DECREE
Amending and supplementing Decree No. 107/2004/NĐ-CP dated April 1, 2004 of the Government on the number of Deputy Chairpersons and the structure of members of People's Committees at all levels

THE GOVERNMENT
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Law on Organization of People's Councils and People's Committees dated November 26, 2003;
Pursuant to Resolution No. 26/2008/QH12 dated November 15, 2008 of the XIIth National Assembly on piloting the non-establishment of People's Councils at district, town, and ward levels;
Pursuant to Resolution No. 724/2009/UBTVQH12 dated January 16, 2009 of the Standing Committee of the National Assembly on the list of districts, towns, and wards of provinces and centrally governed cities piloting the non-establishment of People's Councils at district, town, and ward levels;
Pursuant to Resolution No. 725/2009/UBTVQH12 dated January 16, 2009 of the Standing Committee of the National Assembly on adjusting the tasks and powers of People's Councils and People's Committees at provincial and centrally governed city levels and stipulating the tasks, powers, and organizational structures of People's Committees at district, town, and ward levels where there are no People's Councils;
Considering the proposal of the Minister of Home Affairs,
DECREE:
Article 1. Supplement Article 9a after Article 9 of Decree No. 107/2004/NĐ-CP dated April 1, 2004 of the Government on the number of Deputy Chairpersons and the structure of members of People's Committees at all levels, which has been amended and supplemented according to Decree No. 82/2008/NĐ-CP dated July 30, 2008, as follows:
"Article 9a. The People's Committee of a district where the pilot program of not establishing a People's Council does not fall within the scope prescribed in Article 8 of this Decree shall have seven members including one Chairman, three Deputy Chairmen, and three Members. Based on the capacity of cadres, the administrative area, and the actual conditions of the locality, the Chairman of the People's Committee of the district shall assign tasks to each Deputy Chairman and Member of the People's Committee."
Article 2. Effectiveness and responsibility for implementation
1. This Decree takes effect from April 1, 2009 until the end of the pilot program of not establishing People's Councils at district, town, and ward levels.
2. The Minister, the Head of a ministerial-level agency, the Head of an agency under the Government, and the Chairman of the People's Committee of a province or centrally governed city shall be responsible for implementing this Decree./.
