of the final exams at the end of the first semester and the end of the academic year are unusual compared to regular assessments, teachers may propose that the school allow students to take different tests to accurately assess their learning outcomes.

3. Periodic assessment on abilities and qualities

In the middle of the first semester, at the end of the first semester, in the middle of the second semester, and at the end of the academic year, class advisors base their assessments on the manifestations related to cognition, skills, and attitudes during regular assessments of the formation and development of each student's abilities and qualities, summarized as follows:
a) Good: meeting educational requirements clearly and consistently;
b) Achieved: meeting educational requirements but inconsistently;

c) Need to strive: not fully meeting educational requirements, manifested unclearly."

5. Amend and supplement Article 12 as follows:

"Article 12. Assessment of Students with Disabilities and Students in Flexible Classes

Assessing students with disabilities and students in flexible classes ensures their right to care and education.
1. Students with disabilities who follow inclusive education methods are assessed like non-disabled students with adjusted requirements or according to the individual education plan.
2. Students with disabilities who follow specialized education methods are assessed according to regulations for specialized education or according to the individual education plan.

3. For students in flexible classes: teachers base their assessments on observations and regular evaluations during flexible class sessions and the results of periodic assessments in Mathematics and Vietnamese subjects conducted according to Article 10 of this Regulation."

6. Amend and supplement the name of Article 13 and Article 13 as follows:

a) Amend and supplement the name of Article 13 as follows:
"Article 13. Evaluation File and Summary of Evaluation Results"

b) Amend and supplement Article 13 as follows:
"Article 13. Evaluation File and Summary of Evaluation Results
1. The evaluation file includes the Student Record Book and the Summary Table of Educational Assessment Results for the class.
2. Midway through the semester and at the end of the semester, teachers record the educational assessment results of students in the Summary Table of Educational Assessment Results for the class. The Summary Tables of Educational Assessment Results for each class shall be retained at the school in accordance with regulations.

3. At the end of the academic year, the class teacher records the educational assessment results of students in the Student Record Book. The Student Record Book shall be kept by the school throughout the time the student studies at the school and shall be handed over to the student upon completion of the primary education program or transfer to another school.

7. Amend and supplement Clause 1, Article 14 as follows:

"1. Criteria for Completion of the School Year Program:
a) Students who are confirmed to have completed the school year program must meet the following conditions:

- Periodic assessment of learning outcomes at the end of the academic year for each subject and educational activity: Completed well or Completed;

- Periodic assessment of each ability and character trait at the end of the academic year: Good or Achieved;

- Periodic examination scores at the end of the academic year for each subject must be 5 points or higher;
b) For students who have not been confirmed to have completed the school year program, teachers shall develop plans, provide guidance, and assist; conduct supplementary assessments to determine completion of the school year program;

c) For students who have been guided and assisted but still do not meet the conditions to complete the school year program, depending on the extent of non-completion in subjects and educational activities, the level of development of certain abilities and character traits, teachers shall prepare a list to report to the principal for consideration and decision regarding promotion to the next grade or retention in the current grade."

8. Amend and supplement Article 15 as follows:

"Article 15. Acceptance and Handover of Educational Quality
1. Acceptance and handover of educational quality ensure the objectivity and responsibility of teachers regarding student assessment results; help teachers receive students for the next academic year with sufficient information to plan and implement effective educational measures.
2. The principal shall direct the acceptance and handover of educational quality:
a) For students in grades 1, 2, 3, and 4: the class teacher shall discuss with the teacher who will receive the students in the next academic year about the prominent or limited aspects of the students, and hand over the student assessment files as stipulated in Clause 1 of Article 13 of this Regulation;
b) For students in grade 5: the subject team shall prepare periodic examinations at the end of the academic year for the entire grade; organize invigilation and marking of the examination papers with the participation of teachers from the secondary school in the same area; the class teacher shall complete the student assessment files and hand them over to the school.

