CIRCULAR
Amending, supplementing, and abolishing certain articles of circulars within the field of organizational cadres and related circulars under the jurisdiction of the Ministry of Justice39/2025/NĐ-CP
Pursuant to the Law on Government Organization No. 63/2025/QH15;
Pursuant to the Law on Local Administration Organization No. 72/2025/QH15;
Pursuant to Decree No. of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Justice;Pursuant to Decree No. 150/2025/NĐ-CP of the Government stipulating the organization of specialized agencies under provincial People's Committees, district-level city People's Committees directly under the central government, and district-level People's Committees, town-level People's Committees, and special administrative-economic zones under provincial and district-level city People's Committees directly under the central government;
Pursuant to Decree No. of the Government on positions and staffing levels for civil servants;Pursuant to Decree No. 106/2020/NĐ-CP of the Government on positions and staffing levels for personnel in public service units;
Pursuant to Decree No. 120/2020/NĐ-CP of the Government stipulating the establishment, restructuring, and dissolution of public service units amended and supplemented by Decree No. 83/2024/NĐ-CP, Decree No. 283/2025/NĐ-CP;
The Minister of Justice issues this Circular amending, supplementing, and abolishing certain articles of circulars within the field of organizational cadres and related circulars under the jurisdiction of the Ministry of Justice.
The phrase "or examination" is abolished pursuant to Clause 6, Article 8 of Circular No. 15/2025/TT-BVHTTDL dated November 25, 2025, of the Minister of Culture, Sports and Tourism amending and supplementing certain articles of Circulars prescribing job codes, qualification standards, and salary grades for civil servants in the heritage culture, library, grassroots cultural activities, sports, fine arts, art performance, film, and cultural propaganda sectors, which takes effect from January 15, 2026.
Article 1. Abolishing, amending, and replacing certain articles and appendices of Circular No. 02/2023/TT-BTP dated June 29, 2023 of the Minister of Justice stipulating positions for civil servants in specialized judicial affairs
1. Abolishing Point c Clause 2 Article 1 and related provisions on positions for civil servants in specialized judicial affairs concerning "district level", "District People's Council", "District People's Committee", "Chairman of District People's Committee", "Justice Office" at Appendix I, Appendix II, Appendix III, Appendix IV, Appendix V, Appendix VI, Appendix IX issued together with Circular No. 02/2023/TT-BTP.
2. Abolishing the phrase "criminal record" at Section V Appendix I and the phrase "criminal record" at Section 1 Description of Position Senior Administrative Legal Officer, Principal Administrative Legal Officer, Administrative Legal Officer at Appendix VI; abolishing Point 6 Subsection 2.5 Section 2 Description of Position Senior Administrative Legal Officer at Appendix VI; abolishing Point 5 Subsection 2.5 Section 2 Description of Position Principal Administrative Legal Officer at Appendix VI; abolishing Point 5 Subsection 2.5 Section 2 Description of Position Administrative Legal Officer at Appendix VI issued together with Circular No. 02/2023/TT-BTP.
3. Amending the phrase "Graduated from a university majoring in Law" to "For the Ministry of Justice: Graduated from a university majoring in Law or other relevant majors"; For Departments of Justice: Graduated from a university majoring in Law" at Subsection 5.1 Section 5 Description of Position Senior Legal Drafting Officer, Principal Legal Drafting Officer, Legal Drafting Officer at Appendix II issued together with Circular No. 02/2023/TT-BTP.
4. Replacing the phrase "commune, ward, town" with "commune, ward, special zone" at Section 1; Point 8, 9 Subsection 2.5 Section 2 Description of Position Senior Legal Promotion Officer, Legal Mediation Officer, Legal Access Officer, Principal Legal Promotion Officer, Legal Mediation Officer, Legal Access Officer, at Section 1; Point 7, 8 Subsection 2.5 Section 2 and Point 9 Subsection 2.5 Section 2 (or for provincial level) Description of Position Legal Promotion Officer, Legal Mediation Officer, Legal Access Officer at Appendix III issued together with Circular No. 02/2023/TT-BTP.
