PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation and Applicability
Article 1. This Joint Circular stipulates code numbers, standards for pharmaceutical professions, and appointment and grading according to these professions.

Article 3. General standards for professional ethics
1. Devotion to the cause of healthcare, protection, and enhancement of people's health;
2. Understanding and properly implementing the rules of conduct for civil servants in the healthcare sector.

Chapter II
OCCUPATIONAL STANDARDS
Article 4. Senior Pharmacist - Code Number: V.08.08.20
1. Duties:
a) Lead the planning and implementation of drug supply, storage, distribution, and usage; chemical substances, raw materials, and consumable medical supplies;
b) Lead the preparation of specialized drugs (pediatric, oncology, ophthalmic, otolaryngological, dermatological), test solutions, disinfectants, and traditional herbal medicines;
c) Lead and implement quality assurance for compounded drugs within the unit or assigned scope;
d) Participate in consultations when required;
đ) Lead and implement information, advice, guidance on drug use; monitor prescription and drug use, evaluate drug usage;
e) Lead the monitoring, compilation, and reporting of information related to adverse drug reactions;
g) Lead the sampling of drugs from the market for quality control and evaluation;
h) Be responsible for managing and guiding the use of equipment serving pharmaceutical techniques, testing, and biochemistry in the unit;
i) Lead the development of procedures and professional guidelines for pharmaceutical work including testing, compounding, biochemistry, herbal medicines, and drug distribution;
k) Lead the establishment of quality standards and review testing methods;
l) Lead scientific research, teaching, and training in professional and technical skills for students, trainees, and other professionals;
m) Lead line guidance work;
n) Lead statistical and reporting work.
2. Qualifications regarding education and training:
a) Graduated with a Master’s degree in Pharmacy or a Doctorate in Pharmacy;
b) Possess foreign language proficiency equivalent to level 4 (B2) or higher as prescribed in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014 of the Ministry of Education and Training on the six-level framework for foreign language proficiency in Vietnam;
c) Possess basic computer skills as prescribed in Circular No. 03/2014/TT-BTTTT dated March 11, 2014 of the Ministry of Information and Communications on standards for computer skills;
d) Hold a certificate of training in accordance with the senior pharmacist standards as prescribed by law.
3. Competence and professional standards:
a) Understand the Party's viewpoints, policies, and the State's laws regarding healthcare, protection, and enhancement of people's health; be aware of the direction for professional and technical development both domestically and internationally;
b) Have the ability to organize and practice effectively in the fields of testing, storage, distribution, and advisory services for medicinal raw materials, drug forms, and cosmetics;
c) Have the ability to develop, implement, supervise, and evaluate pharmaceutical work in healthcare facilities, communities, and national health programs in line with global trends;
d) Have the ability to organize and oversee the implementation of regulations and laws on pharmaceuticals;
đ) Serve as principal investigator, co-investigator, or main participant (at least 50%) in a ministry-level or higher scientific research project or invention that has been accepted;
g) An employee promoted from the position of principal pharmacist to senior pharmacist must have held the position of principal pharmacist or equivalent for at least six years, including at least two years in the most recent period.
