Regarding land and real estate under state management and allocation during the implementation of land management policies and socialist transformation policies prior to July 1, 1991Prior to July 1, 1991

NATIONAL ASSEMBLY OF THE SOCIALIST REPUBLIC OF VIETNAM
Considering that, in the national liberation struggle, the national democratic revolution, and the socialist revolution, the State promulgated and implemented land management policies and socialist transformation policies related to land. These policies originated from specific conditions and circumstances of the Revolution at each stage and had historical significance, contributing to the successful completion of the construction and defense of the Socialist Republic of Vietnam;
Pursuant to the Constitution of the Socialist Republic of Vietnam in 1992, amended and supplemented by Resolution No. 51/2001/QH10 dated December 25, 2001 of the National Assembly, tenth session;
Pursuant to the Report No. 1516/CP-CN dated November 5, 2003 of the Government, the Review Report of the Committee for Legal Affairs, and the opinions of the National Assembly deputies;
RESOLVES
Article 1: The State will not reconsider the policy orientation, policies, and implementation of land management policies and socialist transformation policies related to land issued before July 1, 1991.
The State will not recognize claims to reclaim land and real estate that the State has managed and allocated during the implementation of land management policies and socialist transformation policies related to land.
Article 2: The State will complete the legal procedures for the ownership of all people regarding types of land and real estate that the State has managed and allocated during the implementation of the following policies:
1. Transformation of leased land and real estate;
2. Transformation of private commercial enterprises directly related to land and real estate;
3. Management of land and real estate of organizations and individuals (category 2/IV) in southern provinces and cities after the liberation (April 30, 1975);
4. Management of ownerless land and real estate;
5. Management of land and real estate at specific time points and of associations, religions;
6. Management of land and real estate of those who evacuated, relocated, or left the country.
Article 3. In cases where the owners of land and real estate that the State has managed and allocated during the implementation of land management policies and socialist transformation policies related to land now genuinely face difficulties with housing, the State will have policies to facilitate their improvement of living conditions.
Article 4. The Standing Committee of the National Assembly is tasked, based on this Resolution of the National Assembly and the proposal of the Government, to specify the handling of certain specific cases, ensuring the interests of the State, the rights and legitimate interests of citizens, and being consistent with the actual conditions of the country.
Article 5. This Resolution shall take effect from July 1, 2004.
The Government shall guide, direct, and uniformly organize the implementation throughout the country, ensuring the completion of the implementation of this Resolution within five years from the date it takes effect, with a spirit of urgency and economy.
The Vietnam Fatherland Front and its member organizations shall widely publicize and mobilize all strata of the population to strictly implement the National Assembly's Resolution.
The National Assembly calls upon compatriots within the country and overseas Vietnamese to support and strictly implement the National Assembly's Resolution for the common good of the entire nation, considering this a practical contribution to the cause of stabilizing and developing the country.
This Resolution was adopted by the National Assembly of the Socialist Republic of Vietnam, the 11th term, fourth session, on November 26, 2003.
