CIRCULAR
Regulations on standards, tasks, authorities, and appointment of teachers to serve as the General Leader of the Ho Chi Minh Communist Youth Union in public general education institutions in public general education institutions
Pursuant to Decree No. 123/2016/NĐ-CP dated September 1, 2016 of the Government on the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;
Pursuant to Decree No. 69/2017/NĐ-CP dated May 25, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;
Pursuant to Decree No. 29/2012/NĐ-CP dated April 12, 2012 of the Government on recruitment, utilization, and management of civil servants;
After receiving opinions from the Ministry of Home Affairs in Circular No. 3472/BNV-CCVC dated July 3, 2017; from the Ministry of Finance in Circular No. 8855/BTC-HCSN dated July 3, 2017; and from the Central Committee of the Ho Chi Minh Communist Youth Union in Circular No. 10039-CV/TWĐTN-CTTN dated August 3, 2017;
At the proposal of the Director of the Department of Teachers and Educational Management Staff;
The Minister of Education and Training issues this Circular regulating the standards, tasks, authorities, and appointment of teachers to serve as the General Leader of the Ho Chi Minh Communist Youth Union (hereinafter referred to as teachers serving as the General Leader of the Union) in public general education institutions.
Article 1. Scope of Regulation and Applicability
Article 1. This Circular regulates the standards, tasks, authorities, and appointment of teachers to serve as the General Leader of the Ho Chi Minh Communist Youth Union (hereinafter referred to as teachers serving as the General Leader of the Union) in public general education institutions.
Article 2. This Circular applies to teachers serving as the General Leader of the Union in primary schools, secondary schools, general education schools with multiple levels (including primary or secondary levels), county-level general education boarding schools for ethnic minorities, primary-level general education semi-boarding schools for ethnic minorities, secondary-level general education semi-boarding schools for ethnic minorities, and schools and classes for persons with disabilities.
Article 3. Private general education institutions shall apply these regulations based on their specific circumstances.
Article 2. Standards for teachers serving as the General Leader of the Union
Clause 1. Teachers selected to be appointed as the General Leader of the Union must meet the following standards:
Point a) Meeting the criteria for the teaching profession according to the rank of the teaching position they hold (the criteria for primary school teachers are stipulated in Joint Circular No. 21/2015/TTLT-BGDĐT-BNV dated September 16, 2015 on the code and criteria for the position of primary school teacher in public schools; the criteria for secondary school teachers are stipulated in Joint Circular No. 22/2015/TTLT-BGDĐT-BNV dated September 16, 2015 on the code and criteria for the position of secondary school teacher in public schools).
Point b) Having been trained in youth work and the relevant subject they teach or having received training in youth work.
Point c) Possessing the ability to coordinate with organizations inside and outside the school to organize activities of the Union and youth movements.
Clause 2. Priority should be given to selecting teachers who have skills in music, fine arts, physical education, public speaking, event organization, and communication to assist the school in organizing Union activities and youth movements effectively.
Article 3. Tasks and Authorities of Teachers Serving as the General Leader of the Union
Clause 1. Implementing the tasks and authorities of teachers at each educational level as prescribed in the current School Charter.
Clause 2. Advising the principal on matters related to the professional field of youth work and youth movements within the school.
Clause 3. Planning, organizing, and managing programs for members of the Union and students in the school according to the plan of the Department of Education, the program of Union activities, and youth movements of the Council of the Union at various levels.
Clause 4. Establishing the organizational system of the Union's grassroots units in the school according to the principles of organization and operation of the Ho Chi Minh Communist Youth Union; training the team of leaders of the Union's branches and councils at various levels.
Clause 5. Coordinating with relevant organizations and individuals to organize Union activities and youth movements, and educational activities in the school.
Clause 6. Studying, practicing, and participating in specialized training courses organized by the Department of Education and the Council of the Union at various levels to enhance professional knowledge and skills.
Clause 7. Being provided with conditions to carry out Union activities and youth movements, and educational activities suitable to the actual conditions of the school and locality.
Article 4. Appointment of Teachers as Head of the Youth Union
1. The Principal shall coordinate with the School Council to select teachers for appointment as Head of the Youth Union.
2. After obtaining the unified opinion of the Department of Education and Training or the Provincial Department of Education and Training (the direct management unit of the school) and the Youth Union Council at the same level, the Principal shall issue a decision appointing a teacher as the Head of the Youth Union of the school.
Article 5. Term of Service for Teachers Appointed as Head of the Youth Union
1. The term of service for teachers appointed as Head of the Youth Union is five years. Upon expiration of this term, the school has the responsibility to arrange for the teacher to return to teaching in accordance with their trained specialty.
2. In cases where the teacher's term of appointment expires but they still meet the criteria and have the desire to continue serving as Head of the Youth Union, the Principal shall coordinate with the School Council to consider and decide according to the provisions of Clause 2, Article 4 of this Circular.
3. In cases where the teacher's term of appointment has not yet expired but they cease to serve as Head of the Youth Union, the Principal shall issue a decision terminating the appointment of the teacher as Head of the Youth Union, and simultaneously coordinate with the School Council to consider, select, and appoint another teacher to replace them according to the provisions of Clause 2, Article 4 of this Circular.
Article 6. Effectiveness
1. This Circular takes effect from December 24, 2017.
2. This Circular replaces the regulations on the subjects, selection criteria, and appointment of teachers as Head of the Youth Union stipulated in Section I of the Inter-Ministerial Circular No. 23/TTLT dated January 15, 1996 issued by the Joint Office of the Government’s Organizational Cadre Affairs, Ministry of Education and Training, Ministry of Finance, and the Central Committee of the Ho Chi Minh Communist Youth Union regarding the guidance on working conditions and responsibility allowances for teachers serving as Head of the Ho Chi Minh Communist Youth Union in general education schools, and replaces Clause 3, Article 22 of Circular No. 41/2010/TT-BGDĐT dated December 30, 2010 issued by the Ministry of Education and Training promulgating the Charter of Primary Schools.
Article 7. Implementation Organization
1. Teachers serving as Head of the Youth Union shall enjoy benefits and policies in accordance with current laws and the provisions of the following documents:
a) Circular No. 05/2005/TT-BNV dated January 5, 2005 of the Ministry of Home Affairs guiding the implementation of the allowance for responsibility work for civil servants and public officials.
b) Circular No. 28/2009/TT-BGDĐT dated October 21, 2009 of the Ministry of Education and Training promulgating regulations on working conditions for general education teachers.
c) Circular No. 16/2017/TT-BGDĐT dated July 12, 2017 of the Ministry of Education and Training guiding the framework of job positions and staffing levels in public general education institutions.
2. In cases where the referenced documents in point a, Clause 1, Article 2, Clause 1, Article 3, and Clause 1, Article 7 of this Circular are amended, supplemented, or replaced, the new provisions shall be implemented.
3. The Department of Education and Training shall instruct the Departments of Education and Training and subordinate units to select and appoint teachers as Head of the Youth Union in accordance with the standards, tasks, and authorities stipulated in this Circular; cooperate with the Youth Union Councils at all levels to inspect and supervise the implementation process in educational institutions./.