Article 5. Chief Pharmacist - Code: V.08.08.21
1. Duties:
a) Develop and organize the implementation of plans for supplying, storing, distributing, and using medicines, chemicals, raw materials, and consumable medical supplies;
b) Lead and organize the implementation of compounding medicines (for pediatric specialties, oncology, ophthalmology, otolaryngology, dermatology, etc.), test drugs, disinfectants, and traditional herbal medicine preparations;
c) Organize and ensure the quality of compounded medicines at the unit or within the assigned scope;
d) Participate in consultations when required;
d) Organize and implement information, counseling, and guidance on drug usage; monitor prescription and drug usage, evaluate drug usage;
e) Organize and implement monitoring, compiling, and reporting information related to adverse drug reactions, and track antibiotic resistance of common pathogens;
g) Organize and implement sampling of drugs from the market for monitoring and evaluating the quality of circulating drugs;
h) Be responsible for managing and guiding the use of equipment serving pharmaceutical techniques, testing, and biochemistry in the unit;
i) Develop procedures and professional guidelines for pharmaceutical work such as testing, preparation, biochemistry, herbal medicine, and drug distribution;
k) Participate or lead in establishing quality standards and validating testing methods;
l) Conduct scientific research, teaching, training, and technical instruction for students and healthcare staff;
m) Organize and implement supervisory work;
n) Lead the implementation of statistical work and reporting;
2. Qualifications regarding education and training:
a) Graduated with a Bachelor's degree in Pharmacy or a Master's degree in Pharmacy or higher;
b) Have language proficiency equivalent to level B1 or higher as stipulated in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014, issued by the Ministry of Education and Training on the six-level foreign language proficiency framework for Vietnam, or have ethnic language certificates for positions requiring ethnic languages;
c) Possess basic computer skills as prescribed in Circular No. 03/2014/TT-BTTTT dated March 11, 2014 of the Ministry of Information and Communications on standards for computer skills;
d) Hold a certificate for training according to the chief pharmacist job title standard as prescribed by law;
3. Qualifications regarding professional expertise and skills:
a) Understand the Party's viewpoints, policies, and the State's laws regarding healthcare, protection, and enhancement of people's health; be aware of the direction for professional and technical development both domestically and internationally;
b) Possess good organizational and practical skills in areas such as testing, storage, distribution, and advice on the use of raw materials for medicines, various types of medicines, and cosmetics;
c) Possess skills in assessing and inspecting compliance with pharmaceutical regulations and laws;
d) Serve as principal investigator, co-investigator, or main participant (at least 50% of time) in research projects at the institutional level or higher, or in scientific inventions or technical improvements that have been successfully reviewed and accepted;
đ) Staff promoted from the pharmacist job title to the chief pharmacist job title must have held the pharmacist job title or equivalent for a minimum of nine years, including at least two years in the most recent period holding the pharmacist job title;
Article 6. Pharmacist - Code: V.08.08.22
1. Duties:
a) Develop and implement plans for supplying, storing, distributing, and using medicines, chemicals, raw materials, and consumable medical supplies;
b) Organize the implementation of compounding medicines (for pediatric specialties, oncology, ophthalmology, otolaryngology, dermatology), test drugs, disinfectants, traditional Chinese medicine preparations, and herbal medicine preparations;
c) Ensure the quality of compounded medicines at the unit;
d) Participate in consultations when required;
đ) Provide information, counseling, and guidance on drug usage; monitor prescription and drug usage, evaluate drug usage;
e) Monitor, compile, and report information related to adverse drug reactions;
g) Implement sampling of drugs from the market for monitoring and evaluating the quality of circulating drugs;

c) Possess skills in implementing and inspecting compliance with pharmaceutical regulations and laws;
d) Develop and implement plans for pharmaceutical work in healthcare facilities, communities, and national health programs;
đ) Provide drug information and participate in community education about drugs;
e) Staff promoted from the fourth-grade pharmacist job title to the pharmacist job title must have held the fourth-grade pharmacist job title for a minimum of two years for associate degrees or three years for diploma degrees.
Article 7. Pharmacy Level IV - Code: V.08.08.23
1. Duties:
a) Forecasting, issuing, and storing common medicines, chemicals, raw materials, and consumable medical supplies within the scope of assigned tasks;
b) Compounding some common medicines, preparing traditional Chinese medicine, and medicines from herbal ingredients;
c) Assisting pharmacists in higher positions to compound medicines for specialized departments;
d) Conducting biochemical tests according to established procedures;
đ) Participating in quality control and testing of medicines, chemicals, and herbal ingredients;
e) Participating in sampling medicines on the market, receiving samples sent by individuals/organizations for monitoring and evaluating the quality of circulating medicines;
g) Implementing regulations, guidelines, professional procedures, infection control, and occupational safety in pharmacy work;
h) Participating in compiling and reporting information related to adverse drug reactions;
i) Using and maintaining equipment serving pharmaceutical techniques, testing, and biochemical analysis within the assigned scope;
k) Managing records, statistics, and reporting in accordance with regulations;
l) Participating in scientific research.
