Circular No. 23/2023/TT-BTNMT amends and supplements certain provisions of Circular No. 20/2016/TT-BTNMT dated August 25, 2016, issued by the Minister of Natural Resources and Environment regarding the construction, exploitation, and use of natural resources, environmental marine and island data bases.

 CIRCULAR

Amending and supplementing certain articles of Circular No. 20/2016/TT-BTNMT dated August 25, 2016 of the Minister of Natural Resources and Environment on construction, exploitation, and utilization of natural resources and environmental databases for marine areas and islands

Pursuant to the Law on Marine Resources, Environment, and Islands dated June 25, 2015;

Pursuant to Resolution No. 79/NQ-CP dated August 18, 2017 of the Government on simplifying administrative procedures and citizen-related documents related to population management within the scope of the Ministry of Natural Resources and Environment's state management functions;

Pursuant to Decree No. 68/2022/NĐ-CP dated September 22, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Natural Resources and Environment;

At the proposal of the Director of the Vietnam Marine and Island Affairs Department and the Head of the Legal Department;

The Minister of Natural Resources and Environment issues this Circular amending and supplementing certain articles of Circular No. 20/2016/TT-BTNMT dated August 25, 2016 of the Minister of Natural Resources and Environment on construction, exploitation, and utilization of natural resources and environmental databases for marine areas and islands.

Article 1. Amending and supplementing certain articles of Circular No. 20/2016/TT-BTNMT dated August 25, 2016 of the Minister of Natural Resources and Environment on construction, exploitation, and utilization of natural resources and environmental databases for marine areas and islands

1. Amending and supplementing Point a Clause 2 Article 14 as follows:

“a) Name and address of the organization; full name, place of residence, contact address, identification card number or citizen identity card number or personal identification number or passport number of the individual; fax number, telephone number, email address (if any) of the organization or individual;"

2. Amending and supplementing Clause 3 Article 14 as follows:

"3. Documents requesting data provision can be submitted directly to the database management agency or sent via postal service or electronic network; requests from state agencies may be sent via official letters or fax.

When collecting data directly at the database management agency, organizations must present an introduction letter; individuals must present their national identity card or citizen identity card or personal identification number or passport or certified copy thereof."

Article 2. Supplementing and replacing certain provisions of Circular No. 20/2016/TT-BTNMT dated August 25, 2016 of the Minister of Natural Resources and Environment on construction, exploitation, and utilization of natural resources and environmental databases for marine areas and islands

1. Replacing the phrase “Vietnam Marine and Island Administration” with the phrase “Vietnam Marine and Island Department” in Clause 1 and Clause 4 Article 5, Clause 2 Article 7, Point e and Point g Clause 1 Article 8, Clause 4 Article 9, Clause 1 Article 18 of Circular No. 20/2016/TT-BTNMT dated August 25, 2016 of the Minister of Natural Resources and Environment on construction, exploitation, and utilization of natural resources and environmental databases for marine areas and islands.

Replacing the phrase “Circular No. 11/2013/TT-BTNMT dated May 28, 2013 of the Minister of Natural Resources and Environment on retention period of specialized natural resources and environmental files and records” with the phrase “Circular No. 46/2016/TT-BTNMT dated December 27, 2016 of the Minister of Natural Resources and Environment on retention period of specialized natural resources and environmental files and records” in Clause 1 Article 9 of Circular No. 20/2016/TT-BTNMT dated August 25, 2016 of the Minister of Natural Resources and Environment on construction, exploitation, and utilization of natural resources and environmental databases for marine areas and islands.

2. Adding the phrase “and Circular No. 14/2020/TT-BTNMT dated November 27, 2020 of the Minister of Natural Resources and Environment promulgating Procedures and Economic-Technical Standards for Construction, Maintenance, and Operation of Information Systems in the Natural Resources and Environmental Sector” after the phrase “Circular No. 26/2014/TT-BTNMT dated May 28, 2014 of the Minister of Natural Resources and Environment promulgating Procedures and Economic-Technical Standards for Construction of Natural Resources and Environmental Databases” in Clause 3 Article 6 of Circular No. 20/2016/TT-BTNMT dated August 25, 2016 of the Minister of Natural Resources and Environment on construction, exploitation, and utilization of natural resources and environmental databases for marine areas and islands.

Article 3. Effectiveness

This Circular takes effect from February 15, 2024.
