Decree No. 28/2016/NĐ-CP Amending certain Articles of Decree No. 56/2014/NĐ-CP dated May 30, 2014 and Decree No. 18/2012/NĐ-CP dated March 13, 2012 of the Government on the Road Maintenance Fund

DECREE

AMENDING SOME ARTICLES OF DECREES NO. 56/2014/NĐ-CP DATED MAY 30, 2014 AND NO. 18/2012/NĐ-CP DATED MARCH 13, 2012 ON THE HIGHWAY MAINTENANCE FUND

Pursuant to the Law on Government Organization dated June 19, 2015;amng 6 năm 2015;

Pursuant to the Road Traffic Law dated November 13, 2008;

At the proposal of the Minister of Transport,

hươngíTHE GOVERNMENT issues this Decree amending some Articles of Decrees No. 56/2014/NĐ-CP dated May 30, 2014 and No. 18/2012/NĐ-CP dated March 13, 2012 on the Highway Maintenance Fund.nhn hành Nghị định sửa đổngi một số Điều của Nghị định số 56/201No.14/NĐ-CP dated May 30, 204 and Decree No. 18/2012/NĐ-CP dated March 13, 2012 of the Government on the Highway Maintenance Fund. 13 thángáng3 năm 2012 của Chính phủ về Quỹ bảo trì đường bộ.

ARTICLE 1. Amend some Articles of Decree No. 56/2014/NĐ-CP dated May 30, 2014 and Decree No. 18/2012/NĐ-CP dated March 13, 2012 on the Highway Maintenance Fund as follows:m 2014 và Nghị định số 18/2012/NĐ-CP ngày 13 tháng 3 năm 2012 của Chính phủ về Quỹ bảo trì đường bộ như sau:

1. Clause 1 of Article 1 of Decree No. 56/2014/NĐ-CP dated May 30, 2014 of the Government is amended to read as follows:

“Clause 1. Road usage fees are collected annually per vehicle for motorized road vehicles including cars, tractors; semi-trailers and truck-trailers pulled by cars or tractors and similar types (hereinafter referred to collectively as cars).”

2. Clause 2 and Clause 4 of Article 1 of Decree No. 56/2014/NĐ-CP dated May 30, 2014 of the Government are repealed.

3. Clause 3 of Article 1 of Decree No. 56/2014/NĐ-CP dated May 30, 2014 of the Government is amended to read as follows:

“Clause 3. Provide guidelines for managing road usage fee collection and specify the period for declaration and payment of road usage fees (monthly, quarterly, annually, or during vehicle inspection periods) applicable to cars.”

4. Clause 2 of Article 12 of Decree No. 18/2012/NĐ-CP dated March 13, 2012 of the Government is repealed.

ARTICLE 2. Effective date

This Decree takes effect from June 5, 2016.

ARTICLE 3. Implementation

The Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial and centrally-run city People's Committees are responsible for implementing this Decree./.