2. Qualifications regarding education and training:
a) Graduated from a pharmacy college or higher;
b) Possessing language proficiency equivalent to level 1 (A1) or higher as stipulated in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014, issued by the Ministry of Education and Training regarding the six-level foreign language competence framework for Vietnam, or holding a certificate in ethnic languages for positions requiring the use of ethnic languages;
c) Have computer skills meeting the basic standard for information technology use as stipulated in Circular No. 03/2014/TT-BTTTT dated March 11, 2014, issued by the Ministry of Information and Communications on information technology skill standards;
3. Qualifications regarding professional expertise and skills:
a) Understanding the viewpoints, policies, and guidelines of the Party and the State's policies and laws on public health care work;
b) Having the ability to perform professional procedures correctly;
c) Having the ability to determine needs and plan drug supply;
d) Having the ability to guide patients and the community on safe, rational, and effective drug usage.
Chapter III
GUIDELINES FOR PROMOTION AND SALARY GRADING BY PROFESSIONAL RANKS
Article 8. Principles for appointment and salary grading by professional ranks for pharmacy staff
1. The appointment to professional ranks for staff specified in this Joint Circular must be based on their job positions, assigned tasks, and in accordance with Article 9 of this Joint Circular, ensuring that they meet the professional rank standards for pharmacy as stipulated in this Joint Circular.
2. When appointing from the current civil servant grade to a professional rank in pharmacy, it shall not combine with salary increment or promotion in professional rank.
Article 9. Cases of appointment to professional titles;
Staff who have been appointed to pharmacy grades as prescribed in Decision No. 415/TCCP-VC dated May 29, 1993, issued by the Minister - Head of the Civil Service Organization Department of the Government (now the Ministry of Home Affairs) concerning the issuance of vocational standards for civil service grades in the health sector; Decision No. 78/2004/QĐ-BNV dated November 3, 2004, issued by the Minister of Home Affairs concerning the issuance of lists of civil service grades and civil servant grades, now being appointed to professional ranks in pharmacy as prescribed in this Joint Circular, as follows:
1. Appointment to the professional rank of Senior Pharmacist (code V.08.08.20) for staff currently holding the Senior Pharmacist grade (grade code 16.132).
2. Appointment to the professional rank of Chief Pharmacist (code V.08.08.21) for staff currently holding the Chief Pharmacist grade (grade code 16.133).
3. Appointment to the professional rank of Pharmacist (code: 08.08.22) for staff currently holding the Pharmacist grade (grade code 16.134).
4. Appointment to the professional rank of Pharmacy Level IV (code V.08.08.23) for staff currently holding the Associate Pharmacist grade (grade code 16.135).
Article 10. Salary Classification
1. The professional ranks of pharmacy prescribed in this Joint Circular apply the Salary Scale for Professional and Vocational Staff in State-Owned Public Institutions (Scale 3) issued together with Decree No. 204/2004/NĐ-CP dated December 14, 2004, of the Government on the remuneration system for cadres, civil servants, public officials, and armed forces, as follows:
a) The professional rank of Senior Pharmacist (code V.08.08.20) applies the civil servant salary coefficient type A3 (group A3.1), from coefficient 6.20 to coefficient 8.00;
b) The professional rank of Chief Pharmacist (code V.08.08.21) applies the civil servant salary coefficient type A2 (group A2.1), from coefficient 4.40 to coefficient 6.78;
c) The professional rank of Pharmacist (code V.08.08.22) applies the civil servant salary coefficient type A1, from coefficient 2.34 to coefficient 4.98;
d) The professional rank of Pharmacy Level IV (code V.08.08.23) applies the civil servant salary coefficient type B, from coefficient 1.86 to coefficient 4.06.
2. Salary grading upon completion of probation period and appointment to professional rank: After completing the probation period as prescribed and being authorized by the competent authority managing staff to appoint to a professional rank, the following salary grading will be implemented for the newly appointed professional rank:
a) In case of having a Doctor of Pharmacy degree, the third grade with a salary coefficient of 3.00 of the Pharmacist professional rank (code V.08.08.22) will be assigned;
b) In case of having a Master of Pharmacy degree, the second grade with a salary coefficient of 2.67 of the Pharmacist professional rank (code V.08.08.22) will be assigned.
c) In case of having a College Diploma in Pharmacy, the second grade with a salary coefficient of 2.06 of the Pharmacy Level IV professional rank (code V.08.08.23) will be assigned.