5. Abolishing the phrase "specialized inspection in the field of household registration, nationality, notarization" at Point 1 Subsection 2.5 Section 2 Description of Position Senior Administrative Legal Officer; abolishing the phrase "specialized" at Point 1 Subsection 2.5 Section 2 Description of Position Principal Administrative Legal Officer, Administrative Legal Officer at Appendix VI issued together with Circular No. 02/2023/TT-BTP.
6. Replacing the phrase "Civil Execution Bureau" with "Civil Execution Management Bureau"; "Civil Execution Bureau of province, centrally governed municipality" with "Civil Execution of province, centrally governed municipality"; "Civil Execution Branch", "Civil Execution Branch at district level", "Civil Execution Branch under Civil Execution Bureau at provincial level" with "Civil Execution Office area"; "Director of Civil Execution Bureau" with "Director of Civil Execution Management Bureau"; "Department Director and equivalent under Civil Execution Bureau" with "Head and equivalent under Civil Execution Management Bureau", "Director of Civil Execution Bureau" with "Director of Civil Execution of province, centrally governed municipality"; "Branch Director" with "Director of Civil Execution Office area"; "Deputy Branch Director" with "Deputy Director of Civil Execution Office area" at Appendix IX issued together with Circular No. 02/2023/TT-BTP.
6. Replace the term "General Department of Civil Execution" with "Civil Execution Management Agency"; replace "Civil Execution Office of the province/city under central government jurisdiction" with "Civil Execution of the province/city"; replace "Civil Execution Branch", "Civil Execution Branch at district level", "Civil Execution Branch under the Civil Execution Office of the provincial level" with "Civil Execution Area Office"; replace "Director of the General Department of Civil Execution" with "Director of the Civil Execution Management Agency"; replace "Department Head and equivalent positions under the General Department of Civil Execution" with "Head of Department and equivalent positions under the Civil Execution Management Agency"; replace "Director of the Civil Execution Office" with "Director of Civil Execution of the province/city"; replace "Branch Director" with "Head of Civil Execution Area Office"; and replace "Deputy Branch Director" with "Deputy Head of Civil Execution Area Office" in Appendix IX issued together with Circular No. 02/2023/TT-BTP.
Article 2. Amend, repeal, and replace some articles and annexes of Circular No. 06/2023/TT-BTP dated September 18, 2023, issued by the Minister of Justice guiding positions, leadership and management posts, and specialized vocational titles and the structure of civil servants according to vocational titles in public service units under the judicial sector.
1. Amend Article 1 as follows:
"Article 1. Scope of Regulation
This Circular guides the list of job positions, job descriptions, and competency frameworks for leadership and management positions and specialized vocational job positions; the structure of civil servants according to specialized vocational titles in public service units under the judicial sector that operate public services in the following fields: legal aid; notarization; auctioning of assets; registration of security measures; legal support, legal consultation.
2. Amend Clause 2 of Article 4 as follows:
"2. The list of specialized vocational job positions in public service units under the judicial sector includes 12 job positions specified in Annex II attached to this Circular."
3. Repeal the job positions at Annex II and Annex VI as follows:
a) Repeal the job positions of Judicial Record Officer Level I, Judicial Record Officer Level II, and Judicial Record Officer Level III at Annex II;
b) Repeal the job descriptions of the Judicial Record Officer Level I, Judicial Record Officer Level II, and Judicial Record Officer Level III at Annex VI.
4. Repeal the phrase "inspection" at Point 1 Subpoint 2.2 Section 2 Job Description of Notary Public at Annex VIII promulgated together with Circular No. 06/2023/TT-BTP.
5. Replace the phrase "commune, ward, town" with "commune, ward, special administrative region" at Point 1 Subpoint 2.2 Section 2 Job Description of Notary Public at Annex VIII promulgated together with Circular No. 06/2023/TT-BTP.
Article 3. Amend some articles of Circular No. 04/2022/TT-BTP dated June 21, 2022, issued by the Minister of Justice guiding the management council and criteria, conditions for appointment and removal of members of the management council in public service units under the judicial sector.
1. Repeal Point b Clause 1 Article 2 of Circular No. 04/2022/TT-BTP.
2. Amend Clause 1 Article 5 as follows:
"1. The proposal document for establishing the Management Council of the public service unit; the proposal document for establishing the Management Council of the directly managing superior unit of the public service unit (if any); the proposal document for establishing the Management Council of the directly managing superior unit of the public service unit under the Bureau is the Bureau under the Ministry; the proposal document for establishing the Management Council of the public service unit under the Department of Justice under the People's Committee of the province is the Department of Justice."
