Pursuant to the Law on Inland Waterway Transport No. 23/2004/QH11 dated June 15, 2004; the Law No. 48/2014/QH13 amending and supplementing certain articles of the Law on Inland Waterway Transport dated June 17, 2014:
Pursuant to the Law on Prices No. 11/2012/QH13 dated June 20, 2012;
Pursuant to the Law on Fees and Charges No. 97/2015/QH13 dated November 25, 7 2015;
Pursuant to the Decree No. 177/2013/NĐ-CP dated November 14, 2013 of the Government detailing and guiding the implementation of some provisions of the Law on Prices and the Decree No. 149/2016/NĐ-CP dated November 11, 2016 of the Government amending and supplementing some articles of the Decree No. 177/2013/NĐ-CP dated November 14, 2013;

The Minister of Finance promulgates this Circular regulating the price of technical safety inspection and quality inspection services for inland waterway vessels.
Article 1. Scope of Regulation
This Circular regulates the price of technical safety inspection and quality inspection services for inland waterway vessels applicable to all vessels required to undergo technical safety inspection and quality inspection according to the provisions of the Law on Inland Waterway Transport.
Article 2. Applicability
1. Organizations, individuals subject to the inspection by the Inspection Authority for technical safety and quality of inland waterway vessels shall be responsible for paying the service fee to the Inspection Authority in accordance with the provisions of this Circular.
2. The Inspection Authority includes the Vietnam Registration Agency, units under the Vietnam Registration Agency, and inspection units under local Departments of Transport.
3. Other related organizations and individuals.
Article 3. Service Fee for Inspection
1. The service fee for technical safety inspection and quality inspection of inland waterway vessels shall be implemented in accordance with the service price table attached to this Circular.
The service fee prescribed in this Circular already includes value-added tax but does not include the fee for issuing the Design Approval Certificate and the Technical Safety and Environmental Protection Certificate as stipulated by the Ministry of Finance, nor does it include accommodation, travel, and communication costs incurred for inspection work at locations more than 100 kilometers away from the Inspection Authority's headquarters. Accommodation, travel, and communication costs for inspection work at locations more than 100 kilometers away from the Inspection Authority's headquarters (if any) shall be implemented in accordance with the current regulations of the Ministry of Finance regarding the subsistence allowance for state agencies and public institutions.
2. For inspection tasks not specified in the service price table attached to this Circular, the inspection fee shall be calculated based on the actual time spent inspecting, with a rate of VND 200,000 per hour. The minimum charge for one inspection session is VND 200,000 per session.
3. In cases where the first inspection fails, the inspection fee must still be paid according to the service price table attached to this Circular corresponding to the type of inspection; when re-inspecting the vessel, the inspection fee shall be calculated based on the actual time spent inspecting as stipulated in Clause 2 of this Article.
4. When collecting service fees, the Inspection Authority shall use service supply invoices in accordance with the Decree No. 51/2010/NĐ-CP dated May 14, 2010 of the Government on invoices for goods sales and service provision; the Decree No. 04/2014/NĐ-CP dated January 17, 2014 of the Government amending and supplementing certain articles of the Decree No. 51/2010/NĐ-CP dated May 14, 2010 of the Government on invoices for goods sales and service provision; the Circular No. 39/2014/TT-BTC dated March 31, 2014 of the Minister of Finance guiding the implementation of the Decree No. 51/2010/NĐ-CP dated May 14, 2010 and the Decree No. 04/2014/NĐ-CP dated January 17, 2014 of the Government on invoices for goods sales and service provision and any subsequent or amended documents (if any).
The Inspection Authority has the obligation to publicly disclose information and post the service prices, pay taxes on the collected amounts, and manage and use the remaining funds after tax payment in accordance with the law.
Article 4. Implementation
1. This Circular takes effect from January 1, 2017, and replaces Circular No. 123/2013/TT-BTC dated August 28, 2013, issued by the Minister of Finance, stipulating the rates of collection, procedures for collection, payment, management, and use of fees for technical safety and quality inspection of inland waterway vessels.
2. During the implementation process, if there are any difficulties, it is requested that agencies, organizations, and individuals promptly report them to the Ministry of Finance for research and guidance./.