3. The implementation of salary grading for staff in professional ranks as prescribed in Clause 1 of this Article for staff who have been graded in pharmacy grades as prescribed in Decision No. 415/TCCP-VC dated May 29, 1993, issued by the Minister - Head of the Civil Service Organization Department of the Government (now the Ministry of Home Affairs) concerning the issuance of vocational standards for civil service grades in the health sector; Decision No. 78/2004/QĐ-BNV dated November 3, 2004, issued by the Minister of Home Affairs concerning the issuance of lists of civil service grades and civil servant grades and Decree No. 204/2004/NĐ-CP dated December 14, 2004, of the Government on the remuneration system for cadres, civil servants, public officials, and armed forces will be carried out as follows:
a) Staff appointed to a professional rank in pharmacy with the same salary grade coefficient as in the previous grade shall continue to maintain the same salary grade and percentage of seniority allowance exceeding the scale (if any) enjoyed in the previous grade (including time counted towards the next salary grade increase or seniority allowance exceeding the scale if any in the previous grade) in the newly appointed professional rank.
Example: Ms. Nguyen Thi B was classified as a mid-level pharmacist (code 16.135), grade 3, salary coefficient 2.26 from March 1, 2014. Now she has been appointed to the position of pharmacist level IV (code V.08.08.23) by the competent authority, thus she will be classified at grade 3 with a salary coefficient of 2.26 for the position of pharmacist level IV from the date of signing the decision; the time for considering the next salary increase will be calculated from March 1, 2014.
b) In the case where a civil servant has a college degree in pharmacy and was hired with classification under category A0 according to Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on the salary system for cadres, civil servants, public officials, and armed forces, and now is appointed to the position of pharmacist level IV (code V.08.08.23), the classification grade within the appointed position shall be based on the time of compulsory social insurance contributions according to the state-defined salary scale (excluding the probation period) as follows:
Starting from grade 2 of the appointed position, every two years (twenty-four months), they will be promoted to one grade (if there are interrupted periods without receiving social insurance benefits, these periods will be accumulated). If during the working period, there is a year in which the assigned tasks are not completed or disciplinary action is taken, the promotion period will be extended according to the regular salary increase regulations.
After transferring the salary classification to the appointed position according to the above provisions, if the salary coefficient assigned to the appointed position plus any excess tenure allowance (if applicable) is lower than the salary coefficient already received in the old position, then they will continue to receive the difference in salary coefficient (including any excess tenure allowance, if applicable) from the old position. The retained salary coefficient difference will be enjoyed throughout the time the civil servant is classified under the pharmacist level IV position. Subsequently, if the civil servant is promoted to a higher position, this retained salary coefficient difference will be added to the current salary coefficient (including any excess tenure allowance, if applicable) to classify the salary for the new position upon promotion and cease to enjoy the retained salary coefficient difference from the day the new position's salary is received.
Example: Mr. Nguyen Van C, who has a college degree in pharmacy, was recruited as a civil servant at Hospital Y and has been contributing to compulsory social insurance since January 1, 2008 until now, and was classified at grade 3 with a salary coefficient of 2.72 for category A0 from January 1, 2015, and during his working period, he always completed assigned tasks and was not disciplined. Now that he meets the conditions and is appointed by the competent authority to the position of pharmacist level IV (code V.08.08.23), the classification of grades within the position of pharmacist level IV will be carried out as follows:
Mr. Nguyen Van C's working period from January 1, 2008, excluding the six-month probation period, starting from grade 2 of the pharmacist level IV position, and every two years being promoted to one grade, he will be classified at grade 5 with a salary coefficient of 2.66 for the position of pharmacist level IV by July 1, 2014; the time for enjoying the new grade salary in the position of pharmacist level IV will be from the date of signing the decision; the time for considering the next salary increase will be calculated from July 1, 2014; simultaneously, he will also receive an additional retained salary coefficient difference of 0.06 (2.72 - 2.66).
By July 1, 2016 (after two years), Mr. Nguyen Van C meets the conditions for regular salary increase to grade 6 with a salary coefficient of 2.86 for the position of pharmacist level IV and continues to receive the retained salary coefficient difference of 0.06 (total salary coefficient received is 2.92).
4. Promotion to a higher position of pharmacist for civil servants shall be implemented after being appointed to the position of pharmacist as stipulated in this Circular and implementing salary classification according to the guidance provided in Clause 1 Section II of Circular No. 02/2007/TT-BNV dated May 25, 2007 of the Ministry of Home Affairs guiding salary classification when upgrading, changing positions, or changing categories of civil servants and public officials.