Article 4. Amend Article 1 of Circular No. 07/2022/TT-BTP dated November 1, 2022, issued by the Minister of Justice stipulating classification criteria, conditions for establishment, merger, consolidation, and dissolution of public service units under the judicial sector.
"Article 1. Scope of Regulation
This Circular stipulates classification criteria, conditions for establishment, merger, consolidation, and dissolution of public service units under the judicial sector operating public services in the following fields: legal aid; notarization; auctioning of assets; registration of security measures; legal support, legal consultation."
Article 5. Amend and supplement some articles of Circular No. 09/2025/TT-BTP dated June 16, 2025, issued by the Minister of Justice guiding the functions, tasks, powers of the Department of Justice under the People's Committee of provinces and centrally governed cities, and the functions, tasks, powers of the Office of the People's Council and People's Committee under the People's Committee of communes, wards, and special administrative-economic zones in the field of justice.
1. Add Clause 4 following Clause 3 of Article 3 as follows:
"4. The Department of Justice shall notify the grassroots-level authorities of the contents of legal normative documents issued by the National Assembly, the Standing Committee of the National Assembly, the President, the Government, the Prime Minister, Ministers, and heads of ministerial-level agencies that require the grassroots-level authorities to implement according to the provisions of the law."
2. Amend Point a of Clause 3 of Article 6 as follows:
"a) Perform the duties of the permanent office of the Provincial Coordinating Board for Popularizing and Disseminating Law."
3. Add Clause 4 following Clause 3 of Article 10 as follows:
"4. Perform the duties of the permanent office of the Provincial Coordinating Board for Popularizing and Disseminating Law."
4. Amend Clause 7 of Article 11 as follows:
"7. Specify the functions, tasks, and powers of the office and specialized departments under the Department in accordance with the functions, tasks, and powers of the Department of Justice; manage the organizational structure, civil servant quota, civil servant grade, and number of staff working in public service units; implement salary systems and incentive policies, training, education, commendation, and disciplinary measures for civil servants, officials, and workers under the management of the Department of Justice in accordance with the provisions of the law."
5. Amend Points b and c of Clause 5 of Article 13 as follows:
"b) Assist the grassroots-level People's Committee in monitoring, inspecting, summarizing, and concluding the implementation of legal normative documents, reporting, and providing information on the organization of implementation, monitoring the implementation of legal normative documents at the local level according to the law.
c) Develop and submit to the grassroots-level People's Committee for issuance plans to monitor the implementation of legal normative documents if necessary; organize the implementation of tasks according to the monitoring plan (if any) or according to tasks assigned by the grassroots-level People's Committee; compile and propose to the grassroots-level People's Committee on handling the results of monitoring the implementation of laws and promptly handle the results of implementing legal normative documents according to the requirements of the provincial People's Committee."
6. Amend Point a of Clause 1 of Article 15 as follows:
"a) The provincial People's Committee shall be responsible for specifying the functions, tasks, and powers of the Department of Justice in accordance with the guidance provided in this Circular."
Article 6. Amend technically some articles in Circular No. 11/2025/TT-BTP dated June 25, 2025, issued by the Minister of Justice amending, supplementing, and abolishing some articles of circulars within the scope of state administration of the Ministry of Justice.
1. Amend the numbering and name of Article 10. Effectiveness of Implementation as follows:
"Article 11. Effectiveness of Implementation."
2. Amend the numbering and name of Article 11. Transitional Provisions as follows:
"Article 12. Transitional Provisions."
Article 7. Effective Date
This Circular takes effect from December 1, 2025.
Article 8. Responsibility for Implementation
1. The People's Committees of provinces and cities, Heads of units under the Ministry of Justice, Directors of Justice Departments of provinces and cities, heads of public service establishments, and related agencies and organizations shall be responsible for implementing this Circular.
2. In the course of implementation, if there are difficulties or obstacles, the relevant agencies and units are requested to report in writing to the Ministry of Justice for guidance and resolution in accordance with regulations./.
