The Minister of Culture, Sports and Tourism issues this Circular issuing the List of goods for export and import under the specialized management of the Ministry of Culture, Sports and Tourism to determine commodity codes in the List of goods for export and import of Vietnam.

Article 1. Attached to this Circular are appendices listing goods for export and import (the list)

1. Appendix 01: List of goods for export under permits within the specialized management scope of the Ministry of Culture, Sports and Tourism to determine commodity codes in the List of goods for export and import of Vietnam (HS code);

2. Appendix 02: List of goods for import under permits within the specialized management scope of the Ministry of Culture, Sports and Tourism to determine according to HS code;

3. Appendix 03: List of goods for export under conditions within the specialized management scope of the Ministry of Culture, Sports and Tourism to determine according to HS code;

4. Appendix 04: List of goods for import under conditions within the specialized management scope of the Ministry of Culture, Sports and Tourism to determine according to HS code;

5. Appendix 05: List of goods prohibited from export within the specialized management scope of the Ministry of Culture, Sports and Tourism to determine according to HS code;

6. Appendix 06: List of goods prohibited from import within the specialized management scope of the Ministry of Culture, Sports and Tourism to determine according to HS code.

Article 2. Provisions on the use of the list.

1. Principles for applying the list:

a) In cases where only the first four digits of the HS code are listed, all eight-digit HS codes within that four-digit HS group shall be applied.

b) In cases where only the first six digits of the HS code are listed, all eight-digit HS codes within that six-digit HS sub-group shall be applied.

c) In cases where the HS code is detailed to the eight-digit level, only that eight-digit HS code shall be applied.

2. The list of goods for export and import determined according to HS code prescribed in Article 1 of this Circular shall apply the principles and forms of management of export and import of goods within the specialized management scope of the Ministry of Culture, Sports and Tourism as prescribed by the Minister of Culture, Sports and Tourism.

3. In cases where the goods cannot be identified under which HS code in the List of goods for export and import (or the goods have not been assigned an HS code), when handling export and import procedures, samples of such goods must be taken for examination by the competent authority to serve the classification of HS code.

Article 3. Effectiveness and Implementation

1. This Circular takes effect from October 9, 2018.

2. Appendix 1, the List of goods for export and import classified according to HS code within the specialized management scope of the Ministry of Culture, Sports and Tourism issued together with Circular No. 28/2014/TT-BVHTTDL dated December 31, 2014 of the Minister of Culture, Sports and Tourism stipulating the management of international trade activities within the specialized management scope of the Ministry of Culture, Sports and Tourism, shall cease to be effective from the date this Circular takes effect.

3. The Department of Planning and Finance, Ministry of Culture, Sports and Tourism is the advisory body assisting the Minister of Culture, Sports and Tourism in organizing the implementation and guiding the execution of this Circular.

During the implementation process, if there are any arising issues or difficulties, organizations and individuals are requested to report to the Ministry of Culture, Sports and Tourism (Department of Planning and Finance) for consideration and resolution./.