Chapter IV
IMPLEMENTING PROVISIONS
Article 11. Effective Date
1. This Circular takes effect from November 20, 2015.
2. Abolish the vocational standards for pharmacy positions prescribed in Decision No. 415/TCCP-VC dated May 29, 1993 of the Minister - Head of the Organizational Cadre Department of the Government (now the Ministry of Home Affairs) on promulgating vocational standards for positions of cadres in the health sector.
3. Abolish the provisions regarding the list of pharmacy positions issued together with Decision No. 78/2004/QĐ-BNV dated November 3, 2004 of the Minister of the Ministry of Home Affairs on promulgating the list of positions of cadres and public officials that have expired effectiveness from the date this Joint Circular takes effect.
Article 12. Application Provisions
1. Civil servants who have been appointed to pharmaceutical ranks as stipulated in Decision No. 415/TCCP-VC dated May 29, 1993, of the Minister - Head of the Organizational and Cadre Affairs Council under the Government (now the Ministry of Home Affairs) on the issuance of vocational standards for civil service ranks in the health sector; and Decision No. 78/2004/QD-BNV dated November 3, 2004, of the Minister of Home Affairs on the issuance of the list of civil service ranks and pharmaceutical ranks shall be appointed to the occupational titles specified in this Circular. The competent authority managing and using civil servants has the responsibility to create conditions for civil servants to supplement the remaining criteria of the pharmaceutical rank they were appointed to.
2. From January 1, 2021 onwards, new civil servants recruited into the fourth-level pharmaceutical occupational title must have a college degree in pharmacy or higher. For civil servants with a secondary-level pharmacy degree, who were recruited and appointed to the fourth-level pharmaceutical occupational title before January 1, 2021, they must be standardized to reach a college-level pharmacy degree at the latest by January 1, 2025. In cases where civil servants are sent to study to achieve a college-level pharmacy degree but do not participate in the training or fail to meet the required academic standards, the employing unit must report to the managing unit to consider reassigning their work or implementing staff reduction measures.
Article 13. Implementation Organization
1. This Circular serves as the basis for the recruitment, utilization, and management of pharmaceutical civil servants in public healthcare facilities.
2. Non-public healthcare facilities may apply the provisions of this Circular for recruitment, utilization, and management of human resources.
3. The head of public healthcare facilities directly managing and utilizing civil servants has the responsibility to:
a) Review job positions within the unit, develop plans for appointing pharmaceutical occupational titles within their management authority, submit them for review and decision by the competent authority or make decisions according to delegated authority;
b) Appoint occupational titles for pharmaceutical civil servants under their management to corresponding pharmaceutical positions according to their authority or delegated authority after the appointment plan has been approved by the competent authority;
c) Develop plans and create conditions for civil servants holding the fourth-level pharmaceutical occupational title to participate in standardization training to reach a college-level specialized degree as stipulated in Clause 2, Article 12 of this Circular.
5. Ministries, ministerial-level agencies, government agencies, provincial People's Committees, and centrally-administered city People's Committees have the responsibility:
a) Direct subordinate units under their management to implement the appointment of occupational titles and salary grading for pharmaceutical civil servants in public healthcare facilities;
b) Approve plans for appointing occupational titles and salary grading for pharmaceutical civil servants in public healthcare facilities under their management transitioning from current pharmaceutical ranks to corresponding occupational titles as stipulated in this Circular; resolve issues arising during the appointment process according to their authority;
c) Make decisions on appointing occupational titles and salary grading for pharmaceutical civil servants under their management to corresponding pharmaceutical positions in public healthcare facilities according to their authority.
d) Report the results of appointing occupational titles and salary grading for pharmaceutical civil servants in public healthcare facilities under their management to the Ministry of Health and the Ministry of Home Affairs.
1. The Minister, Heads of Ministries equivalent to ministries, Heads of government agencies, Chairmen of provincial People's Committees under the central government, and related agencies, units, and individuals are responsible for implementing this Circular.
1. The Minister, head of a ministerial-level agency, head of an agency under the Government; Chairman of the People's Committee of provinces and centrally-administered cities are responsible for implementing this Circular.
2. During implementation, if there are any difficulties, please reflect them to the Ministry of Health for consolidation and coordination with the Ministry of Home Affairs to examine and resolve them./.
