CIRCULAR
Amending and supplementing certain Circulars onregular reporting systems in the Industry and Trade sector
Pursuant to Decree No. 98/2017/NĐ-CP dated August 18, 2017, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;
Implementing Decision No. 559/QĐ-TTg dated April 24, 2017 of the Prime Minister approving the "Simplification Program for Reporting Systems in State Administrative Agencies";
At the proposal of the Office of the Ministry of Public Security;June 2024;Issued by the Office of the Ministry;
The Minister of Industry and Trade issues this Circular to amend and supplement certain Circulars on regular reporting systems in the Industry and Trade sector.
Article 1. Amending and supplementing Circular No. 32/2012/TT-BCT dated November 12, 2012 of the Minister of Industry and Trade on the implementation of wind power project development and model Power Purchase Agreements for wind power projects
1. Amend Clause 4 of Article 9 as follows:
"4. Annually, no later than January 15 and July 15, the People's Committees of provinces with wind power projects must submit semi-annual periodic reports (in accordance with the form attached to this Circular) regarding investment registration activities and the progress of implementing projects within their province to the Ministry of Industry and Trade via paper or electronic versions through the email system at [email protected] for management and monitoring."
2. Repeal Clause 5 of Article 9.
3. Repeal Article 15.
4. Supplement the Form of Periodic Report on Investment Registration Activities and Project Implementation Progress as set forth in the Appendix attached to this Circular.
Article 2. Amending Circular No. 31/2014/TT-BCT dated October 2, 2014 of the Minister of Industry and Trade detailing certain contents related to electrical safety
1. Amend Point a of Clause 2 of Article 18 as follows:
"2. Annual periodic report
a) Reporting time: Before January 15 of the following year".
2. Amend Point c of Clause 3 of Article 20 as follows:
"c) Statistics and monitoring of electrical accidents, violations in high voltage transmission line protection zones on the territory and annual reporting to the Ministry of Industry and Trade (through the General Department of Safety and Environmental Protection) before February 1 of the following year."
Article 3. Amending and supplementing Circular No. 28/2015/TT-BCT dated August 20, 2015 of the Minister of Industry and Trade on the implementation of pilot self-certification of origin for goods under the ASEAN Trade in Goods Agreement
Amend and supplement Clause 7 of Article 11 as follows:
"7. Monthly, in the first week of the following month, submit reports to the Department of Import-Export - Ministry of Industry and Trade on commercial invoices containing declarations of origin issued for exported goods in accordance with this Circular (in accordance with the form specified in Appendix IV attached to this Circular) via electronic mail at [email protected] or electronically through the self-certification invoice declaration software."
Article 4. Abolishing certain provisions in related Circulars concerning regular reporting systems in the Industry and Trade sector
1. Abolish Point d of Clause 6 of Section III of Circular No. 03/2008/TT-BCT dated March 14, 2008 of the Minister of Industry and Trade guiding certain contents stipulated in Decision No. 55/2007/QĐ-TTg dated April 23, 2007 of

Abolish Article 19, Clause 7 of Article 20, Clause 9 of Article 21 and Appendices 2, 3, 5 of the Technical Management Regulations for Hazardous Machines, Equipment, Chemicals with Special Safety Requirements in the Industrial Sector issued together with Decision No. 136/2004/QĐ-BCN dated November 19, 2004 of the Minister of Industry (amended and supplemented by Circular No. 14/2011/TT-BCT dated March 30, 2011 of the Minister of Industry and Trade).
3. Abolish Clause 6 of Article 24 of Circular No. 43/2012/TT-BCT dated December 27, 2012 of the Minister of Industry and Trade on the management of hydropower planning, investment construction of hydropower projects and operation of hydropower facilities.
4. Abolish Clause 5 of Article 25 of Circular No. 02/2014/TT-BCT dated January 16, 2014 of the Minister of Industry and Trade on measures for energy conservation and efficiency in industries.
5. Abolish Article 11 of Circular No. 23/2014/TT-BCT dated July 25, 2014 of the Minister of Industry and Trade on procedures for drafting, reviewing and approving Design and Manufacturing Contracts for domestic equipment in thermal power plants.
Article 5. Effective Date
1. This Circular takes effect from November 12, 2018.
2. During the implementation process, if there are difficulties, organizations and individuals should reflect them to the Ministry of Industry and Trade for guidance and resolution./.