3. The Director of Education and Training shall direct schools in the same area to organize the acceptance and handover of educational quality for students completing the primary education program and moving up to grade 6, in accordance with the conditions of the schools and the locality."

9. Amend and supplement Article 16 as follows:

"Article 16. Awards
1. The principal shall present certificates of merit to students:
a) End-of-year awards:

- Students who excel in all learning and discipline requirements: assessment results for subjects are Completed well, abilities and character traits are Good; periodic examination scores at the end of the academic year for subjects are 9 points or higher;

- Students who achieve outstanding results or make significant progress in at least one subject or one ability or character trait, as recognized by their teachers and class;
b) Special awards: students who achieve outstanding results during the academic year. 2. Students with exceptional achievements shall be considered by the school for recommendation to higher authorities for awards."

10. Amend and supplement Article 17 as follows:

"Article 17. Responsibilities of the Department of Education and Training, the District Education and Training Office
1. The Director of the Department of Education and Training shall be responsible for:
a) Directing the Head of the District Education and Training Office to organize the implementation of primary school student assessment on their jurisdiction; report the results of implementation to the Ministry of Education and Training;
b) Guiding the use of Student Records.
2. The Head of the District Education and Training Office shall direct the Principal to organize the implementation of assessment, acceptance, and handover of educational quality of primary school students within their jurisdiction; report the results of implementation to the Department of Education and Training.

3. The Director of the Department of Education and Training and the Head of the District Education and Training Office shall be responsible for monitoring, inspecting, resolving difficulties, and issues during the implementation of this Circular at the local level.

11. Amend and supplement Article 18 as follows:

"Article 18. Responsibilities of the Principal
1. Shall be responsible for directing the organization and promotion of the implementation of student assessment according to this Circular; ensuring the quality of assessment; reporting the results of implementation to the District Education and Training Office.
2. Respect the autonomy of teachers in implementing the student assessment regulations.
3. Direct the issuance of periodic examination questions; develop and implement plans for nurturing and assisting students; accept and hand over the educational quality of students; confirm the final year assessment results of students; review class advancement; manage student assessment file records.

4. Explain and resolve concerns and suggestions regarding student assessment within the scope and authority of the Principal.

12. Amend and supplement Article 19 as follows:

"Article 19. Responsibilities of Teachers
1. Class Advisors:
a) Shall be primarily responsible for assessing students, the education outcomes of students in the class; complete student assessment files according to regulations; accept and hand over the educational quality of students;
b) Notify parents individually about each student's learning and discipline assessment results;
c) Guide students to self-assess and participate in assessing peers and peer groups. Promote parents about the content and methods of assessment according to this Circular; coordinate and guide parents to participate in the assessment process.
2. Teachers not serving as class advisors:
a) Shall be responsible for assessing the learning and discipline process and academic results of students for subjects and educational activities according to regulations;
b) Coordinate with class advisors, teachers in the same class, and parents to conduct student assessments; complete student assessment files; accept the educational quality of students;
c) Guide students to self-assess and participate in assessing peers and peer groups.

3. Teachers shall monitor the progress of students, record notes for students who have incomplete content or outstanding potential. In necessary cases, teachers notify parents individually about each student's assessment results.

13. Amend and supplement Article 20 as follows:

"Article 20. Rights and Responsibilities of Students
1. Have the right to express opinions and receive guidance and explanations from teachers and principals regarding assessment results.

2. Self-assess and participate in assessing peers and peer groups according to teacher instructions.

Article 2. Abolition and change of wording

1. Repeal Clause 3 of Article 5, Article 7, Article 8, Article 9, and Article 11.

2. Replace the term "assessment" with "evaluation" in Clause 2 of Article 3.

This Circular takes effect from December 25, 2025/.

The Chief of the Office, the Director of the Primary Education Department, the Director of the Testing and Quality Assurance Department, the Heads of relevant units under the Ministry of Education and Training, and the Directors of provincial Departments of Education and Training shall be responsible for enforcing this Circular.

Article 4. Effective date

This Circular takes effect from November 6, 2016./.
